Why do people always mention their DUI as if it's less egregious than other crimes? You're worse than a guy who shoplifted, you're worse than a guy who got in a fight, you're worse than a guy who uttered threats. You're not as bad as a burglar, that's where id sort you. So why do people mention it as if its mitigating circumstances?
I saw 'Better Call Hall' billboards this weekend. Made me laugh. If you can ride the coattails of a hit TV show about a shady lawyer and make it work then more power to you.
That's only true if you don't break up the advertising concerns that all ultimately represent big pharma. Normally they do in most kinds of ad buy charts. Then Big Pharma makes up essentially the first 12 positions.
Lawyers can't ADVERTISE?? Sorry, what? Morgan & Morgan alone spends upwards of $10 million dollars a year. I dare you to drive more than a mile without seeing one of their billboards. Local news, every single ad break is 2 different injury lawyers. They can't solicit you directly, but they damn sure can run ads.
I'm kinda glad those laws were pared back. I got a speeding ticket recently. Tried to find a lawyer in the area of the ticket and got nothing. Week later, a flyer shows up in my mailbox.
We have shown love for our local lawyer who has advertised on the back of the phonebook for decades. If he ever considers a big mustache or an eye patch, we will recognize him in public immediately
Hi Mike! I’m so happy to hear that you’re here to help!! Help is desperately needed. I’m not over exaggerating. I have a feeling you just might have fun with this one David and Goliath and Goliath and Goliath.
I always wondered why I always saw Layers advetise themselves billboards and benches, but almost never with ads on websites or phone calls like other businesses
Any one from Chicago might remember this guy, a defense lawyer for traffic cases. A friend told me to look for the guy who looked like Dennis the menace father. He was easy to find and good too.
Fun historical fact about lawyers from a history teacher: They had lawyers back in ancient Greece, however they functioned more as skilled orators rather than legal experts. A problem with them was that when a wealthy guy got accused of something he’d hire one of the best lawyers, that lawyer would then write and preform an amazing speech getting the patron of whatever crime. So, some city states banned lawyers from attending court. This only lead to said lawyers becoming professional speech writers instead, the guys still attending court could just preform the pre-written speech.
I had multiple lawyers send me advertisements in the mail days after being arrested. No phone calls, but many letters in the mail. They had my court info and chages already pulled up and written in their letters. They had my info before I got it...and I'd already hired a different lawyer.
For those looking for more info, when a lawyer is advertising directly to people at a time when they are not “thinking straight” or in a crisis of some sort (ex. After a motor accident, or injury) this is known as overreaching and is illegal because its viewed as a deceptive practice. Regulations were loosened to allow tv advertising and print advertising without losing their license to practice from the Bates vs. State Bar of Arizona case. The decision was made to protect advertising from lawyers (that is not overreaching) under the first amendment. I studied this case for my advertising ethics class so I was surprised to see this on my feed haha
In my experience working for lawyers, the ones on the billboards and TV ads are PI mills with heavy employee turn around where you get lost in the sauce.
Well - in my country we are not only protected from lawyers that way. That goes for almost every business. No one can contact you to try to make money unless you consented up front.
Hey Mike, a perfect follow-up video would be how a new lawyer can build up then practice without being an "ambulance chaser". How did you do it with these restrictions in place?
It also exists to protect victims from harassment, which is what direct marketing is. Advertising broadly and giving people the opportunity to contact someone on their own is different.
That’s part of the reason why it’s still exists. But I don’t think harassment was one of the primary original reasons. I think it was more about lawyers having this learned ability to pressure people into doing things that maybe we weren’t in their best interests.
My Dad never advertised. I never advertised. I am proud of that fact. I would never want the kind of client who would choose his lawyer from an ad anyway.
Honestly it sounds like a good law to have because I would hate getting a DUI and then a day later like 20 lawyers contact me wanting to snatch up my case
Its like having a martial art license and having rules tied to them, where im from if you are caught fighting and have a martial arts license you will get charged with armed assault because you're basically a deadly weapon, a lawyers weapon is their brain 😂
This also protects you from shady firms that would send out runners to solicit you when you are at your most vulnerable. After an accident or surgery or the like where your emotions are at your most primal and the higher brain is operating at at best, 20%.
I was in car wreck 12 years ago. Thankfully both of us walked away even though both vehicles were totaled. The other driver was at fault, that he had blacked out at the wheel which he had never done before. I honestly felt that suing him would do him more harm than any good I would get out of it, so decided not to. Accident happened Dec 23. I got TEN FLYERS from various law offices Dec 26. Pretty sure Christmas was the only reason I didn't get any Dec 24. They didn't stop coming until mid-January.
In Germany it was forbidden to advertise as lawyers until 1987, and it is still quite restricted; these screaming lawyers in TV ads in the US are still illegal. In Germany a lawyer or lawyer firm is only allowed to advertise in a objective manner, only saying things that are relevant to the job, and not about getting a mandate for an individual case.
As an adult I have three different friends who are lawyers none of them have been in the fields I need assistance with probate real estate but whenever I attempted to get lawyers for basically Slam dunk easy cases I was ignored for not having enough billable hours
I love that these legislatures were likely made up of mostly lawyers, and they're still like "yeah, you can trust these lawyers. They're so bad we have to ban them from all sales" 😂
For those that think this is dumb, in Argentina, a country where this law is either not enforced or non-existent, lawyers chase after ambulances and wait in hospital ERs. They are called "caranchos," and they target people at their weakest and most desperate time to charge them exorbitant fees.
And this is also why lawyers at one time were considered “the devil” - far more educated than the common man and also very persuasive which is how the devil himself is described.
I feel like advertising lawyers on a billboard or TV is waaaaaaaay different than, having 4 lawyers call you the day after jail because you got a dui.
That is why calling you directly is prohibited.
@@MagnumMuscle1000yet it happens anyway

“Why can’t lawyers advertise?” As lawyers are the #2 industry in advertising according to Nielsen.
Depends on the State. Even when allowed to advertise there are restrictions on what types of services or results can be advertised.
What's #1?
Lawyers are allowed to advertise, now. Up until June 1977, Lawyers were not allowed to advertise, they weren't even allowed in the yellow pages.
That's only true if you don't break up the advertising concerns that all ultimately represent big pharma. Normally they do in most kinds of ad buy charts. Then Big Pharma makes up essentially the first 12 positions.

That Monopoly edit was hilarious to me, lol
Pharmaceutical needs this prohibition as well.
drug companies are calling you directly? but, yeah, I don't understand how, or even why, they advertise on TV. You need a doctor to prescribe it.
I'm kinda glad those laws were pared back. I got a speeding ticket recently. Tried to find a lawyer in the area of the ticket and got nothing. Week later, a flyer shows up in my mailbox.
The fact that we are need protection from the people meant to defend us legally says alot about the world we live in

Thanks for posting this that answered my question pretty well from yesterday's video!
A buddy of mine got a DUI and had mail adverts from 7 different lawyers within 3 days. We couldn’t even figure out how they knew.
Now you need lawyers to protect you from lawyers.
Who would ever think that lawyers are dangerously persuasive? I have also never actually read an EULA.
We have shown love for our local lawyer who has advertised on the back of the phonebook for decades. If he ever considers a big mustache or an eye patch, we will recognize him in public immediately
The editing in this one is 💯 perfection.

David and Goliath and Goliath and Goliath.
Call Morgan & Morgan. "For the people"
'lawyers were persuasive' ah how things have changed
I believe that this applied across the board to all professions originally - doctors, dentists, lawyers, etc
Come to Las Vegas, they advertise on buses, tv, billboards, you name it. Gets really annoying. They even have jingles !
I always wondered why I always saw Layers advetise themselves billboards and benches, but almost never with ads on websites or phone calls like other businesses

I caught that
Got in a car accident and had a lawyer call my hospital room about five minutes after I got in the room.
We need that protection.
Made a trip to AZ recently and saw signs for Rafi law. I know it's not you, but made me think of you lol
I call lawyers, legal assoc., agencies... its all about 'no competition', and to give advantages to clients.

So, lawyers have always been lawyers.

Highly Recommend 99% Invisible's episode on the history of lawyer ads.
“Ambulance chasers” back in the day
In my experience working for lawyers, the ones on the billboards and TV ads are PI mills with heavy employee turn around where you get lost in the sauce.
Ironically enough, we have our own Rafi here in AZ and you can't go 500 ft without seeing their advertising!
It used to be hard to find a lawyer 20 years ago if you didn't know anyone.
“Better call Saul”
They be regulating lawyers like ancient Celtic tricksters and those of the fae realm
"why cant lawyers advertise" As if 90% of the billboards in Louisiana arent for law firms

I remember lawyers advertising all nearly 40 years of my life. 👀
The case that allowed lawyers to advertise (without overreaching) is from 1977. Bates vs. State Bar of Arizona

Better call Saul.
Eric Posin in Vegas sued and won against the government and opened up the door to advertising and had the first lawyer billboard.
We don't have that rule in Illinois. Consequently if you are a night owl like me you are stuck watching too many lawyer commercials on TV!
Mass advertising on television is ok, so long as the lawyer follows certain rules about content.
It also exists to protect victims from harassment, which is what direct marketing is. Advertising broadly and giving people the opportunity to contact someone on their own is different.

Lawyers in Australia weren't even allowed to advertise until 1987
Considering law is regulated at the state level in Australia this seems to be an oversimplification
@@TheMrcbritt2 yes it is a simplification

Yet they let the predatory insurance companies advertise all day to us.
Crazy how if you don't pay your credit card bill Realtors will call you asking if you want to sell your house.
The part that kills me is that by being a "law abiding citizen", I would have to be educated enough to know enough of the laws in order to abide laws.

Great! Now the lawyers need a way to be safe from us 😠
Would be great to see a full episode on what those regulations were and are. Actually like heaps interesting.
Just read the model rules of professional conduct (ethical rules) for lawyers. They are simple and fairly short.
There would have to be 56 episodes since lawyers are regulated at the state level (I’m accounting for DC and the terrorities)
After seeing that vid about a lawyer calling someone to a doctor's office i can see why

Not in person or on the phone to people they know need a lawyer.
that law should include doctors too
