Understanding UNDRIP

  • Indigenous peoples in Canada, and all Canadians, expect the federal government to uphold the admirable principles of the UN Declaration on the Rights of Indigenous Peoples (UNDRIP). But with the government invoking closure on Bill C-15, which would implement UNDRIP in Canadian law, many questions remain unanswered about the government's approach.
    Some Indigenous activists have decried C-15 as ‘domesticating’ UNDRIP and making it subordinate to Canadian law. As well, given that "free, prior and informed consent" of Indigenous peoples is a central principle of UNDRIP, it is unfortunate a large number of First Nations, tribal councils and treaty organizations have not been adequately consulted on the very legislation that would cement this principle. Meanwhile, Indigenous resource development organizations have also expressed concern the legislation will negatively impact their ability to attract much-needed investment and business to Indigenous territory, thus affecting their economic rights. And resource developers warn that without clarification, Canada’s reputation as a safe and reliable investment environment for resource projects will suffer.
    It is time to rethink Canada's approach to UNDRIP. That is why MLI has gathered some of the top experts on Indigenous affairs and natural resources policy, as well as Indigenous leaders whose perspectives need to be heard, for an online panel discussion on the issues.
    Ken S. Coates, Munk Senior Fellow at the Macdonald-Laurier Institute, will moderate a panel discussion featuring:
    - Chris Sankey, Senior Fellow, Macdonald-Laurier Institute, former elected Councillor for the Lax Kw’alaams Band, Chairman and CEO of Blackfish Enterprises
    - Heather Exner-Pirot, Fellow, Macdonald-Laurier Institute
    - Melissa Mbarki, Policy Analyst, Macdonald-Laurier Institute, member of the Muskowekwan First Nation, consultant and operations analyst for natural resource projects in Western Canada

    This was an excellent video! Thank you. I am appreciative of Heather, Chris and Melissa’s perspective. As a non-native Canadian, born and raised here, I consider myself Indigenous to Canada and also want to protect and love my country instead of feeling like I don’t belong here :( this is my home and I always loved Canada. I speak for myself and am very fearful of where our country is headed and I don’t want this to be a tool to create hatred, fear, racism (both ways) and even more division by the Liberal gov’t and UN. My children are being taught in schools that they are “colonizers and come from evil roots - this is not the case, our family NEVER harmed a single person ever. Then with First Nations they are being taught victimhood which makes me sad and it also breeds racism towards “colonizers”, I grew up surrounded by 4 nations and am very understanding of the “feelings” that are in the air. I feel sad for the nations as they are robbed by corruption and they should be able to own their own homes on their land and decide the education of their kids! Hereditary education vs the indoctrination that the kids are fed is only setting them up to hate us “whities”, feel like victims vs empowered and hopeful and at the mercy of the chiefs with no accountability of the funds and the allocation of them to support them! There is so much money that there is NO EXCUSE for the state that many of the First Nation Canadians experience everyday :( it’s not right and it makes us all sad and frustrated. Side deals and corruption are hurting the nations everyday and their only way to change anything is a vote but then the cycle continues. Transparency and honest humans with strong ethics and not just wanting control and greed needs to get out of the way. There is no reason we Canadians shouldn’t ALL be prospering!! United we stand, divided we fall.

    "All Land would be considered Aboriginal Land until ceded by treaty"
    BC was Annexed...most of BC is Non-Treaty...

    50% was promised...that is how the Indian Trust Fund was started... where is this Indian Trust Fund? Think now 50% of logging, fishing, mining, oil, gas...did the Crown bring the land...

    I agree 100% this veto needs to be addressed. We have Economic Development, Lands and Resources Reconciliation, and Consultation Staff in many of our communities, my concern is why no one even our leaders reach out to us. The Treaty and inherent relationship need to be addressed. The people need to be the frontline group to discuss this issue

    Ok, Chris let's generalize us. I'd say it's safe to say we all have and always had guidelines, and protocols throughout North America when it came to trade networks

    How much money will this cost the non indigenous Canadians. They are all very heavily taxed as it is.
    How will this legislation affect the homes and the land that non indigenous Canadians have bought?

      As long as they decide to continue to let you live on their land you'll likely be fine. Some of your property taxes might go to the band going forward, also some laws may change

    Just like Ken has said how can you get all these people to come together and understand how did the Crown and the Indigenous peoples first understand? There were millions of I digenous people's living here...germ warfare was used...diseased blankets...small pox, chicken pox, the common cold...(just a little bit of history)...

      There weren’t millions of indigenous people living here in the era of early settlers. There were only about 30 000 indigenous people.

      Trust the UN is only wanting the land and resources from Native Bands . The UN wants your property all land in so Canada . Canada is a corporation , registered in United States . Please go research . Also you ought to research that the INAC is withholding trillions of dollars of Native monies that is doled out to all Native Bands . Thus tax payers never have paid any of their taxes to Natives ! Research !!!!! UNDRIP sis not our friend !
