Gideon v Wainwright (1963) In 1961, Clarence Earl Gideon, was accused for stealing some sodas, beers, and $50 - wants access to counsel but he cannot afford a lawyer by himself - and Florida did not provide everyone with a lawyer at the time - had to defend himself and loses, got the max sentence of 5 years in Jail - Studied law while in Jail (especially the constitution) - found that the 6th amendment requires assistance of counseling for all - and found that the 14th amendment saying that no states shall make laws that takes away people's citizen rights Now Gideon petitions first to the Florida court, then wrote to supreme court later - On 1962, Supreme court took Gideon's case - Supreme court provided a lawyer for Gideon, and won the case with a 9-0 verdict Now Gideon gets a retrial in Florida (with a lawyer this time) - lawyer questioned the witness in depth, and the Jury decided later that Gideon wasn't proven gilty beyond just a resonable doubt - Gideon is now free, and he made it clear that all states have to provide legal counsels for the accused. Did the trail only make the state courts follow the 6th amendment or all amendments
Only the 6th amendment. Selective incorporation under the 14th amendment. I'm keeping it short because this was a year ago.
