      @@jeffthornton6998 ...not really true. They can easily issue a bench warrant, and then force the examination, then proceed with the case. Obviously, he won't sit in jail long before conviction or examination.

    As soon as a defendant starts claiming they don’t understand in a criminal case, the matter should be immediately rescheduled to an in person appearance in court and a competency report compiled

    This kind of crap wouldn't go on in Florida. After 2 dwlsr, the next is a felony and the driver gets tagged as HTO, habitual traffic offender which revokes his license for 5 year and they put out a pick up car for forfeiture on the computer. This guy has at least 3 major violations, one dwlsr, DUI, and not using the interlock, plus he's probably violating probation.

    It's all very simple but the court isn't speaking his language.
    "Your answers indicate that you may be found incompetent to represent yourself or to assist in your defense. If you are found legally incompetent, you will be held in a psychiatric institution until you are able to assist in your defense. At that time your trial will continue. If you fail to cooperate or are unable to cooperate you will be adjudicated guilty or mentally incompetent and sentenced to a prison that has a ward for the mentally incompetent."
    The judge could also include "Sometimes we have defendants that act incompetent and the doctors will uncover that tactic if it is being used. If found to be malingering (faking a mental illness) you may have an additional charge of theft of services which comes with additional time on a sentence and required repayment of all medical costs incurred by the county."

    Usually depending on the state, the DMV won't restore the license while a case is active, so that means, he can't get insurance and the registration is canceled because of no insurance. So, all the delays the sovcit throws out, just helps the state, because the state's goal of keeping him off the road is accomplished.

    By ordering a psych evaluation, the judge is playing exactly into the SovCit's hands. Their tactics are: delay, obfuscate, and more delays. In the hope that the prosecution will get tired of it or too lazy to continue so there will be a dismissal or watering down to a mere slap on the wrist, and the SovCit will declare victory and continue on with their bad behavior. Instead of treating these as minor cases, our system should recognize them for what they are: anarchy in the making. We are already seeing an escalation of this SovCit defense strategy, from petty thefts to DUI to out and out frauds, to refusal to pay rent and child support. What's next? Battery, arson and worse? As citizens we must demand our legal authorities to crack down on this, and hard!

      Well, it's both. SovCits believe in an alternate reality where the legal system that they have been told about exists. It doesn't. What they don't understand it that they have been sold (and sometimes have actually paid money for) imaginary versions of the legal system, sometimes including imaginary documents. In a sense, yes, once they believe in this imaginary system, they think that there are clever arguments that they can make that will relieve them of responsibility or consequences.

      its not not psych eval, its mental competency eval. The defendant says he doesnt understand simple charges, so the court has to basically do an IQ test to make sure he is not MR.

He admitted his guilt, yet still presumed to have done nothing wrong. Gaol him for the contempt and then add on the sentence for his crime. The rest is bollocks.

      I’ve found Zoom to be extremely helpful in getting cases moving that would normally have to be continued ad nauseam because of scheduling conflicts. It’s also been helpful for hearings that are extremely brief by nature. Also, it’s been a very good protection option for plaintiffs in HRO/OFP cases, whereas the defendants must appear in court at the hearings. Because of Zoom, abusers have difficulty reoffending the way the could in the past.
      Also, in criminal cases, defendants will often get too comfortable on Zoom and start acting in ways they would normally try to conceal if they were in person. If your job is supposed to be finding the guilty party, or at least being in the periphery of a courtroom, you’d have to be *blind* to not see the value in Zoom hearings. The court sees the litigants and their behavior in ways they couldn’t before, and they rule accordingly. Zoom is better than any lie detector.
      I mean, I don’t know what your experience with Zoom as an attorney has been, but for me it’s made my work so much more efficacious.

    These competency hearings are a waste of time. He is 100% competent. you just need to hold him in contempt and let him sit in jail for 30 days to think about his nonsense, you can do the competency hearing during that time.

      The strange part is, he wants to be seen as competent to stand trial; if he is deemed incompetent, the charges are stayed and he walks.
