    The judge missed the mark on so many levels. The defendant was trash!
    1. He drove drunk.
    2. He called that man a slur.
    3. He hit a woman.
    4. He continued to call that man a slur.
    I wish this case went to Judge Mathis or Judge Judy. They would have lost it!

    The defendant is horrible. Why wasn’t him assaulting her talked about more. And who cares that they left him on the road. He was driving drunk and could’ve killed them. Luckily he pulled over smh.

    I really REALLY don't like how Judge Milian handles cases like this. She just heard a grown man who was DRUNK DRIVING punched a woman IN THE FACE and her first comments are "did you really leave them on the side of the road?" ARE YOU FUCKING SERIOUS??? I'm not gonna say why I think that is but I do think there's a reason.

      She didn't address the drunk driving because this is civil court, not criminal. What they should have done after he insisted driving, was not get in the car with him; they could have also made the decision to call the police once they were on the side of the road.

    Judge Milian has addressed manyyyyy people that have assaulted others. She dropped the ball on this case but let’s not make it seem like she’s never went off on someone who’s abusive.

    Instead of asking for the cost of the old phone (it would be the depreciated value) AND a new phone , she should have asked for punitive damages, plus the assault. Her lack of knowledge really hurt her financially.

    So glad they lived to tell their story. When I was in HS I had some friends that were dating and they got in an argument outside of their car and they were both killed on the side of the highway in the city. 😢RIH

    I can't believe the Judge charged her for their Lyft rides home! Did she really expect her to let him back in her car when he was literally attacking her and her car and breaking her stuff??! I would have left his ass too! If someone is out of control and violent, it's their own problem to figure out how to get home. Absolutely ridiculous ruling.

      The reason the rides were reimbursed is because the rental car was in his name therefore she essentially stole his car which it’s a crime. I’m not saying that it was a bad decision on her part to remove herself from the altercation the only way she could but that is the legal reasoning behind the ruling.

      @@shannonpeek5165 I understand what you're saying but I still disagree. It was completely reasonable on her part. She's not going to get out of the car again, where he is still acting out violently and after he just hit her, especially on the side of the highway, at night and in the rain. She really didn't have another option, she did what she had to because her immediate safety was threatened. And giving him back the keys and control of the vehicle after 1. He was already driving recklessly and 2. Is now also enraged in anger and acting erratically, would be completely irresponsible and pose a danger to everyone on the road, including himself. He's lucky the cops weren't called on him because it was definitely warranted and they certainly wouldn't have let him drive in his condition. Not to mention, he probably would have been arrested and the car most likely would have been towed. So if anything, him having to get a Lyft ride probably saved him a lot of money and legal trouble. The way I look at it, her leaving him and taking the car was a direct consequence to his actions and poor behavior.

      @@sashabenoit1518 I’m NOT disagreeing with you that she mad the correct choice. But what people sometimes don’t understand is that the correct choice does not always mean it is the legally correct choice. Morally, absolutely but the law doesn’t care about that unfortunately and a judge is bound by the law even if they feel different morally. In this situation, she has other options available to her. She could have called the police and gotten their help. She couldn’t driven the car to a safe location and called a ride share and texted him to tell him where the car was. Instead, she chose to take the car that was legally rented in his name and leave him on the side of road while she left the area and returned home with the rental. It probably would’ve been a little more understandable if she would’ve just used the car to get out of the situation and then left it in a safe location. Then she could’ve rented her own car or arranged other transportation to get back home. She did not have to take his rental to return home in, leaving him stranded in the area with no other option but to use ride share services because he couldn’t rent another car since he already had an active rental. Once again, i do not disagree with her choice that night but legally she was in the wrong by taking the car to return home and leaving him stranded.

      @@shannonpeek5165 I do understand that not all choices we make, even if they are absolutely necessary for us or the right thing to do, morally speaking, does not always equate to being legally reasonable. It's just like Judge Milian always says, "It could be the best choice you ever made for yourself and you did what you felt you needed to do for you. But sometimes our good choices, don't cost someone else." I'm 100% with you on that. I also didn't realize that she took the rental all the way home with her and that that caused extra and unnecessary complications because of how far she was. I must have missed that point. So I actually agree that she took it too far in doing that and that the reasonable thing would have been to remove herself from the situation, park the car safely, and then find her own way home from there.

    This case gave me Shenquella Robinson vibes. Glad she left when she did! IDK how a man can assault a woman and it not be addressed. I don't feel like he should get the Uber fees paid to him. He was drink driving, he should've taken an Uber to begin with. I agree she shouldn't have taken the car, but he was at fault.

    Judge Milian, you missed a lot here. You minimized her being assaulted and failed to see that seeking safety was the most important goal for this young lady. And why advise someone not drive off the highway for her own safety? I feel like the verdict and judgment were based on thinking a woman, or black woman can take a beating!!

    This is one of the only cases where I think she is 100% wrong for not calling out the defendant. He is a piece of crap and she just shrugged her shoulders. She was more upstate that he was in a strangers yard.

    The plaintiff forcing him to pull over while driving drunk, may have been the BEST thing to happen!! She potentially could have saved ALL of their lives! Judge Milan should have awarded her the entire amount she was asking for JUST for doing that! And the fact that he assaulted the plaintiff SHOULD have been addressed!

      Yeah, honestly it sounds like everyone was drunk, everyone was throwing hands and pulling wigs, etc. No way to tell who got hit by whom. The only things that were clear are he dropped the phone, and she took the car that wasn't in her name.

    He shouldn't have gotten the Lyft costs reimbursed; I'm sure they left the rental car at the airbnb for him so he could still use it, and just b/c it was in his name doesn't mean he's the only one who paid on it.

    Judge took it way too easy on the defendant - he's a woman-beater bully! He should've been arrested for assault & battery. The judge didn't make him cover her leaving as if they were supposed to stay in the house with a guy who battered both of them; he made it unsafe for them, so he should pay.

    I hate when the judge misses lies told. That girl said he got out of the car, walked in front of the headlights, and smashed the phone on the ground. Then we hear the 2 guys got in a fight, and the phone was broken. Thats a big difference, and honestly, whoever swung first during the fight should be responsible for the broken phone, mean words, and name-calling cant break a phone.
    Judge should have pressed them both to get the truth out. The case would have finished totally different.

      Yes, everyone in the comments mad she didn't get on the defendant more about her getting hit in the face. There is no proof aside from her saying he hit her, that he caused it. If all of them were throwing punches, pulling wigs off, etc. she could have been hit anytime, by any of them during that. She also said he threw her phone down and stomped on it, and then it came out the phone was knocked out of his hand by her boyfriend. The only things the judge could rule on were facts. And the only things that were clear were that he dropped the phone, and she took the car that wasn't in her name.
