My current tenant is the opposite. He's actually trying to take over my house. He actually came up with a proposal to convince me to put him and his husband on the title of my house 😂😂😂😂 and has made fraudulent claims to his renter's insurance company company. His latest shenanigans was stopping payment on October rent. Claiming that he feared for his safety from the hurricane and needed to evacuate even though the house is in a no flood, no evacuation zone. Of course he has every right to leave the city. I have no problems with that at all. But you still have to pay the rent. With his recent behaviors, too much to describe here, I have already retained a lawyer. He just doesn't know it yet.

That house is very small & only partially updated with a terrible kitchen. I would do rental only. Anyone who does rent to own will have buyers remorse after living there for a while. The rental client would likely at least stay a few years & then move on to something better.

Seeing that they left the property in good condition I would consider giving some, not all, of the option consideration back. But if you don't that doesn't mean you are doing the wrong thing. That's what contracts are for. You taught me that.
I would not consider giving anything back because the text that was sent on "Sunday " specifically stated the house would be "professionally cleaned"; it was far from it. Plus, the outside was unkempt as well. It definitely could have been worse both inside and out. That dog smell is not going to be inexpensive to get rid of. I do a random drive by to my rental properties to get an outside visual and if it's looking suspect, I'm contacting the tenant to let them know I'll be stopping by the next day for an inside inspection.

One very important detail you left out when going over the lease to purchase option process and lease is maintenence responsibility. In most cases, this is the sole responsibility of the tenant and, depending on what type of shape the plumbing, ac/heating, electricity and roof are in as far as repairs and/or replacements go, it can also be the major reason tenants tend to back out of the lease.

New subbie and it’s funny that this is the first video I’ve seen. I live in the area and have passed this house many times. It always stuck out because the lawn was always the worst on the block. This is very interesting info.
You seem like a nice man. However, that house is so small. I think it needs to be expanded or fixed up differently. Too small , after a while people start to feel closed in. Put in the contract no dogs until you completely pay for the house.

The place doesn't look bad, seen worst. Don't punish the tenants if they paid on time and were responsible. Like someone else stated "maybe they're going through some difficult times." Get rid of the carpeting and replace with tile or LVP.
Kris, I would not refund the option fee payment. I would clean it up, resale on a 2 yr LO, get a $10K option fee (and a potentially better tenant buyer), then sale on a 30 yr contract for deed.

I would do another lease option . Once I get the next down payment, then give them a partial reimbursement of their down payment, the amount would be totally up to you. I would definitely do a thorough cleaning of the place and subtract that from the amount.
The kitchen has no counter space or cupboards for a 3 bed the lighting looks dated. Needs new flooring go with wood flooring in all rooms much cheaper in long run an put in some new cupboards in the space in dining area along the upper wall

Both parties understood that. If it was refundable it is highly unlikely the tenant would consider giving you any money. The agreement is the agreement. I like the LO option I think it’s phenomenal you are attempting to educate regarding this process. I would do all the things necessary to repair the home have it smell good and proceed with the process of getting another lo tenant and if you get one quick enough in consider giving a portion. But otherwise I would initially say no because they didn’t do as promised with professionally cleaning and the yard. I don’t know what happened and not wanting to judge but as least if they did their part you would consider bending the rules
In Texas I read that we have to record the installment contract and that instead of a eviction we would have to foreclose on the tenant buyer to get the property back and remove / release the installment contract from the public record. As a wholesaler as well I remember seeing these installment contracts on the title commitment and the public records. Additionally I read that if the tenant paid 48 months of their contract for deed that if we had to court that the tenant buyer would have equitable interest in the property even though they haven’t received the deed . What is the work around to these issues because foreclosure takes a long time and more money??? Or should we just lease and have the tenant sign a compliance sheet outlining that they are responsible for all of the repairs and be very specific and detailed . We can evict them and it’s shorter and cheaper. Need a little help I’m closing on a deal with a renter in place and I’m trying to see how to proceed. Thank you

It appear lease option is best, gives you that large down payment and you not responsible for up keep while they're there, and if lease is broken you get to use some of the down payment for make ready. to be able. No you don't need to give any of the down payment back because you have to use some of that to get the house ready, replace the door and tub and some cosmetics.

No. Not everyone desires a big home. No sense in spending more money when you can just lease or sell.

I would do another lease option . Once I get the next down payment, then give them a partial reimbursement of their down payment, the amount would be totally up to you. I would definitely do a thorough cleaning of the place and subtract that from the amount.
The kitchen has no counter space or cupboards for a 3 bed the lighting looks dated. Needs new flooring go with wood flooring in all rooms much cheaper in long run an put in some new cupboards in the space in dining area along the upper wall

No refund period…..

Great video and outstanding breakdown of lease option sir. The tenant could leave the place in immaculate condition and I would not return any money. It is nonrefundable. Both parties understood that. If it was refundable it is highly unlikely the tenant would consider giving you any money. The agreement is the agreement. Neither party should be upset when the other party abides by the terms of the agreement.

I like the LO option I think it’s phenomenal you are attempting to educate regarding this process.
I would do all the things necessary to repair the home have it smell good and proceed with the process of getting another lo tenant and if you get one quick enough in consider giving a portion.
But otherwise I would initially say no because they didn’t do as promised with professionally cleaning and the yard. I don’t know what happened and not wanting to judge but as least if they did their part you would consider bending the rules
That was a good deal on that property, $1350 per month for a 3 bedroom. In new orleans a house like that would go for $1500 -up

In Texas I read that we have to record the installment contract and that instead of a eviction we would have to foreclose on the tenant buyer to get the property back and remove / release the installment contract from the public record. As a wholesaler as well I remember seeing these installment contracts on the title commitment and the public records. Additionally I read that if the tenant paid 48 months of their contract for deed that if we had to court that the tenant buyer would have equitable interest in the property even though they haven’t received the deed . What is the work around to these issues because foreclosure takes a long time and more money??? Or should we just lease and have the tenant sign a compliance sheet outlining that they are responsible for all of the repairs and be very specific and detailed . We can evict them and it’s shorter and cheaper. Need a little help I’m closing on a deal with a renter in place and I’m trying to see how to proceed. Thank you

You should give them back part of the deposit it’s only a year at least $3000-4000. They did not destroy the house.
All in all, they left the house, ok 👍🏽. I would wait to get another tenant, then maybe give a credit.

It appear lease option is best, gives you that large down payment and you not responsible for up keep while they're there, and if lease is broken you get to use some of the down payment for make ready. to be able. No you don't need to give any of the down payment back because you have to use some of that to get the house ready, replace the door and tub and some cosmetics.

Well the economy is tough man but as an investor I understand both sides of the coin!A lot of people basically don’t save for hard times and so life happens but according to the letter they were moving on to greener pastures or maybe a job opportunity.Perfect house for a tenant buyer however.I never used the deodorizers but the equity capture still appears to be about $40-60 thousand dollars based on the numbers you provided.To me your monthly payment is reasonable considering it is an option.On an option they get no money back but I know people that pay more than that for just rent.
