The officer should be charged with murder.
This is the exact same situation that Brian Malinowski found himself in. Now both men are dead. Like the ATF, the deputy should be charged with murder.

In this case the victim was INSIDE their home...unable to see who was at the door...& was shot while LEGALLY holding his handgun pointing down & not at the Officer or anyone else...

A Prosecutor has to present the case to a Grand Jury...which decides whether or not to indict...
If they do, then a warrant is issued & the subject is arrested & appears before a Judge who determines if bail will be granted...then there's a TRIAL...
and if the subject is found guilty beyond a reasonable doubt THEN they go to prison..
Fortunately in America we don't throw people in Prison without a trial.

@@jeffanon1772 you're nit-picking, tho. Also, it's been, what, 3 weeks plus since this incident? It should not take 3 weeks for our justice system to, at the very least, get the ball rolling. It really shouldn't take more than 3 weeks for a judge to look at the body cam footage, call for a grand jury, indict, try and convict a felon like this cop is. Lawyers and a squishy-hearted/minded population makes these things drag out for months/years at the cost of millions to you and me, the taxpayers. You should be pissed off this hasn't happened more quickly, but apparently, you're someone who likes being bent over the taxation barrel. I personally don't like having my hard-earned income stolen from me only to have it spent on stupidity and legalities (but I'm splitting hairs). This is a cut and dried case. They gave them the wrong apartment. They thought it was coming from his apartment, it was coming from the apartment adjacent to his. The cop was given bad information, and made a bad decision based on bad information. Had that actually been the address where there was domestic violence, a man answering a door with a firearm most certainly is a threat. The problem lies with the bystanders giving them the wrong apartment number.

@@jamesTBurke For what? Trying to report a crime? Getting the address wrong? It's a common mistake at these complexes to get incorrect info not to mention the errors between the 911 operator and dispatcher.
Had the cop not panicked and killed the wrong person he could have disarmed the individual, conducted the initial investigation, hopefully determine he's at the wrong place, then talked to the person who called it in, possibly find out where the fight/argument did happen and talk to that person.
Instead he mag dumps at the first sight of a gun that wasn't pointed at him, certainly justified to pull his weapon, but until the weapon is brought up he had no reason to fire.
Never live next door to Karen. If she doesn't know or like you...... It can end very bad.

In this jurisdiction the murder charge requires premeditation. I understand you're emotional. But it takes literally 30 seconds to search laws and determine that this man might be guilty of involuntary manslaughter / negligent manslaughter. No department in Florida will consider his application due to the amount of coverage this incident has produced and with him being under investigation by FDLE ( Florida Department of Law Enforcement) plus the airmans family can request/ demand the Criminal justice standards and training commission pull/revoke his law enforcement certification thus making it impossible for him to ever work in any law enforcement capacity again in the state of Florida or any other state.

I worked law enforcement for a few years. Bottom line you have to be confident in yourself to do this job. You can’t allow fear or prejudice to come into play or someone will be harmed or killed.
Cops are trigger happy
Their scared it's sad but that what fear does to rookies I took all the training for law enforcement and we knew not to shoot unless the weapon was pointed at us or an innocent person, this worked a lot better when you were paroling your own neighborhood were you knew everybody then some fool politician decided that you might show favoritism so you got sent to someone else's neighborhood now you got to spend time learning who who if you can even trust them.

The officer absolutely must be charged. The point is that the same would be the case for anyone else in the same situtation. The officer is not special, does not derserve special treatment. He know the job was dangerous when he took it, that is no excuse to attack innocent civilians.

I cannot begin to tell you how much I agree with you. There are so many people commenting on this video who clearly have not watched the full body cam footage in it’s entirety. And are not well informed at all about all the details of what happened, and especially about the facts that have come to light that led up to this deputy’s justifiable firing. That former deputy was so wrong. He should never be a cop ever again anywhere and should be in jail. I’m not sure what they should charge this deputy with that will succeed because I’m not a lawyer. But that deputy should face at least some jail time, which will keep him away from guns for some time, and will never allow him to be a LEO ever again.
I am a veteran Air Force guy. And have been to training courses in that area. I am so appalled by this, and that’s an understatement

It’s not a training issue it’s a leadership problem. The Sheriff sets the tone for the whole department! The cops are probably told to shoot everything first? Before this guy was was in office, officer involved shootings were rare.
If not, then don’t be in your own space with a gun at any time lest some concerned citizens call the law. This should never, ever have happened.

To the LEO'S that say it takes a special person to do your job. Try land surveyor where you have legal right to trespass and ppl come at you with loaded guns, pipe wrenches, and speeding vehicles. Stumbling across meth cooks and out numbered by nut jobs. YET I HAVE NEVER DRAWN MY GUN. STFU about it takes a special person. I face danger far more often and I don't get special legal protection, qualified immunity, paid for team of lawyers.

I work in aerospace quality control. Thousands of peoples lives depend on me doing my job correctly every day. There is actual Federal law that requires a minimum sentence of 10years and (not or) a 1 million dollar fine, if there is a loss of life as a result of my negligence.
It takes a special kind of person to be honest, measure every feature on every part 100% every time. It requires a person of serious dedication to the craft, commitment to customer, and morale standards to never cut corners.; law enforcement need not apply.
