@@DashDriver-z1r I agree with you entirely. The thing is with the police, they are so used to intimidating people when it comes to traffic matters as most people will just buckle. What worries me is that so many coppers don't even know the laws they're supposed to be policing. I went to the Magistrate's for non-insurance and as a professional vehicle operator that could have had very serious implications for my legal repute and entitlement to hold an operating licence. The actual evidence against me was "...and, Sir, the defendant was not on the Motor Insurance Database and so..." My defence was in the form that the Road Traffic Act requires insurance. I did have insurance and presented my policy documents as well as a witness from the insurance company who had attended Court to confirm under oath that cover was in force. The problem was that the copper thought- mistakenly- that if it wasn't on the MID then it wasn't insured... But that's nonsense. I have a vehicle out now that is insured but only joined the fleet on Friday and isn't on the MID yet. Though the vehicle we sold a week earlier is no longer on our insurance but is showing on the MID. A colossal waste of Court time- and mine. All because a copper didn't know the law. What worries me is how that charge got through his Sergeant, Inspector and CPS.
Sometimes people have no choice but to represent themselves. and legal aid is not easy to get now. I have had to do it many times and most I've won but that's because evidence is the key. There is something very satisfying about winning when you know you are right..
It happened to me years ago. Criminal damage. I thought I could represent myself but made a complete hash of it. Luckily the Magistrate was in a good mood and asked the caretakers the questions for me and he chucked the case out. To say I was happy was an understatement.
I think that's exactly the point. If you get a sympathetic magistrate, they will help you out, but if you get a snotty one then you can easily screw yourself, at which point a few hundred quid on a solicitor suddenly sounds like a really good idea. I would always recommned good legal advice, not because you can't get through without it, but basically to prevent you screwing yourself up.
I believe the respect you showed the court and especially the police officer, showing yourself to be considerate and law abiding, went a long way to convince the court that you were only there to correct a mistake made by the officer and not seeking vengeance. If you had gone at it with a crooked cop attitude, I’m sure the outcome would have been different and then your commentator would have been correct. Great example on how to go about things when you know you’ve done no wrong. Integrity won the day. Happy travels.
Never Ignore Official Letters. Always Engage with them, because sometimes the simple Act of telling them you Want a Court Date, can be enough for them to Withdraw.
True mostly, but not always. It really does depend on what you mean by "official" if it is something in reference to my driving license then yes i agree. However in my younger years i did ignore stuff from private parking companies as well as debt collectors and it literally went away. Equally i did the same with more serious debts and got a CCJ, so it does depend. I am not telling people to be dishonest either i am just saying your statement is not strictly true...
I, embarrassingly, got caught drink driving in 2001. I also chose to not "Lawyer up" against the recommendations of "general consensus". I went to court and expressed my genuine remorse, embarrassment and appreciation of the potential devastation I could I caused that night!!!! Of the 6 people in court that day accused of D/D, I was the only one with no lawyer, yet the only one offered a D/D awareness course (which I accepted) which subsequently reduced my 12 month ban by 3 months. I fully appreciate and understand that these are wholly, completely, different circumstances, but sometimes "Lawyering up" implies arrogance and downright disregard for the law; hence you need someone else to fight your battle for you!!!. Every situation is different; and getting a defence lawyer may not always be the best way to deal with a particular situation. Just my tuppence worth. Solicitors are there to find loopholes to get you out of trouble (I know in reality that’s not all they do). But that was my reasoning. I said I have nothing that needs to be presented in a certain way as I just want to tell things how they were. I think not having a solicitor was definitely part of what helped me in this situation so I do agree with you on that!

The absolute right thing to do was to challenge the case. When you're in the right, all you have to do is tell the truth. The easiest job in the world. Well done. Something that seems to simple can become difficult when people say everything is against you. I had something along similar lines in a work related dispute (someone said id done/said something I knew I hadn't). The individual changed their story, contradicted themselves, I just told the truth. Work had to apologise for suspending me when i was the one who raised to HR, which should have said it all. That individual moved to a different department with a pay cut, I left the company and now earn double in a higher role. Keep up the cracking vids💪🏼
Bravo to you Adz for standing up for yourself and not letting bully you into paying a fine for something you didn't do! 👏👏 I find it quite scary that the police can just accuse you of something with no evidence and they go straight to issuing you with a punishment without even questioning it. If you weren't as switched on and as confident as you are, you might have felt pressured into just acceptint the punishment and not taking it further. Victory in the face of injustice! Some police officers make mistakes, and unfortunately, some even fabricate stories. A few seem to think they're above the law, on a power trip where they're always right and never wrong. Well, congratulations on overcoming those ones. In principle, you absolutely earned your compensation and should have accepted it for the inconvenience and stress you went through. It would also serve as a reminder to the thousands of people wrongfully convicted that they should fight for what is right, and as a lesson to that officer-and others like him-to be more diligent and observant in the future. The solar panel was picking up 30W input in direct sunlight and kept dropping to zero with the tiniest bit of cloud. I decided it was crap and sent it back...
Well done for winning your case. I understand the law around mobile usage has changed recently and there are a lot of cases going through the magistrates courts currently. 6 points is a lot if you need your license for work. I would strongly recommend others get legal advice as not everyone is as eloquent as yourself and generally they do take the officers word over yours. Take care👍

Congratulations on the outcome. One thing that did shine through the entire saga is just how much they system goes out of the way to discourage people from seeking redress for injustice. It would be interesting to know if the potential court fees you would have incurred had you lost, would have equally been incurred by the organisation that brought the charges (the police), as someone has to pay those court costs (normally the looser). Anyhow, all history now, onwards and upwards.

Hi, Firstly, I am over the moon and so happy for you, that you were found "Not Guilty" it was obvious from your very first video on the matter that you had not been on your phone. I am really impressed with the way you handled this, by not showing anger and blowing your lid. You dealt with this in a calm collective and very professional way. The issue the police officer had is he let his ego get the best of him, just like many a person would have done in a similar situation and instead of holding his hand up and admitting he had made a mistake in his observation, (especially after you explained and literally showed him how there was no way you had been on your phone), he decided to try to save face by trying to push you into a corner and get you to admit to something you had not done. This was then backed up with the summons to go to court and threats of an even bigger fine alongside the 6 points you would get if you lost the case. "Well Done" for holding your cool and fighting this to the end because many a lesser individual would have just caved in and accepted the fine and 6 points. Mainly due to being scared of the unknown and frightened due to idiots saying things like they will always side with the police when its one against one, despite the police officer actually having no evidence what so ever of the crime being committed by yourself. Finally what impressed me the most and goes a long way to show the integrity and honesty of you as a person is how you declined to go for compensation against the police for this incorrect accusation. I personally would have done the same as you but I would hazard a guess, a high majority of people would see £££ signs in their eyes and have gone for the compensation regardless.
Here to second your statement about Adzs integrity and honesty in this matter, didn't play the victim and try and milk the system. I would be interested to understand if there is any mechanism within the police force to retrain the officer after losing a case?
Always know your rights. And never accept you are in the wrong when you knew exactly you were not breaking the law. That officer believed you wouldn’t challenge, because sadly, and in his experience many won’t show your brave determination. Applaud you greatly, and well done for sharing. It helps people. We expect standards from officers. Maybe he was having an off day. But you rightly observed and stood your ground.

In normal cases like that they would ask the time of the incident plug your phone in check the last time you was on your phone job done

This is a good point. The are plenty of innocent people who would not be able to defend themselves in court.

Congratulations on the outcome. One thing that did shine through the entire saga is just how much they system goes out of the way to discourage people from seeking redress for injustice. It would be interesting to know if the potential court fees you would have incurred had you lost, would have equally been incurred by the organisation that brought the charges (the police), as someone has to pay those court costs (normally the looser). Anyhow, all history now, onwards and upwards.
I just bought an all Powers solar charger and panels, I bought it as I live in a remote part of France and we have loads of power cuts. Great you stood up for yourself with the court case, well done. You make me laugh with your e plantations. Thanks great vlog. Jo in 🇫🇷

Well done on fighting your case, it would have been all too easy to roll over but with those points you'd be paying alot in increased insurance costs, so well worth taking them on - especially as you are in the right!.

Hi, Firstly, I am over the moon and so happy for you, that you were found "Not Guilty" it was obvious from your very first video on the matter that you had not been on your phone. I am really impressed with the way you handled this, by not showing anger and blowing your lid. You dealt with this in a calm collective and very professional way. The issue the police officer had is he let his ego get the best of him, just like many a person would have done in a similar situation and instead of holding his hand up and admitting he had made a mistake in his observation, (especially after you explained and literally showed him how there was no way you had been on your phone), he decided to try to save face by trying to push you into a corner and get you to admit to something you had not done. This was then backed up with the summons to go to court and threats of an even bigger fine alongside the 6 points you would get if you lost the case. "Well Done" for holding your cool and fighting this to the end because many a lesser individual would have just caved in and accepted the fine and 6 points. Mainly due to being scared of the unknown and frightened due to idiots saying things like they will always side with the police when its one against one, despite the police officer actually having no evidence what so ever of the crime being committed by yourself. Finally what impressed me the most and goes a long way to show the integrity and honesty of you as a person is how you declined to go for compensation against the police for this incorrect accusation. I personally would have done the same as you but I would hazard a guess, a high majority of people would see £££ signs in their eyes and have gone for the compensation regardless.
Here to second your statement about Adzs integrity and honesty in this matter, didn't play the victim and try and milk the system. I would be interested to understand if there is any mechanism within the police force to retrain the officer after losing a case?

Always know your rights. And never accept you are in the wrong when you knew exactly you were not breaking the law. That officer believed you wouldn’t challenge, because sadly, and in his experience many won’t show your brave determination. Applaud you greatly, and well done for sharing. It helps people. We expect standards from officers. Maybe he was having an off day. But you rightly observed and stood your ground.
Well done successfully defending yourself in court. Is a good accomplishment. I respect it.

Milk roll is the modern version of the milk loaf of the 70s and 80s. It is a lighter white bread. A lot liked the loaf as the slices were smaller and thinner so not too heavy for many. Now though its a bit sweeter than the original one
