    There was an incident 14 months ago (which I already discussed in previous van life episodes), that led to me having to attend a court date. And at the time I said I'd update you on what happens. So this is what this video is about.
    But of course, in this video I also take the campervan out, cook some food in the van, and find a park up by the beach in the UK.

    Victory in the face of injustice! Some police officers make mistakes, and unfortunately, some even fabricate stories. A few seem to think they're above the law, on a power trip where they're always right and never wrong. Well, congratulations on overcoming those ones.
    In principle, you absolutely earned your compensation and should have accepted it for the inconvenience and stress you went through. It would also serve as a reminder to the thousands of people wrongfully convicted that they should fight for what is right, and as a lesson to that officer-and others like him-to be more diligent and observant in the future.
    Once again, congratulations, buddy. Very well done. I can't express how pleased I am to hear this news. Have a great day, and enjoy your trip wherever it takes you, my friend!

    It happened to me years ago. Criminal damage. I thought I could represent myself but made a complete hash of it. Luckily the Magistrate was in a good mood and asked the caretakers the questions for me and he chucked the case out. To say I was happy was an understatement.

    I, embarrassingly, got caught drink driving in 2001. I also chose to not "Lawyer up" against the recommendations of "general consensus". I went to court and expressed my genuine remorse, embarrassment and appreciation of the potential devastation I could I caused that night!!!! Of the 6 people in court that day accused of D/D, I was the only one with no lawyer, yet the only one offered a D/D awareness course (which I accepted) which subsequently reduced my 12 month ban by 3 months. I fully appreciate and understand that these are wholly, completely, different circumstances, but sometimes "Lawyering up" implies arrogance and downright disregard for the law; hence you need someone else to fight your battle for you!!!. Every situation is different; and getting a defence lawyer may not always be the best way to deal with a particular situation. Just my tuppence worth. Have a strapping pint on me Old Bean and congrats!!! Much Love and happy, safe travels .

      Thank you so much Mark!! It’s appreciated mate!!
      And yeah I completely agree. They asked why I chose not to have legal help and I said it’s because the way I see it. Solicitors are there to find loopholes to get you out of trouble (I know in reality that’s not all they do). But that was my reasoning. I said I have nothing that needs to be presented in a certain way as I just want to tell things how they were. I think not having a solicitor was definitely part of what helped me in this situation so I do agree with you on that!

    Bravo to you Adz for standing up for yourself and not letting bully you into paying a fine for something you didn't do! 👏👏 I find it quite scary that the police can just accuse you of something with no evidence and they go straight to issuing you with a punishment without even questioning it. If you weren't as switched on and as confident as you are, you might have felt pressured into just acceptint the punishment and not taking it further. And the fact the officer didn't even have to show up in court...such a joke! 🙄 Well, you showed them! 🎉

    Hi, Firstly, I am over the moon and so happy for you, that you were found "Not Guilty" it was obvious from your very first video on the matter that you had not been on your phone. I am really impressed with the way you handled this, by not showing anger and blowing your lid. You dealt with this in a calm collective and very professional way. The issue the police officer had is he let his ego get the best of him, just like many a person would have done in a similar situation and instead of holding his hand up and admitting he had made a mistake in his observation, (especially after you explained and literally showed him how there was no way you had been on your phone), he decided to try to save face by trying to push you into a corner and get you to admit to something you had not done. This was then backed up with the summons to go to court and threats of an even bigger fine alongside the 6 points you would get if you lost the case. "Well Done" for holding your cool and fighting this to the end because many a lesser individual would have just caved in and accepted the fine and 6 points. Mainly due to being scared of the unknown and frightened due to idiots saying things like they will always side with the police when its one against one, despite the police officer actually having no evidence what so ever of the crime being committed by yourself. Finally what impressed me the most and goes a long way to show the integrity and honesty of you as a person is how you declined to go for compensation against the police for this incorrect accusation. I personally would have done the same as you but I would hazard a guess, a high majority of people would see £££ signs in their eyes and have gone for the compensation regardless.

    • @GeoffSlack
      @GeoffSlack 3 години тому +1

      Here to second your statement about Adzs integrity and honesty in this matter, didn't play the victim and try and milk the system. I would be interested to understand if there is any mechanism within the police force to retrain the officer after losing a case?

  • @erraticuk
    @erraticuk Годину тому +1

    Just remember they are not nice people. Thats just soft intimidation tactics to get to admit you are guilty.
    A lot of people earlier this year ended up with prison time for falling for those tactics and not fighting it out in court.

    I am absolutely delighted to hear you were found not guilty. It was clear from your previous video evidence that you do not hold your phone whilst driving and this in itself throws into question the ‘evidence’ against you. There is a golden thread enshrined in U.K. law regarding ‘identification evidence’ stated in the case R-v-Turnbull. In that case the judge made it clear that no matter how certain a witness is about (his) identification evidence, (he) could still be very much mistaken. That same principle applies to any case where the only evidence is that of an individuals evidence about what he believed he saw. That and you excellent cross examination in which you highlight the officer’s inconsistencies and errors on the day in question left the magistrates with no alternative. They had to conclude that the burden of proof on the prosecution to show that you had committed the offence (beyond all reasonable doubt) had not been met. You have also shown that it is best to ignore comments from people who by their very language, evidence their bias against the police when commenting.

The bit that annoys me about what happened to you, is that not everyone is clever enough or brave enough to do what you did , in standing up for yourself , so they would have just had to swallow the fine and the points , even though they didn't do anything . The police guy should have documented his evidence better, not just to protect himself but to safeguard you also . I'm glad you won , it's a leg up for the little guys .🙂

    Good result. As a young 'un in the seventies I used to respect our local bobby in my small Wiltshire town and even received a clip 'round the ear for setting off bangers in the high street. Better that than him telling my Dad!
    Almost fifty years later, living maybe twenty miles away still in Wiltshire, I wouldn't trust a copper as far as I could throw him or her and if I ever get pulled over my phone will be recording everything. It's a bloody shame that you can't trust the police any more but it's their own fault for putting people through nonsense like you've just gone through.
    Seems proper policing is just too difficult so let's pick on easy targets and waste everybodies' time.

    • @Michael-u3j4g
      @Michael-u3j4g 2 години тому +1

      Why? His calls in and out have nothing to do with the case as it's perfectly legal to make and receive calls while driving, that's the reason cars have controls on the steering wheel that answer calls and stuff so you don't break the law by touching your phone, because it's legal to use your phone while driving as long as your not touching it. plus even if it was illegal to make or receive calls, that info from his phone wouldn't prove he wasn't doing other things on his phone. The only time someone's call history would be used, is if there was an accident and the police wanted to prove that even though the person wasn't doing anything illegal they was probably still distracted by the phone call
