    This video describes the 6 options available when you receive a photo enforcement ticket in Arizona:
    1. pay the ticket.
    2. request a civil traffic hearing.
    3. take defensive driving school.
    4. Say "that's not me driving!"
    5. Wait.
    6. Hire an attorney.

    On June 29th, our daughter received 2 photo tickets in a car we purchased for her. A traffic ticket and complaint summons was mailed to us on August 22nd. I stuffed it in a drawer and just came across it again today, October 5th. We have not received a second summons or service as of this 105th day later. Based on your description, this matter will be dismissed.
    Question, if this was not dismissed, would we have been required to identify the driver??? In our mind, that seems like the responsibility of the police department, not us. Moreover, couldn't people just lie on someone they didn't like? This system seems incredibly flawed to me.
    You totally saved us here, at no charge. If ever anyone is looking for a referral, we will send them to the Traffic Law Guys. (With these college kids, chances are better than average.)

      I would expect the ticket to be dismissed, unless something weird happened. Most courts, with the exception of Paradise Valley, have some sort of online visibility where you can check up on the status of the ticket. We always recommend checking up on the ticket after the 90 days has run just to make sure everything went as expected.
      A recipient of a ticket is not required to identify the driver. However, if the ticket is served, and the ticket was issued to the wrong driver, by the time you get to a hearing you can almost always safely identify the driver without risk of a ticket to the actual driver. It's a little more involved than just saying it was someone else without anything to back it up though.

    I have five tickets in my mailbox today.... unbelievable...they say final notice of school speed violation (these are the first notices, but it says final notices) and not traffic ticket and complaint...but they are asking me to pay these amounts...Are these tickets and if not do i have to send them money...and if i dont pay can they penalize my credit or freeze my car registration and tags

    I actual just got one last wk, I was about to make a left turn and realized I wasn't going to make it so I backed up... I crossed the line but didn't take the red light. I was surprised they still issued the ticket. I was thinking of going to court to fight but looking at this makes me want to wait. PLEASE HELP

    Do you waive service rights if you look up the ticket on Ecourts?

    I recived 2 photo speed ticket with the amont way up high I can even aford, and these both thickets are showing me that taken from the same location, but different days and times, so PLEASE what do you recommend me to do

      Hi, My first question would be have you been served with these tickets? We have a separate video on service. If you have NOT been served, definitely wait and see what happens. If you don't get served, and you don't waive service, the tickets will be dismissed on their own. If you have been served, or if you have waived service by telling the court you received the tickets, then you need to take action. Unless you have a factual argument (it was my brother driving, for example), the odds of success at a hearing are low. I would take defensive driving for one ticket if you are eligible, and either pay or request a hearing on the second. If the tickets have been served, there is unfortunately going to be some cost to resolve them.

    :Thanks for the video! ?? [ I did the communicate with the city questioning the validity for a photo speeding ticket, of near 12 over. then then they sent out more & I missed making it to my postal box & getting my mail & the new date, so more fine & de-fault now, would doing a motion for changing the de fault status & doing the driving school, even though it is less then a week out, based on not having their mailing in time a good thing? Are Motions netting me in to further things with them that I may not want ?? & I plan paying the amount as well. More looking for vacating having things on my insurance. ] :Thanks.

      At this point, you have nothing to lose by filing a motion to set aside the default. Worst case, the court says no, and you pay the fine. It won't get worse than the current situation. Best case, they set aside the default and you can take defensive driving school.

    My wife received one from a photo trap van with no video evidence, just picture saying 41 in a 25, it says if it is not paid by a certain date (25th) that it will be handed over to collections with a $25 extra fee. Do they need to serve us before they hand it to collections?

      They would need to serve your wife before it is sent to collections, and based on what you're saying, it sounds like the court believes your wife has been served. I would not expect there to be any notifications about collections unless the court believes your wife has been served and a judgment has been entered against her.

    what are the option if I say it was not me and I got a letter saying it was me? court day was the same day the letter was sent, in scottsdale AZ

      If you missed a court date, options are limited. If you missed a court date, the court may have entered a default judgment against you. Then your options would be to either pay the fine, or see if the court will set aside the default judgment. I would only ask to set aside the default if you actually have an argument, or if you are eligible for defensive driving school. Otherwise, just pay the fine. If the court has not entered a default judgment, then your options are request a hearing (if you in fact have an identity argument), pay the fine, or take defensive driving school, if you are eligible. You can always give our office a call to discuss available options too. Odds are it won't make sense to hire us, but we're happy to share helpful information.

      @@trafficlawguys Thank you so much for your advice! one more thing in the video you mention the ticket would be dismiss after 90 days from the infraction, still true even if the photo ticket has a court day?

      @@andre_bella Scottsdale has 90 days to serve a ticket. If they don't serve it, then it would get dismissed. When you mailed in the letter contesting identity, you waived service. In other words, you acknowledged that you received the ticket and Scottsdale is no longer required to serve you. It won't get dismissed after 90 days now - you will need to take some sort of action to address the ticket.

      @@trafficlawguys thank you again for your advice. The court has not entered a default, so I called them today and they extended the court day, seems like I'll be attending traffic school :( also I love your channel, very great content!!!

    hey got a question so basically i got a photo taken when i stopped on a yellow light then turn red then i reversed back to my lane but is that possible to get a ticket for that ? anndd if i do get a mail ticket should really wait it out and hope for the best for the 90 days?

      Hi Jerry, I'm not clear if you actually received a ticket, or if you think you might receive a ticket. In a technical sense, it seems possible to get a ticket for what you describe, but we have not encountered that exact situation. If you do received a ticket by mail, I would generally advise either taking defensive driving school or waiting to be served, and then taking defensive driving school if served. Of course, all of the options discussed in the video are available to you, you just need to make a choice that you feel comfortable with.

    Just got a photo enf traffic light ticket for non stop on right turn on red. I am at the lawer level. The city sent one letter for paying the ticket or other options, I waited and a second letter looking more ominous had a late penalty fine added and stressed that I should now just pay for it. These letters clearly state on the back side of the paper that this is a civil penalty, not criminal. No jail, warrant, driver record impact, insurance impact or credit report impact. haha, what a scam.

      It's not clear what the status of your ticket is, but I did want to note that while these tickets are civil in nature, and as you point out correctly there no possibility of a warrant or jail with these tickets, they do often create problems with driver records and insurance. If a driver is found responsible for a red light ticket, it is a 2-point violation, there is a fine, and the driver will be required to attend an 8-hour traffic survival school class to avoid a suspension. If the fine goes unpaid, it could result in the judgment being sent to collections.

      @@trafficlawguys I am trying this out as an experiment and it's interesting how it's turning out. Why would they hire a law firm to scare me into paying the ticket and not a collection agency? Also, I noticed that they want me to send the payment to a PO Box and not the city of the violation. In addition, they did not increase the charge to be paid...it stayed a 100 dollars (75 + late fee of 25).
