      He has said that several times, remember that most of those cryptos where premined and their founders used the money for development, and the expected development was suposed to cause a price increment, therefore if You apply the Howey test they Will result a security. Am I wrong? I do not live in the usa but that is what I have allways understand, Even before Saylore said they where a security. That in the USA, they are a world appart no matter what the laws in the rest of the world Say. The buyers of the icos bought with money the coins as an investment expecting that they Will make a profit with the development (efforts) of the founders (promoters).

    I could never hate you Toby, but I think Saylor makes some strong points. And, by the way, what would be so wrong with ETH being treated as a security like AAPL or other big companies? I don't think much would change. We would still trade it on exchanges like we do today. I'm not in favor of ETH being deemed a security, but if it happened I wouldn't lose any sleep. Good ideas always find a way to come to the fore.

      Because if it is declared a security, then to get listed on a stock exchange or for an ETF, they would have to get registered. Getting registered means they would have to open up their books to the SEC. You think that is ever going to happen? 😂

      Sure, they have value. The issue is that as a security, to get registered for an ETF, they will have to open up their books and show exactly all the funding they received, where the pre-mine/IOC went, and every other financial detail.
      I guarantee not a single one of these chains will be doing that, which means, they will never get an etf.

      Except for the fact that XRP, an alt, has already been ruled in court by judge Torres and agreed to by the SEC to not be a security. Thus you have only two coins in the US with regulatory clarity, BTC and XRP.

      ETH on the secondary market is not a security, however, it is a security being sold via Concenses and even back to day 1 prior to the ICO and there after. That being said, if Blackrock wants an ETH ETF it will get an ETH ETF and there is nothing anyone can do about it.

    So he is saying a different thing then the courts already ruled. The courts already rules that XRP is not a security and secondary market txs are not securities txs. Furthermore SEC already approved ETH futures which makes ETH a commodity. And SEC already made conflicting statements which means every judge has to simply acknowledge that SEC is acting in bad faith.

      Whatever Saylor says is wishful thinking on his part. Blackrock may have asked him to say this to spread ETH FUD so they can get ETH at lower prices. If XRP is not a security then ETH is not either. Remember Saylor wanted the BTC dominance to go to 80%. Here is a guy who's entities own close to 1% of the BTC supply. This is a supreme greedy, vicious investor who will do anything in his power to help move his investment at the expense of other investors. He is a POS, period!

    I agree with him. ETH became a security under US law when it moved from PoW to PoS protocol. That said, this hasn’t been formally stated by any regulatory body, but from a Howie analysis perspective, ETH is now a security. That doesn’t mean there can’t be a spot ETF though, I think there will be

XRP can be an ETF if Blackrock desired and it would be approved by the SEC since it is not a security. As for ETH, that is a different story. Saylor can only say things regarding ETH and other alt coins except XRP. Thus he is wrong both in the US and globally.

My first realization was that SEC chair Gensler was right when he said Eth wasn't a security because the design using proof of stake was decentralized enough.

    The SEC may have made previous pronouncements that ETH is not a security but they have the right to change their stance as new information surfaces. Same goes for Bitcoin. If it was discovered that through some obfuscatory mechanism Satoshi™ had pre-mined a significant amount of Bitcoin that could be secretly accessed or that the network could be controlled or influenced beyond the currently understood parameters and functions then they could also reclassify it as a security.

      To Stake ETH you need hardware, ETH, electricity, a building. You need to do work like a miner. I mined Ethereum for 4 years. I worked for my ETH. Saylor never mined Bitcoin. He is doing zero work to maintain Bitcoin. Yet he expects to profit off the work of others. All the ETH I have I got through mining and doing the work. You are talking out of your ass.

I have always thought that Eth is, and always has been, a security and I am not convinced XRP's landmark judgement was 100% 'not a security' I think they got a green light for their CBDC work.     And what he said was, according to what you read here, they will never be be commodities, just unregistered digital securities.
    Based on that, not until those digital securities are registered as such will there be a US spot ETF

    Yes, Ethereum raised over $18 million through an initial coin offering (ICO) between July 22 and September 2, 2014. The ICO involved selling 50 million ether (ETH) tokens at a price of $0.31 each, and investors received ETH in exchange for Bitcoin (BTC).     ETH is a security, like a company, they pre-mined stock for insiders and had a corporate ICO fund raising round. They have central planners who can adjust the supply. They pay a stake dividend.

    Good advice to everyone everywhere. ETC as mentioned by so many people at the moment is the original ETH and is proof of work, it has no group that owns it, it is decentralized, it is just like Bitcoin. If you are smart, you will realize ETC will replace ETH after ETH will be declared an security. And that is the facts

    By what I am reading in the comments, presuming the majority are from the US, they seem to lack the basic understanding that there is a whole world outside of the US and if the US wasn't there would still be fine and go on with business as usual. Saylor knows full well that there are alt coin ETF's outside of the US and that XRP, an alt coin, has regulatory clarity in the US as not being a security so ruled by judge Torres and accepted by the SEC. Saylor is dead wrong regarding ETF's on the global stage and in the US, that is yet to be determined.

    Thank you Toby. Please excuse my ignorance, but would you please explain how or if Ethereum qualifies as a DAO and how consensus works in Ethereum vs. Bitcoin. Seems to me that governments might like something that is "Proof of Stake". After all, isn't that what Wall Street is?

    Sailor is a BTC maximalist and doesn't like ETH because of the pre mining.
    I think his last sentence is pointing on ETH as an enabler of smart contracts that is going to replace the institutions and first the banks and traders, therefore they are going to fight is harder than they fought BTC, because it is possible.
    Nothing and nobody can stop BTC.

    Saylor bought Bitcoin at the perfect time and it ripped making it seem like he is credible. Right now the Ethereum ETF is likely if not this year, then next year. If it does pass though, Alt coins and layer 2s are going to bear the brunt of the ETF and I think that is why they are going to try to delay it.

    Bitcoin solves a problem, so an ETF makes sense, it makes it easier for more people to solve the problem. I can see how Solana solves problems that require speed. So an ETF for Solana makes sense, too.
    What problem does Ethereum solve, that isn't already solved better by Bitcoin (store of value) or Solana (transactions per second)?
