  • Dr. Robert Fastiggi, Professor of Systematic Theology at Sacred Heart Major Seminary in Detroit, discusses the Orthodox view of divorce in this excerpt from his talk entitled "The Authority of the Roman Pontiff and Other Points of Division between Orthodox and Catholics Today." Dr. Fastiggi's talk was part of the Conference on the Greek Schism, sponsored by Christ the King Chapel Ministries at Franciscan University of Steubenville.

    The council of Trent did define it, you are right. And the Roman church found a loophole as always: just hand out annulments like candy, by saying the marriage was never valid to begin with. If a couple married for 40 years that then receives an annulment, supposed to go to confession to confess 40 years of adultery / scandal? Certainly not. At least the Orthodox are honest about it.

      The great majority of annulments come from lack of form That is to say Catholic people getting married legally but not inside the church. They got married perhaps by a judge or in some Las Vegas chapel or whatever. This is a phenomenon that has happened in the modern world but didn't happen very much in the '70s the '60s the '50s the '40s etc
      That makes up the great majority of American annulments for example.

      Most marriages weren't done in a valid intention from the start. That's why there are many annulments. Even not wanting to guide your children in the faith is a reason for annulment. This is a result of a crisis of faith, not a loophole.
