      I totally agree with you! Bond revocation should depend on how he tested at the time of the incident, not how he tests now! This is his fourth offense, and he ended a child's life! Lock him up! Too bad if the tests are expensive! Too bad if it's inconvenient with his job! He has broken the law! Jeez, our justice system is so frustrating! Sometimes it seems like everyone bends over backwards too much for these habitual criminals! 😡😡

      It has nothing to do with his freedom it has to do with the prosecution will not be able to go to trial in 90 days as required if he is locked up.
      Some judges ignore the 6th Amendment and due process laws this judge doesn’t.
      So if they can keep him out on bond it increases the likelihood of conviction.

      Obviously he has a massive addiction problem and has never been able to or willing to deal with it.
      Genetic predisposition to addiction is hard enough to overcome if you’re the smartest most determined person.
      This guy hasn’t been determined enough to do so.
      He can’t even muster enough self control to get his drivers license renewed.

    This is flippin ridiculous! The defendant KILLS a 10 year-old while under the influence of SEVERAL substances, with a suspended driving privilege, AND on the phone! He should not have a bond PERIOD! This child was riding his bike and his life was taken by the negligence and carelessness of this man. I suspect that whoever posted his bond is part of the problem!

      Unless deemed a flight risk, everyone deserves a bond. Innocent until proven guilty. In no way does that statement reflect how I feel about this guy or his case. And I'm certainly not defending his actions. However, emotions can't change the laws.
      I will say the 1 day sentence for violating the bond was a bit weak. It was interesting to hear the judge say something along the lines of, "just because we order you not to use doesn't mean you can. It'd be like ordering you not to breathe." Pretty...progressive (enlightened?) stance on the situation. Especially in a case like this.

      Judge explained why he has a bond. When someone is held in jail they have a right to a speedy trial. They have the right to have the case heard within 90 days. The prosecutor wouldn’t have all of the information within 90 days. There are test and reports she needs to wait for. So in that case he gets a bond to wait for trial.!

      @@Justme0288 This is correct. Without lab results the best they could charge him with is a first count of involuntary vehicular manslaughter without aggravating factors (unless they can prove he intentionally killed the kid) and he would get a max penalty of 7 years in prison.

    This is why they need to go harder on repeat DUI/DWI offenders. Three previous convictions and now he has taken the life of a young child. First conviction should be mandatory 1 yr in jail, second offense 10 yrs, third offense, life. This child would still be alive today if we took these offenses more seriously.

    I sort of understand why he was given bail at first. Once it came back he was under the influence in the crash and tested positive once released his bond needed to be revoked and his bail amount increased significantly.

      They need time to gather all reports before they can start trial. If they lock him up they need to go to trial in less that 90/180 days because of speedy trial rights.

    That sanction was way way too light. Someone, a ten year old is gone from this world and this jackass doesn’t get it. From the get go he should have been wearing a drug patch or tested everyday. Too expensive? Too bad, the judge admitted that people can’t just quit these addictive substances without help, so put him in treatment and keep testing if he gets out. The idea of him out of jail while a family didn’t have their child at Christmas, infuriating 😢

Was willing to accept that if that was a one time mistake, and he was clean today, and there were increased monitoring, he could stay out on bond. I think it’s important to recall what the judge said about having to go to trial within 90 days of his bond being revoked. She’s still waiting for the cell phone data, which could take weeks. As long as this guy isn’t driving, he’s not a direct danger to society. I think it was a reasonable approach.

      The DA literally asked for bond revocation, and then went to whatever the judges decision would be which is pretty much the same as saying you don't think he deserves a bond, but legally he still can have one.

      Judge Middleton has a habit of bending over backwards to preserve a defendant’s job; I have seen it time and again, but at some point you have to balance out the public safety! This is so outrageous, a 10 year old kid is DEAD due to this waste of space driving high. Outrageous!

      He was in jail…..which means he didn’t have access. Once released he went right back to catch up. Synonymous or not, there is still a family without their 10 year old.
      And the judge was handing him the no contest.

      @@carriepriegel6477 They are hardly synonymous. Saying they are disregards the hard work people do to get clean. In this case it’s a matter of drug availability. There was no easy access to drugs in jail so one would hardly say she got herself clean. Asked on her attitude she didn’t get herself clean. She simply didn’t have access. When she out of jail she immediately began using again. People who relapse experience a prompt that is often a catalyst. I could be wrong and I don’t pretend to be an expert but I spent 15 years of my life with junkies and that was what I observed. If I’m off base I welcome your insight.

      Do you not listen to the whole thing. The state will the have to proceed to trial by 90 days and the Judge is doing what is right by keeping him on bond because speedy trial is mainly for jail cases and the Judge suspects that all evidence will not be in by then so he is trying to balance it.

Guilty.” What the Judge is saying is that simply having a controlled substance in your body (have you ever taken ADHD meds, benzos, painkillers, muscle relaxers, etc.?) doesn’t mean you were impaired by them, especially with a tolerance. He was being impartial, not “too light.” Innocent until proven guilty, but I personally think this guy is guilty as sin.

      What do you mean? First of all, a positive for meth and “amphetamines” only means he took meth, since it breaks down into “amphetamines” via hepatic metabolization. He was probably using “heroin” which is not real heroin (3,6-diacetylmorphine) anymore, most is fentanyl diluted with cutting agents and morphine. I could name about 60 other things he could’ve been taking. In the grand scheme of things, he could be taking a lot of other stuff.

    And it cost $45 for testing which would be $135 a week, did I hear right? And your point is what, innocent until proven guilty? How safe is it to speculate the accused spends that much on drugs and alcohol each week, hmm. So the accused should have no consequences? Yes, in my opinion, even in the interim, particularly someone who has shown by their actions, that at best, they have a very very serious out of control addiction and therefore cannot be trusted and at worst they are cruel, callous and cold-blooded. Yes actions and words have consequences.
    This little 10 year old boy, and all the lives he touched and could have/would have touched, all of those lives are changed forever. At what point does a balance of justice, honor, accountability, responsibility, respectability, dignity, compassion and so much more find itself back into humankind and therefore the courts.
    24 hours of jail for using felony applicable drugs, almost immediately upon being released from jail on a case that involves a death, is sadly textbook addict behavior. I’m sure the fact that this person was allowed to walk away with a “toddler tap” on the finger is not in agreement with the desires, opinions, expectations, or beliefs, values and/or ethical standards of the child’s family, friends and many others around world who have lost someone, particularly a child, to an inebriated or impaired or reckless or careless or negligent person.

    Wow at first I thought it was just an accident he had while driving on a suspended. Then it just got so much worse for him. He seems way too young to have already had all these issues and all related to driving. This dudes life is over and he’s only got one person to blame. I truly hope he can accept responsibility and make the proper changes.

    At the time of the accident he was positive for meth, fentanyl, and a couple other drugs… while having 3 previous DUI’s, no insurance, suspended license, and a child died in the accident.. ya he needs life

    Ya'll are letting your hearts rule instead of your heads, which is extremely dangerous in a court system.
    He was let out on a bond because they want to get him on that final DUI charge which will allow the max penalty. If they try to charge him within 90 days(which would be required without a bond) then they may not have the lab results back and cannot consider drugs a factor, whether they know he used them or not. That would mean that at best they could charge him with a first count of involuntary vehicular manslaughter without aggravating factors unless they can prove he intentionally killed the kid, which carries a max penalty of 7 years in prison in this case.

    Everyone commenting has to remember he hasn’t been convicted of anything yet. So, while he MAY have been involved in a traffic incident resulting in the tragic and needless death of a young boy and he MAY have been on drugs at the time (notwithstanding the presumptively positive test results), he is still a presumed innocent person. The purpose of bonds and bail is not to punish someone, but to make sure they appear for court and protect the public. The distinctions here are not always easy to draw but they are important. It’s not a situation where a person who is accused of breaching bond that they’re automatically incarcerated; they are still presumed innocent of the breach.

    I can't say that I like the idea that Middleton is the judge for this case. I think judge Middleton is going to let his feelings get in the way of this animal going away for as long as possible. That was a new statement I hadn't heard before. Just because you're taking a lot of different drugs doesn't mean you're necessarily intoxicated with them. I haven't heard of any addict who takes these drugs without intending to get high off them. You're wrong judge. This man is showing you exactly what he intends to do. He's going to do drugs and he's going to drive. Screw the poor little child that will never have a life because of him. Shame. I hope the prosecutor goes after him as hard as she can.

    I think these videos belong to the police departments. I don't understand how a private individual can make money on them. Since nobody is willing to pay taxes that take care of public works, I think the States, Counties, and municipalities should be the ones who benefit.

    I can understand why the judge wnts the guy to keep his job. He didn't start working last month at Wendys. If the slim chance is there that you'll get and stay clean, you only do so by having structure in your life. Going to work at least 5 days a week is a very good thing. Most people that sit home all day are more likely to use drugs and alcohol out of boredom. This guy has done allot of crimes though, I don't know the exact timeline, maybe that's why they didn't take him.

    how did he get money for $100,000 bond and get appointment at eight for Atty? Obviously he had money to post the bond. He should have done financially available to have an attorney. That's kind of weird obviously hiring council now but... in the end, the kid paid

      100k bond is not that much.. all you have to do is contact a bondsman, if you have any collateral to put up, such as a house, they will gladly post your bond, and if you show up to your next hearing, they get the money back + interest. If you don’t show up they hunt you down or keep your house.

      Okay, but if you listen to what's going on here, he killed a child, he's being shunned by the town (and his co-workers), his house has been broken into and rendered uninhabitable, he's had to move fifty miles away, and he apparently tried to drug his way into oblivion his first five days out on bond. All that's factoring into whether or not his bond is revoked and what sanctions he can reasonably be expected to pony up on. If the judge feels the need to go on the record with hearings and dates? Understandable, imo.

    Judge Middleton seems to be forgetting a lot of stuff these days. I hope he’s okay. It could be stress around the holidays, burnout or some kind of underlying issue, but he used to have a bulletproof memory.

    During the years while Biden and his crew were in office,the laws were changed in that plea deals are the norm and everybody gets let out on bond. Judges are bound within a set of guidelines that restrict what they can do. Hopefully, over the next four years some of this will change.

      Plea deals have always been the norm; the criminal justice system can’t work without them. There simply aren’t enough resources or time to send everything to trial and, in most cases, people plead guilty in exchange for a reduced sentence or some other consideration. It’s the acknowledgment of guilt that comes with a guilty plea (or no contest plea) that’s the important bit as it saves society tons of time and money in the prosecution.
