      It could be that some people are conflating the Phil with Thailand, because (I heard) that divorce/common-law in Thailand is a lot like the West. I've heard horror stories of Thai women divorcing their foreigner husbands, after he spends a lot of money and buys a house for them, and kicking him out. That is not as easy to do in the Philippines (yet).

      Don’t marry them, period.
      If you must, don’t grant them access to all accounts. I don’t think the Philippine legal system can garnish accounts outside the country. Maybe Gracie can confirm that.

      @@redpillsatori3020Not quite. InnThailand , if you are married, then common law 50/50 applies for everything except land. Foreigners cannot own land. They can own a condo. With regard to land it is possible to get a 30 lease in your name. I think this is pretty much the same in the Philippines?

    Many of us don’t have much in The Philippines, we just drip feed enough funds month by month to keep things going. Some have houses and vehicles, and of course, they can be at risk.
    Never have too much in The Philippines, keep the bulk of your asset’s offshore.

    Nice to see Gracelyn again. She definitely is qualified to clear the air on this subject.
    So, a few takeaways:
    1) If you plan to live in the Philippines for the rest of your life and plan on major purchases (condo, car, etc), make those purchases BEFORE you start dating.
    2) Get to know the Filipina/Filipino you are dating VERY WELL before: a) "dipping your stick" b) moving in with each other c) marrying them. This takes SEVERAL months or even a year or two in the case of marriage.
    3. Keep receipts of any major purchase and a paper trail on any asset transfers.
    4. Keep your foreign bank account and make money transfers to a local Philippine bank for yearly/monthly/daily expenditures.
    5. Treat your partner as you would want to be treated. She/He is not your maid, door mat, or possession (no matter what freaky stuff you are into).
    Pea, you vixen! Dropping another 2-parter on us! 😤 Oh well, we'll manage. Thanks for the info drop, and thanks to Gracie for provided the real facts on this issue.
    (PS: For the record, if you wanted to put on your Pirate Captain Pea costume and stay at my place being "eye-candy" all day long, I'd be okay with that. 🤭😜🤣)

      Make her keep her current living apartment, mailing address, etc. She's always a "guest" in your place. Make sure she goes back to her place once in a while. Don't allow her to receive mail at your place. Don't give her a key to your place. Let her live out of her suitcase - don't let her store many of her things at your place. It will also make it easier to breakup if you need to. Also maybe keep her honest if she knows things can change the next time she goes all tampo.

    Unfortunately for me, my scammer was married to me. It didn't start out that way but, it sure did turn into that. Legally, I'm still married to her but, have not seen her in 21 years(believe me, it WAS because of her). She left me sick, homeless and nearly bankrupt. She also abandoned our son when he was only 15 years old!!! She used him(blamed him) to get all the money from me. Claiming he was "running up bills she had to go behind him and pay". It was all a lie! She was cheating on me and her new bf and her hatched a plan. Even her family turned on her. Since I last saw her, she has been pregnant at least 3 times I know of. Has lived in 4 provinces(Cebu, Leyte, Negros Oriental and now, Metro Manila) has not spoken to our son in 5 years. Her family told me her and her bf were also into drugs. Thankfully, I'm fine and, more importantly, my son is thriving as a Chef and is engaged to a wonderful young lady who just became a Registered Nurse.

      @@TheFilipinaPea I never saw it coming. She was real good at it. I should of had an inkling of it when, at times, when I was there, she sounded like she didn't want to come here. But, when I would ask her, she always said she wanted to. Her cousin, who was in California, was suppose to take me in when I returned per agreement with the U.S. State Department(my government brought me back home after i was hospitalized there). I believe what happened is that she(my wife) told her cousin to lie to the government so they would give me the plane ticket and she didn't have to do anything else. I would up stranded at the airport in L.A. for 8 days followed by a 10 day hospitalization and 5 years of homelessness.

      Thanks for sharing. I think there’s many many many stories like this. I remember when I was in the navy during the nineties working with sailors going thru the same thing. Some two or three times. In this case though it sounds like she got strung out on drugs. Shacked up with the wrong guy and fell off the track. To abandon her child is out of character for them and for their own family to disowned her is also very out of character. If it was methamphetamines then it’s a long road to sobriety.

    I've heard a few of those lies about Filipinas. Of course I usually ask the person to provide proof. To which they usually give the generic answer of a friend of a third cousin's uncle knew someone who heard about someone to whom that happened. Gracelyn is always so helpful.     Thank you so much for the legal information. Videos like this bring peace of mind in the knowledge of things foreigners are and are not allowed to do in your country, and how to protect themselves with the law on their side. It's interesting learning the actual differences between countries, rather than the diluted BS some people will spew out just because they are butt hurt about the situation in their own country they are facing and claim it's the same way everywhere without finding out the reality of the situation. With your giving us the actual legal information from your country it creates a peace of mind knowing that people coming to your country are covered by law.
    I really like the way that you ask questions to Gracelyn that sound odd, but real in the way of how some people would try to shift the legal system in their favor to take advantage of another person. Great questions and scenarios. This is exactly how to help protect your audience, By asking the questions that may or may not come to reality to find out what the outcomes would be.

      Couples here in America have all kinds of scenerios. Not just the Philipines. Just being gentle, slow and let Christ bring you together to your mate.       @@TheFilipinaPea Pretty Much...Back when I was in the military, then a cop, then a Federal Agent, I was slightly aggressive. That's over Now since reaching retirement. Let's enjoy the sunrises and sunsets. I am age 53 now. Leave that violent stuff to today's 17 year old joining the military and federal law enforcement. My advice to them.... Just invest in a 401(k), some privately purchased stocks, as I did, and you will be on an Awesome Beach, Care Free, like I am....

    I lived in the P.I. for a year in 1971, these questions didn't even come to mind. It's interesting how they have advanced 50 years later. Not only do the questions get asked, but lawyers have researched answers that they're quick to refute.

      @@TheFilipinaPea The only problem I have is not being able to buy a home in the Philippines with out being married. To your comment, in real estate usually with the increase of interest rates it forces most owners to lower their price. So a cash game is king in this situation. I do have an additional question for you. Maybe you can do a video on it. Most of the bloggers I have spoken to tell me they would never buy a condo in the Philippines. That the value is not there. What's your thoughts on a foreigner buying a condo?

    I moved to the Philippines in 2012, oh! and by the way, I have been following your channel since you started, and you deserve all the rewards that have come to you, very informative, my experience living in the Philippines for 11 years and living with Filipina for a long time, 3 serious relationships, the first two I was still learning lol, the last one I blame the pandemic , a 5 year relationship that one.
    I learned early that as a foreigner I have no rights here, and I have lived here under this knowledge, I only rent , I only have a bank account from my country Australia, my income comes from there as well , and I don’t own anything here except a cheap car, this means the girl I have been serious with, has chosen me because of me, not what I have, and I can pack a back and leave any situation at any time

    Always an enlightening and joyful moment of information when (legalities of relationship understanding) you collaborate with Gracey Pea, you ask the necessary questions and Gracey provides clear, concise answers even for the laymen to understand for avoiding hassles.     Never deny a Filipina the opportunity to work.
    Rule number 2.
    Encourage your girlfriend to get a job..
    Rule number 3.
    Keep a record of the times you encourage your Filipina to seek employment and her response to this.

      Rule #4 Create a Sexual Contract in English stating explicitly each and all Sexual Acts that she is going to perform for U and on U; and that U are going to perform for her and on her - and list what U R going to pay her for each of those Acts, and how often. Then have a Philippines Attorney draw up the same in Tagalog.

    Hi Pea, I guess the overall summary here is get yourself settled before you move someone in long term. More importantly if you need to know where you stand get a lawyer there and have a consultation. When it comes to finding a lawyer is there any regulatory body over there that oversees lawyers or do you just have to use word of mouth to locate someone reliable?

    I've always heard foreigners cannot own property, meaning land, in the Philippines. You had to go through a Filipino. That is why I was confused when it was mentioned a foreigner could purchase a condo. Thank you for presenting this information today, Ms Pea. Have a nice weekend.

    Hello MsPea I’ve been watching your video for a long time time trying to get good information about living here in the Philippines. I’ve been in the Philippines on 3 different trips with this third trip being my move over here. To sum up my time in the Philippines, I’ve been told by every single Filipino who I’ve spoken with and with some I consider as associates. I never really meant why every single Filipino would tell me to be careful, I was assuming it was about my safety but that wasn’t the case. The people I’ve met and somewhat befriended here are nice people and have given me some good insight and also tell me “Don’t trust anyone “, with that being said most every single person I come into contact with have tried to take advantage of me and some have been successful. When I’ve spoken with the very few locals I have had connections with and trust what they say they always apologize for the behavior of the people that scammed me out of quite a bit of my money. I’m now living in the Cebu area and the only thing that has changed is location. The very few Filipinos I consider a friend are in the Manila area. But it seems to me when I walk around anywhere in the Philippines I’m strictly looked at as a walking ATM. The few friends that have told me many times to don’t trust anyone which I had to put up my gaurd now how can I foreigner actually make friends when even the locals are telling you “Don’t Trust Anyone”. I came here alone and started out not knowing a soul but I quickly learned since I’m alone and not knowing how life works here the foreigners are rich and if your not giving them money then they start talking to you in the local language. I’m now starting to wonder if this is where I want to be. My experience, and mainly due to being alone I’ve been a prime target for anyone and everyone to try to take advantage of me. All of the videos I’ve seen from you can’t really show what life is like trying to live here as a expat alone. But your country is a very beautiful place and I’m not going to allow any person to change my choice in living here. I just have to stay away from everyone which will take away the chance for anyone to try again. 😊😊 still watching your videos, they just started showing up on my feed again.

    Thank you for the information. FYI, in the U.S. there is only a few States that recognize Common Law Marriage. I think seven or eight. I don't live in one of them.😀 And each State has it's own marriage and divorce laws.🤔

    If it gets to the point litigation is required... interview three lawyers and hire the best one. Often, the better ones can be more expensive... but you'll likely get what you pay for. Also, be sure the lawyer is familiar or knows the judge. Since you are the foriegner, you'll need to spend money to equalize the playing field.

    One way to avoid these responsibilities is to work on the "exclusive relation" part. Some friends of mine, in my country, have two relationships just with the purpose that neither two women can claim exclusiveness, hence avoiding the consequences of common law marriage.
    That's the best example know where two halves don't make a whole.

    We use to have common law marriages where I live. The time frame was 7 years of living together. We did away with common law marriages a few years ago though.

    Advice to all the viewers here., bookmark this video. If any Filipina ever tells you she’s going to file to claim any of your stuff, be nice, be agreeable and say to her, “I can see your point of view. Watch this video and then we can talk about a fair split of the assets.” This will fool her into watching the video, and by watching it she will realize that you know she doesn’t have a leg to stand on. Once she’s acknowledged watching the video, which will be evident by the very combative mood she will be in, that’s when you tell her to go pound sand.
    Next problem!

    Hi Pea, in America when you are not married you are not entitled to anything of the other party. To be entitled to monies from the other party you must be married to access "divorce" court. As you said in conclusion, keep everything separated and pay your own bills.

    Speaking as an American attorney, I don't think most people understand what common law marriage is. In most states, it's simply not a thing. There is no common law marriage. In a few it is a thing; however it is very limited. It hardly ever applies to anybody. And when it is invoked or used, it's only use in very specific circumstances typically to protect a weak party. It's one of those legal terms that people throw around all the time and have no idea what it means. And, in the United States, it is not possible to be in a common law marriage by accident. You must hold yourselves out as married. Few people do that who are not actually married

You change any documentation you have to reflect the fact that you are married. Even though you're not. Perhaps you wear wedding rings. You do all those things. Even though you're not married. This is quite rare

    That's a relief for a lot of Americans because many states here have a law that's similar, called "common law", which the state will assume you're living together as 'married-like' after a period of time. In my state is only two years, which is insane cause that's barely enough time to get to know if you're going to be taking the relationship seriously.

      Another thing I would suggest is taking inventory of your belongings along with photos of dated receipts. This is something I'm used to because of common law here.

      Why would you move in a girl with you in America if it wasn't serious? If it is not serious don't live together. Only 8 states still have common law marriage in America
      Also it takes more than just living together to be considered common law marriage.
      Example Texas
      Sec. 2.401. PROOF OF INFORMAL MARRIAGE. (a) In a judicial, administrative, or other proceeding, the marriage of a man and woman may be proved by evidence that:
      (1) a declaration of their marriage has been signed as provided by this subchapter; or
      (2) the man and woman agreed to be married and after the agreement they lived together in this state as husband and wife and there represented to others that they were married.

      This is objectively not true. The majority of states here DO NOT have common law. It’s only a 10 states plus Washington D.C.

    That would be me. On and off for four years, too much stealing and lies. Finally I walked away. And in my defense I’ll add that I kept her around during the pandemic because she was the only girl registered at my condo building and so I couldn’t bring in a new girl even if I had met one. So I took the practical approach and brought her back in one last time to have company during the lockdowns. You can call me an opportunist, but what Filipina isn’t? Lol

      Yeah makes sense to me. As long as a foreigner isn't exploiting children, I tend to side/sympathize with the foreigner more than the locals. No one is looking out for your best interest here, and most people (who proactively attempt to interact with you here) are often just trying to use your for money, so I think it's fair game. It is quite cut-throat here, both in the literal and figurative sense, so watch your back, and don't let them emotionally manipulate you.

      Honestly I think that many foreigners get too used to the way things go in their original country that they believe that it's the way it is everywhere else in the world.
