      THIS !!!! Also holding DCF workers accountable as well !! So many cases where judges and social workers should have helped children but instead handed them over to their abusers . I now know what my topic for my next speech is going to be on .

      I complain to our Almighty Creator daily. No one on Earth can escape the jaws of KARMA !

      I have a niece in that situation now a step dad was arrested for abuse of her. Then arrest in another county for sexual abuse. Stupid judge put her right back into that household. He should be held liable for anything that happens to her. Even with all the records CPS has and the arrest reports and everything he put her back in harms way.

      @@TheLightbright01 The judges do need to be held accountable and the system needs to have clear guidelines. If there are a couple of abusive charges and convictions it should be mandated that they can only have supervised visits.

    "He isn't hurting anyone yet" is the worst legal excuse, both implying the knowledge that the situation will likely get worse and making the victim feel SO unimportant. Because he is, he is hurting her before he physically hurt her.

    Omg I’m so angry. I’m sorry but if the accused abusive father’s OWN MOTHER and sisters speak up and have restraining orders against him, MAYBE take that as a sign for it not just being a spiteful ex trying to alienate their child from him?!? My god this was so preventable. My heart aches for the entire family

      Courts are big on allowing “parenting time” so the non-custodial parent keeps paying child support. Even if the parent has a restraining order by the other parent or arrests/convictions for assault against the other parent, they still get parenting time. It’s not until they abuse the child that their visitation rights might change.

      Yes and they even give sole custody to a parent with a violent past over the parent who actually loves and cares for the child. With evidence of child abuse as well!

    The child defense attorney who tried to argue “it’s inconceivable” that someone who is violent to adults would be violent to children had me fuming… what bigger red flag do you need?? I am scared for the children under her watch.

      yes, I had a problem with her, too. She seems SO out of touch about abusive and toxic people.
      If I just saw this interview without her being identified, I would think she is an ignorant person off the street who is maybe wildly ignorant to the point of kinda stupid or maybe just lucky enough to have really never encountered these behaviors or their effects, in her life.
      And then to find out she is a child defense attorney?! No, get out of here! Scary!!!

      Exactly!!!! I actually work as an adolescent advocate in Philadelphia Family Court where this happened. Sadly this is not a unique situation. The worse part is that both sides feel this way. Our DA thinks he is a PD. Basically anyone can do anything in this city with absolutely no consequences. That’s why our crime rate, abused and neglected children, and poverty levels are at a disturbingly all time high.

    This hits soooo close to home. My ex physically abused my 2 daughters for years after our divorce. I filed tro (temporary restraining orders) after tro but was "unfounded", and my girls were exaggerating their abuse and it wasnt as bad as they were telling me, and was FORCED to send them back. By the grace of god, in februrary, during one of the abuse episodes, one of my daughters filmed it on her tablet and sent it to me. Only then did the courts listen and they were permanently removed from his home. It baffled me that they were 13 and 14 at the time and everyone thought it was "typical teenage daughter and father fights"

    Family Court really is the wild west of all courts. There is NO governing body over Family courts. None in individual states and certainly none at the national level. It's awful. And we all know the problems with CPS. Until there is Federal laws and major social change, individual courts will contine the status quo.
    I am so glad her mom fought for Kayden so hard! Did I miss that the bill is now a Federal Law?

    I wonder what happened to the judge who made the ruling that led to K's death? I appreciate he was working within the law but his lack of insight and unwillingness to read the facts is astounding. I hope the result of his poor judgement keeps him awake at night because he deserves to be haunted by it for the rest of his life.
    I was K's age in the 70s and my parents' divorce was toxic, because of my father's abusive behaviour. I used to hate being made to see him because of all his rage and bad behaviour, as well as his vengeful behaviour towards my mother. He kept asserting how much he loved us, but he was happy to use us as weapons to get back at mom and no one ever stopped him or stood up for us. I am deeply saddened that this is still happening more than 40 years later.

    This was one of the saddest cases I’ve heard. As A Special Ed teacher, teachers are mandated reporters for any kind of suspected abuse in children. Hooray for her mom getting that bill signed. Thank you Rachel for motivating us to take action.

    I have seen the children suffer so many times because judges are just wanting to ensure that the parents get their right but they don't care about the kids and their rights and what's best for the children! It's so infuriating!

    My heart aches for this mother. I went through something similar with my ex. Fortunately I was able to escape with my 3 kids alive. I remember asking the courts and police if they would only act upon a serious injury or death. I hope Kathryn knows she did everything she could.

    Maybe there was no physical violence towards his daughter, but there was violence. she said he would be mad. I’m sure he screamed and yelled and the stuff he said to her about court and Mom that is all emotional abuse and should’ve been taken into consideration.😢

    As a parent who has had to deal with the Pennsylvania child custody system it does not matter how many school officials, how many psychiatrists, how many psychologists, how many social workers, how many BHRS employees including BSC's and TSS's testify in court that the father is abusive mentally and or physically. It does not matter if the father has the child arrested because his new wife or girlfriend attacked the child and the child tried to defend themselves Pennsylvania will force unmonitored overnight visitation with the father. And when it comes to summertime they will force 50/50 physical custody. Now if they get one bad remark about the mother they'll be all over that. Even if the father is in jail for physically assaulting the child you will be forced buy a Pennsylvania family law judge to take that child to the jail to visit their abuser every other weekend. Want to know how I know? Because up until last year when the kid finally turned 18 we freaking lived it! They went from men get zero rights to men can do no wrong even in horrifically documented cases that he is doing wrong.

      This is so true. I live in the same town as this case. I have been through the courts with my daughter and her father is completely crazy. He held me hostage for almost a week and tortured me. I almost died but the courts gave him custody because he made more money. It blows my mind how men get away with so much in this area.

    After going through the courts after being narcissistically abused for years and fighting for my daughter.. the courts traumatized me 10x over. It makes me so scared for my daughters future. They only care about the rights of the parents, they do not think of the children 🥲 this is TRAGIC.

      I had audio which he knew I was recording where my ex admitted to screaming at our daughter while she was a baby while driving erratically with her in the car. His reasoning was that the crying hurt his head. He also admitted to playing games on her (she was six at the time) and didn't deny hitting her. CPS "investigated" and closed the case because he didn't respond to their inquiry. Thankfully he isn't seeking custody, but yeah, CPS didn't even tell me they couldn't reach him. I could have gotten him to contact them, but they didn't really try. He only realized they were looking into him when they sent a letter closing the case, which if he was slightly less lazy would be extremely dangerous. CPS is awful.

    Men’s entitlement to women and children that they perceive to ”belong” to them and believing they have the right to harass, intimidate, stalk, assault and kill them if they aren’t being placated enough by their victims, is a plight on this society. There are at least three instances in my mid-sized town in Pennsylvania, where women with small children have been killed by their significant other after being denied custody or a PFA… FROM MY HIGH SCHOOL GRADUATING CLASS ALONE. I only graduated 10 years ago. They do not do anything in this state to protect women and children against abusers and they certainly never hold those abusers accountable until someone has lost their life.

    If nurses can be held accountable for making a med mistake and killing a patient then shouldn't judges be held accountable for allowing things like this to happen? They had proof. Lots of it. To keep her father away. The judge should be in prison.

    Anyone know what happened to the judge after he found out about this? I imagine he just “quietly resigned” to avoid accountability. I don’t know how these types of cowards can sleep at night, knowing they have just as much of the child’s blood on their hands. 😡

      Judge Jeffrey Trauger is still working. He wrote a response letter saying judges see “toxic and bitter parental communication and conflict” all the time. He wants this to be a “teaching moment for all parents, the media, and the public”. Absolutely shameful.

    After my divorce from a narc woman in 1999., she was still awarded primary custody of 3 minor children. After years of parental alienation, my children are adults aged 35 32 and 26. They do have contact with their mother, but only when they have to. They have gravitated towards me. They are surprisingly well adapted people. It pisses me off no end when any individual proposes legislation to specifically protect women. When do boys, who are children and victims, become perpetrators overnight? Give me an age. Lets look at US female cases in the past 2 years: Vallow-Daybell, Cory Ritchens, Shanna Vander Ark, Ruby Franke. Other cases: Diane Downs, Susan Smith, Andrea Yates, Casey Anthony. All off the top of my head. 50/50 custody is a good starting point.

      It's not about protecting women. It's not about protecting men. It's about protecting the children. When there is clear and undeniable warnings that a parent is unstable - ie arrests due to violent behavior, mental health evaluations that indicate traits that are clearly harmful to the development of a child; observable behaviors by those in a position to witness and report (school counselors, teachers, physicians, coaches, etc) behaviors that are concerning - then no, 50/50 is not a good starting point. But it is a good thing to work towards. Because ideally, children do better when they have access to both parents, and neither have to be perfect parents. But the courts need to be paying better attention to significant warning signs, especially when there is several serious concerns. But you are right - perpetrators can be any gender. And you are getting at an important point - perpetrators do not become perpetrators overnight. But once they are - and they hurt someone - they need to be held accountable. It's gotta stop somewhere. I am sorry that you and your kids went through that, and that's great that they still turned out well adapted!

It all goes wrong when the starting point is that mothers are a first choice unless there is something seriously wrong with them. Then the investigation and history starts and needs expert and unbiased opinion. Regardless of gender. That was not my experience. Yes it is remarkable that my kids broke a pattern. The mother of the victim in this story does not have clean hands. Sorry.

    I had to fight so hard to protect my son! I finally got him safe and got my son's bio dads rights terminated! My amazing husband adopted him! It was a long fight! I wish more court systems in different states would do the same, to protect the children!! It is a long story and I don't mind sharing it!

    My God listening to her story in the Pennsylvania child custody system is exactly the same things that happened to us. He admitted physically abusing or son and somehow or another according to the judge I was just trying to keep our son away from him. Even went so far is to claim as part of Obamacare all men are to be involved in their child's lives and no matter what my ex did he would always have unsupervised visitation with his son. My attorney, the social workers, my son psychiatrist and psychologist, the school psychiatrist, the principal, and two bhrs workers that were all in the courtroom all testifying on my son's behalf with things they have witnessed and things my son had said along with marks on him we all just sat there stunned.

    That attorney, Pendergast is not telling the truth. The truth is courts used to always rule in favor of the mom in custody cases. Then, fathers rights advocacy groups started lobbying judges to recognize the father favorably in custody battles. Now they have judges rule simply on the grounds of doing whatever possible to not divide the child from either parent. Sounds good right? No, because in all eras of custody within court systems it has been a ruling of agenda instead of the merits of the case. Each case should be ruled according to the conduct and behavior of the individuals involved. This is complicated by parents flinging accusations at each other and a lack of investigative ability into every claim made. It would be an un-fundable and endless task. The answer has been a uniform way of dealing with every case whereby parents right to the child method is followed. AKA Parent Alienation! I have seen law enforcement and judges alike ignore sexual abuse, physical abuse, and abandonment to not separate children from their parents.

    Oh my heart!!!! This is absolutely soul crushing and EXTREMELY INFURIATING as well!!!! Yet again our pathetic justice system has failed a child! What makes it hurt even more is hearing that she was afraid of him!!!! I hope that judge AND the police officer that wouldn’t force entry meet karma in the worst way! I hope their actions keep them awake every night!!!! 😡😡😡😡😡. Rest peacefully precious angel girl. I also pray that her loved ones can find some semblance of peace and healing. Absolutely soul crushing 😞💔🙏🏻🕊️♾️

    Immediately the court system failed that little girl. It doesn’t matter if he’s not violent towards kids he is VIOLENT period. She should’ve never been there. That’s the courts fault

    I live in Arizona and this state needs some serious help in situations like this. Not once but twice I have seen mothers forced to bring their children to their abusers and there was nothing they could do. One lady I know actually wound up in jail because she refused to uphold the child custody agreement because the father was very violent and had threatened to kill the family more than once. And somehow the state still felt it was in the child's best interest to still have contact with the father. Thank God he wound up getting arrested and went to jail but he was not arrested for anything having to do with this situation. He was arrested for selling drugs but at that point anything is better to keep him away

    the system doesnt care in a ton of states. i filed a formal complaint about child pornography and they ended the case without even looking into it. i had proof. hope cases like this make a bigger difference for children’s rights.

    The courts should understand that when a parent decides to leave their abuser, that person will turn their anger towards another person, and if that is a child, so be it.

    Why do the courts keep doing this. Why don’t children have a say. If a child is truly scared you will know. You can tell when a child speaks from their ♡ or is speaking from a parent who is making them say things. I can’t even imagine how that little girl must have felt in that moment when she should have been safe at home with her loving mother step father and brothers.
    See something say something only works when a parent is truly clueless of their action. Most abusers keep a straight face outside the home until the front door closes. God Bless her and her family. May change really happen sooner then later.

    Thank you for doing this video. The courts and the systems put in place need to be held accountable for the screwups that continue to happen to people that cannot defend themselves. It's not like we are talking about adults here. This man never should have been alone with his daughter. Yes a child under ten can have different moods but she was saying she didn't want to go over there consistently. That means she shouldn't have been there. Plus she knew enough about the situation that she didn't want to be dropped off by his family because he was be mad. That says he was abusive at the very least emotionally.

    Why does it always gotta be the kids that get unalived? My heart just breaks for that baby and her family. We have got to start having sticker laws for child abusers and people that act the way that guy did. When is it gonna be enough? How many more kids have to die because of this crap? What is it gonna take to get stricter on these horrific crimes against children? When, when is it gonna be enough?????

    Thank you so much for speaking out on this for children who often have no voice. What is also so important, not only all those who spoke out against her father including his own family with orders of protection, but the child herself said she was afraid of her father, witnessed him "punching his dog in the head twice, and then her grandmother and then himself." How can the judge say she is not in danger after that? The child witnessing that violence in itself is frightening, traumatizing and damaging!! It also evidences he is out of control! Why do they need to wait until he actually hurts or kills her? Women have gone underground and even left the country to protect their children. I am also in the helping profession and in the past have volunteered at "Victim Services" a great organization for DV. I helped women go underground having to change their identities to save the lives of their children and themselves. This should not have to happen because they are re-abused in court! I am so glad her mom turned her pain into like you say possibly saving even one child's life changing these laws. Child abuse has devastating consequences that can't be ignored. More needs to be done. Thank you so much again for your video!!

    This is so sad . Another beautiful child taken away for no reason. This man should not have been allowed to be around his child. If she was not with him she would still be alive. If they wanted him to see her it should have been supervised.

    That lawyer woman!! She saying that the father didn't have a recent violence record...but she doesn't even mention the family's reports of violence; even his own sister and mother said he is violent!! And poor child, she was scared of him! Is that not enough???? She says why would a father harm a child he is fighting for...my goodness...as it has never happened before that parents kill their children to get revenge on their ex-es.

    Dam I went to school in this area and my sister still lives in Langhorn and we don’t remember this case. This is just fckn awful it’s crazy how the law just plays with these children’s lives. I’m hearing cases like this way to often. It’s crazy to me for a judge to put a child in the hands of a violent person rather if they hit the child or not these children still have to witness them abuse others. How th is that healthy!     I hope the mother sues the HELL OUT OF THE city as well as the judge allowing the father due to numerous people,family members warning the Judge and others & CPS. Knowing that the father also had others warn of his mental health going south for numerous years prior to this tragedy. May this angel RIP🙏🙏

    OMG! I could slap that woman, the child attorney, who said 'just because a person has a history of violence to adult doesn't mean they would with a child'. that is so stupid. If a person has a history of violence with adults they will with anyone including kids. Where is the common sense? He was violent with his dog as well for god's sake.
    there is a serious problem with judges and the law when it comes to children and p terrible parent. Look at Harmony Montgomery. Taken from a good mom who had drug problems but, a fantastic adoptive home for her and yet is given to her dad without a background check who had a history of violence, criminal behavior and drugs. She died at 5 thanks to a judge.
    Same with a beautiful toddler named Lily furneaux wolfenbarger. The judge disliked single moms and ordered the child to be 50/50 with her dad despite the fact that the child came home with bruises and did not want to go visit. 1he stepmom hated her. One day when Lily had to go and was screaming to not go she ended up with stepmom while dad had to work and she ended up beating the child's head against the tile many times and fracturing her skull. then she took something like a brush and inserted the handle into her vagina and 'raped' her. 1she was her mother's light. Her heart. Lily's death devastated her because a judge did not like single moms.
    So many kids are sent to their deaths because judges are not wise but, have bias and won't listen to the facts.

    Narcissist do not seek mental health because they do not believe there's anything wrong with them. So leaving a narcissist to get mental health is absolutely ridiculously stupid that judge put that child in danger.

    There is no way I could work with CPS because of this exact reason. I see to many children with the same story. I also work with children in healthcare and I am a mandated reporter. I take that very seriously and I do not hesitate if I am uncomfortable with the child’s home situation, I will go through the right steps to get it into the right person to go make sure that they are safe and I am wrong or I am right and I will do everything I can legally to protect my little child who I am taking care of. Thank you for all you do for our children and giving them a voice. I am going to look into the website you left and pass it onto my coworkers. ❤

    A case that I feel needs more exposure as the mother is actively trying to make changes to stop what happened to her to anyone else is that of Mariah Gardner. Her daughter's name was Willow and it was her own father that did it as well. 😢

    She was an actual princess. He was jealous he wasn’t her favorite parent despite him being horrible and that she was loved so much by everybody. Yes, normal people see children and we don’t feel negative feelings but he did. I had one instance where a person in their 40’s screamed and yelled about my toddler being a phone background and how she should be the background and that’s where it stopped. I was so disturbed, I didn’t know people could hate little kids like that.

    If that insane a hole would have been put in prison where he should have been after biting someone's ear off punching a dog and his and his own face and quite a few other things that little beautiful girl would still be alive. Neglect from the judicial system plain and simple, but the black people up in prison for simple crap 😢. Rest in peace little sweetie😢
