      It's a shame that constitutionalism is considered "conservative." Interpreting the Constitution as in its original meaning isn't conservative or liberal. It's originalism and textualism.

    Here the Senator embarrassed herself. The Justice merely pointed out the most basic 8th grade civics lesson: that while the 14th applies to both sexes, the 14th amendment applies to government discrimination as do all the Amendments, limitations on government action; not private action.

    the fact that people get angry about gridlock blows my mind....the federal government only does 1 of 2 things: they are either expanding their power/complicating the laws more, or theyre in gridlock and if i had it my way id prefer them to be in gridlock for the rest of time

    Scalia is sound in logic and communicates it very well. Follows the law as it should be. The epitome of Judgeship

    I am what one might call a progressive liberal, however I really appreciate his view and intellect, even if I don’t agree with it completely. A conservative genius that can’t be replicated. Hope he is resting peacefully.

    Only a true judge would avoid pontificating by espousing his own views regarding whether something should be illegal or not. Scalia was one of the greatest judges because he judged cases in accordance with the constitution and the views that aren’t explicitly stated within it but nevertheless undergird its principles.

    It’s interesting to think Scalia would have supported NFL player’s right to kneel during the national anthem. He would disagree with their method but he would never deny them their right. That’s what happens when you have a man of principle. I don’t agree with him on a lot of things. But you can see how someone like Ginsburg could be such good friends with him. They really are the best among us.

    Antonin Scalia was an exceptional mind that I appreciated. Although, he might not have agreed or liked a certain thing written in the US Constitution, he saw that the value of it was in the text and that the law should be bound in the text and context in which it was written.

    I'm not convinced he wasn't murdered, his personal physician said he was in good health then out of nowhere dies in his sleep...yea ok

      Worth remembering that it is still the case that the most common symptom of coronary disease is sudden death. You can appear totally healthy then 'boom', gone. Often the same is true with stroke.
      Clearly he had risk factors, as we all do, that in his case included chronically overweight/obese and a punishing work schedule. I have no idea about his family history and what that might also tell us; has he a heritage of 'early' deaths in male relatives over generations, for example?
      I'm not accusing YOU of doing it, but so many of the "he was murdered" crowd seem to have no idea about just how common it is for such deaths to occur; they 'need' it to be a murder as they appear to see everything in wildly partisan terms.
      They also seem to forget that his closest personal friend was Justice Ginsburg. In other words, he certainly didn't adopt wildly partisan views the way many of the "he was murdered" crowd clearly do. My guess is they project their own political extremes into a situation in which the most likely explanation has nothing to do with politics.

      He was visited by Obama two days later, he is dead... No autopsy and then cremated. ..An catholic italian guy. ..Yeah ok! ! He was going against Obama saying that Obama care is a violation people's constitutional rights. .. Then once Obama is not president it's found unconstitutional in federal court.. I think he was murdered.

    It's too interesting that Feinstein has to read from her material to cite provisions of the Constitution, considering how most dumb truck drivers like myself can cite the Fourteenth Amendment without even looking at it.

    Wow...Scalia crushed Feinstein. Even Breyer agrees, and he's as far left on the court as we have right now.
    I'm on the "living constitution" side (cultures and civilizations must evolve to progress through the times they exist in, not on historical notions), but Scalia was still a very brilliant man.

      luis manuel they could. Pretty sure one did. But generally they won't. They like being outside of politics and get guaranteed life terms. More common was becoming a justice after being President (Taft)

      Yes, and it's happened before. They would have to resign I'm sure, but yes, there's nothing stopping them from running.
      There are multiple examples of this, such as Salmon P. Chase and William O. Douglas, but no Justice has ever made it past the primaries.

    11:45, Piers Morgan talking as though abortion was unknown in the 18th century. It is said Benjamin Franklin wrote about a technique to induce abortion, known at the time.
    Abortifacients existed in the ancient world, so the concept was hardly unknown to the framers of the Constitution.
    Abortion was mentioned in the classic Hippocratic Oath. The historical dispute can be whether Hippocrates opposed all abortion, or opposed using a pessary to induce abortion.
    As in, other techniques might be OK.

    Citizens united stance makes no sense by his own standards.
    More money in politics =/= representation of free speech.... therefore my money says prostitution should be legal, and hiring of hitmen is justifiable, and my money says I shouldn’t be imprisoned for a violent crime. Et cetera ... you clearly see how this is problematic in this defense.

    I think freedom of speech with regards to the flag requires more analysis, with each situation, circumstance and time in history. During the 1960's desecration of the United States Flag was not allowed. It is certainly more than financial as well as more than a superfluous pretense at loyalty. A Public and freedom of speech allowing access by media for the public to know, but what is the answer in the U.S. when the public domain is everywhere observing and the media is excessively intrusive in the individuals life, yet there is no attempt to give the individual their freedom of speech separate from those in that public domain and those using media rights...
