    Hey Bharat, nice capital growth! Had a similar case with the Finanzamt stealing shares last year because of tax claims that are unfounded, and they never reached out, but they claim they did, like in your case. This system is broke! They lie, and the law is clear in this regard: the Finanzamt needs to make sure that a Bescheid reaches the Steuerpflichtigen, but they don't care unless you bring the case to the Finanzgericht. Romanian ANAF is so much better than German Finanzämter, at least from my experience ... looking forward to learn about your recent fight with them. I think with SAF-T obligation this year there is little space to do wrong calculations.
    Since I'm a tax resident of both Romania and Germany, living primarily in Romania, I started to flood the German Finanzamt with Einsprüche every 3rd week, so they never try to foist a Bescheid on me again. Not my problem if they get angry now because of the Einsprüche ... it is them who started playing foul. Toxic environment for business owners!

      Wow, it’s shocking how common these stories are! Your approach with the Einsprüche is interesting-did you find it actually made them more cautious, or did it escalate things further? Also, how did dealing with the Finanzgericht compare to ANAF in Romania? It sounds like you’ve navigated both systems-any tips or key differences that others should know about?
      Our fight was with the ANAF at Constanta and they were some of the most incompetent people we came across. The moment the case got handed back to Bucharest, everything got solved without any issues. I didn’t even know that it got fixed while recording the video, but I’m so happy it did. It costed me 6 months of my nerves - specially exactly the moment when my daughter was born which was not nice and 20k in legal fees to get this fixed.

      ​@, I don't care about a good relationship with the Finanzamt anymore, because the only thing to make this broken system work right is to go to the Finanzgericht as early as possible. From the experiences of my dad, I don't think that the Sachbearbeiter learn from lost cases and act differently. In fact, my dad had one case last year where the Finanzamt rejected his Einspruch and straight after he filed the Klage at the Finanzgericht, the Finanzamt pulled back and issued a new Bescheid, as requested by my Dad. Obviously the Rechtsbehelfsstelle knew they were wrong, but they gambled if he would give up or go to court. And this year they'll likely try the same shit again, failing again, and proceed the same way the year after.
      I'm in Brasov, hopefully the ANAF here is more competent than in Constanta.
      Since I still life in Germany a part of the year, I might be a double taxation agreement case, though that is not certain, since I leave my keys in Germany when I go to Romania. According to the Schlüsselgewalt-theory, I might not have a Unbeschränkte Steuerpflicht in Germany, however I act as if I would have.
      Two important learnings:
      1. Always have your documentation ready as if you would go to Finanzgericht next week.
      2. Be proactive with the Finanzamt. Don't feed their "fehlende Mitwirkung"-argumentation.

      @@saschaheylik, if so. has a permanent living space in Germany, no matter how long he spends time there, he is a tax resident and "unbeschränkt steuerpflichtig", § 1 Abs. 1 S. 1 EStG.
      A similar rule exists in Romania: Art. 58 a)←Art. 17 Nr. 28 Codul Fiscal.
      If so. is a tax resident in both countries, a double taxation agreement becomes relevant. Otherwise, if so. would only be tax resident in one country, there wouldn't be a need for a double taxation agreement, right?
      According to the BFH Urteil v. 23.10.2018 - I R 74/16, the Finanzamt first has to do the regular Veranlagung and second check if double taxation rules apply, like between Germany and Romania. So both countries calculate the taxes, but only the country with the centre of vital interests gets the right to tax the person. You can read the criteria in Art. 4 of the German-Romanian DTA, it contains the logic how a (tax) resident in both countries is considered to be only (tax) resident in one country.
      Unfortunately in a BMF-Schreiben (12.12.2023) the BMF tries to narrow the criteria of the DTAs with abusive rules like a general assumption of the centre of vital interests in Germany (Rn 15) and intesified Mitwirkungspflichten (Rn 14): guess what: if so. doesn't react on time to a letter from Finanzamt (that he never received (like Bharat or me experienced already)), the Finanzamt can turn this against him and make him pay taxes in Germany as a resident even if according to the DTA he is only resident in Romania.

    As a German citizen I oftentimes wanted to found a company but horror stories always connected with the Finanzamt held me back so I never did it. Dealing with the financial system here is a total pain. Not mentioning the paperwork. Even if one day you should decide to close your company and move abroad they make you pay high amounts of Wegzugssteuer. Germany is set up to be a nation of employees and not of selfmade business men.

      The Problem was the local tax. This tax will be noticed to the Finanzamt but normally has to paid to a different entity (Gewerbeamt or Stadtkasse). The Finanzamt collect the "Einkommenssteuer" (and "Umsatzsteuer") which benefits the county and the state.

    Things like this makes me wish for a whole EU especially Germany Economy downfall. Finanzamt is the biggest EU mafia. If only they treated the German politicians the same way they treat people living in germany and german citizens but to the Politicians they turn a blind eye.. The German Dream (In contrast to American Dream) is making enough cash just to leave Germany forever.

    When I started my own online business and began earning money, I realized that trying to protect the money I earned was far more stressful than earning it in the first place. When I was a salaried employee, I believed there were laws and rules in place, but now I’m experiencing that the environment is more like a lawless jungle. I neither have the time nor the mental capacity to fully grasp this system. Defending the money I’ve earned is incredibly stressful, and I simply can’t handle it. I dont want to be a mafia boss-I just wanted to be the boss of my own small online business.

The more you earn, the more it feels like you’re being watched, targeted, and trapped in a game where the rules only benefit the powerful. It’s no wonder the stress becomes unbearable. The only way forward is to protect yourself-consult a lawyer or financial expert who can help you build an ironclad defense for what’s rightfully yours.
      I have really learnt that the money I spent on the lawyers so far learning things was some of the best money I spent.

    Finanzamt has a very criminal mind set here in germany. They don't take a shit if something is legal or illegal, they do it and you can run after your money on courts. But german tax laws are created so complex that you often do not have any chance
    to get it back, except you have your man in that department.

      While using a foreign broker might seem like a solution at first glance, it’s not as foolproof as it sounds. European tax authorities are increasingly collaborating through international frameworks like the Common Reporting Standard (CRS). CRS is an agreement between over 100 countries, including all EU nations, to automatically exchange financial information. This means that even if your broker is based outside Germany, they are legally required to report your account details, income, and holdings to your country of tax residency-or, in some cases, your former country of residency.
      Tax authorities across Europe-and even beyond-are working together to close loopholes. They share information regularly to prevent tax evasion and ensure compliance. Even brokers in countries outside the EU participate in this system.
      Many brokers, even in seemingly distant jurisdictions, comply with CRS and are obligated to follow any legal directives from European governments. If a tax authority issues an asset seizure or liquidation request, the broker might have to comply, depending on their agreements and local regulations.
      The issue isn’t where your broker is located-it’s about the growing powers of tax authorities to enforce cross-border compliance. Once flagged, your global assets become part of the broader net, and foreign brokers might not offer the protection you’re hoping for.
      Even if your foreign broker initially resists action, tax authorities can push further by targeting your accounts or investments through broader enforcement mechanisms. They might also penalize you directly, such as imposing fines, restricting access to your domestic accounts, or freezing other assets.
      In short, while using a foreign broker might give a false sense of security, the reality is that Europe’s increasingly synchronized tax systems leave very few escape routes. Diversifying globally might be a better approach, but even then, you’re never entirely out of reach.

      The reality is that unless you have a nuke arsenal in your backyard, when it comes to fighting tax "authorities" you are essentially fucked. Most people live unware of this and under impression that they "own" their assets, but in reality they only own as long as no armed thug (legal violators included in that category) claims it as theirs.

    The Finanzamt doesnt collect Gewerbesteuer. You have to pay it to the local town where your business is based. This town also sends you the gewerbesteuerbescheid.

      Yes. We didn’t receive any document from them. Probably that was the problem, but the seizure was still done by some like “Niedersachsiche Landeshauptkasse”

      Yes this is the problem and that his tax advisor dos not told him about. He also has to close his german business by the "Gewerbeamt" after his relocation to another country. Otherwise this will go on because they think he still have a business there.

Not come out of nowhere… its when you didnt Pay your Taxes, Then comes Festsetzungsbescheid,Then reminder, Then Ankündigung der Pfändung, then Pfändung… then they take Money from your Account… so Minimum 4 Letters by Post/Mail bevor this Happens.. so something is wrong in your Story…. Maybe Letters was Send to Romanian Adress if that the Registers Adress of your Company…. Its Not Finanzamt

    Please get a lawyer and sue the german finanzamt, because now this is very important. It´s more than about the princible which lays already on your side! You definitely will get a compensation, because the finanzamt act without consent like you were a terrorist and now they have to seice a part of your assets or sanction you without notification. Next thing is the trail will come to an verdict and this is the most important thing in germany a verdict counts for everybody in the future! You could help raise awareness in front of the constitutional court and show how the finanzamt is standing above the law with their actions! This was not right and definitely not legal but as long as you or other people who withness this first hand on their assets don´t defend yourself in front of the court, the finanzamt will continue with this. If this happens to me because I still live here than I will sue the hack out of them! My brother you seems kinda depressed signs of emotional damage...That alone will grant you a compensation in germany. Wish you the best my brother! Whatever been or gonna be taking from I hope you get it 10x back!

    Your story is truly shocking. The fact that the German government sold your stocks without consent and took the money for pending Gewerbesteuer shows how insane the system can be. As an aspiring student, this makes it even clearer to me that Germany is not for me. I’ve decided to return to India, and every day I feel more confident that it’s the best decision.     Yes, Germany is known for bureaucracy and tax madness. However, I have lived in the USA, Brazil, Russia, Italy and Georgia as well as Germany and have generally dealt with the topic of immigration. Unfortunately, I have to say that in all of these countries and practically all of the countries that I know, the state can take everything from you overnight. And they will always be right because they make the laws themselves. And the practice is always the same: if they find the money in the bank account or deposit in the country, they take it directly from the account. If they don't find the money, you end up in debt with reminder fees and interest on late payments. Much worse if the whole multi-million dollar account is blocked because of 1€ late payment or, for example, "Russian sanctions". I have a Russian passport and you can imagine how much stress I have had with the banks and authorities in recent years. If someone can afford it, a second citizenship would be very helpful, or you should keep the money in the country in which you don't normally do business. And what I've really learned recently is that having a lot of money in your bank account doesn't make you happy, it makes you even more worried.

    If you have any outstanding bills in Germany, a garnishment can be initiated in your absence. This garnishment can be assigned to a collection agency that attempts to collect the money. Such a garnishment title remains valid for decades.
    Pro-Tip: Don't have a bank account in Germany. For larger amounts, you should not maintain an bank account anywhere in the EU.

    The Finanzamt can even put you in dept if you don’t have enough money in your bank account. After that you’ll owe money to the bank because even the bank doesn’t want to mess with the Finanzamt.

      Yes, my dad just won three cases against Finanzamt and I have one case running. But there is always the risk of having formal errors that make the legal action invalid ... and it is time- and/or money-consuming. That is why I started a new business in Romania.

      @@hammerradiology1470, if a foreign (like Romanian) company has no relationship to Germany (no place of management and no permanent establishment, like a branch, office, or workshop in Germany) it is not a taxation subject in Germany. However, if a foreign company does B2C, it needs to retain and transfer local VAT.
      It is ok to travel to Germany and meet customers of the company and to do some work on-site, as long this is not permanent. To be on the safe side, management decisions should only be made in Romania.
      When doing business travelling within the EU and Switzerland, we need to send ourselves because of social security laws, typically by pre-registering our stay at the destination country's border control and we need to have an A1 certificate with us all the time while working, if the border control wants to control it. In Germany the Zoll often controls construction sites, but I've never heard that they controlled an office. However if German Zoll catches one who failed to comply with the Entsendungsprocedere correctly, they can impose a fine of up to 5k€. Switzerland is even worse with fines up to 30k CHF.

    It's funny you mentioned "real estate". We moved to the Americas a few years ago and came back early last year to Germany, and as usual registered in our Local Buergeramt. It was new to me that the Buergeramt does not share our new address directly with the 'FachBereich Finanzen' of that same city that deals with property taxes. They ended up therefore sending my Steuerbescheid for my real estate in the Americas-address. Funny enough, the only letter we did get from our beloved 'Landeshauptstadt ' is threat of Verpfaendung and letters that the 'Ankündigung der Vollstreckungsverfahren'
    I asked them why they did not share addresses among themselves. Their answer: Datenschutzrechtlichen Gründen. Are you freakin kidding me? The state govt does not even share vital data about the citizens within itself. It's up to our guesswork to figure out who needs to know what when we move back to Germany! In that maschinerstelltes Letter from them they basically said they can go as far as ceasing your salary, Pfaendung of all possessions, make our vehicles illegal to drive, investment properties, and basically come after us much and as they see fit.

That what I described above belongs to the latter. Results are pure inefficiencies in the system and more work and heartache for both sides. And by the way, how is it that Datenschutz flew out of the window when they went from level 1 (Bescheid sent to the wrong adddress) to level 100 (Vollstreckungsverfahrung sent to the right address) within a gap of about 26 days. Something does not add up.

    I assume they have sent a letter to your last known address, but that never reached you. I never had direct contact by email with the Finanzamt (and would assume it might be a spam if that happens). It's either through ELSTER, or by old fashioned mail. The problem is that email may not fulfill the appropriate form requirement to be legally binding. You might be able to communicate with them that way, but all formal decisions have to meet the form requirements.
    Maybe a Nachsendeauftrag would have helped. Mail not reaching you after moving is a pretty common problem.

      That was never the problem. The other two Bescheid were sent to my accountant in Germany the same year - 2024 and I moved in February 2021. She received all the documents and communications every time from the Finanzamt and I made the payment every time, except this time when they simply sent nothing and overreached in my stock portfolio.
      It’s not the story with having moved out and that’s why they did it. There’s simply no reasonable explanation for this.
      About the email - probably your experience is different. I’ve lived in Hamburg and Stade - both times I was able to do the most communication with the Finanzamt via email / call.

    The bank will not inform you about the ordered closure of your account. However, you will be promptly notified by the bank as soon as the bank is unable to deduct their account maintenance fees from the forcibly cleared account.

    Dear Brandevise, when part of your MSCI world ETF was sold could you please let us know which country's capital gain tax rule was used?Was that Germany's capital gain tax rule or Romanian capital gain tax rule? As you are now resident of Romania I hope you are now subject to Romania capital gain tax rules which is likely less than that of Germany

    I left germany in 2017 and these things happened to me before with them and like you said the Finanzamt does not give a shit. It was scary sometimes that we had to keep physical copies and print everything from my bank account and broker etc. Other situation if you have a bill unpaid and they sell debt to another company without your knowledge which another shit show on its own.

      Yes He could but there are deadlines and it will take years to process and there are probably thousands of cases in line. Also it doesn't go to the regular criminal court but to the "Finanzgericht", so he'll need a specializef lawyer as well...

    10 year's of learning that is..
    They don't want to you be selbständiger because then you are authorised to tax deduction and they don't want it. What they want do just jobs and pay 42 percent total including social taxes like Arbeits loss versichrungs but they don't want that you get that if you are applying job loss insurance back then you got problems in residency permit to renew.
    That's why they want job seekers but not businesses out of German

    As an emigrant in Germany, I fully believe you. I had some less serious situations too but many. Even with banks it looks like they first subtract from your account and you are always in the situation of stop working to have to make a meeting and fight for your money back. I had situations of being charged interest because their “in-house informatics were not working properly” according to them, when I could see everything correct online from vacations in Portugal. They do it very silently by option not to wake up sleeping dogs.

    I think you have a case to sue them for 2 reasons
    1- for not informing you officially. They should prove they tried reaching you
    2- for claiming the money from your investments which is performing well, is completely wrong. It could be that you had a different method of payment and not these shares

    It's really sad to see that the tax office feeled like they needed to sell your nvidia shares to get the tax money.
    Why did you receive a accounting for Umsatzsteuer from 2021 in 2024? The UST in germany needs to be reported and settled ASAP like 10 days. At the beginning they will mildly remind you but afterwards they can do things like the ones you unfortunately had to experience.
    i'm self-employed in a side business myself and it's really annoying to keep in constant correspondence with the german tax office, but there are fewer surprises if a mistake is made that is quickly rectified. i hope the bureaucracy in germany will be properly streamlined at some point and not become more and more bloated, making it difficult for small companies to simply do their business in this jungle of directive. Germany is unfortunately a country of employees and not of entrepreneurs. Of envious employees who prefer to see self-determined people fall on their faces to feel vindicated. The regulations simply deter too many people from simply start just doing their thing.

    Dealing with the "Finanzamt" is sometimes a pain in the butt. Please note that the Finanzamt is connected to the "Gewerbeamt" but not the same. The "Gewerbesteuer" is a tax from your local town and has to payed to a different entity. In my old town it was the "Stadtkasse" (or "Gewerbeamt") who charged the tax. If you move out from germany you have to tell them who will receive their notifications. It seems you forgot to tell them so they made a seizure.

    Problem is with the economic decline and deindustrialization phase which Europe is in. Indians even salaried should be ready for coming tax controls which very likely will include exit, asset transfer etc. with decline in prosperity, EU is bound to source money via this way. Asia is now the place to be in for doing businesses and even jobs.

    Thank you for making your case public. I’m considering doing the same. They did the same and even worse to me. All my bank accounts were emptied without warning. My portfolio at Trade Republic was frozen. I went to a lawyer to resolve it, and it just kept getting worse. They don't wanna listen. And I don't get any response from the Finanzamt. I don’t want to get into the details now. Things like what you describe are not isolated incidents. I’ve heard from many business partners that similar things happen arbitrarily in Germany without precedent. I can only advise everyone against starting a business in Germany. They let you grow up, and then you get plundered.

    I'm thinking the whole time, if you wouldn't have held these stocks under your personal name but under a Company or better a Holding outside of EU, say in Singapore or a Trust in India.
    Would it have been harder for Finanzamt to get to your assets to simply sell them and seize the money, or Impossible for them?
    2nd point of thinking:
    If your assets were not stocks or Bank related but hard assets like Rental Properin Romania or just Crypto instead of stocks, would the Finanzamt had still gotten ther hands on it?
    This what happen sucks nevertheless and their Audacity to seize more than what they're entitled to😤😡

      If he would have transferred them to a holding company outside of europe they will charge you with capital gains tax on the 1,3 million because it is handled as a sell

      If the crypto is on a hot wallet or exchange, the finanzamt will know since every exchange exchanges information with the finananzamt, if it is a cold wallet the finanzamt wont know, but if you still put the money back in a bank account the banks will ask from origin of money if you dont have any receits they will assume you launder money.

    How are you able to hold German account and securities with non resident status.......can we continue to invest in German Markets like ETF and MF or stocks even after we leave Germany. I mean is it similar to what we Indians do with NRE and NRO accounts where we can invest as repatriable or non repatrriable basis.

    Make sure to give your German tax accountant a proper „Vollmacht“ to represent you and receive all documents for you and forward these to you, not just contact details of someone to contact in Germany in case they cannot reach you. Nevertheless pretty bold move to take 1.5k more for no reason. The seizure is just the final way for making sure the tax is paid. Better move your money/ depot out of Germany to avoid this in future.
