  • Since the beginning of the Pandemic misinformation has plagued the airwaves regarding tenant landlord law. Unfortunately, some of that bad information was circulated by those in the legal field, incorrectly informing landlords they could not proceed with an eviction, increase their rental rates, etc. At the same time we saw a rise in California politicians abusing their power to take away Landlord’s rights.
    On Tuesday, November 1st at 11AM I will be interviewing none other than eviction attorney Mike Brennan of the Brennan Law Firm. We look to set the record straight when it comes to Tenant Evictions, Changes to Landlord Law projected for 2023, and the newly enacted Rent Control Ordinances.

    To balance this discussion, i recommend any tenant facing eviction to self educate on eviction process/laws. the la law library has excellent resources. in particular look for the 'eviction defense' book and 'tenant-landlord' books. they have various defenses one can use. arm yourself with knowledge prior to any meeting with lawyers so you are on common ground

      to "balance the discussion" please advise the tenants to read and comply with their leases. landlords MAINLY toss deadbeats, dumbasses and nuisances. the best way to get yourself thrown out is to be a PITA. then lets "balance" it with laws that don't ENTIRELY favor tenants, many of whom are roaches with dumpster-fire tenancy histories, 550 FICO scores and who are so broke they can't buy lunch without a co-signer. balance...YOU'RE KILLIN' ME! we just saw landlords STATEWIDE get a big fat session of prison sex by the governor and the various cities and counties. i got your balance right here.

    In Adam Smith's Wealth of Nations this is what he had to say about Landlords: "As soon as the land of any country has all become private property, the landlords, like all other men, love to reap where they never sowed, and demand a rent even for its natural produce."

    With a month to month lease, how often does a Landlord have to provide a tenant with a new lease?

    Can you please elaborate on the "Cap your attorney fees at $500" ?

      In you rental agreement there should be an attorney fees clause not allowing the tenant's lawyer to collect more than $500 in legal fees should they win in court. With it being capped it can deter tenant advocacy lawyers from choosing to go the distance in court given they will not collect much in fees from you the landlord.

      Coming to your answer - will that not hurt the Landlord as well given that the clause is for the winning party's reimbursement of any attorney & legal fees? Legally, can we only cap on the tenant side?

      Can the Judge overrule that provision in the contract, and award the Tenants Lawyer more fees upon request?

    They make this law so complicated that is hard to understand i am a tenant in orange county irvine company razes our rent every year we as the other tenant get to gather every night we are so worried for ourselves we don’t know if next year we have roof over over head or not they only think of their benefits and we don’t know if La law in-cloud Oc. ? Who can we call incase we have problem with office ? Please

    Some of these things sound good. But, these sound like tactics that will encourage the state to make more laws. Advice based on hypothetical situations sounds like discrimination, or manipulation at least.

      These are the laws as they stand now. No hypotheticals as investors utilize these laws daily to move things in a positive direction.

    So, if I forgot to put exempt language in lease and didn't give them language I can still go forward with a 60 day remodel without pulling any permits? Why does the Civil Code say I do have to?

    Do you have any information on how proposition H for Pasadena works? I called aagla and they need to talk to legal as well. Rent to be rolled back to may 2021? (Is that legal? That’s two years of rental increases!) so are we to refund the difference for Jan 2023? Are we then to provide another 30 day notice for a max of 7.5% increase of may 2021 (75% of cpi and cpi was 10% this year or did they mean 2021 cpi?) for rent that starts March 2023? Does this mean this is the 2023 rental increase and we cannot increase again for the year? How about the 2022 rental increase? Is it gone? This is a logistical nightmare.

    my issue with section 8 is that i ONLY grant month to month tenancies. no exceptions. never. section 8 requires a 6 month minimum. THEIR rules are the deal breaker

    If I mailed the Tenant a 30 Day Notice of Rent Increase of 9.9% to be scheduled for March 1, 2023, and the Tenant requests the Rent Increase to be rescheduled for a different date, due to a unexpected financial situation...
    If I agree, am I required by California State law to issue ANOTHER 30 Days Notice, and schedule the new Rent Increase for May 1st, 2023...
    Or can I simply hand her a new Rental Increase Agreement scheduled for April 1st, 2023?

      To simplify the situation, have the tenant sign and date a document which states both parties are "deferring" the increase to April 1, 2023.

      It's a video artifact called the moire effect. Basically, it's the pattern on the shirt and the compression from the live stream making it look wavy.
