What about if you have a trust and you are told all the details of shares etc but then you are told of a provision that gives money to the trustees 'who may distribute'? This gives rise to a fiduciary power but how would that fit into the certainty to intention? Would it be the case that the words clearly demonstrate an intention to create a fiduciary power within the trust?
great stuff as always marcus; but am a little puzzled as regards Comiskey [1905] where my reading is that a trust was in fact NOT established... the judgment stating: "here was an absolute gift of the testator's real and personal estate to his wife" with Lord Davey suggesting: "The words which have been so much commented upon, "in full confidence," are, in my opinion, neutral. I think it would be impossible to regard them as technical words in any sense. They are words which may or may not create a trust, and whether they do so or not must be determined by the context of the particular will in which you find them. In the present case I do not think it necessary to determine any such question."
A very good observation but remember that the words are only one aspect. The court also looked at the context and it was clear that there was an intention for the nieces to obtain rights in the property.
