      My brother and i keep trying to convince or mom to just do something fun with it instead of keeping it for us, it seems to me if you need to depend on inherintace then your not really managing your money well

    My mother and father tried to leave all to my mentally challenged brother, who would have lost his SSI until it was spent down, and not a cent to the other four of us, except our oldest sibling prevented this by having them see an estate planning lawyer. Great injustice prevented!!!

      That's good for your brother as well. This way he still gets monthly SSI so he can't blow it all at once and still has an income to survive on. If he had gotten a huge inheritance, he could lose his SSI permanently, have to pay back a huge sum, would likely blow through the money, then be broke with no way to get his SSI back. I hope someone is managing his bills for him. I hope everyone gets a fair deal. Good on the eldest for looking out for everyone.

    It doesn't always work out so well. I took care of my parents for almost a decade. They told my brother he could take any family things, but I would get the house and money. My father got mild dementia and never changed his will. My brother just said he didn't remember their talk and I had to give him $94,000. Now I get to live in this old house without enough money to maintain things as I should. It is surrounded by giant trees and it costs a lot just for tree work.

    I was one who made ultimate sacrifice when my brother passed away, my mother approached my sister and I and said she was going to split her inheritance in half, I said no. My brother would have wanted the money given to our nephew. She never changed her will but because of the state we live in, the money was put in trust because my nephew was a minor. (I'm grateful for honestly, she tried to cash it in.) My nephew is clueless to my sacrifice and has treated me badly. I recently demanded that I be there when he is told of his trust fund as she refuses to tell him he's "loaded") It will explain why I have said repeatedly you will one day regret how you treat me. He treated me poorly and I now know why, he heard of all the crap talking that was done behind my back. I don't hold it against her. It hurts to know he believes the bad things he has heard behind close doors. I won't lie, it hurts but in the end the truth will come out.

    They are lucky because generally the person who does the most, gets the least. I've seen parents try to impress the child who doesn't give them the time of day, after they die, snd to hell with the good ones.

    Whenever somebody refers to somebody else's actions as insolence, it's basically a huge red flag that they're a narcissist, if that wasn't already clear by that point with the way she stole a ton of money and tried to hoard the entire inheritance to herself and planned to kick out her mother and sister, while crowing about how great she is for being willing to wait for them to move out.

    It was common practice at the time of the Regency (1800) in England for heirs of rich men to take loans from bankers to live a luxurious life as soon as the heir heard that his father was in poor health and possibly dying! But when the old man recovered, the younger man was often in a fix how to pay interest and repay the loan!

      Maybe, maybe not. In my part of the world, for example (I'm in Kansas, USA), it's not common for the lawyers to keep wills in perpetuity. The American Bar Association's Model Rules of Professional Conduct only require the lawyer to keep files for five years.

    My sister tried to get my fathers life ins on the day he died. She was not even beneficiary. The money went to pay for my mothers nursing home. She was so mad that she couldnt get the money from the nursing home. LOL

    My siblings and I are close and we are pretty upright and honest. If one of them did something like this, the other siblings and I would hunt them like prey until we brought them down and took back what they stole. Either in money, or in grevious bodily harm.

    "Legal rights share" is a European (mainly UK) legal term, describing the portion of the estate reserved for the spouse, not the children.
    Kayleigh's mother had a legal rights share, not Kayleigh.

    I'm the eldest in my family. When our mum died, I didn't get anything, but I'd already spoken to my m, so I already knew about it. I had no relationship with my mum, as she was abusive towards me, so when she wrote her will, I told her I didn't want anything! That way, I don't have to have anything to do with my stepfather and siblings. I'm 9 years older than my sister, and 10 years older than my brother, so I don't have anything to do with the either, and I'm more than happy to keep it that way!

    I bet that after staying away for a year or so, Kayleigh comes back to try to patch things up with mom and persuade HER to write a will favoring Kayleigh. And She may have some persuasion power, something growing that is showing as a bulge in her belly.
    OP was unwise to let K go without getting it in writing that K would never dispute the will or seek to take money / property from mom and OP!

      Needs to have a dispute clause in the will. Leave $1 to anyone you don't like, so they can't claim to be forgotten & then include "anyone who disputes the will as written relinquish all claim to any inheritance" (meaning they won't even get the $1).

    I don't know of any US state that allows the spouse to be disinherited. And you don't get to transfer the assets until the probate court accepts the will dirt bag. So no you don't get the money the day of the funeral.

    Uh...because that's the LAW. ANY time someone makes a new will that is completely different from the original, the original becomes null and void, thus cannot be held up in a court of law!

    Legitimste Wills MUST be filed with the County Courthouse in which the person lived, to.prevent this crap. The lawyer keeps a copy, and the person filing the Will keeps a copy
    The original is filed with the Courthouse.
