सर धन्यवाद. इस संदर्भ में जानना चाहता हूं १) जमिन संबंध में न्यायालय में दावा लंबित है २) वादि की बहन, वादि के द्वारा दी गयी पाॅवर आॅफ एटार्नी का दुरुपयोग कर, जमीन की रजिस्ट्री कर देती है. ३) प्रतिवादी इस आधार पर वादि का अधिकार निरस्त करने का आवेदन देता है. प्रतिवादी रजिस्ट्री की अधिकृत प्रतिलिपि पटल पर प्रस्तुत करने में असफल रहता है, आवेदन खारिज हो जाता है. ४) वादि को निजी प्रयासों से प्रतिलिपि मिल जाती है. आपसे मार्गदर्शन चाहिए १) क्या वादि को वह रजिस्ट्री इसी दावे में प्रस्तुत कर निरस्त करने का आवेदन देना चाहिए, (धारा ५३ के अंतर्गत). २) रजिस्ट्री निरस्त करने के लिए प्रथक दावा लगाना चाहिए. कृपया मार्गदर्शन करें.

If he is known of fact that it is disputed property then can't , he have to honour the decision of court. But if he purchased in good faith then can file a suit (rarely) but as a separate case not in the same case. Thank You.

It is as such not carrying any 'attachment' like effect...people having ownership can transfer ..and no notice to pending of case can also be proved by third party, if really can not be known to him/ her having no connection with any of the parties....
