    i have a reservation over ur view. once the reversioner objected or resisted within 3 years of determination of the interest or term , then only the period of easement will be excluded for computation. otherwise an easement period can be computed by dominant owner even though the servient heritage is an interest holding property

    I think Reversioner, would have to resist the claim filed by way of suit by the claimant of easementary right, within 3 years after the determination of life interest. Reversioner needn't file to any suit.

      I am also thinking the same. Logic says why should a reversioner himself go and file a suit after the determination of Life interest within 3 years.

      This is bcoz that if the reversioner would not resist the claimant of easement within 3 yrs he would have no say later on in the matter... Means thereby that if the claimant is not resisted by reversioner the period shall not be then excluded of which claimant is claiming!

    The section reads as, if the claim is resisted by the person(reversioner).
    Pay attention to the use of word "resisted" and not "instituted ".
    Moreover , the heading of the section also aims at protection of right of the reversioner and not conferring a unnecessary burden of instituting the suit.
    Also the burden of proof is on the person seeking declaration and not otherwise.

    I don't understand here that why reversioner would claim when he already has possessionry right upon such property ,nd what would happen if he had not claim?? Plz explain last portion through the help of example

      Resist by reversioner isliye hai coz jb life interes khtn hone ke bad usko possession mila fir bhi the 3rd party was continuously using the land to usko rokne ke liye suit lgayega reversioner n uska limit 3 years hai
