Near to my house, a person riding their own horse on someone else’s property, fell off and was injured. That person sued the property owner and took away his property. So be careful
I run multiple motorcycle tracks that the neighbor kids can come and ride on whenever they like. For legal reasons, I wouldn't have given him consent. I would have said something along the lines of If you ride back there you don't have my consent, but I'm not going to bother you". I am a massive advocate for letting kids fart around on unused or land that they are not hurting. But you do have to cover your ass for getting sued. The biggest issue is even if they are great people and won't sue you personally. If he flips that quad and needs an ambulance ride. The insurance company can actually sue without the consent of the person on the plan. So if I were you get a liability release waiver. If you want one that's already made up I would be happy to give you a copy of the one I use, which I had made by my lawyer.
Enduro fury, Thanks so much for the advice! I'm sure I could've handled it better, but I made it up as I went. I guess I'm OK for the waiver, but you are correct. Be a good idea to start getting people to sign them. Glad to see another small business owner getting by. Brother, please come back!
Pastures and fields are not "unused land". But you are right about Farmer Brown now being on the financial hook for any and all accidents or injuries he sustains on the property. Good luck.
@@tearl5676 "unused or land that they are not hurting," I think I was clear with my statement your correction isn't warranted. I was encompassing everything from the trees to planted fields with this statement.
The kid should ask permission to ride on this guy's land, we use to fish at Shepekas Creek on Mr. Shepekas land we would ask him if we could fish at the creek , he said you can but don't throw your garbage around or beer bottles. Everyone got along then.
I'll give the kid the benefit of a doubt that he's just socially awkward, but you were much calmer than I would be encountering someone smirking and side-eyeing me that much when they're in the wrong. 0% chance he'd be allowed back on my property if he's going to act like like I'm the one being a jerkoff.
Thanks bud. I'm catching alot a anger from about of 3 percent of the comments. For the look at my pocket bit. The kid obviously felt safe. I was coming up with it on the fly. I just wanted to be in control to make sure nobody tried something stupid or dangerous
Wow this guy is alot calmer than I might have been? Clearly the kid saw him the first time and he should have stopped then. I might have given him the benefit of the doubt but he immediately lied to the property owner and had a cocky smirk on his face the whole time the property owner was trying to talk to him respectfully. I would of rethought my decision et that point about allowing him to ride on my property? And I have a feeling down the road the property owner is going to regret giving him permission???? Firstly the kid should have asked the first time for permission but didn't so that was strike one against him.
William, Thanks for your counsel. Wise advice for any future trespassers. Not if, but when. I'm sure i will or have paid for it in some way. But I will share this land with others unless they are proven untrustworthy. Joyriding on others property is not anything I haven't done plenty of times. Actually, recently I got lost on atv as the sun went down. Ended up way off our property. Tried to find a way home till like 10:00. Finally gave up trying to find my own way home. Had to ask someone else to come find me. It was a whole big thing, and embarrassing
You should see the people on the short telling me i deserve to have charges pressed and should have my gun rights removed. Maybe i should have done it differently. But i was coming up with it on the fly.
Maybe. Or maybe a kid that laughs when he gets nervous. Or maybe it was done as an example of how trespasser could be treated. Truthfully, I came up with my words as I said them. And the audience did give some wise advice. Maybe it was a training exercise. Maybe it was a publicity stunt. Maybe it was real. I will provide more info in future videos!
Sorry, but that is not the way to handle trespassers. You have now given him permission on video, to be on your property and are you are now responsible if he breaks his damnfool neck or has some other kind of accident or injury on your property. You rolled over for this jerk.
You handled that perfect!! You're a good man.
you were fair and kind to the young man and were respectful so you got it in return.
Thanks. Hope to hear from u again on Bigdave's-farmlife

Creating motorcycle paths could be considered an attractive nuisance… have the parents sign a release of liability…post no trespassing signage…
