...never use the phrase "you were lucky" toward a cop. That's dangerously close to a threat and beyond provocative. It's a completely unneccesary risk if you're not absolutely in the right by the book.
It IS a threat. IK Canada is stricter, but any utterance that can be reasonably perceived as a threat against your safety is considered a threat here. So saying, "you're lucky I didn't pepper spray you" can be reasonably perceived as a threat towards his safety as its clear she already had the thought and idea to do harm and made that intention clear and public. Wanting to harm someone is a natural and normal human reaction, but we normally filter and control ourselves knowing the consequences of it. Generally, people who make those thoughts known are seriously considering it, or are impulsive and there's a risk some harm could come, whether or not it's the initial threat.
Never use the phrase “you were lucky” to anyone person who has a higher authority then you, it makes you sound like an entitled idiot, a threat, and disrespectful.
You were lucky I didn't have my pepper spray on me or else I wouldve also been convicted for assault.
Even if you are absolutely right by the book, fight it in court, not with the cop. It'll just make it worse and you'll end up actually committing a crime. There's a few laws on the book about verbally resisting.

@Takahashi Shimo Mo I don't think that's true. I know multiple police officers and none of them are racially motivated to do anything. In fact, one of the officers I know is black. I have a feeling you are biased against the police for something unrelated to race.
@Takahashi Shimo Mo I've seen that study before. Unfortunately, it was not scientifically valid. It used the same situations on different officers and each officer only got to do it once. Sure, they were more likely to shoot a black person carrying a gun. ( And it wasn't just open carry it was illegal, and the suspect had committed a crime before hand.) The thing about it was they never had the officers that shot the black actors do the same simulation with white actors. In fact, some actors (randomly) were told to act more aggressive. It was a bad experiment that didn't have a control group or anything.
@Takahashi Shimo Mo I can't guarantee that we are even talking about the same one, however I believe the one I was talking about was funded and run by Vox or Vice or something like that... As for the video you showed me, I am teeter-tottering on if race had any role in that, just based on the same reasons above on the fact that you cannot do this on the same officer, which is a shame. I appreciate your ability to have a conversation in the comment section without name-calling or senseless arguing, by the way. As for what I believe, I know for certain that there is most definitely racist cops in America, but I also know that the majority of the cops you will meet are not. If you take a look at some of those body cam channels on UA-cam you will see tons and tons of evidence of police being kind and curious of all races
