  • Legendary game developer, Pirate Software, has solo developed and shipped countless beloved titles. Why then would this super successful, universally beloved developer target a small indie game developer with a DMCA takedown? Brandon Ferrentino is developing Idle Streaming Bonanza. Let's analyze the situation.

    Thank you, (EDIT: There seems to be no intent by the Lawyer or Dev to take this to court.)
    Now here's another thing worth noting on this problem and where it's going to bite Jason's entire ass.
    He claimed that Kronos was a Lawyer in his threats to the developer, The Dev's Lawyer was told by Kronos that they're not an Attorney.
    The Dev's Lawyer then responded by stating that this is a potential 512(f) problem.
    So he lied and tried to strong arm an indie developer without evidence (and most likely was trying to make himself out to be the better man by "dropping charges") but the DMCA being false under 512(f) outright puts Jason at fault. This is disgusting and with my limited but modest understanding of the law. is a violation to many more and larger issues also.
    I hope we see Jason taken to court.

      Garbage opinion? Which one? I agree with several of his points. The cost being enough to inhibit certain types of games and certain games from being made is not theory. The same issue happens in every other industry where regulation adherence costs are high. I also think he spoke on the issue of rights-holders. Have whatever opinion you want to about copyright, but the law is that only the copyright-holder is entitled to the profit of their work. And some components of Stop Killing Games directly oppose that. He argues quite well in his presentation. Can't agree with all of his complaints, though. Companies shouldn't have to be legally obligated to do that. It should be willing. Otherwise, you get crappy malicious compliance.

      @ All regulations come with cost. Who cares? The idea that we shouldn’t protect the consumer because it could potentially hurt businesses is absurd. You know that the laws that keep food manufacturers from putting sawdust in the food loses the business money? As does the laws that require meat production plants to be cleaned and inspected. The consumer should have certain rights that trump anyone’s “right” to make money and have a business. As it stands, the way corporations treat software violate many law and traditions. It is an under regulated medium that has yet to be brought up to standard. They literally “sell” “purchased” goods that don’t even fit the definition of sold or purchased. Either the language around the product must change or the way the product is handled must change. As it stands, a lot of software actually break a lot of local laws.
      Who’s even talking about anyone other than the copyright holder getting profit from the ip?? This is an argument that Pirate software manufactured. Nobody is arguing that they should be able to make any kind of profit off games they didn’t make. It’s a literal strawman scenarios that pirate made up and then argued as though anyone in stop killing games is pushing for this. All stop killing games wants is for companies who claim to be selling you a product, not be able to just turn off said product. If a company wants to sell you a temporary license, they must say so. Thankfully this is becoming law in California.
      See how you’re regurgitating Pirate’s lies? This is why I don’t like him. You should look at Louis Ross man’s response, as well as the creators response and stop being spoon fed nonsense from a known liar. A man who lies about the TV show Mr.Robot because he is mentally unwell 😂.

      Of course Thor assumed it was in the game. The developer literally claimed that. Why would he be forced to purchase and play the game to confirm. If someone tells you they used your voice without giving credit in their game and you take action with that information I can't imagine why that would not be how it goes down.

    Honestly, the "why didn't he check the game" part is easy to understand: he would have to finish the game, and even if he didn't come across the voice clip, that wouldn't guarantee it wasn't in the game. He may just not have triggered the conditions for that clip to play.
    On the other hand, a casual check would quickly reveal that the game doesn't contain any clips from real-life streamers, so odds of any of his clips being used would be very slim. Furthermore, if you don't find any clips from real world streamers in a quick check, even if the game would contain such clips, they would be rare enough to fall under "fair use".
    Either way, he should have done some due diligence before threatening legal action. And there should be penalties for filing invalid DMCA claims. At this moment, the DMCA process favours the claimant, resulting in a lot of bogus claims being filed, e.g. in order to suppress unfavourable product reviews, criticism, ...

    I am glad PirateSoftware did this DMCA strike. It's rather genius, in fact, because it achieves 2 things at once;
    First, it brings eyes to a small game that otherwise may have remained unnoticed...
    And more importantly, it informs the public of his duplicitous character, and further cements him as a lolcow.

Kinda understandable why he DMCA'd it. If someone told me they robbed my savings I would hand them to the police too before checking as well, maybe thats just me but at the very least it not a "false DMCA out of nowhere" which is what a lot of people are claiming.

    Pirate Software is a mouthpiece for Dan Clancy, the Twitch CEO. They literally cited each other as "sources" when asked questions about the twitch adpocalypse! Also, the guy is an Activision sympathiser. He seems like a plant by someone higher up.

      @sungrandstudios Some of his shorts started coming in my feed a few months back. And he does have that initial razzle-dazzle, but soon I realized that said some of the most obvious things in a manner which seems like he is unraveling a great mystery. But, I definitely remember, in a recent Dan Clancy interview with softball questions, where he cited "even Pirate Software said that there is no adpocalypse going on". I might have extrapolated a bit from there. You might come across more information as a person associated with the industry.

  • @ScottE-2
    @ScottE-2 6 днів тому +2

    The funny thing is, for a mage without mana, the best thing he could've done was nothing. It would've become irrelevant. But by how he responded he bolstered the Indie Dev who would've otherwise been lost to obscurity. Pirate Software's Intelligence stat is only matched by his smugness and entitlement. It also makes me chuckle the number of different ways you've mispronounced his name. Though on a slightly serious note, he is in all senses a pathological liar which is a rabbit hole I don't think most of the public would want to bite into. Just like how he said he had mana, when in fact he spent the last of it running away. It's something I'm surprised more didn't notice with how aggressive he was when it came to shorts recommendations or that the man has been larping about having experience in an entry level job. Which kind of echoes a problem many people these days find with jobs requiring ungodly amount of years before applying. It also reminds me of this one job instance where, they asked for like 5 years in something that had only been made recently. I forget what it was.
    No clue how often you read comments after the 5th hour but... I like your work. Found you through Leaflit, you're an alright guy. I hope your day finds you well once you've found this comment.

    • @ablackbunny3149
      @ablackbunny3149 6 днів тому +1

      Honestly, his way of responding is also a constant in most of these situations involving him. The dude has his own take he seems to regard as gospel and when someone goes against his take, he gets uber defensive and straight tells the other party that they're wrong and that he won't engage with their argument. It happened with the Stop Killing Games incident, happened when the guild confronted Jason after the failed raid, and he's doing a similar thing with this indie dev lolsuit.
      The way he responds to these situations only makes things worse. You'd think that he'd learn to just chill out a bit, talk it out with the other party, and maybe throw a bone with an apology, but here we are now.
