First of all, during marriage registration,if someone declares himself/herself as unmarried which actually he/ she is not,then marriage becomes null and void if husband/ wife after knowing this lie,refuse to honour such marriage. But here, Shami may have committed a legal mistake that after knowing such lie,he continued his conjugal life. But he is still entitled for getting divorce in the ground of cruelty. Wife is clever enough and she didn't marry according to Islamic law but married according to common civil law. He deserves divorce. His wife afterall can't deny the fact that she married Shami based on lies. He can refuse maintenance of Jahan's children whose father is not Mohammad Shami. Jahan first married a shopkeeper who hails from Murshidabad district of West Bengal. Debu Das who is very close with Shami once stated that Shami is very simple hearted person.
