  • The Oregon Supreme Court late Wednesday afternoon denied a request by the state Department of Justice to have it review a circuit court judge’s decision to prevent enforcement of Ballot Measure 114.
    The court also ruled the Harney County suit to pause the gun control measure will stand.
    In their one-page decision, the justices gave no reasoning for their decision.
    The state tried to dismiss the pause and start up Measure 114 on Thursday, which was when it was supposed take effect after Oregon voters narrowly approved it last month.
    On Tuesday, Judge Robert Raschio in Harney County issued his decision just hours after federal Judge Karin Immergut denied a separate motion for a preliminary injunction.
    The Oregon Attorney General's Office filed its petition earlier Wednesday, saying its petition looked to align the state court's decision with the federal court’s decision.

      I like how they want to take a right and turn it into a privilege 😂 come on getting a permit to get a gun just ridiculous I can understand for concealed carry and for taking that firearm out as most states have that but you can't just require a permit to purchase the gun itself could you imagine if we applied this logic to everything else you need to get a permit for free speech you also need to get a permit to vote that little bit about unreasonable search and seizure nope permit..... I know this is a ridiculous comparison but that's pretty much what they do they regulate every aspect of the second amendment but not any of the other amendments.

      You left out all tube fed shotguns will become illegal because they can hold more than 12 of them short 12-gauge shells.
      Lever guns also will become illegal because many of them can hold more than 12 cartridges like pistol cartridges.
      Pump rifles also that use pistol cartridges that take more than 12 again become illegal in Oregon.

      @@Lure-Benson This is actually incorrect. Section 11 (C) as it's written states exceptions to the Large Capacity Magazines does NOT INCLUDE "A tubular ammunition feeding device that is contained in a lever-action firearm."

      Another person into rare old firearms showed a Colt rifle in 44-40 with a tube feed magazine said these guns would be illegal under 114.

    Read the SCOTUS decisions in MacDonald, both Heller cases, and the Bruen decision. 114 has been found unconstitutional on all areas.

    Everyone already knows that the 1st 10 Amendments in the Constitution are the Bill of Rights. The 2nd Amendment is the only Amendment in the Bill of Rights that clearly states “Shall Not Be Infringed”. Why is it that the 2nd Amendment is the most infringed upon Amendment in the Bill of Rights ? I would love to have an answer.

      That you think it’s the one that is the most infringed is incorrect. It’s more like the one that gets the most attention. I would offer a simple explanation, though. The other 9 aren’t used as an excuse mechanism to abuse and pervert the right of self defense into permission for all we see today. Both sides of this fence are guilty. Why? Because we insist on allowing our problem to be our solution. People have been killing people since the dawn of time. Guns do little more than allow the spineless wimps among us to get in on the action from a safer distance but everyone has to have one. Meanwhile, the next shooting happens down the street - killing brought to you by a career criminal who’d just stolen that gun out of a car glove box in the parking garage - owner left it there because it’s not allowed in the courthouse.       Don't forget about the 4th amendment. SCOTUS has made rulings that chip away the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated.

    There are rules in place for contested rulings where it causes harm to retailers and customers in these cases. You can't just shut it all down and bankrupt businesses when they enact dubious new laws...with no ne processes in place. The 2nd Amendment 'shall not be infringed'. The stuff in Russia would not be happening now if they had similar rights.

    Best reporting on Measure 114 so far. Great job.
    I have an Oregon CHL. Paid a county approved NRA instructor with live fire training as part of the CHL requirement. The Permit to Purchase is triplicate and duplicate of the CHL. Why do I need another permit when they have the fingerprints, background check, CHL training, live fire training? Already did all this. Had more background checks and fingerprints than most. This is unconstitutional. FICS is broken. Been waiting since 11-22 and still not approved yet. 16 days still waiting.

      Don't be fooled, It's the father's duty to "train" their children firearms safety. We don't have to prove shit.       @@ronin223 Only because GOA is larger and with more resources. That also means that they will have less money to fight battles on other fronts that don't have a 2A state organization. Every gun owner who lives in a state with their own organization should support them and help them grow, so they have the ability to defend their own state. National organizations such as GOA and FPC should be in a supporting role if they need help. Too many battles on too many fronts for GOA to take on alone!
      And I hope you're making extra donations to GOA for their help.

    What do you all not understand about the 2A…. Shall NOT be infringed. How can it not be any clearer! More people die from drunk drivers then guns and you aren’t banning vehicles.     114 is going to do nothing but waste millions in text pair dollars on litigation.
    Multiple LEO State have clear statements that because of its intentionally non-functional structure, 114 will require them to take officers off the street to do administration work. The net effect is that it will literally increase crime due to the lack of enforcement available.
    Additionally, like every new firearms restriction law that gets passed, it massively increases the sale of firearms prior to its enactment.
    Moreover like all gun laws, they are obeyed by the law abiding. This will do nothing criminals from using guns.
    Pretty much every school is a gun-free zone. That law does exactly zero to stop lunatics from shooting up schools. There's no law that can stop some someone who is not going to obey the law.
    Even having that law is laughable. As if violating that law is more heinous than murdering people, he's already about the most extreme violation of the law that one can imagine.
    Nobody has time to read in detail everything that they're voting on. And this was sold with a slick marketing package to the Oregon voter.

    How do I take my high capacity gun to th gunsmith? How do I get it repaired or painted? What about gunsmithing?? I am an aggrieved party. I want to paint my gun & have it serviced. I am not a gunsmith. I can't do it. I'm not certified in cerakote.

    Idk about Oregon becoming part of Idaho, but Portland should at least become part of Washington. That would solve all our states issues. Also, why are these legislators allowed to pass this stuff knowing full well it's unconstitutional? They should be punished for attempting to subvert the constitution.     Any time a law is proposed, the mere contemplation of which causes vast swaths of citizens to take action to circumvent it, is a bad law. If I propose to lower the allowed blood alcohol level for DUI, people won’t run out and drive drunk the day before it passes. Our laws are not supposed to try and alter the behavior of the citizens they affect. Rather they should be a reflection of the citizens’ desires and morals. This is utterly fundamental to our nation’s principals. It’s simple really: most people should like most laws. If 1 or 2 percent of the population doesn’t like it, that may not necessarily be enough to render it bad. But when there are more guns in a country than people, the idea that it’s some fringe group who oppose a proposed gun law is absurd by definition.

    I think we should limit the capacity of fuel tanks to 3 gallons, this would prevent long highspeed chases. You don't need more than three gallons as that should be plenty to make it to another fuel station. The magazine capacity ban is totally asinine and puts people's lives in danger much the same way as running out of fuel on a busy highway at night would do.

    hands of Oregon Residence. (Conservatively.)
    230 thousand firearms were purchased in Oregon
    last year. If we average out 200 thousand were
    semiautomatic with 4 magazines (2 sold with the
    firearm and 4 to five extra purchased at time of sale,

    Over twenty years, this is an average of 16 million
    standard over 10 round magazines. However; with
    each attempt to "Gun Grab" scheme put millions of more magazines over 10 rounds were purchased each year.
    How is the state justified to ban all these millions of magazines already in residence hands or even
    justified to what the Measure 114 is attempting to
    limit the ability of carrying this magazines each day.
    The state can not stop unlawful drugs lest enforce those laws let alone have them go through the justice system. 50 million magazines out there. Get real!

      If you read the text of the measure, you can still posess magazines with a standard capacity over 10 rounds on your property, at the range, and while driving to and fro. How they expect to enforce that is beyond me. But this measure isn't the gun grabbers' end goal, it's a tiny step that would give them room to further infringe on our rights down the road.

      I appreciate your view.
      The point is there are 30 million over 10 round magazines in Oregon. I can not buy or obtain a 10 round magazine from a dealer, Midway USA because of the law.
      Many firearms have no 10 round magazines produced for them. Rendering one not able to utilize the firearm for self defense in the near future out side of Home, Hunting or at the Range.
      I did not buy the weapon for those reasons, but in traveling and doing my daily affairs in this horrific hostel world!

    These fools in Portland thinks its hard to reload magazines, I can do a reload in under a second. 10 round magazines are sub-standard capacity. 30 rounds is standard for ARs, 15 or 17 is standard with the majority of pistols.

    @ 640 the statement is totally false. ALL buyers undergo the state background checks, not a small percentage. NO ONE is being instantly approved without.
    There was a time when the background check was NEARLY instant, weeks ago. I hope that is the mistake being made here.

    There's going to be a gun show in Reno this weekend -- I hear that dealers are bringing every magazine and parts kit they can get hold of, because they expect to sell out by Saturday afternoon. Gee I wonder who they are selling to? One dealer that supports the women from my training classes sent out an email promising that they will not boost their prices, and they told me this afternoon that they have presold several PALLET LOADS of AR-15 magazines alone! They are also offering a discount to anyone showing Oregon, Washington, California or Canadian ID who buys 5 or more mags (any type) and/or 10 boxes of ammo.
    California cops routinely get rooms at the Atlantis (across from the convention center), drive around checking cars with California plates, and take pictures from their hotel windows in hopes of spotting people carrying packages to CA cars. I expect Oregon to start doing the same thing -- after all, it's a lot safer to go after honest gun owners than the BLMafia and Klantifa rioters who have made Portland such a paradise on Earth . . .

    even if this does pass, i dont foresee this going well for the state in general. people are gonna be packing their bags and marching to idaho in groves and there will likely be those who refuse to hand over their rightfully owned firearms and magazines. i for one will be moving to idaho very soon. not going to tolerate this nonsense anymore. me along with many other people saw this coming years ago and ive been preparing for it ever since.

    Measure 114 language states that magazines that are readily convertible are banned. This covers virtually all magazines because they have base/floorplates and can be adapted to hold more than ten rounds. That means almost every semi-auto handgun will be useless. This also applies to shotguns that can hold more than 10 minishells and lever action rifles if they can hold more than 10 rounds.

    What are the historical analogues to justify State Licensing Schemes for the bearing (you can bear open or concealed!) of arms for lawful purposes (e.g. self defense) as Americans go about pursuing Life, LIBERTY and Happiness? Regarding the magazine issue upon buying new gun, you can't transfer the magazine but you could disassemble them and transfer as "magazine repair kit". At least, that's what we did in my resident State to get around their unconstitutional legislation.

    The missed the point where any magazine that can be modified, i.e anything with a base plate is banned. That's just about 100% of modern firearms outside of revolvers and 1911's will be banned from purchases going forward. THIS IS A BAN ON GUNS, FULL STOP!

    So to buy a gun, you have to take a course by shooting at a range. In order to shoot a gun your buying, you need a gun to shoot. To get a gun you will have to pass a background check

    I have never understood how anyone can think a law requiring a "permit" (i.e. permission) to exercise a Constitutionally protected right is allowed. If so, why not a permit to vote? A permit to get a fair trial? A permit to go to church? Under the Constitution, all are equally repugnant--as is a permit to own a gun.

    If something requires a permit it's not a "right." And "shall not be infringed" is pretty crystal fucking clear. I don't give a shit if half the state voted to pass a bill, if something is unconstitutional it's unconstitutional and therefore ILLEGAL and a breach of contract by the government.

      My house payment is $500 a month. I would move if I could afford to buy somewhere else. There was only one drug dealer in the neighborhood 20 years ago, now there are 6 drug houses. Every time one dies, it seems like two more show up to take his place. Fukin zombies. Aim for the head.

    Just build your firearm. No 'permit to buy', no BGC, no serial numbers. If you have family and friends who live in a free state, contact them and see if they will mail you a few standard capacity 12,15,17,21, and 30 round magazines. Don't think the USPS is going to x-ray / scan every single package coming into Oregon.

    Oregonians need to reprint and distribute there state and fed constitutions!!!!! Hardly anyone has copies. The Fed Papers can help county governments push back with supreme court cases. Paper work distribution. Governors and AG's west coast are anti constitutional for years. Even the taxation intentions of law outlined in the fed papers

    bought 4 firearms this month and got 2 of them without a background check after 3 days.
