Cheating is such an ambiguous term. In this case, Faith considers her marriage to be over, she's not going back to Tom, so she doesn't feel like she's being unfaithful to him, not to mention she's sleeping with Pat, the man she loves, not some guy she's having a fling with behind her husband's back. Yet at the same time, because Tom is sick and obviously mentally unstable, it does seem like they're flaunting their relationship and being self-centered. I guess after doing the "right thing" for so long (first Pat with Delia, then Faith with Tom), they just want to be together and be happy. At the same time, it does seem a bit insensitive.
It's not really ambiguous. You either cheat or you don't. I'm not saying Faith doesn't have reason to want the marriage over but that doesn't make what she's doing not cheating. Maybe call it cheating with just cause, but it's still cheating. Fast track the divorce if you see no other way out (you've got a sister as a lawyer) and then do what you want with whoever you want. But it's still cheating until the marriage is over.

As wrong as Faith and Tom's marriage was, this also feels wrong with this public display so quickly. It's not what I believe Faith or Pat would do. They'd keep it more private and personal.
