I'm going to guess, he partially owns the house. I work in class action, so I'm not versed in real estate law, but it is possible that if he is a partial owner and the courts didn't grant a restraining order (which, from experience I know most cities require proof of physical violence or property damage to get one, which is disgust IMO because someone threatening to hurt you should be enough & legal statistics show most threats of violence with people you know IRL do result in violence if left unmanaged) then he'll have every legal right to stay and she'd have nothing she could do about it except for leave, which, if all her money is tied up in joint account during a divorce she might not have the funds or options to do. Abusers set up situations that make you fiscally, emotionally, and basic needs wise dependent on them. They do so wanting to trap you so that you can't leave them when they finally show their true colors. This process can sometimes happen slowly over multiple years. I have personal experience in this, both from my own relationship with someone who flipped their switch 2 years in after I was cut off from options as a very young woman, and with my biological father as a child. If he is still there, it is because he's made it impossible for her to leave without risking her children's lives. For example, a common tactic abusers use is making a home or lease fully or partly in their name so that when they have children, if the abused partner leaves (choosing to be homeless) they can use that as leverage to get custody of the kids. And, even if proven abusive, if she had no means to offer home/food/care then the children could be take and placed in temporary foster care. Even if this is unlikely, he is likely using it scare her into submission. The darkest part of abuse is that most people only see it from the outside, so they don't see the lays of control and manipulation and trapping that abusers create prior to exposing their true selves (as less than maybe 1% of abusers get abusive early in the relationship.) Abuse is a frog slowly boiling in a pot so it doesn't know it is being cooked until it is too late to escape the boiling water.

I’ve been a family law paralegal for decades and I have read a lot of nasty text message, but this was by far the most vile. We always advise our clients not to say anything in writing that you wouldn’t want the judge to read. This looks looks really bad for him. Perhaps the abuse was just verbal, not physical, we don't know. Had it been way out physical abuse, running out of the house would have been easier. But sadly, one learns to endure verbal abuse. So, legal editor and survivor here. Anyone curious, she probably hasn't kicked him out because she legally cannot do so. It is a common tactic for abusers to be partially on house deeds so that they legally cannot be kicked out. Additionally, unless she can get a restraining order, which if he hasn't touched her in CA would be hard, she has no legal recourse to evict him. And, if she leaves, if her funds are tied into joint accounts that cannot be touched during the divorce process, she may have to chose to be homeless. Having children, he likely has framed that if she leaves he can get custody or that they'll go to foster care, because she'll have no means of care. Abusers spend time cutting victims off from fiscal resources before showing their true colors. They need your trapped. And less than 1% of abusers express obvious abuse early in the relationships. I'm going to guess, he partially owns the house. I work in class action, so I'm not versed in real estate law, but it is possible that if he is a partial owner and the courts didn't grant a restraining order (which, from experience I know most cities require proof of physical violence or property damage to get one, which is disgust IMO because someone threatening to hurt you should be enough & legal statistics show most threats of violence with people you know IRL do result in violence if left unmanaged) then he'll have every legal right to stay and she'd have nothing she could do about it except for leave, which, if all her money is tied up in joint account during a divorce she might not have the funds or options to do.
Abusers set up situations that make you fiscally, emotionally, and basic needs wise dependent on them. They do so wanting to trap you so that you can't leave them when they finally show their true colors. This process can sometimes happen slowly over multiple years. I have personal experience in this, both from my own relationship with someone who flipped their switch 2 years in after I was cut off from options as a very young woman, and with my biological father as a child.
If he is still there, it is because he's made it impossible for her to leave without risking her children's lives. For example, a common tactic abusers use is making a home or lease fully or partly in their name so that when they have children, if the abused partner leaves (choosing to be homeless) they can use that as leverage to get custody of the kids. And, even if proven abusive, if she had no means to offer home/food/care then the children could be take and placed in temporary foster care. Even if this is unlikely, he is likely using it scare her into submission.
The darkest part of abuse is that most people only see it from the outside, so they don't see the lays of control and manipulation and trapping that abusers create prior to exposing their true selves (as less than maybe 1% of abusers get abusive early in the relationship.) Abuse is a frog slowly boiling in a pot so it doesn't know it is being cooked until it is too late to escape the boiling water.
Men like that always pick the sweet sensitive ones, because they are easy to victimize. I am really afraid for her safety. He should not be allowed to live in her house.

I’ve been a family law paralegal for decades and I have read a lot of nasty text message, but this was by far the most vile. We always advise our clients not to say anything in writing that you wouldn’t want the judge to read. This looks looks really bad for him. Of course, he’ll probably try to spin it by saying she got off on that kind of talk. This is just gross.

Perhaps the abuse was just verbal, not physical, we don't know. Had it been way out physical abuse, running out of the house would have been easier. But sadly, one learns to endure verbal abuse. So, legal editor and survivor here. Anyone curious, she probably hasn't kicked him out because she legally cannot do so. It is a common tactic for abusers to be partially on house deeds so that they legally cannot be kicked out. Additionally, unless she can get a restraining order, which if he hasn't touched her in CA would be hard, she has no legal recourse to evict him. And, if she leaves, if her funds are tied into joint accounts that cannot be touched during the divorce process, she may have to chose to be homeless. Having children, he likely has framed that if she leaves he can get custody or that they'll go to foster care, because she'll have no means of care. Abusers spend time cutting victims off from fiscal resources before showing their true colors. They need your trapped. And less than 1% of abusers express obvious abuse early in the relationships. It is a frog in a pot slowly boiling.

I read the texts for the first time last night and I still felt upset this morning about it. The guy is a new level of messed up. The kids shouldn’t be anywhere near him and if they are, as soon as they are old enough to understand how he treated their mom, they will never ever speak to him again. Ever.

This is beyond disturbing, and that is just ONE text among hundreds, I cannot imagine the abuse she's been putting up with, no house is worth staying in a toxic, hostile, and dangerous environment, I wish she'd move out with those kids. And to know their father is even capable of that type of verbiage is a very good reason to limit his time with them, any good she puts into them will be undone by him.
She might be staying there until she gets full custody of the kids. If he's a danger, she wouldn't want them to be alone with him.
This is very concerning and not normal! I truly pray she is able to get a divorce if she hasn’t already and that he gets nothing including the kids. Please save this somewhere so she can have proof. This saddens me. Lord willing she will be okay! Please Heavenly Father help her!! In the name of Jesus!!! Amen!!!
