I'll do you one better. I had an original alpha account given to me by Notch when he was first starting out. Microsoft deleted it when they decided to migrate to a different system, claiming they had the right because of my agreement to their TOS that I never read, never signed, and was never sent.
I lost my account in the migration because the old email was deleted. There was tens of thousands of account lost to that particular issue and I am convinced Microsoft purposefully ignored it so a huge wave of people would have to re buy the game and get them more money.

can't agree more, so many people, in government, high up in big companies, just in any place of influence break and abuse laws to the detriment of the every day person, and we are just supposed to take it? An additional complaint I would add: telemetry that you cannot opt out of on modern minecraft versions due to being "essential" (screw off with that mojang) (violates GDPR)
Windows, your phone, and youtube takes more data & way more valuable. Minecraft's required data includes: User & Client ID, Minecraft Session ID, Game Version, OS, Platform, If it is a Modded Client, Launcher Name, Event Timestamp (UTC) [No idea what it is but it's very probable that not important to us], if you opted in for sending more data, World Session ID, if the internal / external server you are playing is modded, the type of server, the gamemode, and Realms Map Content, Time since Load (Seconds & Ticks) None of that is personal info about you, the most "critical" information would be User / Client ID, and you can't do meaningful shit with it. Not all kinds of Telemetry are bad, it's the data they recollect from you, does that mean that is good for Minecraft to collect info of your play session without being able to opt out? No. It is horrible? Also no, you can use this info to know which updates make a higher spike in players or stuffs like that, idk i've never used telemetry, but just wanted to clarify that NOT ALL of it it's bad.
@@xaxurro I don't use Windows, I consented to data collection on my phone, I didn't consent to data collection in Minecraft (whenever I play modern, I utilise a mod to disable telemetry which shouldn't be needed)
I think honestly the most important thing you touched on in this video is the servers that have loot boxes. Makes me sad when I imagine Minecraft's young player base wasting there money on Minecraft gambling loot boxes. Minecraft needs to protect against that.
They tried, back in the day, but people hosting the servers got so mad that it caused Persson to leave Mojang. left to a company that is fine with gambling.

I'd say the core development team are still working hard, they just don't really get a say on features. It's the corpos that pull that BS. It also seems that their Stockholm team are severely lacking in talent, which is why it took 3 years for Caves and Cliffs to be completed. That said, once Gnembon joined a lot of good stuff started changing in the background fast.

I know it was for a bit, but I feel the need to clarify that in the U.S. you CANNOT put anything you want in a EULA and get away with it. There have been many companies sued in the U.S. for having unlawful TOS.
They can put whatever they want and most people will acquiesce because they don't have the time, energy or money to sue over it. Individuals have to sue corporations to stop them from breaking the law instead of the law being enforced; that is the problem!
I really hope your campaign goes well and you'll be able to proceed legally against Mojang, because as far as i love their game, we live in Europe, not in a Cyberounk like dystopia, where mega corporations can do whatever they want. @MilesProwerTailsFox Also I have Legacy console edition aswell, the best version, also Eaglercraft, Eaglercraft only goes up to 1.8.8, but it is a full version of Minecraft in your browser, yes, browser, it has low quality sound and force low textures to help run in the browser, but it's the full 1.8.8 game. Also since the EULA only applies to versions 1.9 and after, just make such server on 1.8 or lower.

I remember when the OG EULA changes to remove gambling from servers went up, the server community lost their minds, whining about profit loss. I was happy about it because I hated the egregious nature of it all, and gambling. To my shock and horror, those gambling elements slowly returned to the game and I didn't even notice because I don't play MP. What a joke.

What I would LOVE this to result in is the EU to get involved for Sweden improperly implementing article 47, that would hopefully lead to them applying more scrutiny to companies BEFORE consumers have to spend their time on it.
I hate that the legal system is reaction based rather than audit based. It should never be on a broke consumer to challenge a trillion dollar company in court. The company should be doing the right thing on pain of being nationalised.
As someone who has studied a bit of EU law, I'm not convinced that consumer law would have any influence on the relations between Mojang and commercial servers. A commercial server would by definition not be a consumer under EU law. As far as I can tell he would still be able to run this server, as long as it didn't have monetization. He's confusing the system by trying to both sue as a company and a consumer, which have wildly different protections. It's hard to tell if this would be a violation of the charter, without seeing what he actually argued to his state. I'll reserve my anger against the swedish government for now.

Oh the "Brand Guidelines" do exists, but it is a closed document reserved for the partner creators on the Bedrock Marketplace. We have to comply with the firearms, militar, gambling, etc things and are heavily enforced, BUT GUESS WHAT the big players on the Marketplace and the server owners (as you showed) have a do-whatever-you-want pass up their asses and we the other small partners can't tell nothing bc yes taking MONTHS to answer the complaints is a tactic they use constantly...

I wish all the best, but coming from an American a notable flaw in this strategy is you have very publicly stated the exact amount of lawyer-hours you would be able to afford. I don’t know about EU, but in USAmerica it would be extremely simple for a corporation to drag out a case until the other side loses steam.

Fun fact about something slightly off-topic you mentioned: While it's true that companies can legally put "you can't sue us" into legally binding documents, it's a bit more complicated than that, and in many circumstances you can still sue them regardless of what you signed. It's confusing and complicated, and oftentimes it does mean you can't sue them, but oftentimes it *doesn't.*
In all jurisdictions there are hierarchies of legal systems to prevent the enforcement of contracts that are: “I’m allowed to murder your family and you’re aren’t allowed to take us to court”. In Europe, Humans Rights legislation is high up the chain and there an article which includes consumer protection in a limited capacity. If the T&C breach this; then the ‘you can’t sue us’ clause is worth null.
They know these clauses are unenforceable, but putting them in anyway means you'll have to dispute them in court to escape them, which 99.99% of consumers are not willing to do.

The law should be that if there's any illegal terms in a EULA, the entire thing is void. Corporations should be terrified of putting anything in there that they don't absolutely have to out of fear that they could lose *everything*
just on case it isn't clear: you should always have the right to sue, because it's your only way to legally fight against something. i am pretty sure in any reasonable country, there is a law that prohibits the stripping of the right to sue, because the basic principle of justice is "everyone is the same" and this principle cannot be uphold if you cant sue anymore.

That case was more of a trademark/patent troll trying to trademark shit after the fact years after it was popular to get money of the IP that has been public for years. Also if that case went through it would set a precedent that all mods,maps, resource packs etc can be copyrighted. The WHOLE point of modding is to share ideas. It's an easy way to destroy modding for every game cus no modder wants to figure out who has the rights to each mod spanning back years. Many of the great mods we see today would never been made.

The bit about all of the gambling addictions really hurt and is making me think just what the Australian news would do with that information. They "shut down" my account because it was created in 2010 with just a username and i couldn't transfer it to a Mojang account because I "didn't have a receipt". It was a gift. And the person who gifted it to me didn't have that receipt anymore. I told them. They didn''t care. I tried it 2 more times. They didn't even try to resolve it. Goodbye my account I guess.
I transferred to a microsoft acount when we were forced to. Next day i got logged out of the launcher, tried to log back in and it said the account did not exist. I contacted mojang support and they said it's microsoft's problem, microsoft support said it's mojang's problem.

Getting rid of C418 was a disaster for the vibe of the game that they refuse to address. They've been creatively bankrupt for years. Now of course the suits are by far the more egregious side of this, yeah, but at this point they just can't seem to do _anything_ right anymore.

4:50 The thing is, changing a legally binding agreement after signing it, without getting consent from both parties, is also illegal in the USA. It's just big corpos can keep lawsuits going forever until the people suing them give up. There are also rules here about what can and cannot be in such agreements, and only a few years ago a court rules some EULAs non-enforceable. Regardless, they shouldn't even have the legal power to enforce any rules on privately owned servers.

You should really try push the idea of people donating a small amount each. When people hear "Please donate to my gofundme" they immediately think about donating €10+, and frankly, most people aren't bothered to donate that much money. But if you push for every to just donate €1, then far more people will donate and you'll have a far better shot at reaching your goal. Also try reach out to bigger content creators for them to promote the video and gofundme, hope something comes of this
One problem you MIGHT run into is that these policies might actually be enforced by Microsoft, a US company now, instead of Mojang, but I don’t know that for sure. Hopefully this works out!
The European Union forced Apple to switch to USB-C chargers in all future iPhones by informing them that the lightning cable violated EU law, and if they didn’t change it, all Apple products would be banned in all of Europe. The EU could still tell Microsoft that they can shape up or ship out.
What do you mean? They already put basically as much as possible in T&C and then add some more just for good measure as it pretty much never hurts a company and can be beneficial even if 90% of it won't hold up in court. Some of it will hold up and with how much they toss in there it usually doesn't look good for consumers and there is also the cost of paying lawyers to go through all those Terms and conditions if you actually want to bring a case against the company.
What I cant believe is I bought my wife a Java edition account like, 7 years ago. We played for awhile. Then she never played again. Last week we sat down to lay a world on LAN and she had to buy the game again. Why? Why wasnt there a way for her to play at least on the versions that were available from before and locally only? What a crock to buy the game again. for no reason.

@@titanpolus5088 I think it was 3 or 4 years ago that they migrated accounts or something and said that anyone that didn't login with a certain short time frame would lose access. It was really stupid. I did migrate my account, but I haven't played since then anyway. It left a bad taste in my mouth and I've since found better games including a game that's a better Minecraft imo. Vintage Story is amazing and I highly recommend it.

Mojang is Swedish but they’re owned by a US-based corporation. Couldn’t they just move the Minecraft IP up the Microsoft food chain, outside of Mojang’s legal scope, so that, legally, Mojang wouldn’t own Minecraft, the direct way that they do now? Judging by the TOS, Microsoft currently owns Minecraft’s brand (the name, logo and its packaging), while Mojang retains the rights to the game itself (all of the code and game assets, except music).

Just gave 50 USD. This is extremely important because without this kind of lawsuit, companies will get away with this kind of shit. I'm not one to throw money at every gofundme that crosses my path, but this is about more than just minecraft in my opinion. This precedent REALLY can't be set.

I had an original alpha account given to me by Notch when he was first starting out. Microsoft deleted it when they decided to migrate to a different system, claiming they had the right because of my agreement to their TOS that I never read, never signed, and was never sent.

Windows, your phone, and youtube takes more data & way more valuable. Minecraft's required data includes: User & Client ID, Minecraft Session ID, Game Version, OS, Platform, If it is a Modded Client, Launcher Name, Event Timestamp (UTC) [No idea what it is but it's very probable that not important to us], if you opted in for sending more data, World Session ID, if the internal / external server you are playing is modded, the type of server, the gamemode, and Realms Map Content, Time since Load (Seconds & Ticks)
None of that is personal info about you, the most "critical" information would be User / Client ID, and you can't do meaningful shit with it. Not all kinds of Telemetry are bad, it's the data they recollect from you, does that mean that is good for Minecraft to collect info of your play session without being able to opt out? No. It is horrible? Also no, you can use this info to know which updates make a higher spike in players or stuffs like that, idk i've never used telemetry, but just wanted to clarify that NOT ALL of it it's bad.

What I would LOVE this to result in is the EU to get involved for Sweden improperly implementing article 47, that would hopefully lead to them applying more scrutiny to companies BEFORE consumers have to spend their time on it.
I hate that the legal system is reaction based rather than audit based. It should never be on a broke consumer to challenge a trillion dollar company in court. The company should be doing the right thing on pain of being nationalised.

As someone who has studied a bit of EU law, I'm not convinced that consumer law would have any influence on the relations between Mojang and commercial servers. A commercial server would by definition not be a consumer under EU law. As far as I can tell he would still be able to run this server, as long as it didn't have monetization. He's confusing the system by trying to both sue as a company and a consumer, which have wildly different protections. It's hard to tell if this would be a violation of the charter, without seeing what he actually argued to his state. I'll reserve my anger against the swedish government for now.

In all jurisdictions there are hierarchies of legal systems to prevent the enforcement of contracts that are: “I’m allowed to murder your family and you’re aren’t allowed to take us to court”.
In Europe, Humans Rights legislation is high up the chain and there an article which includes consumer protection in a limited capacity. If the T&C breach this; then the ‘you can’t sue us’ clause is worth null.
They know these clauses are unenforceable, but putting them in anyway means you'll have to dispute them in court to escape them, which 99.99% of consumers are not willing to do.

The bit about all of the gambling addictions really hurt and is making me think just what the Australian news would do with that information. Gambling is a HUGE problem here - if people found out their kids are gambling in a kids game despite it being illegal and Mojang know it’s happening but aren’t doing shit, then they would get slammed.

They "shut down" my account because it was created in 2010 with just a username and i couldn't transfer it to a Mojang account because I "didn't have a receipt". It was a gift. And the person who gifted it to me didn't have that receipt anymore. I told them. They didn''t care. I tried it 2 more times. They didn't even try to resolve it. Goodbye my account I guess.
I transferred to a microsoft acount when we were forced to. Next day i got logged out of the launcher, tried to log back in and it said the account did not exist. I contacted mojang support and they said it's microsoft's problem, microsoft support said it's mojang's problem.

Getting rid of C418 was a disaster for the vibe of the game that they refuse to address. They've been creatively bankrupt for years. Now of course the suits are by far the more egregious side of this, yeah, but at this point they just can't seem to do _anything_ right anymore.

4:50 The thing is, changing a legally binding agreement after signing it, without getting consent from both parties, is also illegal in the USA. It's just big corpos can keep lawsuits going forever until the people suing them give up. There are also rules here about what can and cannot be in such agreements, and only a few years ago a court rules some EULAs non-enforceable.

You should really try push the idea of people donating a small amount each. When people hear "Please donate to my gofundme" they immediately think about donating €10+, and frankly, most people aren't bothered to donate that much money. But if you push for every to just donate €1, then far more people will donate and you'll have a far better shot at reaching your goal. Also try reach out to bigger content creators for them to promote the video and gofundme, hope something comes of this

They already put basically as much as possible in T&C and then add some more just for good measure as it pretty much never hurts a company and can be beneficial even if 90% of it won't hold up in court. Some of it will hold up and with how much they toss in there it usually doesn't look good for consumers and there is also the cost of paying lawyers to go through all those Terms and conditions if you actually want to bring a case against the company.

What I cant believe is I bought my wife a Java edition account like, 7 years ago. We played for awhile. Then she never played again. Last week we sat down to lay a world on LAN and she had to buy the game again. Why? Why wasnt there a way for her to play at least on the versions that were available from before and locally only?

@@titanpolus5088 I think it was 3 or 4 years ago that they migrated accounts or something and said that anyone that didn't login with a certain short time frame would lose access. It was really stupid. I did migrate my account, but I haven't played since then anyway. It left a bad taste in my mouth and I've since found better games including a game that's a better Minecraft imo. Vintage Story is amazing and I highly recommend it.

Mojang is Swedish but they’re owned by a US-based corporation. Couldn’t they just move the Minecraft IP up the Microsoft food chain, outside of Mojang’s legal scope, so that, legally, Mojang wouldn’t own Minecraft, the direct way that they do now?
Judging by the TOS, Microsoft currently owns Minecraft’s brand (the name, logo and its packaging), while Mojang retains the rights to the game itself (all of the code and game assets, except music).
