I guess you could maybe argue his reaction was to swerve around the car by going into the other lane... but the car pulled out so quickly. However, maybe should've anticipated it.
Merc is visible at 5:41, pulls out at 5:42 and the crash happened 2 seconds later at 5:44. The average human reaction time is about 500ms, probably less but let's be generous. This dude started honking right before crashing, let's say it was about 1.5 seconds after the merc pulled out. An impressive reaction time that's 3 TIMES SLOWER than average. I get that we might get distracted behind the wheel but I think he got lucky. Could have been a kid crossing the street. Here's to him taking what happened as a lesson
I would actually say yes. He actively started steering before slowing down. First thing should be brake. I’ve seen a few videos where people have swerved into the other lane and caused more carnage because of it. Brake always comes first, it seems that’s not the case anymore with more and more horn hogs. ABS exists for several reasons, controllability being one! Most clips go like this: “oh”, horn, steer, brake (sometimes accelerate). Bang “oh you t**t” Brake, steer (hopefully avoid) then horn? Surely?

There is no doubt the mini-bus driver is at fault, for entering the roundabout and crossing the first exit unsafely. But given how much time Harvey had, and that he clearly failed to be alert and react to the situation in a reasonable time and manner, they probably won't get much push back if they want to claim 50/50 responsibility. There is a chance that if pushed, they could successfully argue Harvey was more at fault because of his serious lack of appropriate response. Regardless of the outcome, they need their heads knocking together to wake them up; and perhaps a driving safety course.

I think we established from the full clip (there was a second one by the same driver that week) that the lights were malfunctioning and both had green. The second clip showed him driving down the road in the direction of the black car and two cars seemingly having a green to pull out from the same side road he was coming out of in this clip.
The camera 100% had the green light and the lady ran a red. But if the lights were malfunctioning, then who's to blame anyway though? Pretty sure the lady had the giveway markers on the road, so during a malfunction she should've stopped (just like the red car in the camera stopped which proves the lady ran a red)

The red car is stopped as they do have a red but their light is for left turn only and they will have a red while the black car has green so traffic can turn right from that direction. The cammer submitted a second clip that was on the same episode showing he had a green and cars from the side lane where he was coming out in this clip started to pull out, indicating both had green at the same time. In terms of fault, the council could well be sued for the costs for not maintaining the road but it might end up 50/50 with insurance as he did pull out in front of an oncoming car rather than proceeding with care.

Thing is the guy in the white car wasn't to blame. The road markings at 20:58 show he's actually in the correct lane. The arrow marks show both left turn and straight ahead. The merge didn't work because the white van tried to overtake when he should have held back.

5:39 adds68 has a very fishy clip. You had plenty of time to slow and stop, and it also seems to me like you swerved in to the Mercedes as oppose to away from them. You turned right, in to the car when you should've turned left in to the junction they pulled out from. Your camera is now evidence of you forcing an accident. There is no reason for anyone to turn in to the car they are trying to avoid. You had plenty of room to go around the back or just stop. Insurance would love to see that footage I'm sure.
(I'm not adds68 but) I don't think it's that clear cut, things are closer than they show, he probably assumed the other person had simply overshot and would stop in which case swerving to the right away from the pavement and pedestrian was the right thing to-do. Maybe in perfect circumstances he could of avoided, but 0% his fault and 100% the fault of the car coming into traffic. Put in the same circumstance, would you rather have car crash and 0.001% of killing pedestrian, or swerve left as you suggest and have 1% chance of hitting pedestrian?

Myself, I would've seen a Mercedes driver pulling out on me and would've just stopped there with room to spare. adds68 carried on for a second, then when the Mercedes was well out you can see adds68 turn slightly towards it. Towards the centre white lines and oncoming traffic. The Mercedes stops and at the very last second adds68 turns in to the Mercedes even more. Look where their car ended up with regards to the centre white lines. I understand that maybe adds68 just didn't think the Mercedes would pull out, but they did. We are taught to anticipate things like this on the hazard perception part of your driving test. I also understand that no one turns in to an object they do no want to hit. It is a fact that adds68 turned in to that Mercedes at the very last second, for no explicable reason. Anyone in their right mind would've turned to the left to try and go round the back.

There are 3 things I learn from watching these. 1, 80/20 its the person with the Dash Cam's fault 2, I have lost brain cells watching these 3, It makes me a better driver and now I know what to look out for in when I'm driving

Nailed on that the driver was distracted doing something they probably shouldn’t have been, no way you could be driving there paying attention and not see that car pulling out.
Bus driver was focused on going through the light, the scooter braked far too sharply reacting because of the lights, bus being big doesn't stop straight away, bang. It's happened to me before whilst driving, someone has just slammed on cos the lights have changed to amber and I've nearly hit them. (I'm a bus driver) The driver yes was following far too close, closer than I personally would've been, but... sometimes we go through amber lights to stop sending Margret in the wheelchair bay flying down the bus at 30 mph.
The first clip is a good example of how life can be unpredictable and change in a split second. One moment your walking home from the shop, a second later there's a car rolling toward you.
He had what... 3 sec to even start slowing down, and yet still took like 6 or 7 sec to avoid the danger. Any other person would've safely stopped in the wet unlike him.

Thing is the guy in the white car wasn't to blame. The road markings at 20:58 show he's actually in the correct lane. The arrow marks show both left turn and straight ahead. The merge didn't work because the white van tried to overtake when he should have held back.
@@johnstephenson6231 Correct - this is the A24 roundabout. the white 'car' was actually in the correct lane, the white van is not. there's another exit further round the roundabout which is what the right lane is for.
5:39 adds68 has a very fishy clip. You had plenty of time to slow and stop, and it also seems to me like you swerved in to the Mercedes as oppose to away from them. You turned right, in to the car when you should've turned left in to the junction they pulled out from. Your camera is now evidence of you forcing an accident. There is no reason for anyone to turn in to the car they are trying to avoid. You had plenty of room to go around the back or just stop. Insurance would love to see that footage I'm sure.

(I'm not adds68 but) I don't think it's that clear cut, things are closer than they show, he probably assumed the other person had simply overshot and would stop in which case swerving to the right away from the pavement and pedestrian was the right thing to-do. Maybe in perfect circumstances he could of avoided, but 0% his fault and 100% the fault of the car coming into traffic. Put in the same circumstance, would you rather have car crash and 0.001% of killing pedestrian, or swerve left as you suggest and have 1% chance of hitting pedestrian?

@@randgate I thought the same at first, then I watched it again a couple more times before commenting. Myself, I would've seen a Mercedes driver pulling out on me and would've just stopped there with room to spare. adds68 carried on for a second, then when the Mercedes was well out you can see adds68 turn slightly towards it. Towards the centre white lines and oncoming traffic. The Mercedes stops and at the very last second adds68 turns in to the Mercedes even more. Look where their car ended up with regards to the centre white lines. I understand that maybe adds68 just didn't think the Mercedes would pull out, but they did. We are taught to anticipate things like this on the hazard perception part of your driving test. I also understand that no one turns in to an object they do no want to hit. It is a fact that adds68 turned in to that Mercedes at the very last second, for no explicable reason. Anyone in their right mind would've turned to the left to try and go round the back.

KJ answered above - The update came from the original video. The cam car driver said he went after her but she'd disappeared. The Police found her some time later and apparently her father paid for the damage and took her to the dash cam driver to apologise. Karma. 👍😀

I had a claim against a paramedic who was overtaking on a hill with double white lines and knocked me off my motorcycle and when it come to a head they deemed his driving safe laughable really I understand you got an emergency to get to but doesnt mean you can drive like a twat.

On the original clip, the cammer submitted a second clip of him driving in the direction the black car came from and a car pulling out from the side road when he had green as well, the implication was that the lights were faulty and both showing green

Nailed on that the driver was distracted doing something they probably shouldn’t have been, no way you could be driving there paying attention and not see that car pulling out.
So could mine and she's been dead 30 years and never had a license.
Bus driver was focused on going through the light, the scooter braked far too sharply reacting because of the lights, bus being big doesn't stop straight away, bang. It's happened to me before whilst driving, someone has just slammed on cos the lights have changed to amber and I've nearly hit them. (I'm a bus driver) The driver yes was following far too close, closer than I personally would've been, but... sometimes we go through amber lights to stop sending Margret in the wheelchair bay flying down the bus at 30 mph.
