  • Sen. Dick Durbin, D-Ill. questioned Judge Amy Coney Barrett on Oct. 14, the third day of the Senate Judiciary Committee’s Supreme Court confirmation hearing. "You are the first nominee for a vacancy on the Supreme Court to be considered after July 1 of the election year. … The obvious question is: Why? What’s the hurry? Why couldn’t we wait until the end of November, or December or even January?” Durbin asked. He added that the "orange cloud” hanging over Barrett’s nomination is President Donald Trump’s desire to fill the vacancy with a justice who might vote to overturn the Affordable Care Act when the court hears a challenge to the ACA on Nov. 10.
The hearing came about three weeks before Election Day. The third of four days of scheduled testimony gave senators another opportunity to ask Barrett about her record and approach to the law.
