Surpricingly in these kind of taped clear violations they usually admit the guilt and make a deal, cause they know for sure that in court they will lose and lose more money. Ofcourse the individual cops rarely get any punishment, week paid leave or similar.
It used to work on the UK. Police from a different force would do any investigations needed, like Essex police would look into Lancs Police, Cambs police would look into Sussex police. They didn't know each other and would have nothing to gain and everything to lose if they didn't do a good job. It's now done by the Collage of Policing and, lets say, things are not going so well
The cop will have to do a mea culpa and a week off without pay with the understanding that when he returns he'll get unlimited overtime and a promotion next year. The innocent taxpayers will have to pay any settlement, and life will go on as if nothing happened.

How can he pass a physical for law enforcement but be disabled to the point that he gets more than 50% of his military pay? FYI, at 20 years, a person can retire from the military and receive 50% base pay. 26 years you max out at 75% of your base pay. If he is getting disability pay, after 20 years of service he didn't retire, he chose disability because it could be more.

Indeed. HOWEVER, please keep in mind, our Constitution, and 'Bill of Rights' specifically, does not "allow" us our freedoms and liberties. These 'rights' come to us naturally and are inalienable. Our Constitution merely recognizes and enumerates these rights - which we already retain due to our mere existence. Many tell me this is quibbling, but I believe it is a very important distinction. After all, what the Constitution grants to us - could also be taken from us, via the amendment process. This is NOT the case with 'rights' that are inalienable. No person, government, entity nor law can take them from us! Those that don't understand this distinction (not claiming this of you) don't truly understand freedom.

Officers only have immunity if they are acting within the law and under department policy. Having said that what was shown on the video was disgraceful on the part of the officers. I know they wouldn't speak to "Sovereign Citizen" or "BLM" protester like that. I would like to see the entire video.

A quick glance at the original videos shows the myriad civil rights violations as clear as day. Cops roll up on Mr. Gray thinking that he is homeless and therefore either ignorant of his rights and/or financially lacking in the capability to file a lawsuit. So, they do as they please. No sympathy for the cops here should Mr. Gray get their qualified immunity removed.
This reporting was skewed in my opinion. They should have said that the cops are "self proclaimed" law enforcers. The piece in no way gave credit to the important work that Jeff is doing in teaching hundreds of thousands of people about their rights. Keep in mind that the government doesn't want us to know our rights because once we do we will be more likely to demand transparency and accountability. That is the last thing that they want. A roach is more likely to ask someone to turn on the lights before cops will want true transparency.

What I would like to see is people doing this full time for a living. Go do a civil rights investigation. Videotape said investigation to collect evidence. Once clear and convincing evidence is collected file a civil rights lawsuit. Take proceeds from said lawsuit to fund further investigations. Rinse and repeat. Since this is clearly established law these cowards wouldn't have qualified immunity to hide behind and once they start losing their possessions they may start to change the culture of the corrupt police departments that we are force to financially support at this point.

Sadly, every day in the US, dozens or hundreds of times a day, members of law enforcement violate peoples civil rights. Now the sad thing is that most people do not even know their rights so the cops get away with it. People like Jeff are not really trying to educate the police, they are trying to show us what our rights are, and how to use them. If everyone knew their rights (like the right to refuse to let them search you or your vehicle during a traffic stop) and used them, then in time, cops would all know that they could not strong arm people into letting them tear apart their cars at traffic stops. The real sin here is that kids can go to school for 12 years and learn the words of the constitution, but not really learn how they actually apply to them every day of their lives. It is a miserable failure of the education system. They should be showing vides like these in the classroom to bring the words to life.

An individual cannot be trespassed from public property unless they’ve committed a crime. These cops need to be held accountable for their actions. As a gulf coast resident I was shocked and embarrassed watching the behavior of both officers. The officers should be fired and the mayor recalled for lying. We watched the entire video and he never once did anything inappropriate or illegal. In south MS we respect the US Constitution and do not tolerate law enforcement acting outside of the law like bullies and thugs.
You, as a resident, need to vote out that Mayor then. Attend city hall meetings and demand accountability and justice. Vote out anyone who opposes it, and take notice of who they are, and who they vote for.

City Property is public property and a lot of cops don't know that. Even though Jeff doesn't take money. Does the First Amendment protect panhandling? Yes. As the Willis Court explains, the U.S. Supreme Court has held that the First Amendment covers “charitable appeals for funds.” Because of this, panhandling, solicitation, or begging are protected speech under the First Amendment.

It has ruled that direct solicitation by charitable organizations is free speech but not sidewalk appeals for funds. In fact, in Young v. New York City Transit Authority (2d Cir. 1990), the Court declined to hear an appeal challenging a New York City regulation prohibiting begging in the city’s subway system. In International Society for Krishna Consciousness v. Lee (1992), the Court upheld prohibitions on solicitation at a state fairground, on sidewalks outside of a post office, and within an airport terminal. the 7th U.S. Circuit Court of Appeals in Norton v. City of Springfield (7th Cir. 2016) invalidated Springfield, Illinois’ panhandling ordinance as unconstitutional. Springfield’s ordinance banned only oral requests for immediate money but did not address signs requesting money or oral requests for money later, but that is the 7th Circuit, so it only applies to Illinois, Indiana and Wisconsin. A great deal depends on the way the law is written. It cannot be overly broad, but if you say that Panhandling is not allowed in city parks or buildings, or that aggressive panhandling such as badgering a person continually or being abusive, then that law would likely survive. In Jeffs case shown here though, it was clear that he was not panhandling and that he was on the sidewalk in front of a government building, what the Supreme Court has considered venue for the exercise of free speech. So, it is complicated and one would do very well to look specifically at the state and federal circuit laws on panhandling because the Supreme Court has never ruled that panhandling is 100% protected by free speech. It is clear here though that Jeff was 100% within his rights and equally clear that the cop had zero respect for the 1st Amendment of the constitution, and that the mayor has low ethics.

End qualified immunity! Police behave this way because they know they will not be held responsible for their actions! No other profession gets to behave this way and have no consequences. Police do not have qualified immunity when it comes to the 1st, 2nd, 4th, 5th, and 14th amendment. They are expected to know these rights because they swore an oath to them. Now that being said, while they can be sued for deprivation of rights (and often are, with the individual here being someone that regularly does it), the cops never pay out of their pockets. The small cities have insurance for this (large cities counties and states generally self insure) and the taxpayers pay. There is no qualified immunity for civil rights violations though. Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States, and the civil lawsuit code is 42 U.S. Code § 1983 - Civil action for deprivation of rights. No cop is immune to these federal laws. About 3 years ago, Colorado passed a law allowing citizens to directly sue police in state court, which had not been possible in the past. They did this because it made it far easier and less expensive for people that have their rights violated to sue. By the way, cops are almost never charged under Section 242 of Title 18. The federal government usually does not charge unless police or agents were malicious, or used force inappropriately, but even with use of force, the only time the feds usually act is if the state fails to act and it is rare for them to charge someone if the state has already charged them (many people think that you can't be charged twice, but you can. The state law is different from the federal law so you are actually charged with two different crimes, one federal and one state, but it is very rare for this to happen, though in really serous cases, it has happened.)_

I was forced to memorize the Bill of Rights, and my grade was based on how well I could regurgitate the words. At no time did a teacher actually take the time to give real world examples of how this actually applied to day to day life. Every day in the US, people are told that when a cop asks them for ID, that it is a crime not to give it, and clearly it is not a crime to withhold your ID unless there is articulable reason that you have committed, are committing, or are about to commit a crime. Even in states with "Stop and ID" laws, there still must be reasonable articulable suspicion of a crime for the demand for ID to be legally enforceable, but cop force people to do it and people comply because they really don't know that according to the 4th Amendment, they don't have to. Every day in the US, cops tell people that they have to get out of their vehicle so that the cops can do search, or they believe that they have to consent to a search when they can say that they do not consent to the search. Cops tell people that they have to answer questions at a traffic stop, and you do not have to answer questions at any time without a lawyer present if you choose not to. So, from where I sit, the foundational problem is that cops, like so many others in the US, just don't know what the constitution really means, or they are afraid to stand up for their rights so they cave. If everyone stayed silent during trafffic stops, if that was the actual norm in the US, then cops would stop wasting our time and wright us a ticket, and let us be on our way, rather than play word games and look for a way to justify a search of the vehicle. It isn't cops that are broken, it is the education system in the US.
The entire purpose of the First Amendment is so that people CAN voice their concerns DESPITE people's feelings. If no one ever offended anyone with their comments, the First Amendment would not be required.

Surpricingly in these kind of taped clear violations they usually admit the guilt and make a deal, cause they know for sure that in court they will lose and lose more money. Ofcourse the individual cops rarely get any punishment, week paid leave or similar.

It used to work on the UK. Police from a different force would do any investigations needed, like Essex police would look into Lancs Police, Cambs police would look into Sussex police. They didn't know each other and would have nothing to gain and everything to lose if they didn't do a good job. It's now done by the Collage of Policing and, lets say, things are not going so well
The cop will have to do a mea culpa and a week off without pay with the understanding that when he returns he'll get unlimited overtime and a promotion next year. The innocent taxpayers will have to pay any settlement, and life will go on as if nothing happened.

How can he pass a physical for law enforcement but be disabled to the point that he gets more than 50% of his military pay? FYI, at 20 years, a person can retire from the military and receive 50% base pay. 26 years you max out at 75% of your base pay. If he is getting disability pay, after 20 years of service he didn't retire, he chose disability because it could be more.

Our Constitution merely recognizes and enumerates these rights - which we already retain due to our mere existence.
Many tell me this is quibbling, but I believe it is a very important distinction. After all, what the Constitution grants to us - could also be taken from us, via the amendment process. This is NOT the case with 'rights' that are inalienable. No person, government, entity nor law can take them from us! My father fought people like these cops for three years in Europe during World War II. The people over there were more honest, though they actually wore the swastikas on their arms so everyone knew who they were.

A quick glance at the original videos shows the myriad civil rights violations as clear as day. Cops roll up on Mr. Gray thinking that he is homeless and therefore either ignorant of his rights and/or financially lacking in the capability to file a lawsuit. So, they do as they please. This reporting was skewed in my opinion. They should have said that the cops are "self proclaimed" law enforcers. The piece in no way gave credit to the important work that Jeff is doing in teaching hundreds of thousands of people about their rights. What I would like to see is people doing this full time for a living. Go do a civil rights investigation. Videotape said investigation to collect evidence. Once clear and convincing evidence is collected file a civil rights lawsuit. Take proceeds from said lawsuit to fund further investigations. Rinse and repeat. Since this is clearly established law these cowards wouldn't have qualified immunity to hide behind and once they start losing their possessions they may start to change the culture of the corrupt police departments that we are force to financially support at this point.

Sadly, every day in the US, dozens or hundreds of times a day, members of law enforcement violate peoples civil rights. Now the sad thing is that most people do not even know their rights so the cops get away with it. People like Jeff are not really trying to educate the police, they are trying to show us what our rights are, and how to use them. If everyone knew their rights (like the right to refuse to let them search you or your vehicle during a traffic stop) and used them, then in time, cops would all know that they could not strong arm people into letting them tear apart their cars at traffic stops. The real sin here is that kids can go to school for 12 years and learn the words of the constitution, but not really learn how they actually apply to them every day of their lives. It is a miserable failure of the education system. They should be showing vides like these in the classroom to bring the words to life.

so called 1st amendment activists are getting our rights restricted, they abuse our rights under the first amendment, they go out and harass public employees to get police called, they do this for two reasons, to get clicks and views on youtube to get paid by them and then there is those who do this to file a lawsuit, these people are grifters and scammers abusing our rights under the first amendment, a prime example of this is a channel called DELTE LAWZ a so called auditor who goes around filing lawsuits on cops and anyone that deposes them... decastro v abrams
then we have those who intentionally film private business and stand there filming through a window to get attention which they get, sometimes a member of the public gets angry and confronts them and then the auditor sprays them with pepper spray claiming to be in fear of their lives... they ALL do this for clicks and views on social media, then there are those who fake content one such person was a guy called patrick roth aka newsnowpatrick who got a securtity guard freind to assault him for the camera but he got caught out as we saw the same securty guard in his next video, also roth and newsnowomaha again they set up the police and they got caught out and charged it was on the news...

As a gulf coast resident I was shocked and embarrassed watching the behavior of both officers. The officers should be fired and the mayor recalled for lying. We watched the entire video and he never once did anything inappropriate or illegal. In south MS we respect the US Constitution and do not tolerate law enforcement acting outside of the law like bullies and thugs.
You, as a resident, need to vote out that Mayor then. Attend city hall meetings and demand accountability and justice. Vote out anyone who opposes it, and take notice of who they are, and who they vote for.

City Property is public property and a lot of cops don't know that. Even though Jeff doesn't take money. Does the First Amendment protect panhandling? Yes. As the Willis Court explains, the U.S. Supreme Court has held that the First Amendment covers “charitable appeals for funds.” Because of this, panhandling, solicitation, or begging are protected speech under the First Amendment.
Willis was a Washington State Supreme Court case.

@@KP_Nation Sadly, a state supreme court ruling does not apply outside of that state. In fact, there is no Supreme Court ruling that specifically protects panhandling. It has ruled that direct solicitation by charitable organizations is free speech but not sidewalk appeals for funds. In fact, in Young v. New York City Transit Authority (2d Cir. 1990), the Court declined to hear an appeal challenging a New York City regulation prohibiting begging in the city’s subway system. In International Society for Krishna Consciousness v. Lee (1992), the Court upheld prohibitions on solicitation at a state fairground, on sidewalks outside of a post office, and within an airport terminal. the 7th U.S. Circuit Court of Appeals in Norton v. City of Springfield (7th Cir. 2016) invalidated Springfield, Illinois’ panhandling ordinance as unconstitutional. Springfield’s ordinance banned only oral requests for immediate money but did not address signs requesting money or oral requests for money later, but that is the 7th Circuit, so it only applies to Illinois, Indiana and Wisconsin. A great deal depends on the way the law is written. It cannot be overly broad, but if you say that Panhandling is not allowed in city parks or buildings, or that aggressive panhandling such as badgering a person continually or being abusive, then that law would likely survive. In Jeffs case shown here though, it was clear that he was not panhandling and that he was on the sidewalk in front of a government building, what the Supreme Court has considered venue for the exercise of free speech. So, it is complicated and one would do very well to look specifically at the state and federal circuit laws on panhandling because the Supreme Court has never ruled that panhandling is 100% protected by free speech. It is clear here though that Jeff was 100% within his rights and equally clear that the cop had zero respect for the 1st Amendment of the constitution, and that the mayor has low ethics.

Police do not have qualified immunity when it comes to the 1st, 2nd, 4th, 5th, and 14th amendment. They are expected to know these rights because they swore an oath to them. Now that being said, while they can be sued for deprivation of rights (and often are, with the individual here being someone that regularly does it), the cops never pay out of their pockets. The small cities have insurance for this (large cities counties and states generally self insure) and the taxpayers pay. There is no qualified immunity for civil rights violations though. Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States, and the civil lawsuit code is 42 U.S. Code § 1983 - Civil action for deprivation of rights. No cop is immune to these federal laws. About 3 years ago, Colorado passed a law allowing citizens to directly sue police in state court, which had not been possible in the past. They did this because it made it far easier and less expensive for people that have their rights violated to sue. By the way, cops are almost never charged under Section 242 of Title 18. The federal government usually does not charge unless police or agents were malicious, or used force inappropriately, but even with use of force, the only time the feds usually act is if the state fails to act and it is rare for them to charge someone if the state has already charged them (many people think that you can't be charged twice, but you can. The state law is different from the federal law so you are actually charged with two different crimes, one federal and one state, but it is very rare for this to happen, though in really serous cases, it has happened.)_

I was forced to memorize the Bill of Rights, and my grade was based on how well I could regurgitate the words. At no time did a teacher actually take the time to give real world examples of how this actually applied to day to day life. Every day in the US, people are told that when a cop asks them for ID, that it is a crime not to give it, and clearly it is not a crime to withhold your ID unless there is articulable reason that you have committed, are committing, or are about to commit a crime. Even in states with "Stop and ID" laws, there still must be reasonable articulable suspicion of a crime for the demand for ID to be legally enforceable, but cop force people to do it and people comply because they really don't know that according to the 4th Amendment, they don't have to. Every day in the US, cops tell people that they have to get out of their vehicle so that the cops can do search, or they believe that they have to consent to a search when they can say that they do not consent to the search. Cops tell people that they have to answer questions at a traffic stop, and you do not have to answer questions at any time without a lawyer present if you choose not to. So, from where I sit, the foundational problem is that cops, like so many others in the US, just don't know what the constitution really means, or they are afraid to stand up for their rights so they cave. If everyone stayed silent during trafffic stops, if that was the actual norm in the US, then cops would stop wasting our time and wright us a ticket, and let us be on our way, rather than play word games and look for a way to justify a search of the vehicle. It isn't cops that are broken, it is the education system in the US.
