    Hello Sir,
    If a person went outside the US office on a special assignment for the same company for a year but still managing employees in the US office, can it be considered a Managerial role outside the US office?

    I have total 10 years of experience as a project manager at offshore.
    But I have just 10 months of managerial experience in the sister company (offshore) before I came to US on H1B who filed my H1B and ready to file my EB1C.
    Can you help to understand am I eligible for filling EB1C?

    Hi Mr. Murali- does the 1 year Managerial experinece with the parent company has to be outside US only? for example would people hired within the US at Managerial level still qualify under this category? please let me know. Thanks.

    So no matter if you are l1a or l1b, you need to be in a managerial position outside US for 1 year ?

    Hi, My spouse came to US in dec 2015 and he got promoted as an Assistance manager in the same company and he worked in US as a Assistance manager for more than a year. Then in Jan 2019 our petition got denied and we went back to india. Then we filed our petition in dec 2019 and it got approved in march 2020. But due to covid and National shut down, we didn't get a chance to go for a stamping. Then in Jan 2021 again we filed our petition and got approval in april 2021. And we recently moved to US on march 31st 2022. So, the duration he spent in india 2019 to 2022, he worked for the same client and the company and Even returned for the same company and the client. So, do you think he is qualifying for the EB1c category? As, he's been working in IT Multinational company with a same client and he done his master in MCA with 12+ years of experiences in IT.

    Hi M Bashyam, Can the employee aggregate employment time during the preceding three-year period in order to attain the one-year requirement on Eb1C?
    I worked for 9 months outside USA and move to USA, if employee complete the 3 months again outside USA will it meet the one-year requirement to file the case in Eb1C. Would be happy to hear from you and get the expertise.

    My L1 (5 year ) is due for it's final expecting (year 6&7) this December...
    However the numbers have been bad due to CoVid
    The foreign entity remains committed, to restructure and re- built the business.
    How can the extension be supported in view of lack of progress.

    Hi, I came to USA on L1b in April 2016 and then moved to H1B in sept 2019 in the same company.I travelled to India for 1 month for H1B visa stamping in Nov 2019 and retired in Dec 2019.My company filed for GC in EB2 in year 2020, I got my I-140 approved in Year 2021. Before coming to USA I worked for the same company in India form July 2013 to April 2016 as a manager. I am manager in USA. But my company is not filing my GC in EB1c saying that your petition for GC in EB2 was filed in Dec 2019 and your latest entry to USA was in Dec 2019, thus three in one year period criteria for foreign employment is not met because three years prior to petition filing date i.e., Dec 2019 you were in USA and not in foreign country. I am totally confused now. Am I eligible for EB1c or not? please clarify.
