      The stupidity here is you not understanding how the 3 branches of government work. Supreme Court cannot pass laws but it’s the sole body responsible for interpreting laws. Parliament which is the Legislature passes laws but it cannot interpret the laws. Get a book on democracies older than 100 years and you may learn a thing or two.

    A simple question that can resolve the present controversy in Parliament in respect of the four vacation of parliamentary seats.
    Question:
    *When should a Member of Parliament vacate his seat. Is it during his present term in office or during his probable future term in office, should he win the future election?*
    Article 97 clause 1, paragraphs g and h of the constitution of Ghana.
    1) A member of Parliament shall vacate his seat in parliament -
    (g) if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seeks to remain in Parliament as an independent member; or
    (h) if he was elected a member of Parliament as an independent candidate and joins a political party.
    If it is argued that the member of parliament must not vacate his present seat but rather vacate a future seat if he probably wins a future election, then it would imply that, immediately he is declared a member of parliament in future, he must immediately vacate his seat, so that another election is organized for him to probably win again.
    This view would amount to causing other parliamentary candidates (including the political party candidates to contest the same elections twice) and to what end?
    If this view is upheld, it would also imply that a member of parliament who becomes the Speaker of Parliament, must not vacate his present seat in parliament but rather vacate a probable future seat in parliament.
    It would also imply that upon dissolution of parliament, members should vacate their probable future parliamentary seats.
    *Second follow-up question*
    In the context of this discussion, at which point, can it be conclusive that a member of parliament has either left his political party or joined a political party (if he was initially independent) ?
    *Answer to question two*
    The time of leaving the political party or joining one (if he was independent) occurs before the end of the present term of parliament.
    The time of filing for candidacy with the Electoral Commission is therefore reasonably conclusive as the time that he has left his political party or joined a political party (if he was independent).
    *Final question*
    Should a political party be the only one to report that a person is no longer a member of the party?
    *Answer*
    In this context, any citizen can point out or report a wrongdoing
    *Summary*
    Article 97 is clear that the parliamentary seat to be vacated is the present seat and not a future probabilistic seat.
    The time of filing for candidacy with the Electoral Commission contrary to his "present status in parliament" is therefore the reasonable conclusive evidence that a member of parliament has either left his party, or joined a party (if he was independent); *and must therefore vacate his seat with immediate effect*_

    It is interesting how a certain section sets its own question with answers. The Supreme court has no powers over the legislature, but has sole jurisdiction over interpretation of the constitution. When it clarifies the rules that becomes binding on all.

    Host, Dzata is confused in his argument, Bagbin is confused in his declaration and Majority Leader is also confused in the mist, that is why the Supreme Court comes in to resolve the issue once and for all.     From a common sense point of view. 1) the speaker cannot declare a seat vacant simply because an MP has decided to cross carpet to an opposition or become an independent MP. The spirit of this is visible in many countries when this happens. 2) if we are saying Ghana is different, then it is for the country's supreme Court to say so. 3) a party can sack an MP from its party but cannot sack them from parliament, because once elected as an individual by the people, only the people can choose another at another election. 4) Ghanas constitution does not explicitly say that a seat should be declared vacant should an MP cross carpet.. 5) are we saying all those MPs who lost their primaries and cannot participate on the ticket of their parties for the next elections are no longer MPs currently?

      So are you saying you can hide under the ticket of a party to get what you want and dump the party?. You are a member of Parliament for a constituency in a ticket of a party or independence. If you go independence and win and you decide to join a party per common sense and logical reasoning it should be known to your voters and there should be a provision for them to endorse your stand. You cant just do it as you want and come back to seek for their votes again

    There is no arm of government which is 100% independence. This means, you can use your position to bring your opponent down. What the supreme court had said is final. No one can change it. Anything that you say is like a spectator speaking.

      In Atto Forsen's case, AG was not having any evidence to support his case. But in this current case everybody including u knows that the court was totally doing an assignment for the NPP and President. But the court has rather worsen the case. At first place, the supreme court should hv thrown out the case and refer it to the high court.

    The loud and uninformed Sam George is at it again. In a Constitutional Democracy, the Judiciary makes the laws but the sole interpretation of the laws is left to the Supreme Court. The Supreme Court cannot pass laws, the reverse is the Judiciary cannot interpret it’s own laws…that’s a conflict of interest that democracies around the world avoid. Sam George is very boisterous and lacks basic understanding of the tenets of a democratic system.
