The people suing Midway might have actually had a leg to stand on. Had their contract stated that their performance would only be used in arcades. And that releasing the games on home consoles voided this contract. But it was more slightly that there paid for just the performance in general, and midway was free to use it anyway they saw fit. And the rock band thing was just in very bad taste.

In a way Pesina did something clever, by making Midway themselves argue in court that he is not a recognizable part of the series, they gave tacit permission for him appear in other things dressed as his character from the series.

Initially, the game was only gonna be made into 20 cabinets, that's why he never thought much of checking a contract. At least he's doing good now making appearances in Cons and he has a dojo.
One more relating to the last one on the list, how about someone suing over someone else's likeness? Back in 2010, Axl Rose attempted to sue Activision over the inclusion of his former bandmate Slash appearing in Guitar Hero III. According to him, he and Activison had made a deal where the Guns N' Roses track "Welcome To The Jungle" could appear in the game only if Slash weren't in the game, nor songs from Slash's band, Velvet Revolver, included, which, evidently, they were (while not in the base game, Velvet Revolver songs were included via DLC). However, the big problem for Axl was that he filed the suit in 2010, three years after the release of the game. The judge basically told him he had waited too long and dismissed the case.
Ah yeah I remember that! Activision hilariously flipped the bird at Axl’s “no Slash allowed” stipulation. They not only included Slash in the game as a playable character and put in a Velvet Revolver song, but they also put the top hat-wearing guitar legend front and center of the game’s box art, had him perform the song during the game’s campaign mode (after a duel), and included GnR and Velvet Revolver stickers in guitar controller packs for the game. They were essentially reinforcing what we all knew - Slash IS GnR and an amazing guitarist and Axl Rose was too stuck his own ass to realize it. It’s probably the only time I’ll EVER cheer for Activision.

Man, Guitar Hero (and DDR) feels like it was a lifetime ago. Like 15 years ago or more. I'm 27 and that sure was a culture flash in the pan back in middle school. That was the dying breath of arcades as a mainstream thing in the mid-2000s (in the U.S.)... which those arcade owners were likely aware of, hence the demand to flood the market to make as much as they could before bowing out. I saw someone do a comparison of lady miss keir and Ulala side by side and there was literally nothing similar about the two. Besides, Ulala was made with a number of polygons and her CG model had to be re-drawn a number of times to make sure that she didn’t look too seductive.
To give a little insight in the Lady Miss Kier court battle. The notion that people at Sega had never heard of Deee-Lite is kinda laughable. One of the members of Deee-Lite is a famous Japanese DJ and producer and Deee-Lite's early work (1990 - 1999) was heavily promoted in Japan by Warner Music and Groove is in the Heart is still being re-released to this day there.
Are you just talking about the cards? Because you could get Kadabra in pretty much every game. Only Colosseum, XD, and Black did you have to trade to get the Abra line in there. (at least according to Serebii.)

@@jprofio Wrong, the cards were owned by Wizards of the Coast in the west but due to Wizards being shady AF, they lost a ton of their third party licenses and through the lawsuits all rights went back to the people they had licensed from. Including as it so happens, Blizzard Entertainment who recycled card art for the first Hearthstone cards and made the game with similar (not entirely the same) mechanics as the old Warcraft TCG.

Even more ironically, most Japanese fans had no idea who Uri Geller was until he sued Pokemon. The spoon-bending "mad psychic" was (and remains) a common trope in Japanese media culture. I suppose it **IS** likely that the 1970s-era Japanese comedians who created this trope (including none other than Beat Takeshi, though I think The Drifters member Kato Cha was the most famous one) drew their inspiration from Geller. However, Im sure the Pokemon developers did NOT ... because the comedy-trope spoon-bender was widely known in Japan, but Uri Geller was NOT. Even today if you do a spoon-bending bit in Japan, and ask people who that reminds them of, the majority will probably say Kato Cha.

That one about Johnny Cage... I think he would have had a more compelling case if he tried to say that he and his fellow actors and actresses should have been paid royalty fees for being in the game circa the second release. This could have sparked an entire debate about how people get paid in the game industry, well before it would become relevant today.

Deee-Lite weren't one hit wonders though, their second single Power of Love/Build The Bridge got to 25 in the UK charts and they had 4 other singles in the top 75 (the UK charts company does top 100) and their second album snook in at number 37 in the UK.

You missed some critical information about the Kadabra thing. Its original Japanse name is ユンゲラ - "Yungerer." Which IS very much much based on Yuri Geller's name (Written as ユリゲラ in Japanese, I think. Note how similar the ン(n) and リ(ri) characters are). While the lawsuit is still dumb, it isn't as completely baseless as you make it out to be. Also the Abra line was never removed from the video games. The ban applied to the other surrounding media and merch - the TCG and the anime in particular. The only games they didn't appear in was Black 1 (in which it was a White 1 version exclusive), Colosseum and XD Gale of Darkness (where it could be transferred over from any of the GBA games), and pre-DLC Sword and Shield.
Yeah, to be honest I'm fairly sure in all likelihood that the naming and imaging was definitely an intentional nod to Uri Geller. The naming and symbolism for Kadabra was very on the nose about its inspiration which is the case for a lot of these sorts of things from other Pokemon and even just Japanese media in general. It's a shame he took it so personally insisting the star was some sort of Satanist pentagram and the symbols on his chest was the Schutzstaffel. Lmao.

It could have been actually great if they had the bands and artists perform some covers to be used exclusively in their games, but the idea that you can use Kurt Cobain's likeness to perform anything in the game is an absolute screw up, the fact that nobody seems to have had an issue with it is perplexing.
to me it's the wording. Activision likely said "use your likeliness as an in-game avatar" and that's the key. Avatar. Avatar as is just a character used to represent someone/a band member virtually and that's what they agreed to. Song exclusivity would have little to do with playing dress up for a song, they just get weird thinking of themselves being a Cover band

Honestly, if I was Pesina, I'd go around making appearances at events dressed like I did for playing Johnny Cage. Hell, if I was one of Midway's competitors, I'd have _hired_ him to it. Throw a lot of money at him to be shirtless in shades, advertising products competing with Mortal Kombat. Midway tries to sue for using the character's image? Nope, can't be. According to this court case over here, Daniel Pesina is not recognizable as Johnny Cage. Therefore, his appearance in other things isn't using the likeness of one of Midway's characters, and thus cannot be infringing.

Kadabra having limited exposure in the cards is pretty sad, because it basically meant that any Alakazam or Abra card they print isn't viable since there are limited ways of evolving it. Plus, Kadabra is the coolest looking out of the 3, and frankly much more interesting looking than Alakazam. Kadabra has a dinosaur/demon look to his hands and feet, but with a fox head and tail. It's a mish mash of odd characteristics that somehow work well together with tiny little flourishes with the star on its head and squiggles on its body. Alakazam grows his stache, puts on a diaper, and loses his tail. He keeps the DBZ body armor though, so it's not all bad. Hopefully now with Uri Geller's blessing, even if it may be in writing only, we can start seeing Kadabra again. The Pokemon TCG has too many good artists to deprive them from being able to officially draw the cool looking fox demon.

Dee-Lite is a fantastic group, but Lady Kier seems to have a massive ego that she hasn't exactly earned. Just look at how she trashed Todd In the Shadows's One Hit Wonderland episode on "Groove Is In the Heart" where he had practically nothing negative to say about them or her.
Funny that the marketing for GTAV marketed a very very minor character all over, though, like...they could have had Michael's daughter be in her place instead, at the very least.

Never heard of the Uri Geller vs Pokémon story, but that seems like the kind of shit Geller would try to pull. The Pasina vs Midway story is quite interesting, especially since I thought that him promoting Bloodstorm was the only reason why Midway killed off Johnny Cage and didn't use him in the games for years, but that suit probably had a lot to do with it as well.
Midway probably should have given the Mortal Kombat models a bonus or something after the game hit it big. Even if they weren't contractually obligated to do so, it would have been a classy gesture.
IMO I find nothing wrong with them not giving any extra bonus. As long as they paid the actors according to contract, they don't owe anything else. If the games bombed and Ed Boon went broke, would you expect the actors to pay some of their salary back to help him out/finance another game idea? Plus by your logic the actors should give some of their salary to the gym they pay for, because thanks to the gym, they got in shape for the role to make the game sell bucket loads. They should also pay a bonus to their acting professors (on top of the tuition they already paid) who taught them the acting techniques they used while working on the game that helped the game sell. See how silly this looks?

I can kind of see where they were coming from with the symbols on Cadabra (sp? I have never played Poke Them On). The chest symbol looks a little bit like the SS lightning bolt logo. The star on the head is a little harder to argue, given that it's not really a pentagram per se.

The only one here that I think had any sort of legitimacy behind it is the Guitar Hero one, the Space Channel 5 and GTA V ones were attempts at maintaining relevance, the Pokémon one was an obvious case of ego and the Mortal Kombat one was just ludicrous, especially how their complaint was solely about appearing in the console versions, they authorized use of their likeness for the arcade version, so there'd be no need for further authorization over a simple port. I can think of one situation, where rather than the individual (not quite a celebrity, but pretty close) getting angry over their likeness being used, they approved of their likeness appearing in the game, and it was a game from a studio this person didn't even work for. Shortly before Nioh 2's release on PS4, there was an open beta where players could submit character designs to appear as presets in the final release, one of the male presets that made it through was meant to be Square Enix's Naoki Yoshida, otherwise known as Yoshi-P, and it was pretty spot on. Team Ninja then asked him if it was alright to have his likeness in the game, and Yoshi-P wholeheartedly approved.

In a way Pesina did something clever, by making Midway themselves argue in court that he is not a recognizable part of the series, they gave tacit permission for him appear in other things dressed as his character from the series.

Initially, the game was only gonna be made into 20 cabinets, that's why he never thought much of checking a contract. At least he's doing good now making appearances in Cons and he has a dojo.

Back in 2010, Axl Rose attempted to sue Activision over the inclusion of his former bandmate Slash appearing in Guitar Hero III. According to him, he and Activison had made a deal where the Guns N' Roses track "Welcome To The Jungle" could appear in the game only if Slash weren't in the game, nor songs from Slash's band, Velvet Revolver, included, which, evidently, they were (while not in the base game, Velvet Revolver songs were included via DLC). However, the big problem for Axl was that he filed the suit in 2010, three years after the release of the game. The judge basically told him he had waited too long and dismissed the case.
Ah yeah I remember that! Activision hilariously flipped the bird at Axl’s “no Slash allowed” stipulation. They not only included Slash in the game as a playable character and put in a Velvet Revolver song, but they also put the top hat-wearing guitar legend front and center of the game’s box art, had him perform the song during the game’s campaign mode (after a duel), and included GnR and Velvet Revolver stickers in guitar controller packs for the game. They were essentially reinforcing what we all knew - Slash IS GnR and an amazing guitarist and Axl Rose was too stuck his own ass to realize it. It’s probably the only time I’ll EVER cheer for Activision.

That was the dying breath of arcades as a mainstream thing in the mid-2000s (in the U.S.)... which those arcade owners were likely aware of, hence the demand to flood the market to make as much as they could before bowing out.

I LOVED Space Channel 5 and 100% thought it seemed like a Deeelite/Groove is in the Heart ripoff but have never heard anybody else talk about this or mention it. I had no idea an actual lawsuit took place.
I saw someone do a comparison of lady miss keir and Ulala side by side and there was literally nothing similar about the two.
Besides, Ulala was made with a number of polygons and her CG model had to be re-drawn a number of times to make sure that she didn’t look too seductive.
To give a little insight in the Lady Miss Kier court battle. The notion that people at Sega had never heard of Deee-Lite is kinda laughable. One of the members of Deee-Lite is a famous Japanese DJ and producer and Deee-Lite's early work (1990 - 1999) was heavily promoted in Japan by Warner Music and Groove is in the Heart is still being re-released to this day there.
That last one is pretty crazy but also unintentionally hilarious when you think of the possibilities. 😂

@@jprofio Wrong, the cards were owned by Wizards of the Coast in the west but due to Wizards being shady AF, they lost a ton of their third party licenses and through the lawsuits all rights went back to the people they had licensed from. Including as it so happens, Blizzard Entertainment who recycled card art for the first Hearthstone cards and made the game with similar (not entirely the same) mechanics as the old Warcraft TCG.

Even more ironically, most Japanese fans had no idea who Uri Geller was until he sued Pokemon. The spoon-bending "mad psychic" was (and remains) a common trope in Japanese media culture. I suppose it **IS** likely that the 1970s-era Japanese comedians who created this trope (including none other than Beat Takeshi, though I think The Drifters member Kato Cha was the most famous one) drew their inspiration from Geller. However, Im sure the Pokemon developers did NOT ... because the comedy-trope spoon-bender was widely known in Japan, but Uri Geller was NOT. Even today if you do a spoon-bending bit in Japan, and ask people who that reminds them of, the majority will probably say Kato Cha.

That one about Johnny Cage... I think he would have had a more compelling case if he tried to say that he and his fellow actors and actresses should have been paid royalty fees for being in the game circa the second release. This could have sparked an entire debate about how people get paid in the game industry, well before it would become relevant today.

You missed some critical information about the Kadabra thing. Its original Japanse name is ユンゲラ - "Yungerer." Which IS very much much based on Yuri Geller's name (Written as ユリゲラ in Japanese, I think. Note how similar the ン(n) and リ(ri) characters are). While the lawsuit is still dumb, it isn't as completely baseless as you make it out to be.
Also the Abra line was never removed from the video games. The ban applied to the other surrounding media and merch - the TCG and the anime in particular. The only games they didn't appear in was Black 1 (in which it was a White 1 version exclusive), Colosseum and XD Gale of Darkness (where it could be transferred over from any of the GBA games), and pre-DLC Sword and Shield.
Also, In Japanese Abra is named after Edgar Cayce and Alakazam is named after Jean-Eugène Robert-Houdin, so there's clearly a psychic/magician theme.

Yeah, to be honest I'm fairly sure in all likelihood that the naming and imaging was definitely an intentional nod to Uri Geller. The naming and symbolism for Kadabra was very on the nose about its inspiration which is the case for a lot of these sorts of things from other Pokemon and even just Japanese media in general. It's a shame he took it so personally insisting the star was some sort of Satanist pentagram and the symbols on his chest was the Schutzstaffel. Lmao.
For the Guitar Hero one, it's kinda funny how in contrast Harmonix were under a really tight leash for how they were able to depict The Beatles in The Beatles Rock Band, with them not even being allowed to have song failed animations.

to me it's the wording. Activision likely said "use your likeliness as an in-game avatar" and that's the key. Avatar. Avatar as is just a character used to represent someone/a band member virtually and that's what they agreed to. Song exclusivity would have little to do with playing dress up for a song, they just get weird thinking of themselves being a Cover band

Throw a lot of money at him to be shirtless in shades, advertising products competing with Mortal Kombat. Midway tries to sue for using the character's image? Nope, can't be. According to this court case over here, Daniel Pesina is not recognizable as Johnny Cage. Therefore, his appearance in other things isn't using the likeness of one of Midway's characters, and thus cannot be infringing.

Almost every lawsuit that gets dismissed results in the defendant recuperating their attorney fees at the hands of the plaintiff. It’s the judges way of saying “you dragged (the defendant) into court for no reason, so you can pay for their lawyer”

Kadabra having limited exposure in the cards is pretty sad, because it basically meant that any Alakazam or Abra card they print isn't viable since there are limited ways of evolving it. Plus, Kadabra is the coolest looking out of the 3, and frankly much more interesting looking than Alakazam. Kadabra has a dinosaur/demon look to his hands and feet, but with a fox head and tail. It's a mish mash of odd characteristics that somehow work well together with tiny little flourishes with the star on its head and squiggles on its body. Alakazam grows his stache, puts on a diaper, and loses his tail. He keeps the DBZ body armor though, so it's not all bad.
Hopefully now with Uri Geller's blessing, even if it may be in writing only, we can start seeing Kadabra again. The Pokemon TCG has too many good artists to deprive them from being able to officially draw the cool looking fox demon.

Midway probably should have given the Mortal Kombat models a bonus or something after the game hit it big. Even if they weren't contractually obligated to do so, it would have been a classy gesture.
IMO I find nothing wrong with them not giving any extra bonus. As long as they paid the actors according to contract, they don't owe anything else. If the games bombed and Ed Boon went broke, would you expect the actors to pay some of their salary back to help him out/finance another game idea? Plus by your logic the actors should give some of their salary to the gym they pay for, because thanks to the gym, they got in shape for the role to make the game sell bucket loads. They should also pay a bonus to their acting professors (on top of the tuition they already paid) who taught them the acting techniques they used while working on the game that helped the game sell. See how silly this looks?

I can kind of see where they were coming from with the symbols on Cadabra (sp? I have never played Poke Them On). The chest symbol looks a little bit like the SS lightning bolt logo. The star on the head is a little harder to argue, given that it's not really a pentagram per se.

The only one here that I think had any sort of legitimacy behind it is the Guitar Hero one, the Space Channel 5 and GTA V ones were attempts at maintaining relevance, the Pokémon one was an obvious case of ego and the Mortal Kombat one was just ludicrous, especially how their complaint was solely about appearing in the console versions, they authorized use of their likeness for the arcade version, so there'd be no need for further authorization over a simple port.
I can think of one situation, where rather than the individual (not quite a celebrity, but pretty close) getting angry over their likeness being used, they approved of their likeness appearing in the game, and it was a game from a studio this person didn't even work for. Shortly before Nioh 2's release on PS4, there was an open beta where players could submit character designs to appear as presets in the final release, one of the male presets that made it through was meant to be Square Enix's Naoki Yoshida, otherwise known as Yoshi-P, and it was pretty spot on. Team Ninja then asked him if it was alright to have his likeness in the game, and Yoshi-P wholeheartedly approved.

Definitely remember seeing something about both Taylor Swift and Adam Levine complaining about it in the past haha. Probably for the same reasons as No Doubt. But yeah someone rom Activision/Neversoft really should have told them that players could use the characters to play any other song. I will say while it is fucked up it's pretty funny to see a version of Kurt singing and dancing to Beat it and YMCA.
