    I rewatched the closing arguments multiple times and it was actually Owens that brought attention to the Torres family. Mr Jay was running the video, Mr Cacciatore was up in the well watching the video. It was Owens who turned in his chair and pointed to Jorge's family to get out. Neither Mr Jay or Mr Cacciatore would've seen or heard anything on their own and the video would've continued to play, uninterrupted, while Jorge's mother left the courtroom. This is entirely of Owens making and it's disgusting the way he went about dealing with it in the moment and now.

      ​@bethanychatman9531 but he pointed them out when Jorge's mom started crying...he was the one who told them to leave while the video was playing. All that poor woman did was cry at a video of her son and this ass pointed it out and told her to leave loud enough for the cameras to pick it up...if the DAs didn't notice it the jury may not have either. Technically he's the one who had the outburst in court!

      Yes indeed - we would never have know there was an outburst if Owens hadn't spoken. HE'S the one who made the outburst, IMO. At the time, I wasn't surprised he tried to use it for a mistrial, and after that was denied, I figured he would try again as grounds for appeal.

    It's weird to pretend that the jury won't know that photos of a dead child or a video of a man dying is sad if no one in the room acts sad.

      I don't know if Sarah is pretending. Since her very first interview with police at the crime scene, she has demonstrated countless that she doesn't understand how normal people think, feel, or behave.

      Yes, thank you indeed. And it wasn't just Owens' display (which I thought was meant to bring attention to the family's grief), but Sarah's cold hearted nonreaction to it all. The family's quiet crying was similar to that of the family in the trial of Lori Vallow Daybell and there were no motions raised on the basis there.

      Please stop vilifying the pro bono attorney. Owens is doing what he is supposed to do--provide a robust defense for his client. If he did not raise the issue, he would be negligent.

      @@SmilingSynic It was the WAY he raised the issue. He didn't have to do it in the callous, evil, heartless manner he did, where he POINTED at the family and accused the state and police detectives of a conspiracy against his client. That the video had been out for four and a half years, as if that means a family member finding it distressing and having to leave the courtroom was unnatural. He crossed so many lines. He could have made the motion for mistrial without trying to blame and shame both the victim's family, and accuse the state of ethical violations. The way he did it, and the accusations within, were not necessary at all, and not a part of defending his client or making the motion.

      When you take a child to the doctor you give her something to keep her occupied to prevent her from acting out. Same concept here.
      Besides that, the most generous interpretation of her videos is that she laughed as a person with whom she shared one soul (as she claims) was running out of oxygen.

      Johnny Depp did art and such most of the time. Nothing wrong with it. In fact, it is encouraged for the defendant to leave the work to the attorney's and keep yourself occupied and distracted and calm.

    What emotional outburst? I only heard James Owens creating a scene where there was probably only Mrs.Torres beginning to cry over seeing THE suitcase video. Owens completely blew it out of proportion! That poor woman was upset, naturally. Even if it had never happened those videos alone convicted Sarah Boone! And honestly, Owens didn't do Sarah any favors with his questioning of her!!

      Exactly. I went back and listened very closely to a video that had enhanced audio. I heard what sounded like a muffled cough just before Owen's spoke. In Owens' attempt to blow this up bigger than it was, he admitted that the person bent over so the jury couldn't even see her face. 🙄

    If anyone made a scene it was the defense counsel when during closing he turned around and spoke angrily towards the gallery. Last I heard, you can’t cause your own miss trial.

    Jorge's mother quietly left the room. That's nowhere close to an outburst. The only emotional outburst was from Owens.
    I get it. Owens was throwing crap at the wall in his attempts to avoid the inevitable verdict, but he didn't request any curative instructions.

    Owens was unnecessarily cruel and that is unforgivable. A mother is watching her baby die which is likely the most pain anyone can go through and instead of compassion, he admonished her for having normal human emotion. Frankly, no one would even have noticed had Owens not made a spectacle of it to suit his own devious ends. He is truly despicable.

    Yes, strike three!! We did not hear any outburst, it was not until the cameras turned to the gallery that we even noticed something had happened! I actually thought there was a problem with the stream because the suitcase video seemed to have frozen as it went quite for a couple of seconds. The cameras would have picked up the audio of this "outburst" and we would have heard it. It seems all Mrs Torres wanted to do was leave the courtroom but had to go past of the people to the exit the room. It was probably Mr Owens or someone else who brought it to the court's attention, otherwise I doubt it anyone would have noticed.

      Exactly. The first time I saw this I went back and listened very carefully. I heard something that sounded like a muffled cough just before Owen's spoke. In Owens tirade later he even admitted that the person head bent over double... that means the jury would not have been aware or influenced by their facial features. It's also not the first time Sarah has prodded Owens into having a go at people she didn't want in the gallery. 😮

      @ True not in person, but it was televised and streamed live. We were even aware of someone’s phone going off at some point during the trial when the judge ordered them out! There were reporters inside the courtroom including Joel from Surviving The Survivor who didn’t initially notice anything and said someone was sobbing in the arms of a friend or family member leaning into them for support (it was confirmed later it was Mrs Torres) hardly the outburst described by Mr Owens. But I get your point .

    I was just reading the comments here and generally, they indicate that you just have an exceptional ability to connect with people, even through a computer screen. Who knew that there are scores of people that want to know the deep details of judicial opinions? You, Brother Counsel, figured it out and have carved out this corner of the world that brings so much to your viewers.
    There was a comment on a different Brother Counsel video where the person wrote that they weren't very highly educated, hadn't gone to high school, but they understood Brother Counsel's presentations. I got a little choked up reading that. Connections, and more connections!

    Not to mention the lights in the courtroom were out and there was a video being played in the front of the courtroom. It is very likely that the jury didnt even notice any disturbance until Owens made his own outburst to acknowledge there were people leaving the room

      Exactly. My understanding is that Detective Chelsea was sitting with the family and I suspect it was really bugging Sarah! She's so petty and spiteful.

      @windywednesday4166 I just hope the judge absolutely throws the book at her and locks her up for life....I doubt it but hey at least she didn't take the plea deal that would have had her out in approx 8 years

      @@PH13PH I think the judge will be very fair and considered, as he has been throughout, and will, with great elegance and class, read her for the filth she is, and sentence her to something like 30 years to life, or 40 years to life. One less reason to appeal, and absolutely fair. Means she MAY stand a chance at parole... one day. When she's a very elderly woman. But, and this is crucial, she'd never, ever qualify for parole, even as a woman in her 70s, since she'd never accept responsibility or show remorse. So it will be effectively be a life sentence, without being classed as over sentencing her, since a minimum of 30 years is more than fair, and gives her the very faint hope of freedom one day. Something her victim certainly never had. I won't complain if he gives her life either!
      He has been very systematic, thoughtful and intelligent at every stage, making sure to close every avenue of objection or potential appeal issues, pushing this through to trial to stop the mockery of justice she was attempting, and being very careful and deliberate in the way he did so. So I have every faith that he's going to make sure that not only does she not get away with her nonsense, but also not set up precedents where future criminals can play with the court system the way she has been, and so she stands almost zero chances of an appeal being successful.

      @@scarletamazon3455 honestly this whole time I have just been feeling like it is going to be a 30 year sentence. One thing to note though. Sarah is currently 47 years old. 30 years would make her 77. I do not believe she will make it to that age. Life expectancy in prison is quite a bit lower than out in the real world. Not to mention her past history of heavy drinking. So yes effectively a life sentence. I agree she wouldn't be a great candidate for people because of the factors you mentioned. I just want to hear what kraynick has to say. After watching this trial I think he is one of the best judges I have seen lately. Very fair and intelligent.

      @@PH13PH I agree with you on all points! Although I don't think it'll be as clear cut as "just" 30 years. I think it'll be a minimum of '30 years to life', so she know very clearly that it'll be at least 30 years, and her reaching 77 years old, before she could even apply for parole, that she would never get, even if she did manage to live that long (and I agree, her chances of making it to that age given her lifestyle factors, both current and previous, & family history are also incredibly slim!
      So I'm bracing for a minimum of '30 years to life', knowing I'll still be pleased with and see the justice in that, and have every confidence he'll have carefully considered every factor before he hands down the sentence. I'm thinking he may actually go with a minimum of 40 years to life. The "to life" part will allow him to hammer on the fact she has shown absolutely zero empathy or remorse, poses a danger to the public, still, as a result, and stands no chance of freedom unless and until she takes accountability and shows remorse. We all know, judge Kraynick especially, that she never will, and she will be tormented by that years away tiny flicker of hope of MAYBE getting out. One day. When very elderly, if she makes it that long, and ONLY if, she does the thing she's been so set against doing all these years, and demonstrate some accountability and remorse.
      It'll be yet another thing where she'll only have herself to blame, when she is never fit for release, and won't even adapt to accepting she'll be in there until the day she expires. That tiny, vanishingly small chance of a potential release, but only under those circumstances, and so far into the future, will torment her even more than a flat out life sentence will. ;-)

    The man was asked at every point in the whole process for legal argument and he failed at every single point.
    I appreciate he's following procedures but he could at least have put a bit more effort into it and not treated the Court with such disrespect

    The issue with the emotional outburst argument is while there was some outburst and the family then left the courtroom the record really does not reflect that this issue was so bad as to prejudice the defendant Sarah Boone. While James Owens ask for them to leave the courtroom, he did not immediately ask for a sidebar to develop the record or ask for an immediate curative statement. Rather he asked them to leave and they left thus he got the remedy he asked for. Thus his own cure happened

      Imo "outburst" is much too strong a word... but point well taken! Not only did that 'cure' the emotions issue that Owens had a problem with, iirc the judge asked him if he wanted a Curative statement given to the jury and he declined it.

    The outburst was not all that loud, and the woman was helped out of the courtroom by a family member. James Owen jumped up and was, as we say in the south, very ugly. I was shocked at his outburst, which was considerably louder than Georgia’s relatives outburst.

    Mr owens rant was unhinged and all that angry pointing incredibly rude. Sarah has not displayed any particular emotions throughout the trial. She just wrote notes and did constant lip compressions. However after years of heavy drinking, smoking and a poor diet, she is probably not fully compos mentis. There was no excuse for what Owens did to the Torres family. Also of note is calling Jorge an alledged victim. Disgusting.

    I often remind myself that Owens is just doing his job. However, I really dislike that he called Jorge the “alleged” victim. He is dead, he is a victim. No matter who they believe is at fault or why, Jorge is a victim.

      exactly! Both Looney's Boone and Owens expect them to sit there frozen. Boone too if it were Lukas that was murdered she wouldn't be able to handle it. The family did nothing wrong like you they didnt scream out or curse at her which they have every right to but they still respected the court proceedings. I hope Judge Kraynick gives her extra years in prison for every bogus filing! Even his family didnt react and walked the verdict would had been the same! she's so freakin annoying I'm tired of her!     Remember Travis Alexanders family ran out of the room crying.when autopsy photos were shown? Everyone understood and NO ONE took issue with it. I imagine its very common, this sort of thing. Can you imagine if her motion were granted, what a terrible precedant that would set...?

    I'm more and more relieved after your breakdowns of this motion for mistral. First I was angry. Then slightly anxious because judge kraynick has not swiftly responded ( I'm not critiquing the judge) but I hate to think that owens has any leverage at all

    How hard is it for a jury to understand that the family of a victim is likely to be extremely upset by the fact, but this does not by itself mean that the defendant caused the harm?
    This is ridiculous.

    What is mind boggling is that S. truly believed the jury would acquit her once SHE told her version of the story. So convinced that she rejected the plea deal. I think they really did believe his death was unintentional...that both were battered partners What a gift!!!! But no, S. is incapable of accountability
    .. long story short, S., theres your jail cell to the right..dont wear it out!!!!!😮

    Love your channel, Brother Counsel and all the detailed explanations you gave on the other cases, (especially) last one. Owens asked Nick’s family to leave the court room cause of his mother’s outburst. What outburst? We could hardly hear her but Judge K. did. No mistrial!!!

    Jorge Torres' mother was in court for the first time. She had been warned that the "suitcase" video would be played. His mom had not seen or listened to the video, so it was the first time she saw this. She had stated she believed she could handle it, but hearing her son begging for his life, proved to much. She cried out and almost collaped on the floor. Her family helped her up and she immediately left the courtroom.

      And her videos. Lets face it, all the "evidence" she collected on her phone hoping to prove she was Jorge's victim, only highlighted that the abuser in that relationship was always her. Everything on her phone, plus the police bodycams for arrest and interviews, was more than enough evidence for an M2 conviction, even if she never took the stand. But she certainly helped to demonstrate precisely how evil, remorseless and utterly lacking in any human empathy she is.

    Owens is pretty experienced, and it sounds like he should know better than to file these with weak or poor case support. Why is he doing this or approaching this this way?

      My guess is that the only sure way to get Sarah through the trial is with a lawyer, and that lawyer has to do whatever she wants. Imo, Sarah just wants to be petty and spiteful and pull power trips, and that leaves Owens scrambling to come up with the legal premise to back it up. Much like he used his motion on Miranda rights to get detective Chelsea on the stand to try to dress her down.

    Ther is one issue that did not get addressed in this video that i am curious about.
    When the incident happened Owens did not address his concern to the court. Owens turned around to the gallery and took control of the perceived situation by asking them to leave.
    Wouldn't that be a concern of the court that Owens took control of the situation and implemented a resolution without consulting the court first??
    What kind of implications does that have on a trial or a lawyer?

    IMO Owens made a stink because SB made sure he did. She wouldn’t tolerate Jorge’s family expressing any human emotion that solidified Jorge’s pain and suffering as her victim in his last moments, Owens and SB were made for each other.

      I thought the same! It can only have been a calculated move by the prosecution to elicit that reaction from the mother to affect the jury! I suspect there would have been a guilty verdict without this tactic, it was cruel and unnecessary!

    At first I side eyed the case law all being about girls being SA’d but thought, “well it’s all they could find for their lame motion”, but then to mention the second one and say it doesn’t relate to us anyway makes me mad. Especially knowing about Owens’ co-counsel.

    I'm going to go out on a limb and say that the jury listening to a man begging his girlfriend for his life while he suffocates is already aware of how horrific it must be for the family whether they say something or not. Even if his mother had thrown herself to the floor weeping, I don't think it's going to change anything for the jury. They're listening to a woman castigate a man who is in the process of a slow and terrible death. I wouldn't be surprised if Owens was trying to set up a reason to ask for a mistrial. If it really was one, he should have asked for it right then.

    Of the five motions, this is the most desperate. There was no emotional outburst. Jorge's mother broke down watching her son dying a brutal and tortuous death. She quietly left with dignity speaking not a word. Owens made no request to address the jury who was already instructed that sympathy for either party has no merit in their decision making. This is a heartless motion that will only bring more pain and anguish to Jorge's family. Absolutely despicable!

    Owens is a scumbag and a two-bit lawyer from a one horse town. I really wish someone would do a video on his and Henderson's SA allegations by multiple victims which forced them out of the PD's office. It is truly gross and disturbing preying on their vulnerable clients and one of them almost got disbarred as a result. Owens is not in the same league as Jay and Cacciatore, or on the same planet as Kraynick and it astounds me how disrespectful he was. A lizard and his client got their just desserts.

    I suspect that there are a lot of lawyers who watch Brother Counsel. We appreciate that you actually look at the case law. I've been disappointed that Owens' motions are so weak and so poorly supported. He was a PD for many years and you would think that he would be better versed in the case law and would not cite cases that are not on point. (Not because I think that Boone should get a new trial or should have been acquitted. The case against her was overwhelming.)

    17:14 I followed the Perrywinkle case and what that doctor had to view/testify to, Im surprised all she needed was a small break and Ill just leave it at that. 20:18 JFC. Is everyone just supposed to be emotionless when viewing horrific things. Isn't the jury going to view these images. 21:21 I was watching it on EDB and we couldn't even hear the outburst at all. It was Owens who called attention to it and they were already leaving the courtroom. I think this made the defense and Owens in particular look very cruel, not just to us but to the jury. A mother was watching her son, someone she gave birth to not only take his final breaths, but begging/pleading for help with Sarah mocking and laughing at him. Not to mention he didn't even ask for any jury instructions. The judge can't rule on something that he didnt make a motion on. He asked for a mistrial and thats it.

    Brother Counsel the only thing the poor mother did was start quietly sobbing while watching the video of her son taking his last breaths and asking for help. The family immediately got up to escort her from the courtroom. It wouldn’t have swayed the jury at all in my opinion because by that point they already knew she was guilty of murder. Owens is the one in the wrong here. He likes to point and talk loudly and cause issues that aren’t even issues.
