Maybe you need your ears clean as the judge explained you the law. They aren't allowed to revoke the full sentence until they reach certain number of violations. For misdemeanor cases, the law says you must work with them until there's no other choice left.
I agree. I'm a Michigan resident and don't like the new laws. When you get probation that's your chance to not go to jail. When you instantly fail on probation you should be given the time you escaped.
@@emilykay115 Yes, but the probation recommended 3 days as he was going for treatment. 10 or 3 days don't really matter. It's about trying to help people overcome their addiction. If he fails, he'll serve his time eventually. Maybe I should have been more measured in my reply. It bothers me when people start giving legal opinions when they don't know the laws.
I believe that each missed test or appointment should be a violation, therefore he has about ten probation violations and should be sent away for six months. That’s how I’ve seen it handled in other courts, such as Judge DeSanto. At the very least, each set of violations should be counted as separate violations. Not enrolling in testing is one infraction, not testing when ordered is another infraction, testing positive is the third one, and missing scheduled appointments is the fourth violation. That’s enough to send him up the river, in my opinion. They’re giving him way too much leeway by grouping six or seven violations together, and that’s unfair to people who comply with their terms of probation, because one missed test by them could result in the same penalty as all six of this man’s violations since they are only counted as a single violation. The probation department needs to make changes and get it together because this makes them look lazy. Why do you wait for several missed appointments or tests before taking action?
Therenit is. Another felony watered down to a misdemeanor, take the easieat path for prosecutor. Then did the defendant say, Wow I dodged a bullet. I better get my act together.? Nope, he said screw it.
Intensive programs are supposed to be your only chance. You mess that up you do your time. Why is it so lenient? Seems like a danger to the community
