Capitalist at all, if wages are consistently being pressured downward, by preventing the Worker to move to a better job, while prices are skyrocketing, thats just a bad economy, and ruins the constitutional right to life, liberty, pursuit of happiness, and promotion of the general welfare of the population.
The 13th amendment supposedly ended slavery and involuntary servitude. Frankly, non competes are violation of the 13th amendment and an attempt by businesses to re-institute involuntary servitude (i.e. slavery).
I can definitely see problems on both sides. Imagine you start making a product and make a business to sell it. And you train your employees on secrets that puts your product over others on market. Now your employees can blackmail you by saying they will get a job at a competing company and sell your secrets unless you do/ pay this amount.. At the same time if its not a secret you can’t hold your employees accountable for getting a job at a competitor… So there needs to a rule on whats a company secret and whats not.
Knock offs occur everyday,it's just inevitable in capitalism. I've experienced it with products I've created,and it's done legally. Try being an artist online,everybody tries to steal from you. Everybody.
That doesn’t really hold up when the workers leave that company and go to work for a completely different company in the same field. How can you possibly bind someone to these contracts AFTER they’re no longer under your employment? Non compete agreements are anathema to free markets.

Banning "non-compete clauses" sounds like a good idea to me.

That is what NDA is for. Non compete has nothing to do it with it. Telling privacy business secret is illegal under NDA.

Yeah, that's why they're called contracts. The workers are CONTRACTED. When they breach their contract, they have to pay.
