Purchasing Property (land/ House) on the basis of Power of Attorney

Q. No. 1 Can you purchase the property on the basis of Power of Attorney
Ans. Yes. You can purchase the property on the basis of Power of Attorney
Q. No. 2. Should you purchase the property from an Attorney holder instead of original owner (whose name is reflecting in ownership documents) ?
Ans. Though, you can purchase the property from Attorney Holder but it is neither a better way nor recommended because a lot of complications may occur in this way.
There may be two situations:-
1. The Attorney Holder, who has not purchased property from original owner but only authorized by original owner to sell out the property. (Either they are blood relative, brother, sister etc or an other relation)
(In this case, one thing should be kept in mind that the amount being paid by you should reach to the actual owner)
2. The Attorney Holder, who has purchased property from original owner and has paid its price to the original owner. Man people usually Investors, when purchase any property, don’t get execute Sale Deed in their favour, they only get execute Power of Attorney in their favour
(because the expenses for execution of Power of Attorney are less as compare to execution of sale deed)
Precautions
1. Property Verification
a. Same property is at the spot as mentioned in the document.
b. Located on in same Khasra as mentioned in the document
c. In whose name is it?
d. Free from all sorts of encumbrances
e. No stay order etc.
f. No case pending.
2. Power of Attorney
a. Registered or not?
(Registration record can be checked with the Sub Registrar Office) appearing on Power of Attorney
b. Original Owner or owners is/are alive?
(If died, then no need to purchase, because many complications may happen in future)
c. Try to personally approach the original owner, or if he is abroad, try to telephonically contact him to know the real facts
d. If, you are purchasing the property from attorney holder (who has not purchased the property from actual owner),
i. then try to transfer the amount in the bank account of actual owner and that too with the consent of Attorney Holder) - This condition should be written in the you agreement with attorney holder
e. If, you are purchasing the property from attorney holder (who has purchased the property from actual owner),
i. You may give sale price to attorney holder but through safe way Bank Draft, cross cheque, bank transfer etc

Aur gift deed ma kia minor ka thumbprint lagta ha?????
Agr minor ka thumbprint lagta ha to kab lagta???
Minor(donee) ka name pa gift deed hoti ha us ki mutation kab hoti ???
Mutation ma thumbprint require hota kia minor ka (after majority age)??
