In normal countries, investigations are concluded before arrests are made. In Nigeria, arrests are made and people unlawfully detained before investigations begin

EFCC can't prosecute serving military personnel, unless they have been demised.
Yes, EFCC can arrest and prosecute members of armed forces if the they commit offence as civilians when they are off-duty. If an off-duty officer kills someone, he will be tried in normal court for murder, if convicted, the Army or Airforce will then dismiss him or her. If murder case against him is dismissed he continue to serve in armed forces. If officer commits a crime on duty, he will be court-marshalled by the armed forces.
EFCC has not done anything wrong in my legal opinion.

What you fail to understand is even in whatever foreign country you reside in, the police can arrest but cannot keep serving military person in their custody for more than 24hrs. They are to be handed back to the military which the EFCC failed to do. The Armed Forces Act must be used first on them. If they are dismissed after investigations then they will be handed over to the EFCC not while they are still active personnel.
Also here in Nigeria, ‘suspect’ is used indiscriminately. A university lecturer could be picked up as a ‘suspect’ under any guise tomorrow, even of internet fraud. In all, weak institutions, disregard for basic human rights and rule of law. A state of anarchy.

Lawlessness and lack of training compounded by lack of clear cut delineation of jurisdiction. The Airforce personnel are not above the law, and they are in the jurisdiction of local police, EFCC and all other state governing institution empowered to enforce the law of the land. As an ex-naval officer of USN, we were taught the limitations of our powers and clearly made to understand that US Army, Marine, Navy, Air force have no jurisdiction over any non-combatants. Hence the US Coast Guard who has jurisdiction over non-combatants aka civilians must accompany us during operations that involved civilian interactions. So long story short, train these soldiers well and make them understand the consequences when they choose to be unruly. And clearly throw the book at them - starting from the highest ranking officer in the base they came from -when they go wrong, only then we will have a trained military institution.

We live in a country where the rule of law is useless, when you have serving military personnel as suspects in a crime is there no rule governing the process of arrest and detention, even civilian arrested on cases of crime should have a process. @@walbefriday4128 we have what is called the rule of law in this country meaning that we elect representatives in an national assembly who vote laws. Once these laws are passed it become biding on all nigerians irrespective of who you are. We also have what we call the criminal justice system, from law enforcement agency to the courts and finally prisons. These are institutions of the criminal justice system. When there is suspension that someone may have committed a crime the law enforcement agents is just to investigate and hand over to the court. How then can you be sitting on your couch and assume will confidence that they did nothing. Mind you the EFCC is not Police in the sense that they do not mount road blocks for them to catch suspects. There must have been an intel that they were involve in yahoo for them to leave their office and go and grab them. The military should educate themselves on why they are being paid salary from tax paying nigerians money. Go and read!!!
