As a licensed examiner in QLD. The amount of cars that "Should have failed" a Road Worthy, were in pretty good condition. I hate this war on modified cars. Most of them are more maintained than some of the shit tins I have legimately seen.
Yeah I reckon Queensland, Australia is one of the worser places to own a mod car, at least the state doesn't have the annual inspections that NSW, Australia has. I lived in Brisbane for a bit and I flip cars, they were failing cars that ran and drive while up there, also TMR kept calling me because I didn't transfer rego when selling cars.
its so frustrating here in nsw on some of the beaches the police will be stationed at the entry points to do testing on the 4wds and they have the most ridiculous guides for doing so , meanwhile you have bogans driving around in beat up commodores which are Cleary unsafe to be on the road not to mention the state of the roads we drive on too haha

Ive had many modified sports cars. never had a problem in NSW. the only ones out of anyone ive seen or knew that had issues brought it on themselves with utterly stupid mods or just bad quality work. People are incredibly ignorant. They think that their tyres sticking out of the guards isnt a safety issue. They dont see how an irresponsibly lowered car is actually very dangerous and can have shocking handling effects on normal roads. Loads of stupidly modified 4wd's too. Sooooo many of them are way over weight, or have terribly modified suspension or emissions equipment cut out. Meanwhile, every idiot in QLD is driving out in a rusty heap with bald tyres because they dont need to have annual pink slips. I see it all the time. You might think your rig is cool, but the engineering side disagrees. The rest of us dont want dodgy cars driving around because when you crash into us, your insurance will be void.

Hello! Aussie UA-camr chiming in 😂 So I have been fortunate enough to be able to avoid police attention on all my cars in the past, but I am also under the mindset that if you modify your car tastefully, keep it clean and be a nice human to Police if they pull you over, you're usually pretty good. However, the Night Scene car meets are a straight up avoid nowadays, any meet big or small after 5pm is a guarantee defect station. Which unfortunately kills a lot of the passion for people early on. Defcet Stations are a big thing, but they can also pull you asside during random breath testing, or just in general if they see you driving around. What also makes matters worse, there are also a few of my UA-cam friends, mainly in Melbourme, who regularly have police come door knocking to defect cars or give you a summons because of dangerous driving on UA-cam Videos. They watch us very closely, but I can also understand that as us becoming larger "influencers" doing the right thing should be promoted. Anything on Social media here is HIGHLY watched by the government. In saying that. I have delt with horrible Police Officers, and yes they will certainly turn a blind eye to proper wrecks on the road, where a tastefully modified car get pulled over and gets defected for "having bigger brakes without it being engineered". Another huge issue is usually HWP dont know what they're looking for, and have been known to Defect OEM options on older cars, privacy glass and Standard Supercar Exhaust. We also have terrible roads here, where pot holes can go months without being fixed, no many driveways or speed bumps actually allow for the minimum 100mm height limit, and roadworks sites that you physically have to avoid to hopefully not damage your car. But as always, right time right place, If I'm ripping through the mountains in my evo with no one around and happen to be spotted by a cop, they usually dont mind much and say "slow down, if I see you again doing the same thing I'll have to act", and thats usually how it goes.
It's definitely become a time and place thing. And does also depend a bit more about what you drive. 10 years ago if a cop saw a modified Skyline or a modded Commodore they would almost always go after the Skyline. These days it's more or less how your behaving when they see you. Thankfully my main modified car somewhat flies under the radar as long as it's moving. I've just got to take my chances at an RBT. Also thankfully most of the night meets in SEQ seem to be ok as long as people aren't being muppets. When it comes to modified cars Victoria seems to be the hardest on things followed by NSW.
There is no "tasteful modification, right place right time and good attitude" that will prevent police harrasment of your modified car. @ZacBaldy don't know if you remember the phase 5 give away by street machine years ago. An 85 or 86 XF Falcon with a v8 Windsor in it. The car never originally came out with a v8. Yet the winner apparently was a South Australian, and he couldn't register the car here because it didn't come with engineering paperwork, and no south Aussie engineer would sign off on the finished car as he didn't do the regular checks during the build.

One of Australia's major car websites recently reported of cars being 'defected' because, get this.. the Shift Pattern embossed into the top of the gear lever knob was obscured, worn out, no longer stock, or had been removed. The story originated from an incident in Western Australia, but when "Car Expert" investigated if other States also followed suit with similar legal interpretations of their laws, the good old Victorian Police reportedly said that yes a shift knob gear-pattern (or lack thereof) could possibly be a prosecutable offence, but would neither confirm or deny if it in fact was! Speaking from personal experience, many years ago I was pulled over and received a fine from the Victoria Police for the crime of "Exhibiting Acceleration". Not 'excessive' acceleration, mind you - just exhibiting acceleration! No wheelspin or speeding involved whatsoever, merely accelerating from stationary too smartly for the liking of one single Policeman. Which raises many questions; including how can one proceed from stationary WITHOUT exhibiting some form of acceleration?? In other words, it's a convenient crime of perception, interpreted in random, and applied on a whim. Btw this was in the mid 1970s, my car was a stock 1969 Ford Fairmont V8, and iirc the fine was $63 or thereabouts.
Yes my son couldn't get RWC on his HZ cos it had a white cue ball on shifter from previous owner so he had to etch out the pattern for RWC. But for me back in the 80's i was pulled over every second week for RW checks cos of window tint and mag wheels on a stock standard car. Back then if you had tint and wheels you were a hoon. Best one was in melb cbd checks on batman ave (now fed square) where cop doing the checks didnt know how to change gears as he was sitting in drivers seat wanting to start engine to test brakes, told him to just press clutch since he couldnt find neutral.

The police HATE that you do well. Then when I was home invaded, taken out of my shower in my own home and assaulted, the police told me I was NOT to defend myself if it happens again and the judge gave the known perp community service. I am an Aussie and given all the crime problems this country has (violent crime, theft, drugs etc) I don't think going after car mods is really the best use of police resources. If its a genuine issue (e.g. it makes the vehicle genuinely unsafe, it creates a hazard for other road users or it causes problems like excessive noise pollution) then sure, get it off the road but otherwise if its not harming anyone, let it be.
There are AFP station Sergeants in Canberra that run the minimum number of RBT's they can get away with because they are such a resource intensive undertaking. Officers need to be diverted from other duties for several hours for an RBT stop that is only really viable for 10 minutes.
Some statistics. In 2023, there were 409 homicides in Australia In the same year, there were 1266 road fatalities. Road deaths are the leading cause of death for young men aged 15-24 in Australia. Still think it's not a problem? Not worth the police resources? That nobody's being harmed?

@@a34rwlyup the UK luckily is relatively relaxed on modification, yeah they do crack down if a car is not taxed or uninsured, or if something doesn’t look right the MOT can be revoked, but doesn’t happen that often. There was also a guy who made a toy power wheels ride on car road legal and registered it.

I’ve had modified cars for forty years in Australia and have never copped a defect. My ‘71 LTD 2door hardtop is lowered four inches, has 10 inch wide rears, cranky big block, loud exhaust, steering wheel and seats changed and was my daily driver for seven years. The cops can be arseholes at times but if you’re not being a dickhead they are generally pretty good. Annual road worthy certificates are a pain but it’s nice to know that the car heading towards my family has at least been checked by a mechanic in the last year. Anyway breaking rules and dodging cops has always been part of the game.
100%. The only time I copped a defect (too low was self clearing) was on a random back street taking a mate home from the pub and we just happened on an RBT station. And the guys there thought my car was a bit low so out came the wheel. They also thought it was a bit fumey (decent size cam in an LS will do that on idle) But 1 defect in over 15 years owning said car wasn't bad. As you said it's part of the game. Had we taken a different street it'd have been no dramas. Also the state you live in does dictate the rules. So what happened to me might not happen in another state.
Just shy of 40 years driving modified classic cars here in WA and never had a Canary on any vehicle, despite hundreds of police stops over the decades. I can see that the eastern states are a hell of a lot more focused on defecting vehicles than they are over here!

I live in the ACT (The capitol of Australia). I've never had a defect, I've also never had my car inspected as part of an RBT. Yes, my car is modified within reason though, Lowered suspension, after market rims, strut brace and after market audio. It is all within limits though. It's not too low (meets the 100mm minimum), wheels and tires fit within the guards at correct offset, the wiring for the audio is all checked and approved...

Its isn't "what the police don't like".. Its what places your vehicle in breach of the ADR's or Australian Design Rules. The rules that ensure cars remain safe for the road. It is the task of police to help enforce compliance with the ADR's You'll be surprised what can place you in breach of the ADR's. Even off the shelf lowering kits can make you illegal. What makes adherence to the ADR's an issue, is each state has its own interpetation of them. So for example, whats legal in New South Wales, might be illegal in all other states. (Of course, its fine to drive in those states with new south wales rego. if you move there, your car will not pass a road worthy/safety check..).. At least I now understand how people in the USA can get away with driving absoute rust buckets and other dangerous vehicles on the road..
Yeah one of my mate's kids is always complaining the police are harrassing him but he has a 180SX with full red/blue neon kit going around the underside of the car, he has rims that stick out of the guards, he doesn't have a passenger mirror, etc All he does is take all that stuff off to get defects cleared then puts it all back on again

In North Carolina people cruise the main strip in some towns with modified cars that are clearly not even street legal. The louder the exhaust the better. It's like a competition. As long as your not being a hooligan or racing the cops could care less. That's how it should be. Infact I rarely see people pulled over for speeding. When I see someone pulled over it's usually 3-5 cop cars and they all have their guns drawn. Kinda makes me laugh actually. Knowing they are taking the actual criminals off the streets.
In my state in Aus, that would get your car a major defect in an instant plus you'd get a speeding ticket for $385 and 3 Demerit points. Mind you if you're going 16mph over its an automatic loss of licence
I cut my exhaust of my '85 pontiac with a 305 v8. I'm in st louis county. Even drove it to Kansas city and back. Didn't nobody care. In California they would of gave me a very expensive ticket and maybe even towed my car.
Aussie here mate, its 100000% true Also my State Queensland also has what they call "Hoon Offences" So they can call basically anything they want "Hooning" and it doubles, triples or even more the Demerits and Fines It literally comes down to the Cop who does ya in, and they know NOTHING about Cars. They arent trained in Mechanics let alone Modifications, they see something that they think looks off and thats it, you're DONE Having said that I have a Highly Modified Car and Ive been pulled over twice in 10 years, have a clean Driving record and behave myself on the road, yet the fear is ALWAYS there. All it takes is the get pulled over ONCE by a Cop on a Power trip and/or in a Bad Mood and its over They drone on about how its for "Safety" yet call the after youve had your House broken into or youve been Assaulted and they dont give a single fuck, Drugs everywhere yet they hassle us
Last time I checked I didnt have to revert my car back to stock or wasnt allowed to register it ever again after a defect notice. So it is even worse than in Germany which is insane
@@Crosstieger no, that happens in Germany too. Sometimes they just take away your car even and will sell it off in auctions. You will have to revert back to stock. It's especially bad in Hamburg or Berlin, where greens govern.

Adding JDM options onto cars in australia that were certified according to ADR without those items just because that car had them in the japanese market doesnt make it ok. Laws are different. Pedestrian safety standards have different requirements, probably emissions laws as well.

I have had 38 years worth of random breath tests... I have never been asked to show my license or had my car fine-tooth-combed. It is a four second processes. All over australia. Including in some modified vehicles. You have a whole different flavour of luck.
I once had the cops try for a defect check when I pulled over to answer a phonecall. Lights checking my key position on the dash, his buddy walking around and checking my tyres... "Mate, I'm pulled over and the car is off for a phonecall, what exactly are you looking for? Tread is fine, lights all work, not in operation." Nek minute - breathalyser, wheel stick comes out, have to operate my lights to prove it. This is all despite them finding brand new tyres, car was stock height, and I don't drink. They basically made a 2 min "what's up" turn into a 30 minute defect check, because they found nothing and were bored.
I have never had them not ask for my license in the 3 or 4 times I have been breath tested in the last few years. They also have quite an attitude, probably as most people dislike being randomly pulled over and have the appropriate disrespect for the situation themselves.

The last time I was asked for a licence there was a notice on the car due to the previous owner not paying fines (the registration can also be suspended for this reason). After explaining that I had just recently bought the car the sherif cleared the flag.
back in 80,s. guy i was getting work done by, sheet metal, had an xe falcon wagon, v8, with 4 side draughts.. at an intersection, a yellow monaro hk, was sitting there. falcon did burn out, monaro got pulled for it.. that, is a sleeper. i have a 73 challenger, 340. owned 14 yrs, could not reg it, as it was, is, the wrong color. not 100% original. are you original at age 50.??.
Old mate is exaggerating a fair bit. Yes, modified cars get pulled over & defected all the time, but these are usually modified cars at the extreme end of the spectrum. Modifications are allowed within legal guidelines & most people who modify their cars adhere to those & never have a problem. MCM, who are in my State, modify cars on UA-cam all the time & don't have issues because they do it within the guidelines. Get in to motorcycles if you want to modify a vehicle without restrictions or concerns over being defected. There isn't a motorcycle in Australia that hasn't been modified, unless it's new & sitting on a showroom floor. All of my bikes are modified. I've already modified the brand new bike I bought 2 months ago with 17 modifications.

As a retired ( semi) mechanic in new zealand , we have rules, obey them! If the minimum clearance is 100mm don't drop your car to 80, if the rules say cover your tyres, don't hang them 50mm outside the guards , if you have 9" rims don't put on tyres meant for 6" rims, the amount of crap mods that are on cars that are mainly performed by internet trained back yard goons horrify me as a 10.000hour apprentice trained mechanic (that's 5 years by the way) why spend $30 on a paint job and $500 on illegal mods that g
as an aussie, this is 100% accurate 😂 I had 4 defects on 1 car in 1 year due to cops not liking something on a modified car, altho West Aus we don't have on the spot suspensions unless its hooning
Tassie also has Call In Notices - if there is suspicion that work/modifications are not legal/correctly implemented on a pulled over vehicle, or a vehicle is noticed/reported to be unroadworthy, then the operator has the indicated number of days to have the vehicle inspected and declared clear to drive - certified modifications are fine, you just need to take the paperwork as well when you take the vehicle in for the inspection
I've been driving modified cars in Aus for 18 years and never copped a defect notice. Got out of plenty of defect notices by being polite and respectful to the police officers who pulled me over. A lot of mung beans can't understand this logic and get every car they ever owned sticker'd due to their shite attitude.
Same with me. Heavily modified, but I think the real kicker is - people like us do sensible modification, and not the dickwad additions that look and sound utterly retarded and get unwanted attention.

Here in western australia they arnt as tyrannical about modifying your vehicle as in the eastern states. But in saying that in my late teens early 20s i had VH commodore with ozzy 308. Nothing all that special but i did my roof carpentry apprenticeship during day and worked as cook at night, essentially 14 hr days, to pay for my 308 to be rebuilt with some mild modes, lumpy cam etc, my trimatic 3 speed rebuilt with a stage 2 shift kit, brand new exhaust fitted where i could swap out the muffler for straight through pipe for car events etc, and all new suspension all round with king spring lows and it ran on fat maxxis that wrapped 15inch pursuit rims, nothing crazy at all. On the friday night of the first week she was back on the rd! coming home from my dinnner shift i went through abooze bus and sure enough a sargent on a power trip to try and impress a rookie told me to pull up for a vehicle inspection. First thing he says is he asks who modified my exhaust? 😂 even with the muffler on he claimed it was to loud 🤔🤷♂️🤣. I told him no one modified, its a brand new performance exhaust system from an exhaust shop, i had the receipts for all new work done on the car sitting in the glove box. Then it was the usual pop the hood. When he opened it and saw the feshly rebuilt and sparkling clean 308 in sparkling clean engine bay all he had to say was " wow ". I piped up and said " you have no idea what you are looking at do ya mate? ' 😂. Yeh he didnt like that 😏🤷♂️😂. Funnly enough he didnt pick on how low my car was?🤔 lol but yeh proceeded to yellow sticker me for the apparently loud exhaust. I then got a $150 fine for abusing the shit out of him for smashing his fist on my boot when i started the car screaming " dont fking rev ur car! " lol being vacumm carby on the motor ( from memory a holly revenge? ) u tend to have give it a couple small pumps of accelerator to bring up fuel pressure 😂. Well actually first the sarge threaten to red sticker my car which made me fly of the rails even more telling him he had nothing to justify the yellow sticker let alone a red one! So he was like fine i will fine you for offence language and my response was " fk u and your power trip! " bam! $150 fine😂. The look on the rookies face when i flew of the rails was priceless. I did mention to the rookie that if he wants respect from car enthusiasts that aint the way to get it. Following monday i was at the pits where car cleard to be legal and inspector stating the sargent was a wanker for even putting it on 😂. My second home ended up being the pits with that car lol even though it wasnt anything all that special and not all that loud? Fk it was cop magnet!😂 I did one time get caught doing donuts on a street that was at the back of industrial yard that was never used. The rd was black with rubber as it was a popular spot lol. On that occasion i got a yellow sticker for bald tyres even though i was putting rd legal tyres back on 😏🤣 and that was it. Good old days! Where there was no such thing as a hoon law lol Now i own a tiger mica red with gold flake 1977 HX GTS monaro with a 500hp 383 chev, sequential shift 3 speed turbo 400 built to handle 800hp, one piece tail shaft, 9inch with 3:47 ratio and detroit locker. I forget what suspension 🤔 but the springs light blue? Lol she is fairly low and sticks to the rd bloody well considering her size and weight. She has original 14inch GTS rims and she runs big 4 into 1 headers into twin 2 and half inch exhaust system with catalyic converters and no mufflers! 😏 this old girl is loud even at idle!😂 yet not once since the day ive owned her ( 15 years ) have i ever been pulled over by the police, not a single yellow sticker 🤔🤷♂️🤣. Actually Only time ive interacted with police while being in this car was 2 police officers coming over while i was idling at the servo asking if they could have a look 😏🤣👍. 8:54
So the event being referred to with the racetrack was called modball rally. We were heading to the track when we were put through the largest defect station in Australia at the time. Most cars got through with minor stuff but a few basically were told they couldn't drive on Queensland's roads. Those guys hired trailers and a couple of locals kindly towed them to the other track day. Everyone did the right thing no one was speeding on public roads just enjoying our cars. The other story about the defects we had a guy come from South Australia to participate he was defected the morning we were driving to the Gold Coast from Sydney he was given a few hours to either fix his car or leave the state and he left the state back to South Australia.
In Germany you can modify your car with parts that are TUV certified. Which is most decent aftermarket parts. I’ve seen caged race cars with plates in Germany
Talking about the Defect Notice Stations, every Summernats (massive car show in January, I think, wish I had the time to go) in Canberra, Australia. The Police set the Defect Stations and Patrols all around the city, plus off the Federal Highway at the city border. They check everything. You mod it the way they don't like, they send a Defect Notice, need 14 days to clear it or your registration is suspended nation wide, regardless of where it is registered.
My Toyota Soarer got defeated for tems coil overs and wheels that were one size to small from stock, So I went and got engineering report and stuck it back to the m. Since the soarer was stock with airbag suspension even if I did put it back to stock it's not allowed in Australia anyway
Incorrect, airbag suspension is allowed and some manufacturers have sold new cars with airbag suspension (HSV, Citroen, etc) I owned a 1991 Soarer with factory airbag suspension and it was imported into Australia and passed compliance just fine (along with many other Soarers), i looked at coilovers but didn't bother in the end as didn't want to go through getting it all certified when it was a car I wasn't planning to keep for a long time You can fit airbag suspension to any car as long as you get it properly certified

I'll be moving out of this country in the next decade to the States. Everything here has become far too controlled and monitored, it's suffocating. Everything I want to do is illegal, or highly scrutinized by the police, and it's just not a great way to live. I don't even like beaches, hot weather BBQ's, or sports, so there's nothing left in Australia for me.
Another fun thing about being a car guy/girl in Australia is the EPA.. Exhaust noise limits are excessive in their restrictions and confusing at times and all you need to do is drive past someone and have them lodge a query with the EPA with your registration and you'll get a notice in the mail to get your vehicle exhaust noise tested by a certain date or your registration will be suspended. Then there is limited places that are approved by the EPA to test the noise levels, you can't monitor the test and the conditions for your specific vehicle are hard to find at best and you have no way of confirming that the test has been done properly. They even include "chirps" when the accelerator pedal is released at the test level (slow accel to test level - preset RPM level - then sudden release of accel) You'll be told that "any vehicle with an aftermarket exhaust will fail" even though there is no OEM stockpile hidden away and at some point everyone will get aftermarket parts installed on cars. You also have to pay for the test regardless of if you pass or fail, pass and you pay the costs of the test, fail and you pay the costs of the test, make the required changes and then pay for another test. You can also be fined by the EPA on top of this if they deem it so, especially if you remove the MAF sensor, delete cats or bypass mufflers. I've had a warning on a car I bought second hand but didn't modify, had to buy a whole new exhaust and test it, on another car I was reported to the EPA, it passed the testing first time without changes to the setup at all, still had to pay the "covert fine" for the test.
Yeah they even defect stuff for safety or improves safety such as big brake kits, better suspension, better seat, roll cage etc. all defectable without engineer plate. Which is quite expensive to do so. They make it hard at every turn to have a modded car. It almost killed the car scene completely. Hoon laws were introduced, heavy police presence on any modded cars and it almost died. It also makes parts and labour super expensive for modding cars because they need to pass all these regulations before they can be sold etc. It sucks and one reason I haven't touched a car in a while. Can't be asses dealing with the cops, the cost and the BS around modding. I love it and will for sure go back again soon but for the time being I am sick of being pulled over for driving normally and having a perfectly working and maintained car, much better then 90% of the cars on the road safety wise. Yet it is deemed defective. Even with engineer plates they will still defect you and make it a huge time waste getting it inspected to just get taken off as the car is completely legal per regulations. It's so annoying.
You can put bigger brakes etc on your car but they need to be engineered so they are actually safe seeing as you are changing the design aspects of the car and how it performs. Changing seats isn’t always making it safer as those seats need to pass certain safety tests first and then be okayed to be put in your car hence the engineer but in many cases now when people change seats or steering wheels they are removing airbags and this is the kind of thing that you say make the car safer but they dont
@knight2425 my point was that at every turn of modding a car there is a fee, or a restriction etc. I did mention you need it engineered but let's say you build a car that completely changed the drive line, diff, turbo, brakes, seats, exhaust, steering wheel, front mount, etc that can get very expensive. And unlike most countries where you can swap almost anything into the car....there are restrictions at least in Qld where I am from no displacement larger then what originally came in the car. They won't engineer it otherwise. I also mentioned the restrictions on mods on terms of passing certain safety guidelines etc which also increase the price of the products because they factor it in. It's all barriers so people won't mod their cars more so then safety in my opinion. I've been modding cars since I was 17 and it's changed to a very restricted thing I've the 20 or so years I've been doing it. And regardless of engineering I've been defected just to piss me off and take up my time. They know full well my cars are all legal because I make a point of pointing out the engineering plate yet I still received defects that got taken off as soon as it is inspected. They just wasted my time basically. It's all tricks and traps to discourage the car scene which pisses me off.
@ and my point was that most of the laws are to make sure the car is still safe not only to the occupation others that might be involved in an accident with it. Everything costs money and if you take up people time to get your car engineered then they want to be payed obviously and they won’t do it for nothing considering they are putting their name to it. I’ve modified cars for over 30 years and never been defected even though I’ve had loud and low cars, I put that down to my attitude with cops (been pulled over enough times) and I don’t drive like an idiot on the road or hangout with other stupidly modified cars, I don’t think me not being defected is just luck.
@knight2425 oh yeah I totally get what you are saying. I haven't been defected in a long time but when I owned a R34 I got pulled over weekly for inspections. This was when the hoons were mental and caused the scene to get targeted. So I understood it doesn't mean that some cops just wanted to pin ya for something. I knew if I ever got a defect that it would get taken off as soon as it was inspected. I've never had a major defect. Minor ones like blow off valve etc even though it was plumbed back stuff like that. There is safety then there is over regulation is all I am saying. I feel for sure in Qld that it is over policed and over regulated. I'm all for safety but it went a bit overboard here
Aussie car enthusiast here, just reminding you all of the huge blitz’s on 4WD’s too. Same issues as stated. But we’ve even had police drive around housing suburbs and leave letters in the mailbox of houses that have modified cars in the driveway that are registered, and suspected of being driven on the road with illegal modifications. You then have to front to a defect station/MVR and have the issues inspected. You can’t change the car before going as they take photos of it before you go, and this is all done in your private land. Crazy shit!
This mans from Victoria and he does not lie, it's every bit as bad as he says. I once had the highway patrol kick my tyre and say "Low tyre pressure, that's a defect" and took my car off the road, wasn't even allowed to fit the spare.... my crime? I had bigger wheels and the overall diameter was within spec according to the law and he was annoyed, alot of us decided just to modify our cars as sleepers as a result.
Here in Melbourne they send the EPA guys down to the big meets and pull up everyone leaving the meet it's pretty bs. The cops from a certain precinct go to Port Melbourne where a lot of people meet and record the plates then send out mails to everyone they recorded saying they are accused of a defect and must take their car down to their station for inspection within 14 days or have your vehicle registration suspended
I had a mate get defected for standard brakes just because they were Brembos, After that he was like if I'm going to get done for standard might as well modify it anyway.

I want to clear about the US. Each state and Commonwealth are different. Pennsylvania has some of the most restrictive road requirements where Ohio has some of the most lax laws. In Pennsylvania yearly inspections are required to legally drive on the road. Cars can be lowered to any height. They can be lifted to any height provided the bumpers are low enough for a lower vehicle to hit. Tires cannot be out beyond the fenders but fender extenders can be added to ensure mud and rocks cannot be slung and hit other drivers. Doors can be removed only if the mirrors are attached securely to the vehicle that allows drivers to see. Jeeps generally are the only ones people drive without doors and have mirror mounting available on the A pillar. All lights must work. The frames or unibodies must be solid, and no rust protruding that are an injury hazard are allowed. All brakes must work, brake shoes and pads must be of certain thickness. Tires also cannot be bald. Vehicles with emissions equipment made after 1974 are required to have all their original emissions equipment intact and visible. They don't necessarily have to work. 17 counties require emissions tests to ensure vehicles are not above certain pollution levels. Antique vehicles (those over 25 years old) and registered antique are exempt from the yearly inspection, but are not allowed to haul or be used daily. Ohio has no inspections, certain counties like Cuyahoga require emissions tests. They do have road side safety checks to make sure all lights and brakes work, but these are random. In Ohio fenderless cars are allowed so long as lights work.

Some mods require an approved engineer to sign off, but as long as you modify your car properly, then it's doable. Want to fit some brembos to your corolla.. absolutely, just get an engineer to inspect it and make sure you've done it right. He will OK it and you're fine. It''s a simple process. Want to slam your car, fit tyres too small and run highly cambered suspension.... No, that is not allowed... for good reason. QLD has no yearly roadworthy checks either. No emission tests. The muppets who do stupid and dangerous mods deserve what they get. They are looking for attention and they get it from the cops.
While he has hammed it up for the story a little, but nothing he said was untrue. The cops used to set up at the popular meet places on the Gold Coast all the time. One only has one road in and out, so they set up a road block and went through every car there. Basically took all night as my mate didn't get out of there until around 5am... If you don't believe it, you just haven't come across that special officer yet.
I'm in Canberra. If your car isn't extreme you're golden. I have a 50mm drop on my Lancer. Factory Clearance is just over 150mm. Wheels and Tyres are within factory spec (2%) and don't poke out past the guards, camber is within spec and regularly checked to reduce wear...
Whilst I modify my street cars to a point, it isn't overboard or dangerous, and I have never had a issue with the police, I've been driving modified street cars since I got my licence in 1980 Most of the cars that get defected here are either modified poorly, or they are built, look, and sound like racecars If you want a race car build it for the track or strip and put it on a trailer If you want a modified street car, follow the bouncing ball What do people expect when they build these things for the street Also, since the law has come down harder on modified cars, there is a lot less news about highly modified street cars crashing and killing people In the end, you can modify anything to a point, it'sall there in the states rules and regs for modifications, if you want more, engage a engineer and see what you can actually do legally and what is required for that I've had cars engineered legally, from a engine swap, to adding a turbo, but, I was required to comply with engineering and emissions requirements People complain about the cost of engineering, which in the scheme of a build, is actually a minimal out lay, people spend more on wheels and sound systems than what it costs to legally engineer a street car The problem is people don't do these simple things, they roll the dice, then whinge when they get a defect notice Attitude also comes into play, how you actually drive on the street, and how you talk to people is a common issue, but if you drive like a muppet on the street, and mouth off like a whinging child, you deserve to be treated that way TL;DR: you reap what you sow
Australia is an absolutely shit place for car enthusiasts I don't understand why people, especially the ones that have money don't just buy a car and a house in Europe and go there to drive like 3 or 4 times a year. And with the taxes there you could buy a car and house in Europe for the same price as just a car in Australia

not had an issue for years, but one extreme I've heard is a modified car being defected that was being transported on a flat bed, simply because it had number plate fitted, they went after it.
Australian here, on the 4wd side of things, they often have those strike forces go into forests the defect cars in the middle of the bush, making it a nightmare to get vehicles home. My Ute/pickup has been built to the letter of the vsi laws because of this. Absolutely ridiculous
Man this guy is exaggerating. I’ve been daily driving a modified car (bigger turbo, loud exhaust, lowered suspension) for ten years and have been pulled over 3-4 times. Never had the car gone over with a finetooth comb or defected. Having said that… I’m not going to car meets, driving like a dickhead or getting around with completely bald tyres or a car that is so obviously illegally modified (slammed suspension etc). Everybody has different experiences, this guy is talking the absolute worst case scenarios. Main key with police is (a) don’t make yourself a target and (b) when you do encounter them, treat them like kings. It’s not fun but they feel respected and like they’re in authority and will often go easy.
Pretty much exactly my thoughts, I've only ever had one bad experience with a cop and it was probably my own silly fault for doing a half a burnout in a car park full of other people on a Saturday night. And although he was an aggressive twat, he still didn't book me. Neither did the cops who followed me all the way home from that car park on a different night and pulled me over in my street for a 'random breath test'. Nothing came of that either, I didn't speed or do anything wrong and they ignored my super loud choppy v8 because I didn't give them any grief.
back in 2010 I got my 66 HR defected for non standard bucket seats, I new right off that the cop was going to ping me for something when he started trying to tell me the factory rear seatbelts weren't factory and that he had bad eyes when he asked if my X2 twin carbs was a triple SU setup.... Full defect not to be driven after 72hrs....been thryu numerous breath testing stations and never a problem. After he stuck the sticker on I headed home (fuming) just up the road heading the other way was a car club cruise.......I was just in the wrong place with the wrong Copper...
A little respect goes a long way. I've avoided fines and defects simply by agreeing with everything they say and dropping the odd sir... Words are cheap! Fines and defects are expensive. I've literally been busted speeding in my car or using the push bike lane with my motorbike and left the scene with a warning ⚠️ it's too easy if you're smart
aussie here, i once went to 2024 Bathurst qualifying in my dads jaguar xkr and there was this one highway patrol officer that was just waiting for him to do something stupid, except he wouldn’t because the car already has enough traction problems and eventually as soon as the double lane came up, he cut us off and did about 150 km/h through the mountains. Gotta love cops.
Sometimes it's just down to luck. I've driven modified cars to lightly modified to quite heavily. Only ever been defected once, I was driving a mates car, only mods were slightly lowered (Inch or two max) and a bigger exhaust. Didn't get done for either of those. Got done for a broken steering rack boot. Instantly a defect to Regency (Inspection station). Sadly the cost of fixing the boot and other things we knew they would pick on was greater than the value of the car. So we ended up parting it out.
It's no problem modifying your car here in Australia, but you have to do it the right way. There's rules on literally every aspect of modification and it's clearly stated in freely available documentation. Most of what you see in the video above is people modding their cars with no regard at all to what's legal, or what needs to be done to make it legal, then complaining the cops pick on them.

Ive had 3 defects on my 180SX Type X wing obstructing view...its a factory OEM wing. Ive fought each defect in court and won. The issue is that the laws and the people that are meant to enforce them make no sense.

Everyone forgets the 1990’s massive cut and shut operations that forced the repairable write off requirements. There was also huge amounts of theft that contributed to the vin requirements.
Here in the U.S., the #1 public complaint is the incredibly loud (and childlike, 'look at me'), modified exhausts on cars (motorcycles... and scooters, too). Many cars also have cut-out exhausts, where, with the flip of a switch, the mufflers are bypassed and the resulting NOISE can vibrate houses and is extremely obnoxious. Again, it is due to the very juvenile, 'LOOK AT ME. AREN'T I COOL!', attitude....which makes it worse for everyone else.
Well if you have a dirty windscreen and no way of cleaning it then it's certainly a defect, obviously away from a roadworthy inspection you'd be unlucky to cop that as a defect
Hi. I got pulled into a RBT (Roadside Breath Testing) unit in wooloomooloo after driving through Kings Cross in my 671 Supercharged 1968 Camaro. The Police officer was standing there with the plastic mouthpiece piece in his hand thinking. He then says. Oh, you might as well switch it off, you're going to be here for a while!!! He didn't even allow me to drive the car forward. He made us push the car into the bus parking area! Red Defect and tow the car home!
Yes, been through this all before, and learnt my lesson. I always see, damaged and rusty cars around, but as soon as a nice modded car comes past, they will pull it over. But, I have seen the best and worst of the authorities.
Maybe you should check the accident statistics to check on why they are doing it. Here in New Zealand they are just as tough but if we have done the modification using proper parts we can get it certified at a testing station & it is fine to drive on the road. All cars here have to do a "warrant of fitness" every year or 6 months if it is older than year 2000, the WOF inspector goes over all the safety aspects of our cars. If there is a fault you need to have it fixed within a month & have it retested. It is a hassel but the cars on the road are at least safe to drive.
Here in south africa they're strict only if you don't have money unfortunately. Even as simple as lowering, changing wheels to a lower profile if doesn't look oem and lights get you fined severely, license disks get taken but then again that when they want the extra pay. So corrupt with laws
Car maker's design a car with specifications to meet Australian design rules, there's no vantage of lowering your car, yes it changes the centre of gravity. Bigger disc brakes is just for show. Yes it will give you more braking power but that's been factered in the design. A lot of designs are for the average person. To cater for the average driver's abilities. These laws are to protect people from themselves & innocent by standers. A lot of people think that they are very good driver's & very well might be. But you must be very aware of you soundings , thing's can change in a blink of an eye, Iam blind in my right eye & must extra careful when driving & never had a accident because I'm blind in my right eye.
Car makers design a car to meet a price point. Lowering a car or putting sports suspension improves the handling of it. Bigger brakes drastically improved the braking performance. My volvo came standard with 285mm brakes, factory options of 305 all the way up to a rare two piece AP racing rotor and caliper combo. You're kidding yourself if you think cars are made well from the factory - maybe if you spend $80k+ on a dedicated sports car. If the government cares so much about safety, they'd take on the advice of our race drivers and techs Mercedes overseas - remove the bad drivers from the road and drastically increase the training and requirements for getting a license
@@waynemgtregear7228 not really. If pot holes are damaging cars with modified suspension, then they're equally damaging sports cars with ADR designs. The crappy roads are the problem. The only reason any car is getting damaged is if it's too low, not because it's purely lowered from factory height.
In N.S.W Australia we have for light vehicles over 5 years old need a yearly registration inspection you need this done to register your vehicle but there is no emissions test
In Australia you ARE in fact allowed to modify your car - but there is a number of red lines you can't cross. Under car clearance minimums, noise limits, emissions.. most of it is sensible and common sense. So you comply with all that, and you can modify the car not a problem. The rules are known in each state, it's not an arbitrary decision for the police.
Back in the late 80's I witnessed a young cop defect an Australian chrysler for having no front springs. Even with our objections, the cop went ahead with the defect. The following Monday, we went out to the inspection center (Regency park for the South Aussies), and filled the carpark there with our cars (30 mates in all), for support. The face on the inspector said it all when he read the defect. Chrysler boys will understand.
@nibba5692 is actually not strictly correct. Some modifications require engineers reports, which puts liability back on the engineer. IE forward facing bonnet air scoop. Yet Subaru wrx has just that. Because Subaru accepts liability if a pedestrian is injured by it, assuming the driver was not reckless. Some modifications are acceptable if the car was optioned with that modification. IE engine swaps. My car is a 6 cylinder, yet it was optioned with a 5L v8. All I need to do is an inspection to confirm engine number (to show not stolen), and to ensure it is fitted correctly. Manual to auto is common. Mind you the cost negates the conversion sometimes. In my case it's cheaper to sell my car and buy a v8 if I wanted one. Vehicle re-engineering is straight forward if done sensibly.
In NZ we have compulsory inspection every 6 months to get a warrant of fitness sticker, no or overdue wof sticker $200. If your car is modified it must be certified by an engineer, it is then fully photographed and that is stored on a disc that they attach to the car after the Government has approved wat the Engineer said!. Any deviation needs to be re-engineered, redone and recerted at your cost. Cert cost 3 - 10k. We have guys who import carts to both OZ and NZ from the US and they claim without doubt NZ is way harder. You guys in the USA are very lucky! G
Yea, F that. I understand safety, but this is insanity and simply a revenue generator. It sounds like you can be forced to throw away a perfectly good vehicle for subjective and arbitrary reasons. People have to replace those vehicles. I wonder if there is an auto dealer's association that pushes these laws and is what keeps them on the books via some kind of lobby effort.
There is a definite "Convict/Jailer" mentality prevalent amongst many Police and public officials here in Australia that harks back to the very foundation of the country. Australia was established as a penal colony (essentially one big open-air jail) by the British Empire almost 240 years ago, and there were only two types of people that came here in the early days; prisoners from Britain & Ireland and their guards/administrators (the Royal Marines, British Government officials). Of course over time free settlers arrived and later on many migrants from all corners of the globe, however the original mentality from the early convict days that the great unwashed public are generally a bunch of criminal misfits prone to breaking the law and must thus be kept on a very tight leash by the Police and government authorities with a zero-tolerance approach prevailed. Australia is one of the most over-policed, over-governed and over-regulated countries in the world today.
I live in South Australia, I'm 70 years old so I've been driving for 55 years. As a young bloke I was always pulled over by the cops all the time mostly for excess noise. Yep a defect! Back in the day I would go to my local cop shop to have the defect removed. Well I went through a lot of steelwool, shove it up the exhaust pipe just before I get to the cop shop, the copper would have a listen and all goes well, off comes the defect and a few k's down the road the steelwool would burn out. But today it's a different story you have to go to a motor reg facility and pay to have the defect off, if you're lucky.. Thank goodness I haven't been defected for over 4 decades. I've got a stock 350z and have never been bothered by the cops.. HooRoo
I had a fake (sticker) licence plate and darker than legal window tint on an Evo X that was slightly lowered on slightly wider wheels than stock. I had zero problems... even when two cops noticed my sticker plate, I still didn't get busted. *Attitude is everything.* Act &/or drive like a dropkick, you'll get done! The real problem is that 'enthusiasts' are taking the pee these days, especially with loud exhausts. Ripping through residential streets at midnight at WOT is stupid. Those idiots are fudging up the scene for everyone. Australia is somewhat relaxed compared to Switzerland! 'Cars with Luke' has touched on their tough laws many times.
Over the years I've had modified VH, VJ Valiant Hardtops, a VH Pacer and a 70 Dodge Charger and have been pulled over by police, only to be asked, is this car for sale?
The reason we get nailed is because they can make money off fines or defects, there s no money in actual criminal's most of the time. It's just revenue raising
As someone who loves all cars, modified or standard, I am ok with unsafe or unroadworthy being taken off the road. Most modifications are great but some are just horrific.
In Melbourne, AUS we currently have serious issues with home invasions, knife crime and medical staff and ambulance workers getting attacked, but the police are more interested in fining people for modified vehicles..... sad times
This is really clickbait. So over dramatic. The guy comes across as a complete plonker to be honest. He doesn't even know the difference between a pink and a blue slip (which is nothing to do with modifications), yeah listen to him. Fact is you can modify cars very easily in Australia. I have multiple modified cars. Yes, there are regulations that you're meant to adhere to when modifying a car. Go outside that and you're meant to get the car engineered (certified). However, people drive some completely wild stuff on the street here with no problem. Even if it's not engineered and goes outside of the guidelines. For some, way outside the guidelines... Now, you run the gauntlet on these out there cars that you can get defected. Ive been driving heavily modified cars in the eastern states for 35 years and no issues. Even when caught out doing the wrong thing on the street, I've always been let off. This guy comes across as someone who would definitely fail the attitude test and then have a cry afterwards about how hard done by he is. Ironically, a lot of the strict rules around the repair of damaged vehicles actually came about because of the criminal element involved in rebirthing cars. It was even as bad as getting your well being threatened for bidding on the wrong damaged / stollen car at auction because it was earmarked by criminal gangs. NSW came down very hard on this and it's for the better. Some other states, not hard enough. None of this affects the enjoyment of my modified cars. But hey, seems plenty of people commenting in here from elsewhere around the globe would tell me I should be leaving the country...
your sort of right, But in NSW Depends on the type of defect the police issue here in NSW which is just which box they tick on the issuing paper. Some defects only require the exact written note "Cleared" but if the whole inspection box is ticked the whole car will need to be inspected pretty much what we call a "Blue Slip" back to factory code. Generally a 5 or 7 day timeframe is stipulated on the paper unless once again cops ticks wrong box due to inexperience or just doesnt like you, this isnt much time to run around and sort the issues out sometimes or paying a workshop to fix your car to the standard is expensive being the hours of finding parts and Fitment. All of this i delt with when i first got a car license wile qualifying as and Automotive Mechanic once done i just gave up and when to motorbikes they are faster out the box and dont attract asmuch attention.
It's not just cars, they go after motorcycles as well. I got stopped for random breath testing one Saturday morning and the cop said my exhaust sounded too loud. He stuck a steel rod into the pipes and hit a baffle. Then he said I don't have a stock muffler and he will defect my bike. I pointed to the muffler and showed him that Honda was stamped on it and that it indeed was a stock Honda muffler. He still insisted it was too loud, so I showed him a photo on Honda's web site and he could see it was indeed a Honda exhaust. He was really angry and told me to get out of there. I'm in NSW by the way.
Now the random breath testing spots they setup they will give you a breath test then drug test then if you pass that they will then ask to search your vehicle and they don’t need a reason other than they want to look through your vehicle and if they still find nothing then they check absolutely everything on your vehicle to see if they can find something wrong to give you a defect ticket and charge you a fine that is so big that it makes no sense for the amount the fine is. With them checking the height of your vehicle is illegal because they are checking on a surface they haven’t the knowledge or the required tools laser level to check the surface to be level and able to check the height correctly. They put millions of dollars into all the planing area’s to set the stations up and all the other costs are absolutely disgusting. They put a add on social media how they are adding a new 300 series land to be a undercover police vehicle and it has been kitted out with heaps of aftermarket parts and then the $50-$70k wiring and lighting kits so they end up with a $300k police vehicle and this is for 1 vehicle. They could setup Suzuki jimney’s with absolutely everything it needs to be a undercover vehicle and they would be able to have 10 of them for the price of 1 Toyota landcruiser The major issues citizens are talking about and if there wheels or suspension anything on the vehicle from hitting a pothole In Australia the council or roads department very really if every pay for the damages yet it’s a law that they have to but they have put a amount of damage cost in Queensland we had storms and 100’s of 1000’s of potholes appeared on all the streets roads and highways and people had damage 1 wheel or parts that helped with steering and people were getting prices for parts and they didn’t think of other factors like if you punctured a tyre and bent a rim they would get a price for them but they actually had to put a new tyre on the other side of the vehicle with the same tread pattern to be legally driven on the road. With just a wheel repair and 1 tyre the amount was enough but because so many people had sent in invoices they simply put the amount 3 x higher. Plus if the police turned up to were you had damage your vehicle even though it happened because of the disgusting conditions of the surface your driving on some potholes are as long as family vehicles and I’m not lying and others are as deep as a semi trucks steer tyres can make them so half the size of the tyre height and as wide which can easily kill a whole family going on holiday with caravan. Because you’re vehicle has sustained damage the police have two options and 1 definitely isn’t not giving you a ticket with a fine attached they have two different types of tickets they can issue and you are getting one 1 is not driving to the condition of the road causing a single vehicle accident 2 driving with undue care causing a single vehicle accident and with these tickets if you get one on a holiday period then 6 the 2 territories it’s double demerit points and the 3 states double as well but Queensland if you get the same ticket for speed or not using something that you should have in the space of 12 months then you lose say no seatbelt it’s $1,300 and 4 points and if you get another in 6 months then you have another $1,300 fine but 8 points on that ticket and now no license either and it’s 2,5 years before you get points back on your license. I asked a police bully one day how did they justify the theft amount they put on all the driving offences that citizens are hunted for you to meet quoters that you are given each month well they didn’t answer and decided they should search my vehicle and throw and break everything they could get away with onto the footpath and then after they took the handcuffs off that where 5 clicks more than they should have been and my hands purple when they came off they would leave and say have fun getting home and they would pull relays out under the bonnet and throw them on the grass with your stuff and they would warn you and say don’t go into any station and put in a complaint because any time your vehicle is off your property it’s going to have this done every time and for as long or more pulling it apart with tools or cutting every seat open up look in and they don’t have to pay for anything to be fixed because Australians have had just about every single right taken away from them if we question a cop they can and will throw you in the watch house and you will get 3-4 new charges from them before you get to see a lawyer or judge and we aren’t allowed to hold our cameras or phone and they are going to make a law citizens are not permitted to be able to record police interactions with any recording devices if they stop your vehicle enter your premises or you have a spy recording device on your person and the reason being is citizens should simply do the right thing and police wouldn’t have to stop them and then have an interaction with you and citizens shouldn’t have doubts that the police isn’t being honest with why you have been approached by police and citizens should simply obey and not question or suffer the consequences

The police can not search your vehicle without a warrant or probable cause. Unless you have a knife on the seat or other weapon in plain view, or they can smell weed etc then they can ask to search your car but you can say no and there is nothing they can do about it. The laws are exactly the same as for your house and even your mobile phone. They cant just say we will search your car now for no good reason other than that they want to. Most people don't know what their rights are so immediately drop to the ground to lick cops boots. FTP.

Ive had many modified sports cars. never had a problem in NSW. the only ones out of anyone ive seen or knew that had issues brought it on themselves with utterly stupid mods or just bad quality work. People are incredibly ignorant. They think that their tyres sticking out of the guards isnt a safety issue. They dont see how an irresponsibly lowered car is actually very dangerous and can have shocking handling effects on normal roads.
Loads of stupidly modified 4wd's too. Sooooo many of them are way over weight, or have terribly modified suspension or emissions equipment cut out.

So I have been fortunate enough to be able to avoid police attention on all my cars in the past, but I am also under the mindset that if you modify your car tastefully, keep it clean and be a nice human to Police if they pull you over, you're usually pretty good.
However, the Night Scene car meets are a straight up avoid nowadays, any meet big or small after 5pm is a guarantee defect station. Which unfortunately kills a lot of the passion for people early on. Defcet Stations are a big thing, but they can also pull you asside during random breath testing, or just in general if they see you driving around.
What also makes matters worse, there are also a few of my UA-cam friends, mainly in Melbourme, who regularly have police come door knocking to defect cars or give you a summons because of dangerous driving on UA-cam Videos. They watch us very closely, but I can also understand that as us becoming larger "influencers" doing the right thing should be promoted. Anything on Social media here is HIGHLY watched by the government.
In saying that. I have delt with horrible Police Officers, and yes they will certainly turn a blind eye to proper wrecks on the road, where a tastefully modified car get pulled over and gets defected for "having bigger brakes without it being engineered".
Another huge issue is usually HWP dont know what they're looking for, and have been known to Defect OEM options on older cars, privacy glass and Standard Supercar Exhaust.
We also have terrible roads here, where pot holes can go months without being fixed, no many driveways or speed bumps actually allow for the minimum 100mm height limit, and roadworks sites that you physically have to avoid to hopefully not damage your car.
But as always, right time right place, If I'm ripping through the mountains in my evo with no one around and happen to be spotted by a cop, they usually dont mind much and say "slow down, if I see you again doing the same thing I'll have to act", and thats usually how it goes.
It's definitely become a time and place thing. And does also depend a bit more about what you drive. 10 years ago if a cop saw a modified Skyline or a modded Commodore they would almost always go after the Skyline. These days it's more or less how your behaving when they see you.
Thankfully my main modified car somewhat flies under the radar as long as it's moving. I've just got to take my chances at an RBT.
Also thankfully most of the night meets in SEQ seem to be ok as long as people aren't being muppets.
When it comes to modified cars Victoria seems to be the hardest on things followed by NSW.

@ZacBaldy don't know if you remember the phase 5 give away by street machine years ago. An 85 or 86 XF Falcon with a v8 Windsor in it. The car never originally came out with a v8. Yet the winner apparently was a South Australian, and he couldn't register the car here because it didn't come with engineering paperwork, and no south Aussie engineer would sign off on the finished car as he didn't do the regular checks during the build.

One of Australia's major car websites recently reported of cars being 'defected' because, get this.. the Shift Pattern embossed into the top of the gear lever knob was obscured, worn out, no longer stock, or had been removed. The story originated from an incident in Western Australia, but when "Car Expert" investigated if other States also followed suit with similar legal interpretations of their laws, the good old Victorian Police reportedly said that yes a shift knob gear-pattern (or lack thereof) could possibly be a prosecutable offence, but would neither confirm or deny if it in fact was!
Speaking from personal experience, many years ago I was pulled over and received a fine from the Victoria Police for the crime of "Exhibiting Acceleration". Not 'excessive' acceleration, mind you - just exhibiting acceleration! No wheelspin or speeding involved whatsoever, merely accelerating from stationary too smartly for the liking of one single Policeman. Which raises many questions; including how can one proceed from stationary WITHOUT exhibiting some form of acceleration?? In other words, it's a convenient crime of perception, interpreted in random, and applied on a whim. Btw this was in the mid 1970s, my car was a stock 1969 Ford Fairmont V8, and iirc the fine was $63 or thereabouts.
Yes my son couldn't get RWC on his HZ cos it had a white cue ball on shifter from previous owner so he had to etch out the pattern for RWC. But for me back in the 80's i was pulled over every second week for RW checks cos of window tint and mag wheels on a stock standard car. Back then if you had tint and wheels you were a hoon. Best one was in melb cbd checks on batman ave (now fed square) where cop doing the checks didnt know how to change gears as he was sitting in drivers seat wanting to start engine to test brakes, told him to just press clutch since he couldnt find neutral.

I am an Aussie and given all the crime problems this country has (violent crime, theft, drugs etc) I don't think going after car mods is really the best use of police resources. If its a genuine issue (e.g. it makes the vehicle genuinely unsafe, it creates a hazard for other road users or it causes problems like excessive noise pollution) then sure, get it off the road but otherwise if its not harming anyone, let it be.

There are AFP station Sergeants in Canberra that run the minimum number of RBT's they can get away with because they are such a resource intensive undertaking. Officers need to be diverted from other duties for several hours for an RBT stop that is only really viable for 10 minutes.

There was also a guy who made a toy power wheels ride on car road legal and registered it.

I’ve had modified cars for forty years in Australia and have never copped a defect. My ‘71 LTD 2door hardtop is lowered four inches, has 10 inch wide rears, cranky big block, loud exhaust, steering wheel and seats changed and was my daily driver for seven years. The cops can be arseholes at times but if you’re not being a dickhead they are generally pretty good. Annual road worthy certificates are a pain but it’s nice to know that the car heading towards my family has at least been checked by a mechanic in the last year. Anyway breaking rules and dodging cops has always been part of the game.
100%. The only time I copped a defect (too low was self clearing) was on a random back street taking a mate home from the pub and we just happened on an RBT station. And the guys there thought my car was a bit low so out came the wheel. They also thought it was a bit fumey (decent size cam in an LS will do that on idle)
But 1 defect in over 15 years owning said car wasn't bad. As you said it's part of the game. Had we taken a different street it'd have been no dramas.
Also the state you live in does dictate the rules. So what happened to me might not happen in another state.
Just shy of 40 years driving modified classic cars here in WA and never had a Canary on any vehicle, despite hundreds of police stops over the decades.
I can see that the eastern states are a hell of a lot more focused on defecting vehicles than they are over here!

I live in the ACT (The capitol of Australia). I've never had a defect, I've also never had my car inspected as part of an RBT. Yes, my car is modified within reason though, Lowered suspension, after market rims, strut brace and after market audio. It is all within limits though. It's not too low (meets the 100mm minimum), wheels and tires fit within the guards at correct offset, the wiring for the audio is all checked and approved...
so why bother ''modify,ing it''. checked & approved stereo,??.. ITS 12V.. we should all move to america, europe. WHERE THEY DONT GIVE A SHT.. unless you kill someone.. cars are easy targets..
Its isn't "what the police don't like".. Its what places your vehicle in breach of the ADR's or Australian Design Rules. The rules that ensure cars remain safe for the road. It is the task of police to help enforce compliance with the ADR's
You'll be surprised what can place you in breach of the ADR's. Even off the shelf lowering kits can make you illegal.
What makes adherence to the ADR's an issue, is each state has its own interpetation of them. So for example, whats legal in New South Wales, might be illegal in all other states. (Of course, its fine to drive in those states with new south wales rego. if you move there, your car will not pass a road worthy/safety check..)..

In North Carolina people cruise the main strip in some towns with modified cars that are clearly not even street legal. The louder the exhaust the better. It's like a competition. As long as your not being a hooligan or racing the cops could care less. That's how it should be. Infact I rarely see people pulled over for speeding. When I see someone pulled over it's usually 3-5 cop cars and they all have their guns drawn. Kinda makes me laugh actually. Knowing they are taking the actual criminals off the streets.

Laws are different. Pedestrian safety standards have different requirements, probably emissions laws as well.

Nek minute - breathalyser, wheel stick comes out, have to operate my lights to prove it. This is all despite them finding brand new tyres, car was stock height, and I don't drink.

I have never had them not ask for my license in the 3 or 4 times I have been breath tested in the last few years. They also have quite an attitude, probably as most people dislike being randomly pulled over and have the appropriate disrespect for the situation themselves.

The last time I was asked for a licence there was a notice on the car due to the previous owner not paying fines (the registration can also be suspended for this reason). After explaining that I had just recently bought the car the sherif cleared the flag.

Old mate is exaggerating a fair bit. Yes, modified cars get pulled over & defected all the time, but these are usually modified cars at the extreme end of the spectrum. Modifications are allowed within legal guidelines & most people who modify their cars adhere to those & never have a problem. MCM, who are in my State, modify cars on UA-cam all the time & don't have issues because they do it within the guidelines.
Get in to motorcycles if you want to modify a vehicle without restrictions or concerns over being defected. There isn't a motorcycle in Australia that hasn't been modified, unless it's new & sitting on a showroom floor. All of my bikes are modified. I've already modified the brand new bike I bought 2 months ago with 17 modifications.

As a retired ( semi) mechanic in new zealand , we have rules, obey them! If the minimum clearance is 100mm don't drop your car to 80, if the rules say cover your tyres, don't hang them 50mm outside the guards , if you have 9" rims don't put on tyres meant for 6" rims, the amount of crap mods that are on cars that are mainly performed by internet trained back yard goons horrify me as a 10.000hour apprentice trained mechanic (that's 5 years by the way) why spend $30 on a paint job and $500 on illegal mods that g

Tassie also has Call In Notices - if there is suspicion that work/modifications are not legal/correctly implemented on a pulled over vehicle, or a vehicle is noticed/reported to be unroadworthy, then the operator has the indicated number of days to have the vehicle inspected and declared clear to drive - certified modifications are fine, you just need to take the paperwork as well when you take the vehicle in for the inspection
I've been driving modified cars in Aus for 18 years and never copped a defect notice.
Got out of plenty of defect notices by being polite and respectful to the police officers who pulled me over. A lot of mung beans can't understand this logic and get every car they ever owned sticker'd due to their shite attitude.

Here in western australia they arnt as tyrannical about modifying your vehicle as in the eastern states. But in saying that in my late teens early 20s i had VH commodore with ozzy 308. Nothing all that special but i did my roof carpentry apprenticeship during day and worked as cook at night, essentially 14 hr days, to pay for my 308 to be rebuilt with some mild modes, lumpy cam etc, my trimatic 3 speed rebuilt with a stage 2 shift kit, brand new exhaust fitted where i could swap out the muffler for straight through pipe for car events etc, and all new suspension all round with king spring lows and it ran on fat maxxis that wrapped 15inch pursuit rims, nothing crazy at all. On the friday night of the first week she was back on the rd! coming home from my dinnner shift i went through abooze bus and sure enough a sargent on a power trip to try and impress a rookie told me to pull up for a vehicle inspection. First thing he says is he asks who modified my exhaust? 😂 even with the muffler on he claimed it was to loud 🤔🤷♂️🤣. I told him no one modified, its a brand new performance exhaust system from an exhaust shop, i had the receipts for all new work done on the car sitting in the glove box. Then it was the usual pop the hood. When he opened it and saw the feshly rebuilt and sparkling clean 308 in sparkling clean engine bay all he had to say was " wow ". I piped up and said " you have no idea what you are looking at do ya mate? ' 😂. Yeh he didnt like that 😏🤷♂️😂. Funnly enough he didnt pick on how low my car was?🤔 lol but yeh proceeded to yellow sticker me for the apparently loud exhaust. I then got a $150 fine for abusing the shit out of him for smashing his fist on my boot when i started the car screaming " dont fking rev ur car! " lol being vacumm carby on the motor ( from memory a holly revenge? ) u tend to have give it a couple small pumps of accelerator to bring up fuel pressure 😂. Well actually first the sarge threaten to red sticker my car which made me fly of the rails even more telling him he had nothing to justify the yellow sticker let alone a red one! So he was like fine i will fine you for offence language and my response was " fk u and your power trip! " bam! $150 fine😂. The look on the rookies face when i flew of the rails was priceless. I did mention to the rookie that if he wants respect from car enthusiasts that aint the way to get it. Following monday i was at the pits where car cleard to be legal and inspector stating the sargent was a wanker for even putting it on 😂. My second home ended up being the pits with that car lol even though it wasnt anything all that special and not all that loud? Fk it was cop magnet!😂
I did one time get caught doing donuts on a street that was at the back of industrial yard that was never used. The rd was black with rubber as it was a popular spot lol. On that occasion i got a yellow sticker for bald tyres even though i was putting rd legal tyres back on 😏🤣 and that was it. Good old days! Where there was no such thing as a hoon law lol
Now i own a tiger mica red with gold flake 1977 HX GTS monaro with a 500hp 383 chev, sequential shift 3 speed turbo 400 built to handle 800hp, one piece tail shaft, 9inch with 3:47 ratio and detroit locker. I forget what suspension 🤔 but the springs light blue? Lol she is fairly low and sticks to the rd bloody well considering her size and weight. She has original 14inch GTS rims and she runs big 4 into 1 headers into twin 2 and half inch exhaust system with catalyic converters and no mufflers! 😏 this old girl is loud even at idle!😂 yet not once since the day ive owned her ( 15 years ) have i ever been pulled over by the police, not a single yellow sticker 🤔🤷♂️🤣. Actually Only time ive interacted with police while being in this car was 2 police officers coming over while i was idling at the servo asking if they could have a look 😏🤣👍. 8:54

So the event being referred to with the racetrack was called modball rally. We were heading to the track when we were put through the largest defect station in Australia at the time. Most cars got through with minor stuff but a few basically were told they couldn't drive on Queensland's roads. Those guys hired trailers and a couple of locals kindly towed them to the other track day. Everyone did the right thing no one was speeding on public roads just enjoying our cars. The other story about the defects we had a guy come from South Australia to participate he was defected the morning we were driving to the Gold Coast from Sydney he was given a few hours to either fix his car or leave the state and he left the state back to South Australia.

Talking about the Defect Notice Stations, every Summernats (massive car show in January, I think, wish I had the time to go) in Canberra, Australia. The Police set the Defect Stations and Patrols all around the city, plus off the Federal Highway at the city border. They check everything. You mod it the way they don't like, they send a Defect Notice, need 14 days to clear it or your registration is suspended nation wide, regardless of where it is registered.
My Toyota Soarer got defeated for tems coil overs and wheels that were one size to small from stock, So I went and got engineering report and stuck it back to the m. Since the soarer was stock with airbag suspension even if I did put it back to stock it's not allowed in Australia anyway
Incorrect, airbag suspension is allowed and some manufacturers have sold new cars with airbag suspension (HSV, Citroen, etc)
I owned a 1991 Soarer with factory airbag suspension and it was imported into Australia and passed compliance just fine (along with many other Soarers), i looked at coilovers but didn't bother in the end as didn't want to go through getting it all certified when it was a car I wasn't planning to keep for a long time

As an Australian I can assure you we are controlled like robots like a dictatorship without the executions, and that is no exaggeration. I love America for many reasons.
I'll be moving out of this country in the next decade to the States. Everything here has become far too controlled and monitored, it's suffocating. Everything I want to do is illegal, or highly scrutinized by the police, and it's just not a great way to live. I don't even like beaches, hot weather BBQ's, or sports, so there's nothing left in Australia for me.
Another fun thing about being a car guy/girl in Australia is the EPA..
Exhaust noise limits are excessive in their restrictions and confusing at times and all you need to do is drive past someone and have them lodge a query with the EPA with your registration and you'll get a notice in the mail to get your vehicle exhaust noise tested by a certain date or your registration will be suspended.
Then there is limited places that are approved by the EPA to test the noise levels, you can't monitor the test and the conditions for your specific vehicle are hard to find at best and you have no way of confirming that the test has been done properly.
They even include "chirps" when the accelerator pedal is released at the test level (slow accel to test level - preset RPM level - then sudden release of accel)
You'll be told that "any vehicle with an aftermarket exhaust will fail" even though there is no OEM stockpile hidden away and at some point everyone will get aftermarket parts installed on cars.
You also have to pay for the test regardless of if you pass or fail, pass and you pay the costs of the test, fail and you pay the costs of the test, make the required changes and then pay for another test.
You can also be fined by the EPA on top of this if they deem it so, especially if you remove the MAF sensor, delete cats or bypass mufflers.
I've had a warning on a car I bought second hand but didn't modify, had to buy a whole new exhaust and test it, on another car I was reported to the EPA, it passed the testing first time without changes to the setup at all, still had to pay the "covert fine" for the test.
Yeah they even defect stuff for safety or improves safety such as big brake kits, better suspension, better seat, roll cage etc. all defectable without engineer plate. Which is quite expensive to do so. They make it hard at every turn to have a modded car.
It almost killed the car scene completely. Hoon laws were introduced, heavy police presence on any modded cars and it almost died.
It also makes parts and labour super expensive for modding cars because they need to pass all these regulations before they can be sold etc.
It sucks and one reason I haven't touched a car in a while. Can't be asses dealing with the cops, the cost and the BS around modding. I love it and will for sure go back again soon but for the time being I am sick of being pulled over for driving normally and having a perfectly working and maintained car, much better then 90% of the cars on the road safety wise. Yet it is deemed defective. Even with engineer plates they will still defect you and make it a huge time waste getting it inspected to just get taken off as the car is completely legal per regulations. It's so annoying.
Take up arms against the state
You can put bigger brakes etc on your car but they need to be engineered so they are actually safe seeing as you are changing the design aspects of the car and how it performs. Changing seats isn’t always making it safer as those seats need to pass certain safety tests first and then be okayed to be put in your car hence the engineer but in many cases now when people change seats or steering wheels they are removing airbags and this is the kind of thing that you say make the car safer but they dont
@knight2425 my point was that at every turn of modding a car there is a fee, or a restriction etc. I did mention you need it engineered but let's say you build a car that completely changed the drive line, diff, turbo, brakes, seats, exhaust, steering wheel, front mount, etc that can get very expensive.
And unlike most countries where you can swap almost anything into the car....there are restrictions at least in Qld where I am from no displacement larger then what originally came in the car. They won't engineer it otherwise.
I also mentioned the restrictions on mods on terms of passing certain safety guidelines etc which also increase the price of the products because they factor it in.
It's all barriers so people won't mod their cars more so then safety in my opinion.
I've been modding cars since I was 17 and it's changed to a very restricted thing I've the 20 or so years I've been doing it.
And regardless of engineering I've been defected just to piss me off and take up my time. They know full well my cars are all legal because I make a point of pointing out the engineering plate yet I still received defects that got taken off as soon as it is inspected. They just wasted my time basically.
It's all tricks and traps to discourage the car scene which pisses me off.

@knight2425 oh yeah I totally get what you are saying. I haven't been defected in a long time but when I owned a R34 I got pulled over weekly for inspections. This was when the hoons were mental and caused the scene to get targeted. So I understood it doesn't mean that some cops just wanted to pin ya for something. I knew if I ever got a defect that it would get taken off as soon as it was inspected. I've never had a major defect. Minor ones like blow off valve etc even though it was plumbed back stuff like that.

Aussie car enthusiast here, just reminding you all of the huge blitz’s on 4WD’s too. Same issues as stated. But we’ve even had police drive around housing suburbs and leave letters in the mailbox of houses that have modified cars in the driveway that are registered, and suspected of being driven on the road with illegal modifications. You then have to front to a defect station/MVR and have the issues inspected. You can’t change the car before going as they take photos of it before you go, and this is all done in your private land. Crazy shit!

Here in Melbourne they send the EPA guys down to the big meets and pull up everyone leaving the meet it's pretty bs. The cops from a certain precinct go to Port Melbourne where a lot of people meet and record the plates then send out mails to everyone they recorded saying they are accused of a defect and must take their car down to their station for inspection within 14 days or have your vehicle registration suspended

I want to clear about the US. Each state and Commonwealth are different. Pennsylvania has some of the most restrictive road requirements where Ohio has some of the most lax laws. In Pennsylvania yearly inspections are required to legally drive on the road. Cars can be lowered to any height. They can be lifted to any height provided the bumpers are low enough for a lower vehicle to hit. Tires cannot be out beyond the fenders but fender extenders can be added to ensure mud and rocks cannot be slung and hit other drivers. Doors can be removed only if the mirrors are attached securely to the vehicle that allows drivers to see. Jeeps generally are the only ones people drive without doors and have mirror mounting available on the A pillar. All lights must work. The frames or unibodies must be solid, and no rust protruding that are an injury hazard are allowed. All brakes must work, brake shoes and pads must be of certain thickness. Tires also cannot be bald. Vehicles with emissions equipment made after 1974 are required to have all their original emissions equipment intact and visible. They don't necessarily have to work. 17 counties require emissions tests to ensure vehicles are not above certain pollution levels. Antique vehicles (those over 25 years old) and registered antique are exempt from the yearly inspection, but are not allowed to haul or be used daily. Ohio has no inspections, certain counties like Cuyahoga require emissions tests. They do have road side safety checks to make sure all lights and brakes work, but these are random. In Ohio fenderless cars are allowed so long as lights work.

I live in the same state as him and you can modify your vehicle. Some mods require an approved engineer to sign off, but as long as you modify your car properly, then it's doable. Want to fit some brembos to your corolla.. absolutely, just get an engineer to inspect it and make sure you've done it right. He will OK it and you're fine. It''s a simple process.

One only has one road in and out, so they set up a road block and went through every car there. Basically took all night as my mate didn't get out of there until around 5am... If you don't believe it, you just haven't come across that special officer yet.
I'm in Canberra. If your car isn't extreme you're golden. I have a 50mm drop on my Lancer. Factory Clearance is just over 150mm. Wheels and Tyres are within factory spec (2%) and don't poke out past the guards, camber is within spec and regularly checked to reduce wear...

In the end, you can modify anything to a point, it'sall there in the states rules and regs for modifications, if you want more, engage a engineer and see what you can actually do legally and what is required for that

People complain about the cost of engineering, which in the scheme of a build, is actually a minimal out lay, people spend more on wheels and sound systems than what it costs to legally engineer a street car

Australian here, on the 4wd side of things, they often have those strike forces go into forests the defect cars in the middle of the bush, making it a nightmare to get vehicles home. My Ute/pickup has been built to the letter of the vsi laws because of this. Absolutely ridiculous

Having said that… I’m not going to car meets, driving like a dickhead or getting around with completely bald tyres or a car that is so obviously illegally modified (slammed suspension etc).

Main key with police is (a) don’t make yourself a target and (b) when you do encounter them, treat them like kings. It’s not fun but they feel respected and like they’re in authority and will often go easy.
Pretty much exactly my thoughts, I've only ever had one bad experience with a cop and it was probably my own silly fault for doing a half a burnout in a car park full of other people on a Saturday night. And although he was an aggressive twat, he still didn't book me. Neither did the cops who followed me all the way home from that car park on a different night and pulled me over in my street for a 'random breath test'. Nothing came of that either, I didn't speed or do anything wrong and they ignored my super loud choppy v8 because I didn't give them any grief.
back in 2010 I got my 66 HR defected for non standard bucket seats, I new right off that the cop was going to ping me for something when he started trying to tell me the factory rear seatbelts weren't factory and that he had bad eyes when he asked if my X2 twin carbs was a triple SU setup.... Full defect not to be driven after 72hrs....been thryu numerous breath testing stations and never a problem. After he stuck the sticker on I headed home (fuming) just up the road heading the other way was a car club cruise.......I was just in the wrong place with the wrong Copper...

A little respect goes a long way. I've avoided fines and defects simply by agreeing with everything they say and dropping the odd sir... Words are cheap! Fines and defects are expensive. I've literally been busted speeding in my car or using the push bike lane with my motorbike and left the scene with a warning ⚠️ it's too easy if you're smart

aussie here, i once went to 2024 Bathurst qualifying in my dads jaguar xkr and there was this one highway patrol officer that was just waiting for him to do something stupid, except he wouldn’t because the car already has enough traction problems and eventually as soon as the double lane came up, he cut us off and did about 150 km/h through the mountains. Gotta love cops.

Sometimes it's just down to luck. I've driven modified cars to lightly modified to quite heavily. Only ever been defected once, I was driving a mates car, only mods were slightly lowered (Inch or two max) and a bigger exhaust. Didn't get done for either of those. Got done for a broken steering rack boot. Instantly a defect to Regency (Inspection station). Sadly the cost of fixing the boot and other things we knew they would pick on was greater than the value of the car. So we ended up parting it out.
I didn't think that there was a branch of government that I could dislike more than our current one, but I was wrong!
Added to this, Australia are now wanting in most states to have a High performance car license. I F'n hate living here sometimes.

It's no problem modifying your car here in Australia, but you have to do it the right way. There's rules on literally every aspect of modification and it's clearly stated in freely available documentation. Most of what you see in the video above is people modding their cars with no regard at all to what's legal, or what needs to be done to make it legal, then complaining the cops pick on them.
Yeah right they jump through hoops! I tried to put a factory suspension into my falcon that was optional on another variant same model. Not allowing it with out a engineers report

Ive fought each defect in court and won.

Everyone forgets the 1990’s massive cut and shut operations that forced the repairable write off requirements. There was also huge amounts of theft that contributed to the vin requirements.

Here in the U.S., the #1 public complaint is the incredibly loud (and childlike, 'look at me'), modified exhausts on cars (motorcycles... and scooters, too). Many cars also have cut-out exhausts, where, with the flip of a switch, the mufflers are bypassed and the resulting NOISE can vibrate houses and is extremely obnoxious. Again, it is due to the very juvenile, 'LOOK AT ME. AREN'T I COOL!', attitude....which makes it worse for everyone else.

Well if you have a dirty windscreen and no way of cleaning it then it's certainly a defect, obviously away from a roadworthy inspection you'd be unlucky to cop that as a defect
Hi. I got pulled into a RBT (Roadside Breath Testing) unit in wooloomooloo after driving through Kings Cross in my 671 Supercharged 1968 Camaro. The Police officer was standing there with the plastic mouthpiece piece in his hand thinking. He then says. Oh, you might as well switch it off, you're going to be here for a while!!! He didn't even allow me to drive the car forward. He made us push the car into the bus parking area! Red Defect and tow the car home!

Yes, been through this all before, and learnt my lesson. I always see, damaged and rusty cars around, but as soon as a nice modded car comes past, they will pull it over. But, I have seen the best and worst of the authorities.
Maybe you should check the accident statistics to check on why they are doing it. Here in New Zealand they are just as tough but if we have done the modification using proper parts we can get it certified at a testing station & it is fine to drive on the road. All cars here have to do a "warrant of fitness" every year or 6 months if it is older than year 2000, the WOF inspector goes over all the safety aspects of our cars. If there is a fault you need to have it fixed within a month & have it retested. It is a hassel but the cars on the road are at least safe to drive.
Here in south africa they're strict only if you don't have money unfortunately. Even as simple as lowering, changing wheels to a lower profile if doesn't look oem and lights get you fined severely, license disks get taken but then again that when they want the extra pay. So corrupt with laws

Car maker's design a car with specifications to meet Australian design rules, there's no vantage of lowering your car, yes it changes the centre of gravity. Bigger disc brakes is just for show. Yes it will give you more braking power but that's been factered in the design.
A lot of designs are for the average person. To cater for the average driver's abilities.
These laws are to protect people from themselves & innocent by standers. A lot of people think that they are very good driver's & very well might be. But you must be very aware of you soundings , thing's can change in a blink of an eye, Iam blind in my right eye & must extra careful when driving & never had a accident because I'm blind in my right eye.

Car makers design a car to meet a price point.
Lowering a car or putting sports suspension improves the handling of it.
Bigger brakes drastically improved the braking performance.
My volvo came standard with 285mm brakes, factory options of 305 all the way up to a rare two piece AP racing rotor and caliper combo. You're kidding yourself if you think cars are made well from the factory - maybe if you spend $80k+ on a dedicated sports car.
If the government cares so much about safety, they'd take on the advice of our race drivers and techs Mercedes overseas - remove the bad drivers from the road and drastically increase the training and requirements for getting a license

If pot holes are damaging cars with modified suspension, then they're equally damaging sports cars with ADR designs. The crappy roads are the problem.
The only reason any car is getting damaged is if it's too low, not because it's purely lowered from factory height.
In N.S.W Australia we have for light vehicles over 5 years old need a yearly registration inspection you need this done to register your vehicle but there is no emissions test
In Australia you ARE in fact allowed to modify your car - but there is a number of red lines you can't cross. Under car clearance minimums, noise limits, emissions.. most of it is sensible and common sense. So you comply with all that, and you can modify the car not a problem. The rules are known in each state, it's not an arbitrary decision for the police.
I've had vehicles engineered and defected the next week because " those tyres don't look legal "
Back in the late 80's I witnessed a young cop defect an Australian chrysler for having no front springs. Even with our objections, the cop went ahead with the defect. The following Monday, we went out to the inspection center (Regency park for the South Aussies), and filled the carpark there with our cars (30 mates in all), for support. The face on the inspector said it all when he read the defect. Chrysler boys will understand.

@nibba5692 is actually not strictly correct. Some modifications require engineers reports, which puts liability back on the engineer. IE forward facing bonnet air scoop. Yet Subaru wrx has just that. Because Subaru accepts liability if a pedestrian is injured by it, assuming the driver was not reckless. Some modifications are acceptable if the car was optioned with that modification. IE engine swaps. My car is a 6 cylinder, yet it was optioned with a 5L v8. All I need to do is an inspection to confirm engine number (to show not stolen), and to ensure it is fitted correctly. Manual to auto is common. Mind you the cost negates the conversion sometimes. In my case it's cheaper to sell my car and buy a v8 if I wanted one. Vehicle re-engineering is straight forward if done sensibly.

In NZ we have compulsory inspection every 6 months to get a warrant of fitness sticker, no or overdue wof sticker $200. If your car is modified it must be certified by an engineer, it is then fully photographed and that is stored on a disc that they attach to the car after the Government has approved wat the Engineer said!. Any deviation needs to be re-engineered, redone and recerted at your cost. Cert cost 3 - 10k. We have guys who import carts to both OZ and NZ from the US and they claim without doubt NZ is way harder. You guys in the USA are very lucky! G
Yea, F that. I understand safety, but this is insanity and simply a revenue generator. It sounds like you can be forced to throw away a perfectly good vehicle for subjective and arbitrary reasons. People have to replace those vehicles. I wonder if there is an auto dealer's association that pushes these laws and is what keeps them on the books via some kind of lobby effort.

There is a definite "Convict/Jailer" mentality prevalent amongst many Police and public officials here in Australia that harks back to the very foundation of the country. Australia was established as a penal colony (essentially one big open-air jail) by the British Empire almost 240 years ago, and there were only two types of people that came here in the early days; prisoners from Britain & Ireland and their guards/administrators (the Royal Marines, British Government officials).
Of course over time free settlers arrived and later on many migrants from all corners of the globe, however the original mentality from the early convict days that the great unwashed public are generally a bunch of criminal misfits prone to breaking the law and must thus be kept on a very tight leash by the Police and government authorities with a zero-tolerance approach prevailed. Australia is one of the most over-policed, over-governed and over-regulated countries in the world today.

I live in South Australia, I'm 70 years old so I've been driving for 55 years. As a young bloke I was always pulled over by the cops all the time mostly for excess noise. Yep a defect! Back in the day I would go to my local cop shop to have the defect removed. Well I went through a lot of steelwool, shove it up the exhaust pipe just before I get to the cop shop, the copper would have a listen and all goes well, off comes the defect and a few k's down the road the steelwool would burn out. But today it's a different story you have to go to a motor reg facility and pay to have the defect off, if you're lucky.. Thank goodness I haven't been defected for over 4 decades. I've got a stock 350z and have never been bothered by the cops.. HooRoo
I had a fake (sticker) licence plate and darker than legal window tint on an Evo X that was slightly lowered on slightly wider wheels than stock. I had zero problems... even when two cops noticed my sticker plate, I still didn't get busted. *Attitude is everything.* Act &/or drive like a dropkick, you'll get done!
The real problem is that 'enthusiasts' are taking the pee these days, especially with loud exhausts. Ripping through residential streets at midnight at WOT is stupid. Those idiots are fudging up the scene for everyone.

Over the years I've had modified VH, VJ Valiant Hardtops, a VH Pacer and a 70 Dodge Charger and have been pulled over by police, only to be asked, is this car for sale?
The reason we get nailed is because they can make money off fines or defects, there s no money in actual criminal's most of the time. It's just revenue raising
As someone who loves all cars, modified or standard, I am ok with unsafe or unroadworthy being taken off the road. Most modifications are great but some are just horrific.
In Melbourne, AUS we currently have serious issues with home invasions, knife crime and medical staff and ambulance workers getting attacked, but the police are more interested in fining people for modified vehicles..... sad times

Fact is you can modify cars very easily in Australia. I have multiple modified cars. Yes, there are regulations that you're meant to adhere to when modifying a car. Go outside that and you're meant to get the car engineered (certified).
However, people drive some completely wild stuff on the street here with no problem. Even if it's not engineered and goes outside of the guidelines. For some, way outside the guidelines... Now, you run the gauntlet on these out there cars that you can get defected.
Ive been driving heavily modified cars in the eastern states for 35 years and no issues. Even when caught out doing the wrong thing on the street, I've always been let off. This guy comes across as someone who would definitely fail the attitude test and then have a cry afterwards about how hard done by he is.
Ironically, a lot of the strict rules around the repair of damaged vehicles actually came about because of the criminal element involved in rebirthing cars. It was even as bad as getting your well being threatened for bidding on the wrong damaged / stollen car at auction because it was earmarked by criminal gangs. NSW came down very hard on this and it's for the better. Some other states, not hard enough.
None of this affects the enjoyment of my modified cars. But hey, seems plenty of people commenting in here from elsewhere around the globe would tell me I should be leaving the country...

Depends on the type of defect the police issue here in NSW which is just which box they tick on the issuing paper.
Some defects only require the exact written note "Cleared" but if the whole inspection box is ticked the whole car will need to be inspected pretty much what we call a "Blue Slip" back to factory code.
Generally a 5 or 7 day timeframe is stipulated on the paper unless once again cops ticks wrong box due to inexperience or just doesnt like you, this isnt much time to run around and sort the issues out sometimes or paying a workshop to fix your car to the standard is expensive being the hours of finding parts and Fitment.
All of this i delt with when i first got a car license wile qualifying as and Automotive Mechanic once done i just gave up and when to motorbikes they are faster out the box and dont attract asmuch attention.

It's not just cars, they go after motorcycles as well. I got stopped for random breath testing one Saturday morning and the cop said my exhaust sounded too loud. He stuck a steel rod into the pipes and hit a baffle. Then he said I don't have a stock muffler and he will defect my bike. I pointed to the muffler and showed him that Honda was stamped on it and that it indeed was a stock Honda muffler. He still insisted it was too loud, so I showed him a photo on Honda's web site and he could see it was indeed a Honda exhaust. He was really angry and told me to get out of there. I'm in NSW by the way.
Now the random breath testing spots they setup they will give you a breath test then drug test then if you pass that they will then ask to search your vehicle and they don’t need a reason other than they want to look through your vehicle and if they still find nothing then they check absolutely everything on your vehicle to see if they can find something wrong to give you a defect ticket and charge you a fine that is so big that it makes no sense for the amount the fine is.
With them checking the height of your vehicle is illegal because they are checking on a surface they haven’t the knowledge or the required tools laser level to check the surface to be level and able to check the height correctly.
They put millions of dollars into all the planing area’s to set the stations up and all the other costs are absolutely disgusting.
They put a add on social media how they are adding a new 300 series land to be a undercover police vehicle and it has been kitted out with heaps of aftermarket parts and then the $50-$70k wiring and lighting kits so they end up with a $300k police vehicle and this is for 1 vehicle.
They could setup Suzuki jimney’s with absolutely everything it needs to be a undercover vehicle and they would be able to have 10 of them for the price of 1 Toyota landcruiser
The major issues citizens are talking about and if there wheels or suspension anything on the vehicle from hitting a pothole In Australia the council or roads department very really if every pay for the damages yet it’s a law that they have to but they have put a amount of damage cost in Queensland we had storms and 100’s of 1000’s of potholes appeared on all the streets roads and highways and people had damage 1 wheel or parts that helped with steering and people were getting prices for parts and they didn’t think of other factors like if you punctured a tyre and bent a rim they would get a price for them but they actually had to put a new tyre on the other side of the vehicle with the same tread pattern to be legally driven on the road.
With just a wheel repair and 1 tyre the amount was enough but because so many people had sent in invoices they simply put the amount 3 x higher.
Plus if the police turned up to were you had damage your vehicle even though it happened because of the disgusting conditions of the surface your driving on some potholes are as long as family vehicles and I’m not lying and others are as deep as a semi trucks steer tyres can make them so half the size of the tyre height and as wide which can easily kill a whole family going on holiday with caravan.
Because you’re vehicle has sustained damage the police have two options and 1 definitely isn’t not giving you a ticket with a fine attached they have two different types of tickets they can issue and you are getting one 1 is not driving to the condition of the road causing a single vehicle accident 2 driving with undue care causing a single vehicle accident and with these tickets if you get one on a holiday period then 6 the 2 territories it’s double demerit points and the 3 states double as well but Queensland if you get the same ticket for speed or not using something that you should have in the space of 12 months then you lose say no seatbelt it’s $1,300 and 4 points and if you get another in 6 months then you have another $1,300 fine but 8 points on that ticket and now no license either and it’s 2,5 years before you get points back on your license.
I asked a police bully one day how did they justify the theft amount they put on all the driving offences that citizens are hunted for you to meet quoters that you are given each month well they didn’t answer and decided they should search my vehicle and throw and break everything they could get away with onto the footpath and then after they took the handcuffs off that where 5 clicks more than they should have been and my hands purple when they came off they would leave and say have fun getting home and they would pull relays out under the bonnet and throw them on the grass with your stuff and they would warn you and say don’t go into any station and put in a complaint because any time your vehicle is off your property it’s going to have this done every time and for as long or more pulling it apart with tools or cutting every seat open up look in and they don’t have to pay for anything to be fixed because Australians have had just about every single right taken away from them if we question a cop they can and will throw you in the watch house and you will get 3-4 new charges from them before you get to see a lawyer or judge and we aren’t allowed to hold our cameras or phone and they are going to make a law citizens are not permitted to be able to record police interactions with any recording devices if they stop your vehicle enter your premises or you have a spy recording device on your person and the reason being is citizens should simply do the right thing and police wouldn’t have to stop them and then have an interaction with you and citizens shouldn’t have doubts that the police isn’t being honest with why you have been approached by police and citizens should simply obey and not question or suffer the consequences

The police can not search your vehicle without a warrant or probable cause. Unless you have a knife on the seat or other weapon in plain view, or they can smell weed etc then they can ask to search your car but you can say no and there is nothing they can do about it. The laws are exactly the same as for your house and even your mobile phone. They cant just say we will search your car now for no good reason other than that they want to. Most people don't know what their rights are so immediately drop to the ground to lick cops boots. FTP.
