Hallo Ms Anna, Thank you so much for sharing good knowledge. Over the recent years, I have been battling with paper work to submit to the Embassy. I received a contract for Parcel Delivery Driver however when my employer applied for the Pre-Approval Letter, It was rejected citing that courier deliverers are not recognized as Professional drivers in Germany. When I contacted one of the Federal Employment officer to explain my grievances, he advised me to request my employer to issue me a letter of guarantee that training to attain a EU drivers license shall be granted so I can submit to the Embassy which he did. Just yesterday, I had a long awaited appointment, prepared to submit all my documents, unfortunately the visa officer didn’t concentrate much on the letters issued by the company but requested for the pre-approval letter, hence rejecting my application until I receive it. The consular upon closing my application had advised me to obtain the Application for Pre-approval from the Employer, but changed saddenly and instead requested for the letter. My employer has initiated the process of acquiring the letter but I am still troubled whether I will receive it. In brief, Can a pre- approval letter be issued to drivers particularly in the Delivery of goods using small vehicles? Kindly help shade more light Anna. Thank you!

I just want to write down what I understood from the whole process. So there are two options: either your employer apply for a pre-approval before your visa application or embassy apply for it internally after you submitted your application (together with "erklärung zum beschäftigungsverhältnis" and contract). And first option is more recommended as it can save you weeks. Did I understand right? Thanks so much in advance!

Hi Hemalatha, if your employer refuses to issue to the document, it may help to explain that you anyways need the filled form for your visa or residence permit application. Unfortunately, the job contract is not sufficient to get the approval by the Federal Employment Agency.

Hi, yes your documents will be checked when you apply for the entry visa for Germany to make sure that you are eligible for a residence permit after entering Germany. Hi Oscar, thanks for your comment and congrats on your job offer. The application process and requirements vary a bit depending on the country and location you're in. My general experience is that it's not a digital process but you hand in printouts of everything. In some cases you also need originals or certified photocopies (e.g. for your uni titles). To be on the safe side, I would suggest to take a detailed look at the document checklist of your local German embassy, they usually specify this.

Hi, has your employer applied for the fast track process? If yes, then usually all your documents will be forwarded to the responsible authority. If not, then you will need to submit everything at the local Ausländerbehörde, also a proof of your qualifications. Hope things work out smoothly :)

Hallo Suyash, the pre-approval is always issued for one specific job only. Same goes for the visa, it usually has a stamp mentioning your employer. For changing the employer, you would need to apply again and hand in the new work contract.

Dear Mubin, it's possible for the company but the student will lose his/her student status if he/she goes for a fulltime work contract unless it's an internship that's a mandatory part of the study program. If the student is here on a student visa, it's also important to apply for a change of residence permit to be allowed to work in Germany as a fulltime employee.

Hi jana, i applied for an Ausbildung visa and my approval from BA was misplaced by the employer and till the time they sent it to the visa officer it was expired. Than the employer mailed the embassy about visa status after 7 weeks and they are telling us to wait, as the embassy is waiting for the approval from BA. Hi can I apply for pre-approval from Vorab-Zustimmung if I got job during my masters in Germany and I am waiting for appointment from Ausländerbehörde to change my status from student to blue card or it will be handled internally by Ausländerbehörde in that case. Hi, yes from my experience that's possible. If you are able to obtain the pre-approval before going to your appointment, it's a great way to speed up the process. If not, they can also request it internally. Lately, there have been a few cases where the Ausländerbehörde anyways asked candidates and their employers to apply for pre-approval themselves, so it could be a good choice to handle it this way. Hi, it's up to the Federal Employment Agency to decide but my experience is that in most cases, the qualifications listed in the job description clearly need to fit your qualifications. So for instance, if you get employed as a business manager and there is no reference at all to your engineering qualifications, this could be an issue. I hope this clarifies it a bit.
Hii Anna, I received my offer from a German company in Frankfurt. My company also applied for its approval. But the miscommunication between ZAV department and the company went on for around 2.5 months, I lost my offer. The ZAV is saying that the company has not sent them the required documents. Hi Karthick, this is difficult to tell without knowing your exact qualifications and job offer. In general, you need a recognized university degree to get an EU Blue Card. Maybe the skilled workers visa or IT specialist title could be an alternative? Let me know how things turned out for you!

Hi Abdul, congrats on your job offer. There is a fast-track visa application process. If you want to make use of this, then your employers needs to initiate it and pay an extra fee. I can't really tell how long the general process will take without knowing the details of your profile, location etc. but even with the fast-track procedure the process will most probably take longer if you are currently located outside the EU. If you are moving to Berlin, then it may also be worth it to look into services by relocation agencies that are registered with the Berlin Business Immigration Service.

Depending on whoch specific visa or residence permit you are planning to apply for, this could lead to a rejection. Hi Manoj, I think you need to apply for a change of residence permit before your visa expires. Since this may take some time, it would probably be good to try and book an appointment with your local foreigners authority as soon as possible. If they do not process your application on time, they can often issue a fictional certificate for the time being.

If current waiting times for appointments are not very long, you can also simply submit your application for a change of residence permit, in that case the immigration authorities will request the approval internally.

Hello Janna, My relocation agency requested the federal work agency for ZAV approval along with couple of documents via email and federal work agency replied back that as per the details "companies do not need approval from the federal employment agency because of that is is an employment without consent according to 18b" and residence act in connection with the employment ordinance. Dear Jatin, I guess that this is referring to an EU Blue Card. Usually, they should issue an approval anyways if you request it. But I have now heard from some of my contacts that the Employment Agency is currently experiencing a processing backlog. I think in this case you will be fine without the ZAV document but maybe it's worth it to attach the email to your documents.

Hi Sagar, I'm not aware of a specific expiry date but the approval is tied to your job offer with a specific company. So if the company withdraws the offer or you terminate it then you need to start a new application process.

Hi Joshua, thanks for your comment. There can be different reasons for the rejection. My experience is that very often the salary level is too low or the candidate does not have qualifications that are recognized in Germany (which is mandatory to get a visa). It's helpful if the job title and salary level in your job offer match the data in the Entgeltatlas: web.arbeitsagentur.de/entgeltatlas/. I'd also recommend your employer to reach out to the Federal Employment Agency to find out why they declined their request to figure out if it can be solved or not. I think your employer also needs to report to the federal employment agency about the situation of terminating your job prematurely, given that, you will be registered as a job seeker to look for job and extend your stay after getting a job

I am from India and I recently completed my Master of Science at ETH Zurich, Switzerland in Robotics, Systems and Control that is recognised by Germany. I have got an offer from ABB Munich to work in Munich in Robotics field. The working contract says that I would be employed for 2 years at ABB Munich currently. Hi Uday, usually the shouldn't take more than 4 weeks but I've heard of a few cases now where it was delayed. I would suggest to ask your employer if they could call up the Federal Employment Agency to ask for an update. There is an employer hotline specifically for these kind of inquiries.

Dear Vishal, (1) Erklärung zum Beschäftigungsverhältnis: This is just a form your employer needs to fill and sign and provide to you. The embassy will then send the form to the Federal Employment Agency to get an approval. Your employer can also apply for pre-approval. In case they have done this and have not received any feedback, I would suggest them to call the employer hotline of the Federal Employment Agency for an inquiry. The feedback has to be given within two weeks; once this period is over, approval is usually automatically deemed to have been granted. (2) KMK recognition of your degree: This is a document you need to apply for. You can learn more about it here: www.kmk.org/zab/statement-of-comparability.html. Unfortunately, the waiting times for the Statement of Comparability are 2-3 months. Maybe you could reach out to the embassy once you have initiated the process and ask them to postpone the deadline. Hi, sorry to hear about this. Which city did you apply in? The pre-approval is a case by case decision so it's difficult to tell if they will approve it. But since the requested salary increase was apparently done, I have my hopes up for you. Let us know how it went!

I received a contract for Parcel Delivery Driver however when my employer applied for the Pre-Approval Letter, It was rejected citing that courier deliverers are not recognized as Professional drivers in Germany.
When I contacted one of the Federal Employment officer to explain my grievances, he advised me to request my employer to issue me a letter of guarantee that training to attain a EU drivers license shall be granted so I can submit to the Embassy which he did.
Just yesterday, I had a long awaited appointment, prepared to submit all my documents, unfortunately the visa officer didn’t concentrate much on the letters issued by the company but requested for the pre-approval letter, hence rejecting my application until I receive it. The consular upon closing my application had advised me to obtain the Application for Pre-approval from the Employer, but changed saddenly and instead requested for the letter.
My employer has initiated the process of acquiring the letter but I am still troubled whether I will receive it.
In brief, Can a pre- approval letter be issued to drivers particularly in the Delivery of goods using small vehicles? Kindly help shade more light Anna. Thank you!

I have read all comments and answers. I just want to write down what I understood from the whole process.
So there are two options: either your employer apply for a pre-approval before your visa application or embassy apply for it internally after you submitted your application (together with "erklärung zum beschäftigungsverhältnis" and contract). And first option is more recommended as it can save you weeks.

Hi Hemalatha, if your employer refuses to issue to the document, it may help to explain that you anyways need the filled form for your visa or residence permit application. Unfortunately, the job contract is not sufficient to get the approval by the Federal Employment Agency.

I think the real reason for this approval is to check if this job can be filled by a german resident, i mean if this job can be done by a german so there's no need for a foreigner to come and take this job

Hi Oscar, thanks for your comment and congrats on your job offer. The application process and requirements vary a bit depending on the country and location you're in. My general experience is that it's not a digital process but you hand in printouts of everything. In some cases you also need originals or certified photocopies (e.g. for your uni titles). To be on the safe side, I would suggest to take a detailed look at the document checklist of your local German embassy, they usually specify this.

Hallo Suyash, the pre-approval is always issued for one specific job only. Same goes for the visa, it usually has a stamp mentioning your employer. For changing the employer, you would need to apply again and hand in the new work contract.

Dear Mubin, it's possible for the company but the student will lose his/her student status if he/she goes for a fulltime work contract unless it's an internship that's a mandatory part of the study program. If the student is here on a student visa, it's also important to apply for a change of residence permit to be allowed to work in Germany as a fulltime employee.

Hi jana, i applied for an Ausbildung visa and my approval from BA was misplaced by the employer and till the time they sent it to the visa officer it was expired. Than the employer mailed the embassy about visa status after 7 weeks and they are telling us to wait, as the embassy is waiting for the approval from BA. It's been 2 months already, is it normal to take this much time to process Ausbildung visa without the approval from BA.

Hi can I apply for pre-approval from Vorab-Zustimmung if I got job during my masters in Germany and I am waiting for appointment from Ausländerbehörde to change my status from student to blue card or it will be handled internally by Ausländerbehörde in that case. Hi, yes from my experience that's possible. If you are able to obtain the pre-approval before going to your appointment, it's a great way to speed up the process. If not, they can also request it internally. Lately, there have been a few cases where the Ausländerbehörde anyways asked candidates and their employers to apply for pre-approval themselves, so it could be a good choice to handle it this way. Hi, it's up to the Federal Employment Agency to decide but my experience is that in most cases, the qualifications listed in the job description clearly need to fit your qualifications. So for instance, if you get employed as a business manager and there is no reference at all to your engineering qualifications, this could be an issue. I hope this clarifies it a bit.

I received my offer from a German company in Frankfurt. My company also applied for its approval. But the miscommunication between ZAV department and the company went on for around 2.5 months, I lost my offer. The ZAV is saying that the company has not sent them the required documents. Hi Karthick, this is difficult to tell without knowing your exact qualifications and job offer. In general, you need a recognized university degree to get an EU Blue Card. Maybe the skilled workers visa or IT specialist title could be an alternative? Let me know how things turned out for you!

Hi Abdul, congrats on your job offer. There is a fast-track visa application process. If you want to make use of this, then your employers needs to initiate it and pay an extra fee. I can't really tell how long the general process will take without knowing the details of your profile, location etc. but even with the fast-track procedure the process will most probably take longer if you are currently located outside the EU. If you are moving to Berlin, then it may also be worth it to look into services by relocation agencies that are registered with the Berlin Business Immigration Service.

Hi Manoj, I think you need to apply for a change of residence permit before your visa expires. Since this may take some time, it would probably be good to try and book an appointment with your local foreigners authority as soon as possible. If they do not process your application on time, they can often issue a fictional certificate for the time being.

Hi Mehran, congrats on your job offer! You can ask your employer to apply for pre-approval. If current waiting times for appointments are not very long, you can also simply submit your application for a change of residence permit, in that case the immigration authorities will request the approval internally.

My relocation agency requested the federal work agency for ZAV approval along with couple of documents via email and federal work agency replied back that as per the details "companies do not need approval from the federal employment agency because of that is is an employment without consent according to 18b" and residence act in connection with the employment ordinance. Dear Jatin, I guess that this is referring to an EU Blue Card. Usually, they should issue an approval anyways if you request it. But I have now heard from some of my contacts that the Employment Agency is currently experiencing a processing backlog. I think in this case you will be fine without the ZAV document but maybe it's worth it to attach the email to your documents.

Hi Sagar, I'm not aware of a specific expiry date but the approval is tied to your job offer with a specific company. So if the company withdraws the offer or you terminate it then you need to start a new application process.

Hi Joshua, thanks for your comment. There can be different reasons for the rejection. My experience is that very often the salary level is too low or the candidate does not have qualifications that are recognized in Germany (which is mandatory to get a visa). It's helpful if the job title and salary level in your job offer match the data in the Entgeltatlas: web.arbeitsagentur.de/entgeltatlas/. I'd also recommend your employer to reach out to the Federal Employment Agency to find out why they declined their request to figure out if it can be solved or not. For the skilled workers visa, a pre-approval is always required but it can also be requested internally by the German authorities, so it is usually not mandatory for the employer to provide it. I think your employer also needs to report to the federal employment agency about the situation of terminating your job prematurely, given that, you will be registered as a job seeker to look for job and extend your stay after getting a job

I am from India and I recently completed my Master of Science at ETH Zurich, Switzerland in Robotics, Systems and Control that is recognised by Germany. I have got an offer from ABB Munich to work in Munich in Robotics field. The working contract says that I would be employed for 2 years at ABB Munich currently. The job is closely related to my MSc degree of Robotics. My gross salary is 57,000 Euros and I would be working as a research engineer at ABB Munich. So My questions are:
1. As my gross annual salary is less 58,400 Euros, but as I would be working in field of engineering and my gross salary is more than 45,552 Euros. So, can I apply for Blue Card or I would be needing to apply for arbeitsaufnahme/job visa provided my working contract from ABB would be of 2 years currently?
2. I don't have a residence in Germany currently as I am still looking for one. So, can I still apply "blue card" in the section "purpose of visa" on the page Appointment for visa application.
3. It says on the website that in case of engineering job and salary between 45,552 and 58,400 Euros, then the Federal Employment Agency (BA) must approve your employment. However I was not able to find how to get this approval. So, can you please tell me how to get this approval?

Hi Uday, usually the shouldn't take more than 4 weeks but I've heard of a few cases now where it was delayed. I would suggest to ask your employer if they could call up the Federal Employment Agency to ask for an update. There is an employer hotline specifically for these kind of inquiries.

(1) Erklärung zum Beschäftigungsverhältnis: This is just a form your employer needs to fill and sign and provide to you. The embassy will then send the form to the Federal Employment Agency to get an approval. Your employer can also apply for pre-approval. In case they have done this and have not received any feedback, I would suggest them to call the employer hotline of the Federal Employment Agency for an inquiry. The feedback has to be given within two weeks; once this period is over, approval is usually automatically deemed to have been granted.
(2) KMK recognition of your degree: This is a document you need to apply for. You can learn more about it here: www.kmk.org/zab/statement-of-comparability.html. Unfortunately, the waiting times for the Statement of Comparability are 2-3 months. Maybe you could reach out to the embassy once you have initiated the process and ask them to postpone the deadline.
