Top Democrats won't join calls for Justice Sotomayor to retire

- Democratic senators are not joining calls on the left for liberal Justice Sonia Sotomayor to retire. But for the first time, they’re publicly expressing an unease that history could repeat itself after Justice Ruth Bader Ginsburg’s refusal to step down in 2014 ended in the Supreme Court lurching sharply to the right. Sahil Kapur reports.

Top Democrats won't join calls for Justice Sotomayor to retire
#SoniaSotomayor #SupremeCourt #Politics
Alito and Thomas should be out long before Sotomayor.
why?
Adolf would approve of that too.
They are corrupt
@@brandon3525 I have read that she has health issues.
Yes, they should be, but you never know. So now, we have to pray that Sotomayor doesn't "pull an RBG"...
Thomas and Alito are a lot older than her. Get them out first.
No get out corrupt 46, first
If Biden loses in 2024 and she retires under Trump, she will take all the blame for allowing the Republican majority in the Supreme Court to expand. I am done with Democrats worrying about the feelings of fellow democrats over the cause and policy. It’s always policy over politics but democrats want to be nice and not rock boats within their coalition. Well that’s how we ended up with RBG being replaced under Trump. Time to toughen up and tell people within our coalition the realities they don’t want to hear.
They should be made to step down for open conflict of interests and bias. Gorsuch, Kavanaugh and Barrett all lied under oath when they said that Roe was well settled law. That is NOT what they signed on to with Dobbs decision occurring just a short time after they were sworn in.
Alas type 1 diabetes is a daily grind on ones health. It is not very nice though when people are speaking openly about ones forced retirement.
They aren't going anywhere either.
For the first time in history we have judges on the supreme court making promises for a nomination and then lying about those promises for a confirmation to the bench.Way past time to stack this court!
You need gop SCOTUS seats to retire first while a dem is in office. Looks like it may be another dem next if it is Sotomayor. Then you will desperately need defense, you know like RETIRING IF HEALTH IS IN DOUBT WHILE BIDEN CAN PICK. Still not stacking. Good luck with that. 6-3, there will be no stacking anytime soon in reality. But Dems may trick another and make it 7-2. We shall see what Sotomayor does.
Mr Thomas should be first Supreme Court judge to be removed because he is corrupt judge.
If Trump wins, will you be okay if he packs the court with more judges or is that only when your side wins?
@@Justin-yb2yd He did?
@@travisprice1325 he did not pack the courts. He filled openings like every president does. What numbnuts is talking about packing the court, they're talking about adding more supreme Court justices.
Doesn't anyone remember the way Mitch blocked the appointment of a judge for Obama? What makes anyone think he wouldn't do it again. If this was a thing it needed to be done 2 years ago. We need term limits and a code of conduct.
Do you mean Garland that democrats now do nothing but complain about?
The Republicans can't do it now. They don't have control of the Senate! The rules were changed some time ago to get rid of the 60-vote rule for judicial appointments. And next year, when they are likely to have control, McConnell will no longer be leader. That's why the commentators calling for Justice Sotomayor's retirement (because of her health, not her age or capabilities) want it to happen this year, so that a Democratic president and Senate can confirm a new, younger and healthier justice without Republican interference.
RBG proved that she was one of the worst predictors of American politics:
1. She was sure Hillary would win in 2016./
2. She honestly thought that she could plead for fairness from the Republicans and have the nomination of her successor postponed until after the inauguration of a new president. After all, they insisted that Garland not be confirmed in the last year before a presidential election, and then rushed Barrett's confirmation through with record speed, so she could be seated just days before the 2020 election.
Now she can look down upon us and watch her legacy be dismantled after just a few years of it being part of the law of the land. She will be forgotten in history because her legacy won't last.
My term limit idea:
1. First term on the Supreme Court (and ideally any federal court), 12 years.
2. No later than a year before the expiration of the 12-year term, the justice officially decides to retire or formally requests a second term.
3. Second term, 6 years. Another confirmation hearing and vote by the Senate, which, after 12 years after the first confirmation, will have, say, a dozen new members. The new president is not involved, unless the justice decides to retire or dies.
4. No justice serves longer than 18 years. That allows for the preservation of "institutional memory" and also the realization that they will have to prove to the Senate that they deserve six more years if they want. No disgrace to retire and join (add prestige to) a law firm after 12 years. It also allows voters to know how many justices the president will get to nominate over the course of four years.
Would the granting of the extra six years depend on the politics of the current Senate? No doubt. But we haven't had one of those 98-2 confirmation votes for a long time under the current system either. The votes are almost completely partisan. It's possible that a justice would be more hesitant to follow a particular ideological line in interpreting the law and be more practical if they knew that by doing so, they might be reconfirmed by 98-2, and by not doing so, they might not be reconfirmed at all.
Mitch is powerless - Dems are in the majority in the Senate now, that's their whole point. It's a misguided point, but not any more misguided than you thinking Mitch McConnell controls the approval docket for judges as the minority leader.
One of the conservative judges should resign to make up for McConnell's act of obstruction.
First, McConnell isn't the majority leader in the Senate anymore; Schumer is. Second, Obama's nominee was Merrick Garland, who has been the target of repeated attacks from Democrats for "not locking Trump up".
Alito and Thomas should be forced to leave or how about the liar judges who claimed before they were sworn in about Roe V Wade that it was set in the books.
It's the old fogeys in the Senate who should retire; they're much older than Justice Sotomayor.
Sotomayer has health issues though.
Nobody has a right to say she should retire when both presidential candidates are a decade older than her. She can leave when she wants, they are locked in for another 4 years if they win.
This only justices that need to retire are Clarence Thomas and Samuel Alito for blatant corruption
Gotta keep Brett he brings the beer
RBG was too busy acting like a star while MSNBC was doing hour long shows about how cool she was....... No wonder she didnt retire
Well she wasn't taking money from dependents.
I have the upmost respect for RBG’s work as a Justice, but I believe she did not do the right thing for the country when she did not retire. That said, she was still an amazing lawyer and Justice. Alito and Thomas are a danger and threat to our democracy. RBG was not.
@@kathimeci5179 agreed
That is unwarranted. RBG was a great justice, yes she should have retired, that is one stain in her legacy of an imperfect person, but for who she was and what she did, she didn't deserve the framing you used.
@@kathimeci5179 Yes but complaining about the way things are and not doing anything to change them will get people nowhere. This is why the GOP always wins. This is why they have been able to stack the courts over a decades long process. I won't be at all surprised when the GOP wins this fall, these court cases have been a distraction and the real obstacles are being dismissed.
FORCE THOMAS TO RETIRE!!!!!! He should retire and investigate for his corruption!
😂😂😂😂😂😂😂😂
Are you that ignorant? You can't force a United States supreme Court Justice retire.
You can't force a SCOTUS judge to retire. Only one SCOTUS judge has ever been impeached
@@Justin-yb2ydyes, they truly are ignorant
@@Justin-yb2yd impeachment is a thing so technically you can kick them out
I'd be more worried about the corrupt sell-outs Alito and Thomas.
How about getting rid of the corrupt justices 🤔
Exactly! Absolutely!
Because unfortunately there isn't any provisions in the constitution or Federal law for this to happen.
Hum. There a few other justices that need to retire or step down.
Absolutely! For example, the one who doesn't even know what a woman is!
@bartjargengarblbargeler1980 To be fair, she’s not a biologist.
Right, it’s time to consult my meteorologist to see if it’s safe to go outside and brave the elements.
What a selfish and insulting proposition.
Retire/ kick out Alito, Thomas, Kavanaugh, Gorsuch....SCOTUS has destroyed itself and become super partisan and become a MAGA supporter
👏🏽👏🏽👏🏽👏🏽👏🏽👏🏽
Justice Ginsberg should have retired, but like many who do great things, got caught up in her own sense of importance…..
Why are we not DEMANDING Alito and Thomas retire!
And Biden
Why are you so mad? Male pregnancy not going well?
You triggered the melting magabunnies!!🐰🐰 They're still hurting over Don being completely without any money!!🌈🐰
Because that would be pointless. They would not retire under a Democrat because they would be replaced by Democrats. If Justice Sotomayor has health issues, then she should retire now.
Adolf would approve of that. Dems and Adolf think alike.
When it comes to the SCOTUS, Republicans are constantly playing Money Ball, while the Democrats are playing T-Ball. 🤦♂️
WE THE PEOPLE DEMAND TERM LIMITS FOR EVERY OFFICE IN GOVERNMENT!! INCLUDING COURTS...
We the people demand you not to be so ignorant.
@@Justin-yb2yd like you!!
@@paulabowman4847 I'm not the one who just made an ignorant moronic statement
@@paulabowman4847 instead of being ignorant and dumb, why don't you research why supreme Court justices don't have term limits?
This is distasteful. She's in good health other than a treatable illness. Are we just never going to allow people with chronic illnesses serve as Justices?
When she has a nurse going with her on trips, something is going on.
I can’t even believe people are asking for this. This is insane
Wait, what about Alito and Thomas, aren't THEY older? Why not have them retire before Sotomayor?!
this whole ridiculous call for her resignation (she's only 69 ferchrissakes!) is from some fake story about her travelling with a medic on a plane.
I saw the paperwork and it said "baggage (medic)" she was travelling with a MEDICal bag or MEDICine bag, it was an abbreviation, she's not travelling with a human medic!!
*We need Justice Sotomayor on the court for many years to come*
Oh for Pete’s sake!! Ridiculous! We need to expand the court to gain fairness!!!
I can’t believe this is even a story.
RBG was prime example of letting one's own self-importance supersede the good of the people. Avoiding a 7-2 court with a Republican in the White House is more important than hurting someone's feelings.
Does anyone really think Manchin and Sinema would allow this? He recently said he would only support judges that had at least some Rep support, and she'd probably tank it out of petty vindictiveness.
And for their betrayal neither one of them will be sitting in Congress after November. Guaranteed
Lisa Murkowski, Mitt Romney, Susan Collins, Todd Young, and Shelley Moore would probably support the Supreme Court nominee though. Biden would just need to choose a young, moderate nominee for the court.
DONT MAKE THAT MISTAKE AGAIN! You call for retirement NOW, this close to the election, it’ll never make it to the floor! 🇺🇸💙
As a Latino this is the most incredibly offensive thing I've ever heard. They don't even want us to have one seat. She's 69! RBG was 87! Two decades older
Please don’t act like black racists.
It probably isn't an age thing, but it is a more of a health thing. I agree with the sentiment with RBG. I don't know what she was thinking, but Justice Ginsberg was naive in her thinking that that SCOTUS is a non-political institution.
Who cares if she's Latina, race has nothing to do with being a decent human being for all.
And her being Latina matters why?
erm ... are you sure you didn't misgender the justice?
RBG caused this lean by not retiring because her ego got in the way. The minute she got sick she should have left the bench.
RBG was 87, SS is only 69 - are we going to start the jettison of valuable justices every time one of them sneezes?? I don't support that
@@Marcel_Audubon If it means keeping our 3 on the bench, it's worth pushing them to retire. They can always have jobs in academia. What law school wouldn't hire them?
u 🤡
@@aulvinduergard9952 so we should replace valued Justices in their 60s with teenagers because we're soiling ourselves worrying about one of them dying???
There needs to be term limits. These old fools clinging to power is why the right owns the courts now
RBG is at fault for staying too long. We need to have these convos about justices because we cannot have this happen again. Her whole entire legacy, marred by her refusal to leave, her death was her biggest moment, she will only be the one who died to give Trump the court he needed to do the vile things hes tried and done.
After the 2024 elections who knows when democrats will have a democratic senate and democratic president at the same time again. We have to play defense. Sotomayor may be fine now, but in 5-15 years? If she wants her successor to align with her values she should seriously consider stepping down. RBG thought Hillary would get to replace her but she and the country got unlucky when she was replaced by trump and a republican senate weeks before an election.
Biden needs to get on increasing the number of justices to balance the Supreme Court out.
RBG was in her 80s during those “calls for retirement“, Sotomayor’s not quite 70. It hardly seems like this would be the most pressing issue concerning SCOTUS
Joe Biden: "I dont advocate for Justices to retire, do it when you want"
Justice Stephen Breyer: 😳
Oh sorry *retired* Justice Stephen Breyer 🤷🏽♂
expand the SC to reflect the population not a religion NOW!
I like to dream .....just like MLK did@Your-feelings-dont-matter
If Thomas doesnt have to leave why should anyone
Maybe if the liberals had come at RBG w/this full-court press to retire, we wouldn't be here. RBG undid all her pioneering, legal work getting abortion legalized in the 1st place. I wonder how she didn't see the potential, future problems her staying on the court would cause...🤔😐
It’s not about the judge. She needs to step down so Biden can replace her.
Change these Federal judgeships from lifetime appointments to retirement at age 75.
Tem limits..,..10 years max.
She'll be replaced with conservative justice (Fill in the blanks). 👍🏼😂
Just like that rbg lady 😂
Not with this president & a democratic senate
Thomas needs to go

This is ridiculous. Sotomayor has at least another good 5-10 years on the Court. Libs need to just worry about voting for Biden and getting as many to vote for him as well.
She's only 69. Unless her diabetes is really giving her problems, which I haven't heard of, it seems premature to step down.
RBG's legacy is what this Supreme Court is doing.
Moscow Mitch stole amp seat!!!!🤦♀️
Love Judge Sotomayor!! Obama appointed her, he had the right choice! Latinos are happy also! Don't set any party up before a major election! Judge Kennedy needs to go now
Geez, you cough a little bit on the Supreme Court and suddenly Democrats are calling for your retirement. And I thought Newt Gingrich was bad with his divorces.
She has diabetes for starters. Every time she's ill, the diabetes makes it worse. I like her just fine.
@@PAMELAPORTER-ci7mr Millions of people have diabetes, but people aren't calling for their retirement.
Clarence Thomas is the oldest Justice. I don't hear people calling for his retirement.
is he as old as Joe Biden.
@@Bob-bb3urand not as old as Trump either. But that's not really the point here, is it.
Evil lives well and king and he has a price it’s working w/MAGA agendas
What about Alito and Thomas? They are older.
I've been waiting for Alito and Thomas forever.
If Justice Sotomayor cares about our country, she would retire now.
VOTE BLUE FOR REASON NOT TREASON.
Let Sotomayor stays
Come on, she is 69! That is not 79 or 89.
What should be done is fill with more Supreme zJudges to even more the court,so they can learn how it is to compromise n stop being so ballsy.
I hope not. If Sotomayer leaves, the court will lose half of its collective intelligence!!!!!
Just keep the White House and Senate then you have nothing to worry about.
Come on now, 69 is spring chicken for Supreme Court.
I still have a pin-up of RBG 🔥
Logically, it makes sense. Wiser to play it safe and make the change now.
What I would like most of all is to start hearing talk of disgraced Justice Thomas' removal from the Supreme Court. PBS/Frontline did an excellent job of presenting and explaining the facts of how Thomas has exploited, abused, and sold his position on SCOTUS. He should receive a dishonorable discharge immediately.
This trend toward agism and abilism has got to stop! Believe me when I say that I understand the concern that MAGAs may get the opportunity to put another extreme right-wing person in the Supreme Court. But, let's not forget how this REALLY happened. It wasn't so much that RBG passed away, it was that the Congressional Republican Majority REFUSED to approve the nomination of anyone Obama supported. Why does anyone believe this is going to change when we all know they hate Democrats? Do you honestly think Biden's recommendations are going to get approved before the upcoming election?
We have a democratic senate and we're rolling to another win. President stinky's on his way to prison.
Yall keep saying “why they not asking Clarence Thomas and Samuel Alito to retire” like them two conservative men is about to listen to a bunch of liberals asking or telling them to retire.
Why should she retire? She's young for a SC Justice...Retire Alito and Thomas first!
Term limits. These judges feel entitled with massive ego and a power trip.
Call for Thomas to retire!!!
I’m so happy RBG was stubborn enough to stick it out and ignore the Leftists. Because of her we got a 6-3 Conservative Court. Now the desperation of the Left to get her out before Sleepy Joe is retired, makes me laugh. Hang in there Sotomayor. You are doing America a favor.
Why should she retire when Thomas is violating ethics rules?
Because they're hoping a Republican replaces her like what happened with Ginsberg.
I AGREE. ALITO AND THOMAS SHOULD LEAVE.
69 is still young.
She should absolutely retire if she truly cares about the causes she stands for. Public servants should serve the public, not their own careers.
Stop trying to force the only Latino off the supreme court! Come on now.
Expressing loyalty and upholding traditions for the sake of any of these justices is absolute insanity when they unanimously decided that optics outweigh the constitution and an insurrectionist should be permitted to remain on the ballot while announcing his plan to go full authoritarian to the world.
If SCOTUS has a pseudo retirement age, then the House and the Senate should have the same.
I don't think so as there's 1 senator who's 91.

Ok she is 70, but compared to Bidens 81 this seems nothing to complain about.
People clearly always put themselves first these days... Why not just ride till the wheels fall off.
Yeah. She needs to be gone. Don’t repeat the past mistakes.
It would be really bad if she retired now. Republicans would just stonewall a replacement with the excuse that it's too close to elections, just as they did last time a Democrat had a chance to appoint a justice.
If you care more about democracy, than your ego, you let go.
Another reason to vote blue: we cannot afford any more MAGA extremists on the SCOTUS.
Please retire, Sotomayer!!
We’re not sure how this election is going to turn out. It would be safer for her to retire and let a healthier and younger Latina take over.

@@SF-ww9xe yeah, the US has helped so many countries in the past. But, this one is a set-up.🙄 Nobody needs a brain-washed, myopic point of view from some Trumpster. Shut up, please.
Biden needs to wake up and appoint another if she leaves. A lesson should be learned by now.
Pray she doesn't "pull an RBG" and die under an insane GOP madman.
I give up on both parties of this country smh
PROUD TO BE AN OLD SCHOOLER. THE OLD CAN STILL GO BOLD.
Republicans won’t let Joe Biden to pick new Supreme Court judge just like they did with Obama during in 2016 election. Republicans would just make excuses again. I think Joe Biden and democrats should pick new Supreme Court judge after Joe Biden win 2024 election.
Mitch McConnell would block any new SC nominations because we are again "too close" to an election (except of course when Trump was about to be voted out of office). Have we forgotten?
He’s no longer the head of the Senate so he cannot block anything. Democrats control the Senate which is why there are calls for her to retire.
McConnell is not the head of the senate judiciary committee, but a Democrat is.
I’m still trying to figure out 1) why President Obama nominated her, and 2) what she brings to the table.
Why are the Democrats apparently impotent to do anything tangible about Clarence Thomas, just for starters?
People in this country can think so backwards and stupid sometimes. If she leaves, appoint another under Biden. Have Thomas and the other age old justice to step down too. They're not in tune with today's world. They're all old with stale thoughts and ideas.
Don’t you realize that the supreme court is not a political body of the of government. So it should be of no concern whatsoever whether or not a supreme court justice is “judged” to be left or right.
If Trump gets back in a Supreme Court justice will be the lest of our concerns.
Stop! Why is noone calling for Alito's or Thomas' retirement, or at least recusement?
Can someone PLEASE get rid of the infomercial-like ad for the MSNBC app at the end of the videos!?!?!?! IT'S SO ANNOYING!
