  • Democratic senators are not joining calls on the left for liberal Justice Sonia Sotomayor to retire. But for the first time, they’re publicly expressing an unease that history could repeat itself after Justice Ruth Bader Ginsburg’s refusal to step down in 2014 ended in the Supreme Court lurching sharply to the right. Sahil Kapur reports.

      If Biden loses in 2024 and she retires under Trump, she will take all the blame for allowing the Republican majority in the Supreme Court to expand. I am done with Democrats worrying about the feelings of fellow democrats over the cause and policy. It’s always policy over politics but democrats want to be nice and not rock boats within their coalition. Well that’s how we ended up with RBG being replaced under Trump. Time to toughen up and tell people within our coalition the realities they don’t want to hear.

      They should be made to step down for open conflict of interests and bias. Gorsuch, Kavanaugh and Barrett all lied under oath when they said that Roe was well settled law. That is NOT what they signed on to with Dobbs decision occurring just a short time after they were sworn in.

    For the first time in history we have judges on the supreme court making promises for a nomination and then lying about those promises for a confirmation to the bench.Way past time to stack this court!

      You need gop SCOTUS seats to retire first while a dem is in office. Looks like it may be another dem next if it is Sotomayor. Then you will desperately need defense, you know like RETIRING IF HEALTH IS IN DOUBT WHILE BIDEN CAN PICK. Still not stacking. Good luck with that. 6-3, there will be no stacking anytime soon in reality. But Dems may trick another and make it 7-2. We shall see what Sotomayor does.

    Doesn't anyone remember the way Mitch blocked the appointment of a judge for Obama? What makes anyone think he wouldn't do it again. If this was a thing it needed to be done 2 years ago. We need term limits and a code of conduct.

      The Republicans can't do it now. They don't have control of the Senate! The rules were changed some time ago to get rid of the 60-vote rule for judicial appointments. And next year, when they are likely to have control, McConnell will no longer be leader. That's why the commentators calling for Justice Sotomayor's retirement (because of her health, not her age or capabilities) want it to happen this year, so that a Democratic president and Senate can confirm a new, younger and healthier justice without Republican interference.
      RBG proved that she was one of the worst predictors of American politics:
      1. She was sure Hillary would win in 2016./
      2. She honestly thought that she could plead for fairness from the Republicans and have the nomination of her successor postponed until after the inauguration of a new president. After all, they insisted that Garland not be confirmed in the last year before a presidential election, and then rushed Barrett's confirmation through with record speed, so she could be seated just days before the 2020 election.
      Now she can look down upon us and watch her legacy be dismantled after just a few years of it being part of the law of the land. She will be forgotten in history because her legacy won't last.
      My term limit idea:
      1. First term on the Supreme Court (and ideally any federal court), 12 years.
      2. No later than a year before the expiration of the 12-year term, the justice officially decides to retire or formally requests a second term.
      3. Second term, 6 years. Another confirmation hearing and vote by the Senate, which, after 12 years after the first confirmation, will have, say, a dozen new members. The new president is not involved, unless the justice decides to retire or dies.
      4. No justice serves longer than 18 years. That allows for the preservation of "institutional memory" and also the realization that they will have to prove to the Senate that they deserve six more years if they want. No disgrace to retire and join (add prestige to) a law firm after 12 years. It also allows voters to know how many justices the president will get to nominate over the course of four years.
      Would the granting of the extra six years depend on the politics of the current Senate? No doubt. But we haven't had one of those 98-2 confirmation votes for a long time under the current system either. The votes are almost completely partisan. It's possible that a justice would be more hesitant to follow a particular ideological line in interpreting the law and be more practical if they knew that by doing so, they might be reconfirmed by 98-2, and by not doing so, they might not be reconfirmed at all.

      Mitch is powerless - Dems are in the majority in the Senate now, that's their whole point. It's a misguided point, but not any more misguided than you thinking Mitch McConnell controls the approval docket for judges as the minority leader.

      First, McConnell isn't the majority leader in the Senate anymore; Schumer is. Second, Obama's nominee was Merrick Garland, who has been the target of repeated attacks from Democrats for "not locking Trump up".

      Nobody has a right to say she should retire when both presidential candidates are a decade older than her. She can leave when she wants, they are locked in for another 4 years if they win.

      I have the upmost respect for RBG’s work as a Justice, but I believe she did not do the right thing for the country when she did not retire. That said, she was still an amazing lawyer and Justice. Alito and Thomas are a danger and threat to our democracy. RBG was not.

      That is unwarranted. RBG was a great justice, yes she should have retired, that is one stain in her legacy of an imperfect person, but for who she was and what she did, she didn't deserve the framing you used.

This is why they have been able to stack the courts over a decades long process. I won't be at all surprised when the GOP wins this fall, these court cases have been a distraction and the real obstacles are being dismissed.

    this whole ridiculous call for her resignation (she's only 69 ferchrissakes!) is from some fake story about her travelling with a medic on a plane.
    I saw the paperwork and it said "baggage (medic)" she was travelling with a MEDICal bag or MEDICine bag, it was an abbreviation, she's not travelling with a human medic!!

    RBG is at fault for staying too long. We need to have these convos about justices because we cannot have this happen again. Her whole entire legacy, marred by her refusal to leave, her death was her biggest moment, she will only be the one who died to give Trump the court he needed to do the vile things hes tried and done.

    After the 2024 elections who knows when democrats will have a democratic senate and democratic president at the same time again. We have to play defense. Sotomayor may be fine now, but in 5-15 years? If she wants her successor to align with her values she should seriously consider stepping down. RBG thought Hillary would get to replace her but she and the country got unlucky when she was replaced by trump and a republican senate weeks before an election.

    Logically, it makes sense. Wiser to play it safe and make the change now.
    What I would like most of all is to start hearing talk of disgraced Justice Thomas' removal from the Supreme Court. PBS/Frontline did an excellent job of presenting and explaining the facts of how Thomas has exploited, abused, and sold his position on SCOTUS. He should receive a dishonorable discharge immediately.

    This trend toward agism and abilism has got to stop! Believe me when I say that I understand the concern that MAGAs may get the opportunity to put another extreme right-wing person in the Supreme Court. But, let's not forget how this REALLY happened. It wasn't so much that RBG passed away, it was that the Congressional Republican Majority REFUSED to approve the nomination of anyone Obama supported. Why does anyone believe this is going to change when we all know they hate Democrats? Do you honestly think Biden's recommendations are going to get approved before the upcoming election?
