When a School Calls the Police on a Student
Вставка
- Опубліковано 21 лют 2020
- This video - presented by the Harris County, Texas, District Attorney's Office - shows what happens when a school decides to call the police to have a student arrested. The video is used to help train officers and other adults about the trauma of being arrested at school.
The police should have told the boy his rights and not finger print or take his picture without his legal guardians present.
its a demo
It’s a skit dummy
legally rights only have to be read when one is detained for the purpose of questioning, or once questioning begins
It’s a skit and also they have the right to
Its the law. Specially if its a demo then demo the proper procedure.
I DO NOT THINK SCHOOL'S HAVE THE RIGHT TO CALL POLICE ON A YOUNG STUDENT. THE SCHOOL SHOULD CALL PARENTS OR A GUARDIAN FIRST & TRY TO WORK OUT THE PROBLEM.

I got arrested out of my junior high school back in 2001, for defending a new kid while he was being jumped by multiple other students , one of the kids parents wanted charges pressed . It definitely did not go like this, happened in front of the whole school at lunch being thrown to the ground .

Rest assure they are arresting children by the boatloads!! look at how many kids under 10 have been arrested since 2014. The Institutions are out to lunch and now constructing " arrest videos" for our viewing pleasure. Have they all lost their Minds!!?
Me too☹️ I was praying for him!! I felt so bad for him until I decide to read the comments, so sad that there are some real cases of kids that parents don’t spend time with them, or don’t pay attention.
I noticed in this demonstration that the child wasn't read his Miranda rights or charges by the police when he was arrested. Honestly, that's accurate because when children are arrested in school, due process is sometimes ignored, as if they don't have rights. I've heard of children being arrested for behavior that isn't even against the law, such as yelling in class or disrespecting teachers. It baffles me that schools would choose to get the police involved and traumatize a child for life, possibly ruin their future, instead of calling a guardian.
Under 18 has no rights. He can not legally agree to anything or accept any contract
The law concerning interrogation of children is a little different than with adults. Generally speaking a parent or guardian needs to be present. Miranda rights are only read after somebody has been arrested and is being formally questioned, anyway.
@traci holmer This country has an issue with understanding Miranda rights. As the comment above me said, it’s a little different for minors anyways, but police do NOT read you Miranda rights unless they are planning to formally question you.
Miranda rights a heavily misunderstood. They are only ever required to be read when questioning is planned to be ensued. Children do not have rights (hence they cannot legally sign contracts, etc.). Children can be arrested for behavior not exactly violating the law but rules that the parents/guardians have signed into agreement within a school setting, basically signing on the fact that SRO's can in fact "arrest" minors for petty "offenses". But when it comes to actual law violations, it doesn't matter the age of the person when "needing" to read Miranda rights when not required, as stated above.
☹️☹️☹️😥😥😥😥😥

I didn't see the parents being notified to be present and aware of the charges. I saw two of these and in both cases the school made a decision without parental involvement. In the first story an autistic child was being bullied. The bully got off scott free and the victim was arrested. I've also seen in actual schools where I have lived that their no tolerance policy punished the victim with the oppressor! I'm outraged by this. If I still had small children I would homeschool. Not all children are innocent, but not all are guilty.
There was only one time in my 6 years working with special needs and at risk youth that we had to call the cops and i agreed with it 10 fold. First let me set the premise, this was no first encounter with this kid and to call him a kid is a stretch. Im 6'4 250lb and this kid could give me a run for my money when i was working with him at 22. He was probably 5'10 and pushing 200lb. He just had abnormal strength. Well on this day he punched a kid and when told to stop and they tried to restrain him (a few of the teachers are trained in take downs and special holds to prevent the child from harming themselves or someone elese (that is the ONLY time they can use it) , well when he saw the restraining people around he grabbed a pair of scissors and was trying to STAB THE TEACHERS. It was unreal. Ultimately they had to have me watch him till the cops came cause im the only one these kids dont want to murder cause im a young guy who doesnt treat them like children. Honestly i expected more out of them and they gave it. You treat them like kids theyll act like kids, yes they were still children but when i say that i mean we had 5 n 6th graders acting like 1st graders.. Throwing fits about recess and the like. The parents knew that the kid was going to be taken to juvie for the night before they called the cops, in fact the parents are the ones who said to call them before he hurt a teacher as the staff originally wanted them to come and just take the kid home for suspension and avoid involving police etc. Its a tricky situation, some of those kids really couldnt give less of a shit about you, the police, their parents, or anyone. Ive seen one spit at a cop and hit their parents. Some of these kids i really think would be better off getting scared straight in a way now, and realizing that isnt the life they want before its too late
@@gamgeesamgee12 because the person who originally commented is obviously biased. What she speaks of she either doesnt know the full story or is going off what their kid told them. Demonstartion or not. It is still wrong. I think the school should be fined along with the teacher. As a kid I was strapped - and it was not just a strapping but a beating. No one was charged at the school but it haunted me for years and still does . The police and schools that allow this are promoting future mental issues and should be charged. They should be arrested at school and taken to jail.
Anyone who did a serious crime may have a terrible punishment, but that child deserves forgiveness in his life if he did do something wrong. I've been watching children behind bars in Beyond Scared Straight for a long time. I lost three people in my family. My older cousin and my grandparents. I cried the next day and I needed to be alone for a while, but I had to remember what my grandfather said to me. He said: "We may be gone, but we'll always be with you. Trust us as we trust you." Why adult dont but children does?
@Mankeindustries yes it is
I remember when I was in the 7th grade. My teacher always called her boyfriend on me. Her boyfriend was a cop. Every time her boyfriend came to my school, he threw away my lunch and told me to cook lunch for him. Since I was only 13 years old, I could only cook pancakes and eggs. When I accidentally poked one of the egg yolks, the cop yelled, "WHAT KIND OF WOMAN ARE YOU IF YOU ARE UNABLE TO COOK?!" He then started beating me with his belt. I spent my entire recess time in the kitchen cooking for the cop. I was dizzy due to lack of food. Every time I messed up a pancake or an egg, he beat me with his belt. When I finally got it right, he ate it. When I was about to eat since I was so hungry, he slapped the food out of my hand and said, "NO FOOD FOR YOU! YOU MUST LOOK LIKE A WOMAN, NOT A HIPPO!" My teacher just laughed at how her boyfriend was treating me. Then, he made me clean the entire gym. When I passed out from lack of food, my teacher dumped dirty water all over me and yelled, "HANNAH! GET UP! STOP BEING SO LAZY! A WOMAN'S DUTY IS TO COOK AND CLEAN FOR HER MAN!" When I got up, I continued cleaning even more. When I was finished cleaning the gym, everyone came back in from recess. I saw my little brother Seth. He was crying and had bruises all over himself. Two of his teachers were forcefully dragging him in. When we went back to the classroom, my teacher and her boyfriend continued yelling at me. Another girl in my class said, "I'm a girl. Do I have to cook and clean for a man?" And my teacher said, "No. You're white, which makes you a princess. Hannah's Asian, which makes her a slave." My teacher and her boyfriend went to Seth's classroom and dragged him over to our classroom. My teacher's boyfriend held him at gunpoint and threatened to kill him if I ever ate another crumb of food. When I told him not to shoot my brother because he would die, another one of my teachers just said, "Well, you should've thought about that before you started bleeding every month! You must be a proper lady, not a useless monthly bleeder!"

Mid 2000’s a local middle school made a huge error in judgement and had a couple 12yo kids arrested for literal horseplay. Those kids were scarred and traumatized far more out of proportion to the “assault” they had done. They spent a week in jail until bail was set and made. They were stripped-searched daily and any time even their attorneys visited them. The Ass. Dist. Attorney wanted to make an example out of them.
Thank god when the case came to a head, the judge had sense enough to all but dismiss the case.
Our assistant district attorney said if she had it to do again, she’d prosecute it the same. She’s lucky she retired and moved far away. Many in the community vowed to slap her into next week if seen in public, consequences be damned. None of this should ever happen to children.
Maybe. But, using him as an example should wake every kid's head up that if the police are called to the school, that's what they'll be facing.
He’s not a little boy that you make an example of horsing around in school being bad in school and they locked him up now kids don’t really do things like assault kids kids that really do something and you know these kids you can tell if kids going down the wrong path no that’s the kind of kid you would want to scare a little bit but this little boy They’re crazy the parents calls the news and everything on them

And for those who think I’m not telling the truth this happened at Lincoln Middle school In Michigan, It was for insubordination. The most embarrassing moment of my life, And stop Comparing someone’s else’s experience to mines, What may hurt me May not hurt someone else. Ps, Thank you.

That's shits gone they ain't gotta do that anymore!!!

And he gonna get beet by dad WOOOOO
@@ghostcasper3185 That's incorrect. But in this case, they didn't need to Mirandize the kid because they didn't ask him any questions about the offense. At least not in this video.
You don't have to Mirandize him if you aren't going to question him because they have to have a parent present because he's a minor. No parent, no questions, no Miranda warning needed.
I like how the cop was patient with the boy but don't you think that child is too young to be arrested
No because you can be arrested at the age 11 and up for kids the jail is juvenile
@@MATTHEWVR1233first off the kid was innocent and secondly how do you know if he’s 11 or not? Although he technically is a middle schooler but still the cop falsely arrested him. Luckily this wasn’t real. If it was, I’d say fire those cops immediately for a false arrest on a minor

@@mimimutti8760 some states do this others don’t. It’s not a national law thing. In the US the states are basically different miniature cultures or if you’d rather miniature countries. A lot of various cultures sprung out of one country in the US which is rarely seen in other countries in history. So it really just depends what state you’re in and what county. But I certainly don’t agree with it.

The majority of schools use the police as a last resort especially a child this young. But sometimes things happen.

Why did the kid get arrested for? His teacher is a psychopathic
One time when i was around 10 the police was called on me... In school. I had a meltdown and knocked so many things over. All because i was frustrated 😣
Alot of people get very frustrated at school. I did, only i would have a full on panic attack and it would paralyze me. I would not talk, I would not cooperate, i would freeze.
I’m so sorry about that. One time I was suspended for throwing books and paper and knocking desks over because my teacher wouldn’t let me simply go get a drink of water across the hallway.
@@user-kc4wt9sd9m Why were you throwing books and knocking desks over simply because the teacher wouldn’t let you be excused?

The bad part is that the kid was unarmed, and looking like they were minding their own business, just to have an officer randomly come in and put them in cuffs, then to the station right away. Plus, what makes it worse is the kid looks 10 or 11, maybe even 9. I know this was just like acting, but this is not acted out right. And, the kid was just at his locker in the hallway, not expecting anything, later to find out he'd be in a cell 30 mins later.
At least the cop wasn't harsh on him you see that he was very calm for the poor guy
At least the kid wasn't harsh with the cop, either. He obeyed every police instruction immediately and never asked any questions, including the obvious one: "Why am I being arrested? All I did was try to get something from my locker without any adult supervision!"
Back in the day, teachers at my high school solved student issues verbally and hands on. Never saw a police officer at the school in four years. Times have changed. Nowadays, teachers are not allowed to do anything to students, so they have to call the police to avoid accusations and lawsuits.
Exactly.
but.....there were police officers in back to the future marty................
@CimarronWay
Marty McFly is probably referring to the 1950s and earlier. Us Boomers used to actually get paddled by teachers and administrators. Nowadays teachers get in trouble if they do almost anything other than reward kids. Regardless of what kids do or don't do.

This procedure allows police to do what they need to do with little to no interruptions HOWEVER family is notified fairly quickly. Add to fact this is a training video not an actual arrest.
