    Ugh, I ran into A LOT of discrimination when I went to buy my house as a single female, lots of sellers would hold my offer for DAYS which was full price or slightly over (this was before the market went nuts thankfully) and wait for a "family" or a couple to put in an offer, and they weren't even shy about admitting it! My agent sucked and did not advocate for me, I told her at least 2 times to put expiration date/times on the offer and she wouldn't! I was so disgusted by it, like I don't deserve a house because I am single... WTF!! Thankfully I finally found the right home in a great neighborhood and the seller didn't give a shit that I was single, as long as I had the money to buy it!! I don't get it, it's unfair, single people deserve homes just as much as a family does!!

    Here’s my lesson learned. Purchased a home in 2005 that was built in 1970. Inspection revealed some minor issues which were addressed. The home had been completely updated 3 years prior to our purchasing. Inspection found the plumbing to be in working order (note: slab foundation). One week after moving in I was taking a shower and the shower started to fill with brown water. Checked the other bathrooms and every toilet and tub was overflowing with brown water. GOD AWFUL mess and we had to move out of the house. The entire plumbing system under the slab had failed. Plumbers camera snake showed multiple and recent “bandaid” repairs. Found out through a neighbor the sellers knew the plumbing system was failing: it was not disclosed. We spoke to 3 different attorneys and they all said the same thing: it will cost you more to sue than the new plumbing system and foundation. LESSON LEARNED: if you are buying an older home, have the plumbing system camera snaked by a professional and do not rely on a home inspector to indicate the plumbing is sound.

    Home inspections are superficial in my experience. I have found serious problems in a properties I have purchased. I think they depend on the realtors for their business and they gloss over the inspection to please the realtors to get the deal closed. They don't really answer to the buyers who are paying the inspectors fee.

      I thought nearly the same thing until...I saw a home inspector's report paid for by an owner who isn't selling. My goodness! It was many many pages and made it sound like the house is a dump. It's not, the report is just very in depth. Now the owner knows everything that needs fixed, how serious the defect is, and how soon to do what. I have purchased 3 houses over the years and the inspection included very little. Perhaps it depends on who the inspector is working for. If the bank just needs to know if the property is "worth" the selling price, then maybe the inspection isn't detailed? I don't know. It's been ages since I bought or sold a home.

      Always hire 2 different inspectors and never use the one the agents recommend. Inspectors lie too for the agents or they will not tell you everything

      @@nightowl6260 Exactly!! I get my own inspections now by 2 different companies at least. Like I said in a previous post. The agent likes to use their inspection people and they like to be present but you are not allowed to be there and that is total bull shit!! They tell you that you are BUYING AS IS anyway!! You need to know the repairs you are going to have to do and Agents and their inspection people lie! Be very careful when buying and selling and protect YOUR MONEY!

      I agree with you because that happened to me. The inspector was very nice but he missed something that he should have found which later cost me money. He was a good friend of the seller's agent.

      @@joyceanderson8648 it may depend on the state, but in New Jersey, I was able to be present at the inspection for the home I was buying and so was the buyer for the home I sold.

    Ridiculous, I've been the buyer and the seller. If you're buying a home get your inspections. It's impossible to disclose every single thing about a home.

      Yes. I've bought and sold over 40 houses all over the southwest. This has never been an issue.

      Sellers and buyer and agents LIE! Get 2 or 3 inspections and do not use the one the agent says to use!!

      The best real estate agent I've worked with insisted on exactly this, which I appreciated. Moving away from that area, I do not assume the seller does this and I get a home inspection when buying. But this is simply wisdom. She's not being radical, she's saying for instance here's when X was done. That's not a difficult thing to do, it's completely clear, and it avoids misunderstanding.

    Yes, you can sue a homeowner who didn't disclose issues but will it be worth it? Probably not. I purchased a condo. The home inspector missed a cracked toilet bowl in the guest bathroom. I saw it the first time I cleaned, which means the former owner certainly knew it was there and did not disclose it. I was angry but a couple of hundred bucks to replace the toilet was less costly than hiring a lawyer to sue. If you buy a property, go to the inspection with the home inspector, bring a flashlight, and check everything yourself, even if the inspector looked at it. An extra pair of eyes doesn't hurt and will save you money and aggravation in the long run.

    I have questions! This house was built in 1959, owned by a church previously. There was a stain on the carpeting in one of the rooms, and everytime I cleaned it, it just came back. Simple. I took out the carpeting. Underneath were broken cheap tiles. Considering the age of the house, I suspected possible asbestos tiles. I went to home depot for consult, they told me to cover it with a new subfloor, which I did (an afterthought, probably self leveling concrete would have been better). I told my realtor about it. She asked if I knew for sure it was asbestos. No, I don't. Not a problem, she says. Is it a problem? I did a lead test too, and there is none found, but every contractor had me sign saying there was, not because there was but because the age of the house. The lead test was those crayon like things you can rub on walls and woodwork. All negative, but not an official test with doco. Do I need to say anything about that? Last thing, the fence on my property apparently goes into the neighbors' on both sides. One side, the neighbor (who has moved) wanted it that way, the other? Fence people didn't do their job 24 years ago. That neighbor doesn't want it fixed. How do I handle that? Turns out the entire block is wrong (I hired the best in the city to verify for $1200) This gets so complicated!

    That "walking distance" thing is nuts. It's the sort of 'accusation' that if I were to get, I'd say "F off and get a life".

      Possibly also say - wheelchair accessible neighborhood, as well. In my neighborhood there are ramps installed on the sidewalks.

      Vacation rental listing like to say "close to the beach", "steps from the beach" ,"walking distance to the beach," etc.... As the rental, I really have to dig deep to figure out exactly how close the place is to the beach.

    As is on all sales nowadays , end of discussion. Lawsuits come and go as long as how much you are willing to pay, thus before sale of home account a 5% lawsuit for lawyer defense. The longer it gets dragged on the faster all parties want an end to a lawsuit.

    A good real estate agent will steer their clients clear of hazards. Unfortunately good honest real estate agents are rare. As an agent gains experience he or she will talk less and say things like “there’s the view” and ‘just look at those windows!” and “ there’s the downstairs room” and especially watch closely what is put in writing. There are clients that secretly record the whole interaction trying to get a money word said. In collision with a sleazy lawyer and a crooked judge the fact that secret recording is illegal doesn’t mater.

    That opening scenario is exactly what happened when we bought our house 21 years ago. Leaks everywhere FIVE DAYS after moving in. We should've sued but didnt.

    It should be mentioned that if work was done without required building permit the certificate of occupancy is not valid.

    I think the best thing to do is to use the phrase "AS IS" as much as possible when selling.

    I'm surprised at the example of 'newer' windows. In my country, Ireland, the listing usually has a disclaimer whereby the buyer is advised to make their own enquiries and not to rely on what is in the listing. In this case the seller provided full disclosure before the contract was concluded. Again in Ireland most contracts have a condition 'contract denied until contract completed', so that either party can back out before completing the contract.

      This video completely exagerates the perils of buying a house. Despite this video, in the US, home transactions are designed to be as fair as possible. Even with our laws, I've been surprised by how many people put an offer on a house they are either not capable of buying or have no intention of buying at the offered price. Laws very by state, but generally, once an offer is accepted, a buyer is obligated to buy a home pending a finance contingency, home inspection, appraisal, and survey unless waived in the offer. I have buyer horror stories......

    What about mold that has been covered up? If the buyer can’t “prove” the seller knew about it, they are stuck.

      Excellent question and it's hard to say what the outcome will be in small claims court. The good news is that home inspectors have many more tools today than they did years ago - moisture meters for one. A moisture meter can read through walls and that may be a clue there's active mold.     what are the important things to keep record of ?, do we have a list of examples. I hope we don't need to track the receipt of rocks that I purchased for backyard. however if there are examples, that helps me to keep track.

      Generally there's a home inspection contingency, but sometimes the home inspector doesn't find hidden issues, or issues that only happen 'once in a while'. Thanks for watching!

      @@VoteBLUE2024toSAVEDEMOCRACY Great question - then the buyer should have signed a document waiving their rights to back out during the contract period, and not holding the seller responsible for home defects. As a seller, that document could potentially be very helpful in a legal dispute from a buyer.

    I think we are not as extreme in Canada. I presume you are American. But you have some good information and things to think about. I think it is more likely that a buyer not close on a contract if they find out your language miss lead you unless it was an outright lie.

    Huh....I'm in Canada (Alberta). I wonder if there is the same risk of being sued for all this stuff. I know USA is sue-happy, and we don't have the same laws, so I don't think so.

    I replaced windows furnace central air yard driveway all appliances windows water heater siding roof in 2023 i will sell my home to a new yorker with all inspections and all receipts... as long as they pay my asking price i will pay their closing cost. As long as new york rents continues to raise my new jersey home will sell home here last weeks on the market.

    The best thing is get to sell your house is get an expert, realiable,professinal, license real state agent or agency to sell your house period. And give them their comission. Thats what Im going to do if we decide to sell our home.

      If you’re sued by a buyer, let me guess, “well I had an expert, reliable, professional, license real estate agent”. Lol the court’s response.
      If you’re too slow, the lack of disclosing/concealment is your responsibility - hence “Seller Disclosure”. Doesn’t say, Real Estate Agent Disclosure.
      My guess, if you have a hard time comprehending this elementary point, you’re definitely going to have a hard time analyzing correctly if you have that, “expert, reliable, professional, license agent”.

    Why are not models sued then? Or companies who use models ? Height discrimination is one of the biggest but No one talks about that. Height discrimination is exactly like calling a black the N word

      The Fair Housing Administration is the oversight agency for the discriminatory practices in real estate. The references I made are strictly regarding this agency - which would only apply to housing. Thanks for watching!
