The film based on the struggles of an Indian couple in Norway has now put spotlight on the fight to bring back baby Ariha from Germany. The baby of the Shah couple was taken away by German authorities in 2021 and her parents are now fighting a battle to bring her back.     I'm Croatian and my heart goes out to this couple. In the past I've met quite a few Indians who deeply respected Germany. Now I've noticed that Indians are starting to see Germany for what it really is.

    The more I get to learn about this case, the less inclined I am to believe the parent’s version. This 7 months baby had major injuries to her private parts that needed stitches. But when doctors asked the reason, the parents had no proper answer. Suspecting their not-so proper responses, the doctors had informed police about this.
    What all people need to understand is that CHILD ABUSE IS NOT NORMAL and this has got nothing to do with India/ religion/ race.

      The parents story has been inconsistent, something is very fishy. The parents have no proper explanation for how the child got the injury.

    The parents never explained how the grandmother accidentally hurt the kid. The parents also told in a video that her grandmother hurt her 2 times, not only one time. How did the same accident happen 2 times? She needed stitches in the private part due to a tear. It is not some bruises due to falls.

      @@sumitmishra3575 The parents said that they had not been charged with sexual abuse as there was no DNA to prove penetration. But it was also true that the child's private part was torn and needed stitches. The parents did not elaborate on how the private parts (Vagina or anus most probably as parents only saw the blood) could be torn, not cut or bruised. If they don't have anything to hide. They should come clear. German authority will not elaborate as the child is a minor.

    Two types of investigation should take action
    1) About the hospital who declared sexual assault
    2) Investigation on the parents who are telling the truth or not, and if they are telling the truth question the grandmother.

      There’s evidence that the child might have been sexually assaulted at the parents home and no evidence she’s being assaulted in the foster home. I don’t see the logic of your argument.
      And if you were concerned about the child, you should be asking how she ended up with a serious injury that looks like a sexual assault.

    I'm an Indian, but I'm also a gynecologist, and in no way, can I fathom, how a baby's private parts can be accidentally hurt.
    Just because the parents are Indian, we should blindfoldedly accept their version of the accident, and start supporting what's trending on .

      Sexually assault is easy to find if a victim is minor girl specially in medical term ... and if they are sure about it then there is a real chance that its true.. german govt won't gain anything for doing something like that.
      You can think otherwise just because they gain enough sympathy from indians through movie trailer but i don't wanna see that little kid to get more sexually abused just cos some social influense generated by some over-emotional people who don't care about truth.
      I'm not saying that which side is right but we should be strict in this regard then emotional.

      I've heard of instances where some Indian families (even well off and literate ones) who are deep into superstition n stuff have ended lives of their own babies believing the baby would bring them bad luck and sadly in case of a girl child they don't even need a reason to end the girl baby but in families like these if the universe some how let's the baby live their grandmothers on the other hand will become the baby's Angel from hell and you cannot begin to comprehend how cold blooded these old woman can be...

    Even if it wasn't the parents, there is still someone who sexually abused the girl. And that's why the youth welfare office takes the child in because the child's safety is guaranteed there. Since the parents can't be proven that it was them, they can't be prosecuted for it, but the fact is that there is someone there either with or without the supervision of the parents , the girl was abused. The youth welfare office does not take action so harshly without reason, if the youth welfare office steps in or even takes the child away, then something really bad happened.

    I think this is not an issue for only Indians , this is a problem for all the parents living in the western society ,the government intervenes with parenting way too much. We are humans ,not some kind of robots. Parenting is not a predefined procedure by the governments , it is how the parents interact with their child.

      In this case it is wrong for the government to not return the child to the parents but sometimes government and NGOs should intervene because there are a lot of cases where parents do assault their kids(very few cases sexually).so it might be helpful for those kids to get out of those situations or else those kids without any help might get into wrong tracks and ruin thei life

    Delhi High Court observed that in 2014, of the 1704 cases of rape registered in the capital, 215 cases were instances of child incestuous rape. That was in 2014. I can understand the pain of this family, but these are serious charges and need to be investigated just as seriously.

    *So here's what happened*
    Somebody gave a tip-off to the people of Norwegian child welfare support(CWS) that the children were not treated well:-
    1) Mrs Chatterjee fed one of her children with her hands so the people from (CWS) thought she was "forcefully feeding" them.
    2) Mr or Mrs Chatterjee slapped their child which was also considered as child abuse.
    3) One of the kids was sleeping with their parents on the same bed(idk how this offended them)
    Anyways, this was just a summary of an article I read.

    It's very wrong to mix these 2 cases. The Norway case of the Bhattacharyas are very different that the recent Shah case in Germany. Movie is about the Norway case and there was no allegation of any actual physical abuse. Only emotional abuse due to cultural misinterpretation.
    But the Shah case is about an actual suspected assault to the minor daughter's genitals by the child's grandmother. This case should be dealt with differently. There might be an actual threat to the child in the Shah case.

      I don't know anything about the cases. But please don't discount emotional abuse. It is extremely damaging, be it for a child or even an adult. Our society views emotional abuse lightly as it does not leave a mark like a physical abuse that others can see easily.

    The little girl in Germany who was taken away from her parents was abused (had wounds inside her private parts) . Her parents were questioned how that happened and they said she might have fallen on some toys (which is bullshit and a lie).

      See mother of the child witnessed blood on diaper so she immediately took her to the hospital. When the doctors questioned her what happened she guessed might she had fallen. And she has got would externally. So you can't make it a case of sexual assault.

      Well for those people who are saying why a developed country would do something like that: ever since I saw this news,I got interested in this topic and a lot of other similar cases started coming in my recommendations and I found out that yes this mostly happens in countries like Germany,Norway, Australia, Sweden and all basically all the countries that have strict laws in this matter. And what do they do is that,these child protection agencies take advantage of the loop holes in the government's laws to take away the children and then make money out of them.

    It is said that the grandmother accidently injured the child. But no specifics are provided by the media for us to honestly make an opinion. Like how did she accidentally make an injury? Why did the injury seem to appear like a sexual assault case for German authority? Was it a single injury or multiple similar injuries ?
    If the German authorities are at fault for confusing an accidental injury with a sexual assault, then the child should definitely be brought back to her parents
    But if the parents are really at fault, then it is better for the child to be at foster care or other responsible people.
    We shouldnt form an opinion until all proofs and details are available to us. Germany - India dialogue is the way forward to deal with such complex situations. You can't immediately start clamoring for boycotting German goods and services 🎈

      Precisely, about the only logical comment on this. I wonder if this movie needs to come with a disclaimer since in the Norwegian case the authorities mentioned that there were issues of domestic violence in the family and the mother seemed unable to cope with caring with her children. The couple never clarified on what their issues were and did get divorced. However, the authorities were OK with giving over care to the paternal uncle so sure looks like there was an issue with the parents.

    This comment section is wild… and no one seems to know how the social services in Germany works.
    The authorities can’t even defend their decisions publicly as there are privacy laws involved. The parents can legitimately say anything yet the German authorities involved can’t say a word because the are forced to protect those same parents rights.
    I think the internet should stay out of this situation.
    Either the parents abused the kid or they didn’t. We can’t know and need to trust those involved to find out.

    I think German authority did well. The fact the case is closed for parents does not necessarily mean the child will be returned without risk assessment. It could be years before child will be returned or may not be returned at all. These things are taken seriously in Western countries.

      As a mom of two babies. Injury in the private part won’t just happen randomly. Somebody must have done something. Mostly sexual assaults are abused by close ones or relatives. Some people are very evil. I’m sure the authorities have done thorough medical examination before coming to a conclusion. I hope the baby is safe in the foster home.

    As someone who lives in Germany I know that the state tends to be quite careful and perhaps even to careful when it comes to taking action in cases of child abuse (in the last years we had children die because signs of abuse were ignored or childreen were given back out of care without proper reassessment). So it is quite likely that they actually have quite solid evidence that the child was at least not taken care of or even being abused by someone.

      In India, child protection courts rarely send a kid to a shelter. They try to counsel the parents, usually adoptive, to not beat the child etc.
      Because the alternative is much worse -- sending a child to strangers. It has a deep psychological impact on the kid.

    There is gap in this news or with case of this couple. I live in Germany and my experience here is people are responsible and respective of others. I think unless and until baby is being mistreated by her family the authorities won't even interfere. Germany is already short of a labor and why would they put their money and labor just to harass the parent. I think it's utter nonsense.
    German Government is very careful of it's people. From my perspective if the authorities have identified something wrong with parenting they will not give the baby back as they care for the individual and until the parent proves that they are capable of taking care of the baby.
    There are always 2 sides to the coin so we should not draw our conclusion just based on the news or what we hear.

    Personally, I think people are going into this topic with a one sided veiwpoint. "Sexual Assault" in many European countries can vary a vast number of things, sexual is just the worst reason for it to happen. These things do happen and are taken seriously in Germany and other European countries. When they say no criminal investigation is done, I see it as it could have been the grandmother accidentally injuring the child or it could have been her disciplining the child (which is illegal) and safe to say not farfetched since as an Indian my ass has been beaten countless times (illegal in many countries). So what do we take off from this issue? Respect the laws of other countries and realise that nobody is in the wrong here it's just a misunderstanding born out of who know what maybe it was an unjust police, assault or just an accident. Also take a look at our country before others, we are deep in horseshit. By having a presumption on other countries you are not just narrowing your view but also that of your child, friends, siblings and their opportunities. But with all of that still we should not stop supporting the child and her parents even after this momentary trend that just makes a buck for these large megacompanies. (No Government, Company cares for anybody but that family does hope one more soul could help them reunite)

    Unfortunately sometimes the German public services truly fail their job.
    I remember some years ago they accused a family of sexual assault towards their children and the children were given to foster care where they really were sexually abused, while later it was proven that the parents never had assaulted their children. The family was German, it was not about racism, more about incompetence of staff at local authorities and lack of staff to do the job properly.
    This is not the norm though. It's not common practice in Germany to take away children from their families easily. There must be serious reasons to believe that the family is abusive.

      The hospital claimed that parent sexually assaulted her (That's it). And German authorities took her, the court took away their parenting rights. The parents filed plea, never got any response. VISA eventually expired, parents had to leave Germany.
      When Indian Embassy asked, German quotes what the Hospital said.
      That's what Europeans nations are like, there no legislation, they can do what ever they want.
      UK & USA are different there have trustable legislation which gives you a fighting chance.

    I have zero tolerance when it comes to abusing kids, children & domestic violence of any kind against anyone regardless of age. At the same time, domestic violence is severely under reported in India & has became a norm which I wont support. There is no such thing as little or moderate violence regardless of what form it takes place as some people might argue.

    I was born In norway, I am an Indian, I lived there for eight years in the counties of Rogaland and Ostfold (now a part of viken) I also want to go back to norway and work there for a few years after my graduation. I am fluent in norwegian, almost all my friends were norwegian there except for most family friends. Norwegians are really nice people but there are some racist elements, much less than Germany, France or nearby denmark and neighbouring sweden , but there still is a small group of racists. Norway's Barnevaern or child protective services specifically target immigrant children, 3 of my childhood friends were kidnapped by the norwegian government itself.

    Explanation to Some idoits who r raising doubt on parents on comment section , they must know and read properly , that the sexual assault case has been dismissed against the parents by German court , parents were clearly from all changes by court and yet child has not given back to parents , that is the issue . Foster home is trying to delay the case so after completion of 12 years away from parents , parents will have no right on baby as per German law .

      This is awful and absolutely unacceptable. I was once badly hurt after falling down from a bike while playing as a kid. The wound I got would have been labelled as sexual assualt had it been in Germany or Norway instead of India lol. I cant even imagine staying away from my parents at such a young age and that too, for such a baseless claim.

    Were they deported against their wishes to India? And how can a baby have wounds in private parts? It is the duty of the state to investigate the matter. I felt so upset when the concern of the parents was that, their child is having non veg food. Any caring person's priority would be the well-being of the child, not the religious practise.

    Did half of the commentators' population even look throughout the case's details and the morphological area where the infant was hurt? That is the prime reason why the child was snatched away from her parents. Do not just boycott a country for their immediate response to a presumed case of possible infant negligence and sexual abuse whereby, the young Ariha had to get stitches on the surface of her intimate area.

    My Daughter works at a parent assessment home in Germany.
    Many of her clients are from war torn countries, third world and imprisoned lands.
    Its a cultural shock for them as regards to the tough standard to parental care.
    Any type of mental or physical mistreatment to their standards must be registrable
    Which in due shall be accessed.
    A tribunal then decides according to the case , what the next step is.
    Before any child becomes a custodian of the Govourment.
    The parent/s are interviewed and when necessary, counseled on how to treat their child.
    When that fails, then the child will be put into the care of a care family.
    It is not written in stone that the child will remain.
    Parents have later made a application to get back their children.
    When approved they must agree that at first under the supervision of a care specialist.
    When they achieve the parental standards.
    Then they will be allowed to take their child and live a life together.
    Be it on occasions spot checks will take place to make sure that the child is doing well.
    Its a burocratic hurdle.
    With high jumps.
    The average German finds it hard going.
    So no wonder it seems to those from outside, to be hard and yes even cruel.
