How is a law made reasonably classified and not arbitrary? The Courts have also answered this and held - (1) the classification must be founded on an intelligible differentia which distinguishes persons or things that are grouped together from others left out of the group, and (2) the differentia must have a rational nexus with the object sought to be achieved by the statute in question. The example given above for scholarship for education to the poor as against not giving it to the richer segments of the society, is an example of intelligible differentia. Now in any legislation, the object of the legislation also mentioned along with it. It is the purpose or the objective of the legislation. If it is satisfying this, then it passes the muster and if it fails then it is declared a bad law by the Courts. Now coming to CAA, the object of the law is to provide citizenship to the minorities of three Islamic states, who have been persecuted in these countries(Object). Can Muslims in these countries claim equality with minorities in these countries? There is nothing in CAA against Muslim citizens of India. They have all rights and are equal citizens of India. CAA is aimed at giving citizenship to victims of nonsecularism of neighbouring nonsecular countries like Pakistan and Bangladesh who have taken shelter in India being under religious social and all round discrimination there. Pakistan is old nonsecular Islamic country created by partition of original India in 1947 based on 2 nation theory of MD Ali Jinnah.Bangladesh too has abandoned it's original secular constitution and declared Islam as rastra-dharma ( state religion). As a result nonmuslim there has been subject to social religious and all round discrimination for which large number of non-muslims have left those countries silently and secretly for India in last few decades ,living in India hiding their identity without citizenship. These people have found India safe although without citizenship than their home countries.Most of Nonmuslim exodus from Bangladesh took place during time of previous government of Bangladesh. There is no probability of their government taking these people back to their countries and have repeatedly denied any such exodus. But the non Muslim population has reduced to great extent. Nonmuslim population of Pakistan has reduced to insignificant number and that of Bangladesh has become reduced to 8 to 9 pc now from 25 pc in 1971 in last few decades. For giving citizenship to these homeless people who are victims of partition of original India as well as victim of nonsecularism of the neighbouring non-secular countries like Pakistan and Bangladesh, government of India has formulated CAA It has nothing against Muslim citizens of India. The Muslim Pakistani and Bangladeshi donot require any provision of citizenship in India as they are enjoying all rights in Pakistan and Bangladesh being Muslim countries. However India may keep a quota for citizenship for secular activists of Pakistan and Bangladesh who are likely to be repressed there who want to live in India permanently or temporarily.

Good discussion. Section 6 of citizenship act 1955 allows anyone to apply for citizenship, will be looked into on case to case basis. Very clear explanation by Mr Hamid Bashani. Mr Mufti can recommend to other countries, to take care of all the rest of the world! Why jump on India? I can choose whom I can invite into my home, right? ( Any person means citizen and friendly. Alien)
“The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.”
Inequality cannot be treated with equality but with inequality :- Article 14 hold equality as principle, the society is not equal and whenever the State makes any law/rule/policy which tries to reduce this inequality, then such rules/laws/policies are exempted from application of Article 14 of the constitution. The rule of equality only applies to equals not to unequals.
Reasonable Classification -
But what would be the basis on which it is to be determined that the State has been “just” in making the rules/acts/ policies for the inequity. The Courts have answered that there should be reasonable classification of such people and not an arbitrary one.
In Chiranjit Lal Chowdhuri vs The Union of India and Others, 1950 the Supreme Court held -
“but the classification should never be arbitrary. It must always rest upon some real and substantial distinction bearing a reasonable and just relation to the things in respect to which the classification is made; and classification made without any’ substantial basis should be regarded as invalid”
Test of Reasonable Classification -
What is the test for reasonable classification? How is a law made reasonably classified and not arbitrary? The Courts have also answered this and held -
(1) the classification must be founded on an intelligible differentia which distinguishes persons or things that are grouped together from others left out of the group, and
(2) the differentia must have a rational nexus with the object sought to be achieved by the statute in question.
Intelligible differentia -
The word intelligible differentia though sounds daunting, is very simple to understand. It means one should easily perceive the difference between the people who are included, against those who are excluded. The example given above for scholarship for education to the poor as against not giving it to the richer segments of the society, is an example of intelligible differentia.
Such differentia should also needs to have a nexus with the object of the legislation. Which means the legislation so made, should be related to the object of the legislation and not unrelated to the legislation.
Now in any legislation, the object of the legislation also mentioned along with it. It is the purpose or the objective of the legislation.
Conclusion -
To conclude on Article 14, any rule/law/policy made by the State has to pass through the above jurisprudence. If it is satisfying this, then it passes the muster and if it fails then it is declared a bad law by the Courts.
Now coming to CAA, the object of the law is to provide citizenship to the minorities of three Islamic states, who have been persecuted in these countries(Object). Can Muslims in these countries claim equality with minorities in these countries? Rather being Islamic states, these countries give an enhanced status to Muslims and secondary status to minorities(Reasonable classification & Intelligible differentia).
Therefore all this discussion that this law violates the Article 14, is not correct. Further if the law is violating Article 14, then it should be challenged in the Supreme Court, who is the final arbiter in such matters.

There is nothing in CAA against Muslim citizens of India. They have all rights and are equal citizens of India. CAA is aimed at giving citizenship to victims of nonsecularism of neighbouring nonsecular countries like Pakistan and Bangladesh who have taken shelter in India being under religious social and all round discrimination there. Pakistan is old nonsecular Islamic country created by partition of original India in 1947 based on 2 nation theory of MD Ali Jinnah.Bangladesh too has abandoned it's original secular constitution and declared Islam as rastra-dharma ( state religion). As a result nonmuslim there has been subject to social religious and all round discrimination for which large number of non-muslims have left those countries silently and secretly for India in last few decades ,living in India hiding their identity without citizenship. These people have found India safe although without citizenship than their home countries.Most of Nonmuslim exodus from Bangladesh took place during time of previous government of Bangladesh. There is no probability of their government taking these people back to their countries and have repeatedly denied any such exodus. But the non Muslim population has reduced to great extent. Nonmuslim population of Pakistan has reduced to insignificant number and that of Bangladesh has become reduced to 8 to 9 pc now from 25 pc in 1971 in last few decades. For giving citizenship to these homeless people who are victims of partition of original India as well as victim of nonsecularism of the neighbouring non-secular countries like Pakistan and Bangladesh, government of India has formulated CAA
It has nothing against Muslim citizens of India. The Muslim Pakistani and Bangladeshi donot require any provision of citizenship in India as they are enjoying all rights in Pakistan and Bangladesh being Muslim countries. However India may keep a quota for citizenship for secular activists of Pakistan and Bangladesh who are likely to be repressed there who want to live in India permanently or temporarily.

Article 14 of the Constitution of India reads as under:-
“The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.”
Inequality cannot be treated with equality but with inequality :- Article 14 hold equality as principle, the society is not equal and whenever the State makes any law/rule/policy which tries to reduce this inequality, then such rules/laws/policies are exempted from application of Article 14 of the constitution. The rule of equality only applies to equals not to unequals.
Reasonable Classification -
But what would be the basis on which it is to be determined that the State has been “just” in making the rules/acts/ policies for the inequity. The Courts have answered that there should be reasonable classification of such people and not an arbitrary one.
In Chiranjit Lal Chowdhuri vs The Union of India and Others, 1950 the Supreme Court held -
“but the classification should never be arbitrary. It must always rest upon some real and substantial distinction bearing a reasonable and just relation to the things in respect to which the classification is made; and classification made without any’ substantial basis should be regarded as invalid”
Test of Reasonable Classification -
What is the test for reasonable classification? How is a law made reasonably classified and not arbitrary? The Courts have also answered this and held -
(1) the classification must be founded on an intelligible differentia which distinguishes persons or things that are grouped together from others left out of the group, and
(2) the differentia must have a rational nexus with the object sought to be achieved by the statute in question.
Intelligible differentia -
The word intelligible differentia though sounds daunting, is very simple to understand. It means one should easily perceive the difference between the people who are included, against those who are excluded. The example given above for scholarship for education to the poor as against not giving it to the richer segments of the society, is an example of intelligible differentia.
Such differentia should also needs to have a nexus with the object of the legislation. Which means the legislation so made, should be related to the object of the legislation and not unrelated to the legislation.
Now in any legislation, the object of the legislation also mentioned along with it. It is the purpose or the objective of the legislation.
Conclusion -
To conclude on Article 14, any rule/law/policy made by the State has to pass through the above jurisprudence. If it is satisfying this, then it passes the muster and if it fails then it is declared a bad law by the Courts.
Now coming to CAA, the object of the law is to provide citizenship to the minorities of three Islamic states, who have been persecuted in these countries(Object). Can Muslims in these countries claim equality with minorities in these countries? Rather being Islamic states, these countries give an enhanced status to Muslims and secondary status to minorities(Reasonable classification & Intelligible differentia).
Therefore all this discussion that this law violates the Article 14, is not correct. Further if the law is violating Article 14, then it should be challenged in the Supreme Court, who is the final arbiter in such matters.

Good discussion. Section 6 of citizenship act 1955 allows anyone to apply for citizenship, will be looked into on case to case basis. Very clear explanation by Mr Hamid Bashani. Mr Mufti can recommend to other countries, to take care of all the rest of the world! Why jump on India? I can choose whom I can invite into my home, right?
And, this Mufti never says for a moment, that the persecution of Hindus is wrong...
