Israel does NOT have the right to defend itself because it is an occupier. Occupier's by International Law cannot defend themselves however, the occupied can always defend itself. The occupied can use any measures necessary by anyone, to defend itself agains any occupier.

We kept hearing they need more evidence for genocide. Israel provided that evidence in spades for 7 months while denying an independent investigation into the events of the 7th OCT. These are two separate issues. One is an alleged war crime by people opposing an occupying force who is and has been in breach of international law for 50 years and one is a prolonged genocide of an occupying force upon the people it has taken responsibility for.
These warrants should have been issued separately and reasons for them explained separately. What I see is more of a plea bargain than a warrant for arrest. If it stops the violence by Israel all well and good, (we know it will not).

I also partly disagree with "probability" in terms of hostage torture etc. No one knows what has happened to the hostages and from previous interviews with survivors, they were complimentary of their captors. Was this also taken into account?
I am also dismayed that the Palestinian hostages who have been tortured, lost limbs etc without trial in Israeli jails and the obvious apartheid actions in the West Bank have not been added to this. What about the reporters and children killed during peaceful attempts to return to their homes?

Occupied people have the right to armed resistance by any means against their occupier. An occupying power does not have a right to defend itself against those it occupies. This is a long-established international law. Any suggestion thst Israel "has a right to self defense." Is a gross misrepresentation of international law.
The charges of rape against Hamas have long been debunked, which any prosecutors MUST be aware of. So, these charges against Hamas seem biased and ridiculous and based on racism.
Lastly, according to international law, the aggressor (which the occupier must be considered) "is responsible for the accumulated evil" of ALL actions that happen during the occupation. Therefore, ONLY Israel can be responsible for any illegal actions Hamas takes while that occupation is ongoing.
This is ALL well established international law. Once again, we see Israel being given preferential treatment.
