ASSAULTED AND GOT THE POLICE CALLED ON ME - “No filming” policy at Sydney Trains, Mt Druitt

  • I did an audit at Mt Druitt train station in the belief that the train station is public property owned by the state government and that public filming is freely permitted. I found out that their staff is ignorant about public photography, but also that I needed permission to film at any train station, and to fork out lots of money for the privilege. Their policy effectively curtails public photography around public transport and shows how the government is insidiously overreaching into private recreational pursuits. I was assaulted by one triggered person who didn’t want to be filmed. In the end, the police were close to laying charges on me for intimidating passengers and refusing to provide my contact details.

    “Amateur and professional filmmakers and photographers must obtain permission from Sydney Trains to conduct any filming/photography on our premises.”
    Your requirements:
    • Applicants are required to submit an application for assessment and scheduling - Fees apply
    • A minimum of 10 business days notices is required to process applications.
    • Applicants must obtain Public Liability Insurance for the sum of $20 million.
    • The crew may be required to meet on site prior to filming with a Safety Officer for a briefing (call out fee will apply)
    WEEKEND Fees (non refundable, GST inclusive) $400 per hour (minimum of 4 hours)
    Law Enforcement (Powers and Responsibilities) Act 2002 (NSW), section 99:

    (1) A police officer may, without a warrant, arrest a person if-
    (a) the police officer suspects on reasonable grounds that the person is committing or has committed an offence, and
    (b) the police officer is satisfied that the arrest is reasonably necessary for any one or more of the following reasons-
    (i) to stop the person committing or repeating the offence or committing another offence,
    (ii) to stop the person fleeing from a police officer or from the location of the offence,
    (iii) to enable inquiries to be made to establish the person’s identity if it cannot be readily established or if the police officer suspects on reasonable grounds that identity information provided is false,
    (iv) to ensure that the person appears before a court in relation to the offence,
    (v) to obtain property in the possession of the person that is connected with the offence,
    (vi) to preserve evidence of the offence or prevent the fabrication of evidence,
    (vii) to prevent the harassment of, or interference with, any person who may give evidence in relation to the offence,
    (viii) to protect the safety or welfare of any person (including the person arrested),
    (ix) because of the nature and seriousness of the offence.
    (2) A police officer may also arrest a person without a warrant if directed to do so by another police officer. The other police officer is not to give such a direction unless the other officer may lawfully arrest the person without a warrant.
    (3) A police officer who arrests a person under this section must, as soon as is reasonably practicable, take the person before an authorised officer to be dealt with according to law.
    Note-
    The police officer may discontinue the arrest at any time and without taking the arrested person before an authorised officer-see section 105.
    (4) A person who has been lawfully arrested under this section may be detained by any police officer under Part 9 for the purpose of investigating whether the person committed the offence for which the person has been arrested and for any other purpose authorised by that Part.
    (5) This section does not authorise a person to be arrested for an offence for which the person has already been tried.
    (6) For the purposes of this section, property is connected with an offence if it is connected with the offence within the meaning of Part 5.

    So she, the woman police officer.. had no interest in the assault and actually said she understands why someone would assault him and that its ok for the absent person to do so. She has no knowledge of law and spouts her own opinion and has no jurisdiction over a civil matter which at best, trespassing is but only and it’s important, only when a person has been asked to leave a location or premises whether public or private.. the rest is up to the courts to hold those stepping outside the law accountable.. that is if you dont meet another corrupt law representative along the way

    It is not a public place, this is where people do not understand. It is private property open to the public, now once you engage in illegal activity, harassment, intimidating etc: once you are asked to leave or asked to stop what you are doing, once you refuse, you are trespassing. The police may give you a move on order, or if you refuse to leave, they have the right to arrest you and charge you for tress pass, intail comes with a maximum penalty of $11,000

    Mt druitt police hang around that railway station only in daylight fining people for not having a ticket in broad daylight where their safe. At night when someone is bashed by gangs their no where around to assist the victim.. I guess police don't want to be attacked .easyier to play cops and robbers. As for the train guard he needs to learn that football grounds are private property but public transports stations arent.

      They took 40 minutes to respond to the station staff call, yet the police station is just 5 minutes walk from the train station. Seems they don't care about keeping law and order, only abusing it.

      No. Police have various priorities in terms of incidents to attend to. Furthermore I can't imagine these, or any other two officers coming to the aid of victims surrounded by 20 or so agressive, big, strong Islander males.

    You are honestly asking for trouble just cruising around a train station filming people for no reason especially in western Sydney basically waiting for someone to kick off and say something to you so you can respond with “it’s my legal right to film what ever I want in a public place” , pretty silly ! I understand it’s legal for you to film but honestly it’s a stupid thing to do .

    If you are not harrassing, intimating or disturbing people the police cannot issue a move on order.
    If people don't want to be filmed in a public place it is up to those people to move on not the person filming the public spaces.

      My wife and I arrived Chicago in 2010 coming in from the state of New York. I had my wife take a picture of me at the front of the locomotive once we were in the depot. Two traveling bongo brothers told her to stop taking their picture because as they said the camera '"steals their soul.."

    I find it interesting how many people are saying it's a breach of their "policy." Some people seem to forget that they are public servants and work for us. Public photography is not a crime or illegal. The move-along direction wasn't lawful under LEPRA, and that cop was a rookie. Her supervisor should have immediately corrected her unlawful behaviour. The biggest problem with the police is that we keep allowing them to get away with things that are unlawful, and by not correcting them, we are reinforcing their tyrannical behaviour.

    As I NSW security guard with 6+yrs experiance in every type of unarmed security including dealing with assaults, theft & trespassing just to list some experiences of mine, I am confident that you did nothing wrong in this video.
    -You can legally refuse to provide your details to police as they were unable to articulate any reasonable suspicion that you had committed a crime. You are only legally required to provide details to police if they have reasonable suspicion you have committed a crime.
    -You are legally aloud to film in a public space, regardless of it being private property or public property.
    -Train stations are public property that is operated by a private organisation. They are owned by state governments and operated by public organisations.
    The only thing I'd pull you up on is whilst you do have the legal right to film anyone in a public space, others also have the right to ask you not to film them. If for what ever reason you are unable to comply with this request than legally you can not use that footage or pictures for any official use such as advertising or press or you much blur them out. If they find footage that they are in and it shows them asking you not to film them they can take you to court but you'll probably be made to take the video down or edit them out......many different laws regarding to filming in public! I would also argue that it was evident you were there to cause issues as you'd know how people react to this sort of thing and as such were being a public nuisance (which is the only reasonable grounds for police to ask for your details) as a normal person who was no intending on causing issues would have simply moved on and recorded a different public space if public photography was the honest to god reason for you being there.

You can film in public spaces but if someone does not wish to be filmed you can not use that footage in any legal capacity whether it be in court or in promotion of your business....you can still film them but the footage or pictures can not be legally used, especially if it's recorded that they asked you not to film.

      There is no expectation of privacy in a public place. For clarification, OP is referring to the Criminal Code 1988 (Qld). The video was not filmed in Queensland.

    Completely agree with you, its the same as the Sydney Harbour foreshore. WIth a stroke of a pen it was effecively made private property. These should be challenged as its plain wrong. Sydney Trains doesnt own the rail property I believe it is owned by either Transport for NSW or RailCorp (they are in effect leasing it). All three ABN entities types are state government entities, which require it to be a government body - cant be a private corporation. Kind of shoots their private corporation narative. Plus if you ask them they'll say they are public servants. Any reasonable person would deem the area not past the gates as a public place. Its high time that someone challenge it in court to get a proper ruling. The intimidation concept was novel as its one of the very few reasons they can give a move on directive. Maybe remind them that the if 99.99% of the people walked passed you and said nothing that the 'reasonable firmness' test wasnt met to the move on direction. Probably wont help at the time but if you choose to take it further legally it could help.

      Thanks for your considered response. Interesting that the staff said it's not public property, but they wouldn't commit to the question if it was private property either! Nothing I was doing could be considered a summary offence, but the police pulled the "intimidation" line and cited section 99 of LEPRA, which still rests on a reasonable suspicion an offence has been committed. Notice at 28:07 the constable said that if I don't move on I would be committing "other further" offences - but it wasn't stated that I had committed any offence at all. The deceit from everyone was infuriating. I'll stand my ground and test the policy one day...

    I support the right for people to record in public within reason such as vlogs, filming nature etc but some places their is an expectation of privacy... and filming people going about their day is just asking for trouble and a waste of time for everyone involved . It may not be illegal to film at a train station, but people will take the law into their own hands if you provoke them. For the original poster to argue with the transit workers and then ask them for protection one minute later is humorous... would I have reacted the same way as the irate passenger? no, I would've continued about my business but I'm not everyone any you must be carful who you annoy because some people will take maters into their own hands if they feel disrespected.

    Australian courts are very clear on this. You have every right to film in public spaces, people do not have an "expectation of privacy in public"...the test being, otherwise, it wouldn't be a "public space". Inside a toilet block etc, a person does have an expectation of reasonable privacy, so you could not film. The only thing that police officer should have been doing, was arresting anyone who assaulted you! IF you were filming for expressly commercial purposes or, your filming unreasonably hindered people, that would be different. So long as you are not hindering or harrassing people, you can film away!

      The legislation is pretty clear that it is up to each council to govern filming in public.
      Also this is not a public space. They are correct, it is a corporation owned by the government so it is not public owned space, but rather a business that is accessible to the public.
      If you can name 1 court case in Australia that proves me wrong I'll give you $100.

IF a person is filming for NON Commercial reasons, they are entitled to do so, so long as not hindering others/causing safety issues. Again, Australian courts have been very clear on this. A train station is not typically a place a person would expect privacy.

    It's funny how there's a sign telling people they can't smoke, drink alcohol, put their feet on the seats, etc. but nothing about filming. That said, filming in a public place is like farting in a public place. Both are perfectly legal. We've all farted in public but if there are people around, we try to sneak it out silently so no one notices and most people have the common sense and decency to do that. Whilst it's perfectly legal to rip the loudest fart of all time in a public place, if you walked right up to someone with the intention of doing that just to get a reaction and if you were told off or even slapped for it, you deserved it. You can say you're allowed to fart in public all you like but you set out to annoy someone, just because you can. That's the difference between Sydney Trains not caring about 99% of people who take pictures and video on their stations and trains when they're doing it in a discreet manner with no intention of annoying anyone, and the 1% who make it so obvious that they draw attention to themselves. Attention they hope to get. As it was, no one came near you for 8 minutes and 40 seconds. That's plenty of film for anyone who was just filming the station because they have a genuine interest in trains and stations but you had every intention of going for as long as it took to get the attention you wanted. You went there to draw attention to yourself and if no one paid you any mind at all, your film would not have been put on YT. There'd be no "I filmed all day at Mt Druitt station and no one said a word to me" video and you would delete the footage because you have no real interest in trains or stations. You don't make documentaries and a film about Mt Druitt station is not something you'd keep and watch from time to time. Tell you what, you can't make yourself fart whenever you want to but you can pick your nose and fling the snot around in public. It's disgusting but not illegal so go to a restaurant or similar and do that in front of a bunch of people and see if you're told to piss off. When the manager comes out to see you and tells you to leave, tell him it's legal to pick your nose and you'll be staying and continuing to pick your nose. When the cops turn up, tell them that too. They can't charge you with picking your nose but they can escort you from the place because the manager told you to leave and you didn't. I look forward to seeing the video of you being dragged out by the scruff of your neck saying "but it's legal to pick one's nose in a restaurant" on YT.

      He said he is just filming a glimpse of everyday life. Nothing wrong with that, there are videos of this taken back in the 80s and 70s and they're valuable and interesting to watch now.
      I remembered this channel just the other week when I hopped off the bus and there was a car accident right there. The police rolled up and asked me to leave and not film, I cited LEPRA and stated they need specific reasons to ask you to move along. Namely, you must be intoxicated, harassing or a threat to someone else, or involved in some sort of crime. I hope I was in the right- I think I was.
      Generally, the public and the police even, are unprepared for a person who does a bit of legal research.

      So nobody is allowed to take their phone out of their pocket and use the camera until they get permission from Sydney trains and pay the fees and obtain Public Liability Insurance for the sum of $20 million... So what's going on? Go to Circular Quay train station and I suppose the ferry wharves..and especially on the ferries, folks are taking photos and videos all the time...Ain't nobody freaking out there. Look pal, there are so many people all day everywhere on train stations on trains, bus stops and on buses trams ferries etc using their cameras and the transport authorities can't stop them and nobody even tries ... So whether Circular Quay, Central, Wondabyne or Mount Druitt you cannot discriminate. UA-cam is filled with videos shot on Sydney trains and stations. And do yourself a favour Ramones, re-read and properly understand all that stuff about about permissions, it don't apply to ordinary people using a camera.

Can you not see how insane the permit process is? It is a public place and photography is legal. Exercise that right or lose it forever.

      I generally would just give them a call or speak to a member of staff, especially a train guard.
      I have developed some great relationships with a few of them in Freo and they give me full access to film but I do the buses - I've also had extremely strong relationships with the bus drivers up until covid when everything died down
      It goes to show relationships go a long way

      Up to each council to decide the rules surrounded public filming. Most people just assume you're allowed to film in public because that's what happens in America.
      The guy filming this is not familiar with the legislation, he's just making assumptions.
      Owned by the government does not equate to being public property.
      There's a reason why old mate filming hasn't sued the police over this

    There's no generic rule for filming in public spaces in Australia. It's actually up to each council to decide believe it or not.
    Some councils actually require you to obtain a permit before even filming in any publicly owned space.
    Sydney Trains who owns the space that you are on have always required written permits atleast 10 days in advance before filming.
    You're not in America mate.

    Did the station attendant or station master explain the reason the policy of filming on railway property or of trains is in place? The main reason I had been told by the station master at Newcastle was that if an incident occurs, and you are spending the day on that platform without riding a train filming with written authorisation, protects/ clears you of involvement.

    I'm all for filming an adventure but the way you were just lingered in that one spot focusing on the families was a little creepy..
    You got the close up shot of the Turnstiles, got the longshot of the turnstiles, then stood around for almost 2 minutes, if u got the shots and kept moving you probably would have been fine.
    You should probably have a read up on our laws also, so when you get tested you will actually sound like you know what your talking about.. all your lines you stole straight from American audit videos.
    I also believe you filmed their policy sign on the way in and it had nothing about cameras, maybe they should add that.😂
    What a sad world we live in where we can't even record memories of our own kids playing sports.

    Seriously 😒, NSWPF may be good at some things, but more than half the time they are absolutely annoying and love to disturb people doing nothing!!!
    Most police officers are given instructions, and are just told to do whatever it takes to get their “Scenarios/call-outs” finished, in my opinion!!!
    And unlike back on the day when police where strong, fit and healthy, now you quite often see officers that aren’t too fit! (No offence to anyone who sees this!!!)
    I haven’t had many good encounters/experiences with police at all!!!
    They are just grumpy 😠 and bored 😑, which is why they always disturb people (My opinion!)
    It is so sad to see young people being brainwashed by our country and people who run it!!!
    AND THATS IN MANY WAYS!!!

    I’m feeling very sorry that I’ve seen this video now as I won’t stop going on and on about it!!!
    Anyway, I have heard and seen many videos where station people get annoyed/grumpy and ask you not to film and or kick u off the station!!!
    They are all generally corrupt, including all of our police, ambos, hospitals, and fire fighting services!!!

    I think this is an issue of legality V respect. I don't see anything wrong with walking around filming. I think these types of videos will become very interesting and valuable in decades time, I watch videos of random places and everyday life from the 80s, 70s etc. Like a living time capsule.
    Legally, you can film in public as you don't have a reasonable expectation of privacy in a public place. Didn't seem to be filming any particular person or following any one around, until that guy became confrontational. Maybe the objectors would have a case if one particular person was singled out for filming, arguably harassment.
    People may think its weird to film nothing in particular, but films of everyday life will become very interesting in decades time.

    Same type of thing happened to me 8 7 2023 but I was asked to leave a public Amtrak station in Wisconsin cuz of The station agent , who was only a volunteer , was "nervous" of my vehicle parked in the parking stall .
