    Skills in Demand Visa
The Migration Strategy, released in December 2023, introduced the Skills in Demand Visa. There are three new types of temporary work visas focusing on clear pathways to Australian permanent residency and aiming to alleviate labor shortages.
The three new pathways are called Specialist Skills, Core Skills, and Essential Skills. The Skills in Demand Visa will replace the Temporary Skills Shortage 482 Visa and provide more flexibility to workers and employers.
Key features for all three visas include:

The new Skills in Demand Visa will provide a four-year work visa.
Visa holders will have the ability to move between sponsors with 180 days to find a new sponsor.
The time spent with any approved employer will count toward permanent residence requirements. This will avoid the clock resetting with each employer.
All streams (Specialist Skills, Core Skills, and Essential Skills) will have a clear path to permanent residency in Australia.
There will be a public register of sponsors to assist individuals in finding a new sponsor.
    Specialist Skills Pathway
This pathway recognises highly skilled migrants are hugely beneficial to Australia's national productivity, including through their support of critical sovereign capabilities and potential to grow the skills and expertise of the Australian workforce.
The Specialist Skills Visa will be available to applicants who meet the eligibility criteria, such as being nominated by an approved employer and meeting health and character requirements. In addition to this, it will be available to any occupation except trades workers, machinery operators and drivers, and laborers.
The applicant will need to have earnings of at least AU$ 135,000 a year.
The Specialist Skills Visa processing time for the Specialist Skills pathway is expected to be very quick, only 7 days.
    Core Skills Pathway
Most temporary skilled migrants will come through the Core Skills pathway. The Core Skills visa is designed to bring skilled employees to Australia and to fill the needs that are available now and, in the future, to ensure we can provide ourselves with the goods and services that are needed for the Australian economy.
The Core Skills pathway would be available for a wider range of occupations, including registered nurses, trades, and some machinery operators.
The general eligibility criteria include individuals with occupations on the new Core Skills Occupation List, and individuals with a salary at or above the TSMIT, which is currently AU$ 70,000 a year. As soon as the Core Skills Occupation List is available, we will update it here. The Core Skills Visa is likely to have requirements very similar to the current 482 visa. You can check the 482 Occupation List here.
The Core Skills Visa processing time is expected to be approximately 21 days.
    Essential Skills Pathway
It's a pathway for lower-paid workers with essential skills and might include those earning a salary under AU$ 70,000 a year.
The Essential Skills pathway is likely to have similarities with the current Labour Agreement visas.
When will the Skills in Demand visas be implemented?
The Migration Strategy Action Plan provides the indicative timeframe of late 2024 for implementation.

If the new SID visa is a replacement for the TSS 482 and you’re already on a 482, how do you transition to the new SID visa and does time spent on a 482 count towards the SID with respect to any future PR application? Many thanks and great update on this new visa!

Hi, I received the pre invite from Victoria to apply for 190 Visa. While submitting the application their was question "Have you made an application to/or been nominated by any other Australian state or territory?" Should I answer 'Yes' or 'No' to this question? Actually I have lodged separate EOI's to all the states and territories but did not receive the invite from any state till date. So I'm confused on what to answer for the above question. If I select 'Yes', it is giving me the list of all state/territory to select and also asking for the details(i.e stage in the application process, date of nomination etc..) of other state/territory application or nomination. Please let me know on what to answer for this question. It is a humble request.

What does Australia consider more about Latinos? Here we work hard with the student visa. We are very hard-working and entrepreneurial, but it gives us a lot of restrictions on hours because education costs. There should be a balance. I hope it changes. I live in Sydney.

      Hi, Thanks for your comment.
Yes it is very hard at the moment with reduced work rights on student visas, it now being harder to get more students visas and the limited number of Points based invitations.
It is important to have a strategy in terms of your next visa and or applying for PR.

Are they going to change the point system in the same time? And when is this going to happen? If you have any idea

The Migration Strategy Action Plan says the following about the changing the points test "Discussion paper to be released early 2024."
      immi.homeaffairs.gov.au/programs-subsite/migration-strategy/Documents/migration-strategy-action-plan.pdf
The discussion paper has not been released yet. But discussion is followed by plannning and then drafting regulations. So I would not expect a change in the poinst test until 1 July 2025 or later.

Hi, we don't have all the details yet, but it appears that the Core Skills Pathway may be similar to the 482 Visa, where skills assessments are only required for certain occupations. Hi, Tradies will be in the Core Skills category, which will have a Core Skills occupation list and a TSMIT which is currently $70,000. The Core Skills is likely to be very similar to the current 482 visa.
      Hope this is helpful.

Hi could you please make a video and tell us what is the clear pathway to pr? I am on 482 visa and after working 2 years how do i become eligible for pr application

    • @WorkVisaLawyers
      @WorkVisaLawyers  3 місяці тому

Hi, Thanks for watching and for your question. The usual path to PR for a 482 visa holder is to apply for the employer sponsored Temporary Residence Transition 186 after two years. There are a number of requirements including being under 45 and having competent English.

What about 189 round next financial year ?

    • @WorkVisaLawyers
      @WorkVisaLawyers  4 місяці тому

The allocations levels for the 189 for next year, starting 1 July 2024 to 30 June 2025 have not been announced.
We expect them to be quite low again due to the Federal Government being concerned about the housing crisis. Many people waiting for a points based invitation for 189, 190 or 491 are switching their attention to other paths including employer sponsored and partner visas.
